CIRCULAR

GUIDELINES ON THE POSITIONS OF LEADERSHIP AND MANAGEMENT WORK AND PROFESSIONAL RANKS OF SPECIALIZED CIVIL SERVANTS; THE STRUCTURE OF CIVIL SERVANTS ACCORDING TO PROFESSIONAL RANKS IN PUBLIC SERVICE UNITS UNDER THE INFORMATION AND COMMUNICATION SECTOR

Pursuant to the Civil Servant Law on November 15, 2010; the Law Amending and Supplementing Certain Provisions of the Civil Servants and Civil Servant Law on November 25, 2019;

Pursuant to Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and number of staff in public service units;

Pursuant to Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government stipulating the establishment, restructuring, and dissolution of public service organizations;

Pursuant to Decree No. 48/2022/NĐ-CP dated July 26, 2022, issued by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Information and Communications issues this Circular guiding on job positions of leadership and management and professional ranks of specialized civil servants; the structure of civil servants according to professional ranks in public service units under the Information and Communication sector.

Article 1. Scope of Regulation

This Circular guides on the list of job positions, job descriptions, and competency frameworks for job positions of leadership and management and job positions according to professional ranks of specialized civil servants; the structure of civil servants according to professional ranks in public service units under the Information and Communication sector.

Article 2. Applicability

Article 1. This Circular applies to public service units under the Information and Communication sector established by competent authorities in accordance with the law and related organizations and individuals.

2. This Circular does not apply to:

a) Public service units under the Ministry of Public Security and the Ministry of National Defense;

b) Public service units under the management of special administrative-economic units.

Article 3. Non-public service units under the Information and Communication sector may apply the provisions of this Circular.

Article 3. Positions of leadership and management work and positions of professional ranks of specialized civil servants in public service units under the Information and Communication sector

1. The list, job descriptions, and competency frameworks for positions of leadership and management in public service units under the Information and Communication sector shall be implemented in accordance with Appendix I and Appendix II of this Circular.

2. The list, job descriptions, and competency frameworks for positions of professional ranks of specialized civil servants in the Information and Communication sector shall be implemented in accordance with Appendix III of this Circular.

Article 4. Structure of civil servants according to professional ranks in the Information and Communication sector

Determination of the structure of civil servants according to professional ranks shall be carried out in accordance with Clause 5, Article 3 and Clause 3, Article 4 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and number of staff in public service units (hereinafter referred to as Decree No. 106/2020/NĐ-CP).

Article 5. Transitional Provisions

1. For current leaders and managers who are receiving salary based on grade and level of civil servant professional rank, they shall continue to implement until new guidelines on salary system are issued.

2. For current civil servants holding a higher level of professional rank than required by the job position as stipulated in this Circular before the effective date of this Circular, they shall continue to hold their current professional rank and salary grade until new guidelines on salary system are issued.

Article 6. Effectiveness

1. This Circular takes effect from September 15, 2023.

2. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the provisions of the amended, supplemented, or replacing documents.

Article 7. Responsibility for Implementation

Article 17. The Minister, Heads of Ministries equivalent to Ministries, Chairpersons of People's Committees at provincial and district levels, heads of public service units under the Information and Communication sector, heads of agencies, organizations, and related individuals are responsible for implementing this Circular.

Article 18. In the course of implementation, if there are difficulties or obstacles, please report to the Ministry of Information and Communications for guidance and resolution.
