CIRCULAR

REGULATIONS ON REQUIREMENTS FOR MILK PRODUCTS USED IN THE SCHOOL MILK PROGRAM
USED IN THE SCHOOL MILK PROGRAM

BASED ON THE FOOD SAFETY LAW dated June 17, 2010;art. 6 year 2010;

Based on Decree No. 15/201DECREE NO. 8/2018/ND-CP dated February 2, 2018 of the Government detailing the implementation of certain provisions of the Food Safety Law; Article of Food Safety Law;

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

THIS CIRCULAR REGULATES THE REQUIREMENTS FOR MILK PRODUCTS USED IN THE SCHOOL MILK PROGRAM ACCORDING TO DECISION NO. 1340/QĐ-TTg dated July 8, 2016.

Article 2. Applicability

THIS CIRCULAR APPLIES TO PRODUCTION AND BUSINESS UNITS OF MILK PRODUCTS USED IN THE SCHOOL MILK PROGRAM AND RELATED ORGANIZATIONS AND INDIVIDUALS INVOLVED IN IMPLEMENTING THE SCHOOL MILK PROGRAM.

Chapter II
REQUIREMENTS FOR MILK PRODUCTS USED IN THE SCHOOL MILK PROGRAM
USED IN THE SCHOOL MILK PROGRAM

Article 3. Milk products used in the School Milk Program

Milk products used in the School Milk Program include pasteurized whole milk and pasteurized milk that comply with the national technical regulations for liquid milk products QCVN 5-1:2010/BYT issued together with Circular No. 30/2010/TT-BYT dated June 2, 2010 of the Minister of Health and the requirements set forth in Articles 4 and 5 of this Circular.

Article 4. Requirements for micronutrients in milk products used in the School Milk Program

1. Milk products used in the School Milk Program must ensure 21 micronutrients at the following levels:

(a) No maximum limit is set for Vitamin B2, Biotin, and Iodine because these nutrients are naturally present in milk at high levels and their concentrations vary seasonally.

2. Raw materials for milk products used in the School Milk Program must meet the national technical standards for raw milk issued together with Circular No. 29/2017/TT-BNNPTNT dated December 29, 2017 of the Minister of Agriculture and Rural Development.

Article 5. Management requirements for milk products used in the School Milk Program.

1. Product declaration

Milk products used in the School Milk Program must be declared by production and business units before being circulated on the market according to Decree No. 15/2018/ND-CP dated February 2, 2018 of the Government detailing the implementation of certain provisions of the Food Safety Law and Decree No. 155/2018/ND-CP dated November 12, 2018 of the Government amending and supplementing certain provisions related to investment and business conditions under the management of the Ministry of Health.

2. Labeling

The labeling of milk products used in the School Milk Program shall be carried out in accordance with Decree No. 43/2017/ND-CP dated April 14, 2017 of the Government on product labeling and Decision No. 1783/QĐ-BYT dated May 13, 2019 of the Minister of Health approving the logo for milk products serving the School Milk Program.

Chapter III

IMPLEMENTING PROVISIONS

Article 6. Effectiveness

1. This Circular takes effect from January 20, 2020

2. Decision No. 5450/QĐ-BYT dated September 28, 2016 on temporary regulations for milk products serving the School Milk Program improving nutrition and enhancing the stature of preschool and primary school children by 2020 ceases to be effective from the date this Circular takes effect.

Article 7. Transitional Provisions

1. Milk products used in the School Milk Program that have been procured through bidding processes by localities prior to the effective date of this Circular can continue to be used until the quantities specified in the contracts signed and to be signed are exhausted.

2. Labels of milk products used in the School Milk Program produced, imported, and circulated before the effective date of this Circular may continue to be used until their expiration dates.

Production and business units of the above milk products are responsible for declaring the quantity of labels and reporting to the Ministry of Health (Maternity and Child Health Department) before the effective date of this Circular.

Article 8. Reference Provisions

In case the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replaced documents.

Article 9. Responsibility for implementation

The Head of the Maternity and Child Health Department, Heads of units under and affiliated with the Ministry; Directors of Provincial Health Departments; and relevant organizations and individuals are responsible for implementing this Circular.

During the implementation of this Circular, if there are difficulties or obstacles, organizations and individuals are requested to report to the Ministry of Health (Maternity and Child Health Department) for consideration and resolution./.
