Repealing certain regulatory legal documents issued by the Minister of Health

Pursuant to the Law on Issuing Legal Documents dated June 22, 2015 and the Law Amending and Supplementing Certain Provisions of the Law on Issuing Legal Documents dated June 18, 2020;
Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing several provisions and measures for implementing the Law on Enacting Regulatory Legal Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing several articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing several provisions and measures for implementing the Law on Enacting Regulatory Legal Documents;
Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Legal Department, the Director of the Medical Equipment and Construction Department, the Director of the Maternal and Child Health Department, and the Director of the Traditional Medicine Management Department,
The Minister of Health issues this Circular to abolish certain legal regulatory documents issued by the Minister of Health.
Article 1. Repeal entirely three (03) regulatory legal documents issued by the Minister of Health
1. Circular No. 03/2016/TT-BYT dated January 21, 2016 of the Minister of Health stipulating the operation of herbal medicine trading.
2. Circular No. 31/2019/TT-BYT dated December 5, 2019 of the Minister of Health stipulating requirements for fresh milk products used in the School Milk Program.
3. Circular No. 14/2020/TT-BYT dated July 10, 2020 of the Minister of Health stipulating certain contents in medical equipment tendering at public health facilities.
Article 2. Effective Date
This Circular takes effect from the date of issuance.
Article 3. Transitional Provisions
For medical equipment tenders that have been approved for procurement plan before this Circular takes effect, the unit shall continue to implement according to the provisions of Circular No. 14/2020/TT-BYT dated July 10, 2020 of the Minister of Health stipulating certain contents in medical equipment tendering at public health facilities, or carry out procedures to adjust relevant contents in accordance with current regulations on tendering.
Article 4. Responsibilities for Implementation
The Head of the Ministry's Office, the Inspector General, the Director of the Medical Equipment and Construction Department, the Director of the Maternal and Child Health Department, the Director of the Traditional Medicine Management Department, the Heads of units under and affiliated with the Ministry of Health, the Directors of Health Departments of provinces and cities, and related agencies, organizations, and individuals are responsible for implementing this Circular./.
