Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 08/CT dated January 13, 1992 of the Chairman of the Council of Ministers, now the Government, regarding the establishment and approval of the Economic and Technical Justification for Cat Tien National Park;

Pursuant to Decision No. 117/1999/QĐ/BNN/TCCB dated August 14, 1999 of the Minister of Agriculture and Rural Development concerning the functions, tasks, and organizational structure of Cat Tien National Park;

Considering the proposal of the Director of Cat Tien National Park at Proposal No. 248/VQG dated October 18, 2000. As proposed by the Head of the Department of Organization and Cadres.

DECISION:

Article 1.- Now approve and issue the Regulation on the operation activities of Cat Tien National Park and buffer zone management attached hereto.

Article 2.- THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.

Article 3.- The Heads of the Ministry's Office, the Head of the Department of Organization and Cadres, the Heads of relevant units under the Ministry, and the Director of Cat Tien National Park shall be responsible for implementing this decision.

REGULATIONS

Operation activities of Cat Tien National Park and buffer zone management

(Issued pursuant to Decision No. 09/2001/QĐ-BNN-TCCB dated February 13, 2001 of the Minister of Agriculture and Rural Development)

PART I
GENERAL PROVISIONS

Article 1.- Cat Tien National Park (VQG Cat Tien) is a public service unit directly under the Ministry of Agriculture and Rural Development.

VQG Cat Tien has legal personality, a seal, operational funds provided by the state budget, and is allowed to open an account at the State Treasury.

The headquarters of the Park is located at Ben Cu, Daklua Commune, Tan Phu District, Dong Nai Province.

Representative offices are located in Ho Chi Minh City and Bien Hoa City (Dong Nai Province).

Article 2.- Cat Tien National Park was established based on Decision No. 08/CT dated January 13, 1992 of the Chairman of the Council of Ministers (now the Government) regarding the establishment and approval of the Economic and Technical Justification for Cat Tien National Park; Decision No. 38/1998/QĐ-TTg dated February 16, 1998 of the Prime Minister regarding the transfer of Cat Tien National Park from the People's Committees of Dong Nai, Lam Dong, and Binh Phuoc Provinces to the Ministry of Agriculture and Rural Development; Decision No. 117/1999/QĐ/BNN/TCCB dated August 14, 1999 of the Ministry of Agriculture and Rural Development concerning the functions, tasks, and organizational structure of Cat Tien National Park.

Article 3- Geographic location and management scope of Cat Tien National Park:

1. Geographic location:

Cat Tien National Park is within the jurisdiction of Tan Phu and Vinh Cuu Districts (Dong Nai Province), Cat Tien-Bao Lam District (Lam Dong Province), and Bu Dang District (Binh Phuoc Province).

Geographic coordinates:

- From 11020'50" to 11050'20 North Latitude

- From 10709'5" to 107035'20 East Longitude

2. Boundaries:

- North and Northwest border with Dak Lak Province and Bu Dang District, Binh Phuoc Province.

- South border with La Nga Forestry Company.

- East border is the Dong Nai River and Tan Phu District, Dong Nai Province; Cat Tien and Bao Lam Districts, Lam Dong Province.

- West border is Vinh An Forest Farm, Dong Nai Province.

3. Total natural area of Cat Tien National Park (according to Decision No. 38/1998/QĐ-TTg dated February 16, 1998 of the Prime Minister regarding the transfer of Cat Tien National Park from the People's Committees of Dong Nai, Lam Dong, and Binh Phuoc Provinces to the Ministry of Agriculture and Rural Development for management): 73,878 hectares, including:

- Southern Cat Tien Area (Dong Nai Province): 38,100 hectares

- Western Cat Tien Area (Binh Phuoc Province): 5,143 hectares

- Cat Loc Natural Reserve Area (Lam Dong Province): 30,635 hectares

4. Functional Zones:

Cat Tien National Park is divided into three functional zones

- Strictly protected zone

- Ecological restoration zone

- Service and administrative zone

5. Buffer Zone of Cat Tien National Park: Total area 183,479 hectares

Article 4.- Functions and tasks of Cat Tien National Park:

1. Functions: Cat Tien National Park is a public service unit directly under the Ministry of Agriculture and Rural Development, with the function of conserving and restoring natural resources; developing and protecting natural ecosystems of the National Park; conducting scientific research combined with expanding scientific, educational, and tourism activities.

2. Tasks:

a) Conserve characteristic ecosystems of the Southeast region, conserve biodiversity of flora and fauna species, protect and develop endangered species (such as rhinoceros, elephants, banteng, white-winged ducks, peacocks, pheasants, crocodiles, rosewood, red sandalwood, camphor, agarwood...);

b) Protect upstream forests serving the Tri An Hydropower Project;

c) Organize scientific research to serve conservation tasks of the Park and organize scientific research services, education, tours, and tourism;

d) Implement international cooperation programs in the field of nature conservation and environment as assigned by the Ministry;

e) Carry out programs to educate local people about laws on forest protection and development to protect the National Park;

f) Work together with local authorities to plan and reorganize residential areas in accordance with management requirements and tasks, contributing to stabilizing and improving the living standards of local residents;

g) Manage and utilize assets, materials, labor, and state-provided funds for the Park in accordance with their intended purposes and effectively.

Article 5.- Organizational structure of Cat Tien National Park:

1. Leadership of the Park: There is a Director and one to two Deputy Directors to assist.

2. Supporting Staff for the Director:

- Administrative Affairs Department.

- Planning and Finance Department

- Scientific Research and Technology Department

3. Subordinate units:

- Center for Ecotourism Services, Education, and Environmental Awareness

- Forest Protection Station

- Health Station

- Representative Office in Ho Chi Minh City and Bien Hoa City (Dong Nai Province)

Article 6.- Principles for managing activities of Cat Tien National Park:

- In accordance with the Law on Forest Protection and Development; the Management Regulations for Special Purpose Forests in Vietnam; national legal documents and approved investment programs, plans, or projects.

- Implement the mechanism where the Party leads, workers and staff are the masters through participation in management by trade union representatives, and the Director manages and directs operations.

Chapter II
MANAGEMENT BOARD, DEPARTMENTS AND SUBORDINATE UNITS OF CAT TIEN NATIONAL PARK

Article 7.- Management Board of Cat Tien National Park:

1. Director:

The Director of Cat Tien National Park is appointed by the State to manage and direct the activities of the unit according to the approved Economic and Technical Justification and some programs and projects of the Park.

The Director is responsible to the Minister of Agriculture and Rural Development for all activities of the Park; and is subject to professional guidance from the Forest Protection Department.

The Director is appointed and relieved of duty by the Minister of Agriculture and Rural Development.

2. Deputy Director:

The Deputy Director assists the Director and is assigned to oversee specific areas of work. The Deputy Director is responsible to the Director and the law for the areas assigned.

The Deputy Director is appointed and relieved of duty by the Minister of Agriculture and Rural Development upon the recommendation of the Director.

Article 8.- Functional Departments:

These Departments have the function of advising and assisting the Director of the Garden in managing and directing operations. Each Department has a Head, Deputy Head, and staff members.

1. Administrative Organization Department:

The Administrative Organization Department advises the Director of the Garden on organizational work, personnel, labor wages, administrative management.

The main responsibilities of the Administrative Organization Department include:

a) Organizational Work:

- Proposing to the Director of the Garden to establish the operational structure and manage personnel of the agency.

- Assisting the Director in managing and implementing personnel work according to the regulations of the Ministry, including:

+ Proposing planning, training, promotion, placement, and utilization of trained personnel

+ Managing titles and standardizing business personnel

+ Inspecting the use of personnel in subordinate units

+ Handling procedures for appointment, removal, periodic assessment; proposing salary increases, transfers, rewards, disciplinary actions, retirement, loss of working capacity, resignation for civil servants

- Proposing organizing civil servant examinations and promotions, and assisting the Director in organizing civil servant examinations, handling procedures for approval by the Ministry

- Proposing personnel allocation at units within the Garden according to approved staffing levels

- Proposing solutions to the Director for resolving policies concerning Garden employees (salaries, rewards, disciplinary actions, social insurance, medical insurance, etc.)

- Tracking, managing comprehensive personnel files and related organizational work files

- Chairing and coordinating with departments to complete comprehensive reports related to organizational work (salary fund, quality and changes in the cadre workforce, etc.), Garden activity reports, drafting reports to the Ministry for the Director, and executing other tasks assigned by the Director

b) Administrative Management:

- Implementing and managing the agency's document management work

- Directing grassroots units and relevant departments to organize asset protection and maintain public security

- Organizing reception and guidance for visitors according to requirements

- Preparing plans for office supplies, equipment procurement; preparing plans for construction project repairs; managing and scheduling transportation vehicle maintenance plans

- Cooperating with the Financial Planning Department to promote construction work, supervise and inspect construction progress

- Tracking and urging administrative activities in the agency

- Regularly compiling reports on unit work direction and tasks; reporting on Garden evaluation and overall performance

- Executing other tasks assigned by the Director of the Garden

2. Financial Planning Department:

The Financial Planning Department advises the Director of the Garden on planning and financial accounting work.

The main responsibilities of the Financial Planning Department include:

- Drafting long-term, medium-term, and short-term (monthly, quarterly, annual) economic and financial plans for the Garden, to be submitted for approval by the Ministry

- Managing various types of funds, capital, materials, state assets of the Garden, including:

+ Implementing financial systems and tendering regulations, guiding units to comply with national regulations

+ Handling design contract procedures and submitting them for approval by the Ministry for projects listed in the Ministry's plan

+ Cooperating with the Administrative Organization Department to supervise and inspect construction project implementation

+ Supervising investment funding sources, settling construction project completion volumes according to regulations

+ Compiling settlement documents, preparing financial reports for settlement with higher-level management authorities. Providing necessary information and materials for budget preparation, expenditure quota formulation, auditing, and assessing the effectiveness of fund usage within the unit

+ Executing other tasks assigned by the Director of the Garden

3. Scientific Research and Technology Department:

The Scientific Research and Technology Department advises the Director of the Garden on scientific research and technology work.

The main responsibilities of the Scientific Research and Technology Department include:

a) Scientific Research Work:

- Advising the Director on managing and implementing scientific research projects in the assigned fields

- Developing basic investigation programs; tracking forest resource dynamics and wildlife status; establishing and managing Garden scientific data

- Collecting scientific research information and specimens (animals, plants, insects) for research and educational purposes

- Collaborating with institutes, research centers, universities, domestic and foreign experts, etc., to apply research results to practical applications

- Organizing guidance for research subjects in Garden internships

- Training and enhancing knowledge related to biodiversity conservation and forest resource development for Garden staff and key personnel in buffer zone communities

b) Technical Work:

- Designing contracted forest protection projects, encircled forest nurturing, afforestation, and care projects

- Developing annual forestry infrastructure plans and implementing approved items

- Establishing botanical gardens, nurseries, and native seedling production for ecological restoration zones and buffer areas

- Collaborating with Forest Police Stations to conduct annual forest fire prevention and pest control

- Participating in developing and implementing buffer zone livelihood economic projects

- Collaborating with Ecotourism Service, Education Environment Center to compile promotional materials and educate the community and tourists

Article 9.- Subordinate Units:

1. Ecotourism Service, Education Environment Center (referred to as the Center):

The Center is a public service unit with income from ecotourism. The Center has legal personality, its own seal and separate account to operate within the scope of its assigned functions and tasks.

a) Organizational structure of the Center:

The leadership of the Center consists of a Director and one Deputy Director.

- Director of the Center: is responsible before the Director of the Park for leading and managing all activities of the Center.

- Deputy Director of the Center: assists the Director of the Center and is assigned by the Director to be in charge of specific fields of work.

- Other staff members assist in work.

b) Functions and tasks of the Center:

- Advise the Director of the Park on implementing tasks related to tourism development in the Park, particularly ecotourism.

- Organize reception services for guests and tourism marketing activities. Combine tourism activities with environmental education and natural conservation promotion.

- Coordinate with the Science and Technology Research Department to compile educational materials on the environment and natural resources of the Park.

- Popularize relevant educational materials for teachers and students in the buffer zone.

- Guide tourists and perform other tasks assigned by the Director of the National Park.

2. Forest Ranger Station:

a) Functions and Responsibilities:

The Forest Ranger Station is a subordinate unit of Cat Tien National Park, with the function of enforcing laws on forest management and protection.

The Forest Ranger Station has legal personality and its own seal to carry out official duties as prescribed by law.

The Forest Ranger Station is managed by the Director of the National Park while being subject to professional guidance from the Forest Protection Service.

The main tasks of the Forest Ranger Station include:

- Develop plans, programs, and measures for protecting natural resources and the ecological environment of the Park, and organize their implementation after approval.

- Directly lead forest ranger stations and mobile forest patrol teams in forest management and protection activities, including patrols and inspections.

- Directly handle violations of the Law on Forest Protection and Development and special-use forest protection regulations within the Park's boundaries according to its authority.

- Organize propaganda and education for local residents about the Law on Forest Protection and Development, park rules, and legal documents concerning special-use forests. Set up boundary markers and post protective signs.

- Train professional skills and legal knowledge for forest rangers in the Park.

- Collaborate with functional agencies in the area to develop plans and schemes for forest protection.

- Summarize forest management and protection conditions within the Park to report to the Director and higher-level agencies as stipulated.

- Executing other tasks assigned by the Director of the Garden

b) Organization structure:

The Forest Ranger Station has a Station Chief and one to three Deputy Chiefs; it includes 21 Forest Ranger Stations and two Mobile Teams.

Each Forest Ranger Station has a Station Head.

Each Mobile Team has a Team Leader.

- The Forest Ranger Stations consist of:

- Functions, tasks, and authorities of the Forest Ranger Stations and Mobile Teams, as well as their working relationships, are defined by the Director of the Park.

3. Representative Office:

It serves as the transaction point for Cat Tien National Park. The Representative Office is responsible for:

- Reporting fully, accurately, and promptly (via telephone, fax, or written documentation) the contents of transactions to the Director of the Park for handling.

- Accessing and collecting information both domestically and internationally regarding issues related to the Park and reporting to the Director of the Park.

- Introducing and promoting Cat Tien National Park.

- Executing other tasks assigned by the Director of the Garden

4. Health Station:

Main functions and tasks include:

- Planning, supervising, guiding, and inspecting food, accommodation, hygiene maintenance, and disease prevention for collective units and individuals within the Park.

- Monitoring health care and medical insurance benefits for Park staff.

- Conducting initial emergency treatment and providing medical consultations and treatments for Park staff and visitors within the permitted scope of competence and legal provisions.

- Executing other tasks assigned by the Director of the Garden

Chapter III

RELATIONSHIP OF WORK BETWEEN CAT TIEN NATIONAL PARK AND GOVERNMENT AGENCIES AND LOCAL AUTHORITIES

Article 10.- Relationship with the Ministry of Agriculture and Rural Development:

1/ The Ministry oversees Cat Tien National Park in the following areas:

- Defining the functions, tasks, and organizational structure of the Park.

- Approving operational regulations and amendments to these regulations.

- Managing personnel according to current regulations of the Ministry for subordinate units.

- Funding construction, forest management and protection, scientific research, salaries, and benefits for employees.

- Implementing international cooperation programs and organizing projects both domestically and internationally within the Park.

- Cooperating with provincial People's Committees and related ministries and sectors in relocating residents living within the Park's boundaries, reorganizing production to ensure their livelihoods.

- Inspecting and supervising all activities of Cat Tien National Park.

2/ Departments and Bureaus under the Ministry, based on their respective functions and tasks, assist the Ministry in managing and directing Cat Tien National Park to fulfill assigned tasks.

Article 11.- Relationship with local authorities:

1/ For the People's Committees of Dong Nai, Lam Dong, and Binh Phuoc Provinces: As state administrative bodies at various levels within their territorial jurisdiction, Cat Tien National Park must comply with supervision and inspection by the People's Committees at all levels according to the law. The Park is responsible for implementing Party resolutions and decisions of local authorities related to the Park.

2/ For the People's Committees of districts and communes:

- Cat Tien National Park is responsible for closely coordinating in organizing forest management and protection systems in each locality and conducting propaganda and education activities to mobilize the active participation of the people in managing and protecting the Park.

- Coordinate to implement state policies and management systems for forest protection in Cat Tien National Park and its buffer zone.

3/ For other organizations within the jurisdiction (Department of Agriculture and Rural Development, Forest Inspection Sub-Office...), according to their functions and tasks, they need to coordinate with Cat Tien National Park to fulfill assigned tasks, assist local People's Committees at all levels in performing state management functions over forests and forestry land with respect to Cat Tien National Park and its buffer zone.

Article 12.- Other relationships:

- Cat Tien National Park is related to other national parks and nature reserves nationwide in terms of expertise and professional matters.

- The relationship between functional departments and subordinate units is a cooperative working relationship, helping each other to fulfill common tasks.

Chapter IV

MEETING REGIME AND REPORTING SYSTEM

Article 13.- Meeting regime:

1/ The Park Management Board convenes a weekly meeting every Monday to review and evaluate leadership work, and establish a work program for the upcoming period.

2/ The Park Management Board and leaders of functional departments, centers, stations, and forest rangers, representatives of mass organizations hold a monthly meeting to assess the implementation of common tasks by the unit and each department; roll out plans for the following month. When necessary, the Park Director may convene an emergency meeting with the above members.

3/ A staff congress (general assembly or representative) is held once a year. The agenda includes evaluating and announcing annual activity results, identifying strengths and weaknesses, and setting directions and tasks for the next year.

The congress proceeds on the principle of democratic centralism, transparency, with a spirit of self-criticism and criticism based on constructive suggestions for leadership, guidance, and implementation work of the unit. The duration of the congress ranges from one to one and a half days.

Article 14.- Reporting system:

The Management Board reports quarterly and annually to the Ministry and People's Committees of Dong Nai, Lam Dong, and Binh Phuoc provinces as stipulated.

Functional departments and subordinate units of the Park must implement a statistical reporting system for monthly work and quarterly, six-monthly, and annual summary reports of their respective departments to the Park Management Board.

Chapter V

BUFFER ZONE MANAGEMENT

Article 15.- Scope, area of the buffer zone:

The buffer zone is the forested area, land, or land adjacent to the boundary of the national park and nature reserve.

- The buffer zone of Cat Tien National Park comprises all areas adjacent to the Park's boundaries.

The boundary between Cat Tien National Park and the buffer zone is clearly defined on maps and in the field, marked with boundary posts and signs along both the Park boundary and the buffer zone limit.

- Basis for determining the buffer zone boundary and area:

+ For areas with natural forests, it is the width of the surrounding corridor around Cat Tien National Park, which is 1 km wide between the Park boundary and the buffer zone limit.

+ For buffer zones within communities currently residing there, it is determined by administrative units managed by the District People's Committee.

- The total area of the buffer zone is approximately 183,479 hectares, including:

+ Buffer zones with natural forests and forestry land allocated to organizations, households, and individuals: 64,875 hectares

+ Buffer zones within areas with current residents managed by the District People's Committee: 118,604 hectares, comprising 31 communes and 2 towns: Dak Lua, Ta Lai, Nam Cat Tien, Nui Tuong, Phu Lap, Phu An (Tan Phu district, Dong Nai province); Thanh Son (Dinh Quan district, Dong Nai province); Phu Ly (Vinh Cuu district, Dong Nai province); Dang Ha, Dong Nai, Thong Nhat, Dong Ket (Bu Dang district, Binh Phuoc province); Dak Sin, Dao Nghia (Dak Lap district, Dak Lak province); Loc Bac, Loc Bao (Bao Lam district, Lam Dong province); Huong Lam, Quoc Oai, An Nhon, Da Kho, Da Lay, Da Teh town (Da Teh district, Lam Dong province); Phuc Cat I, Phuc Cat II, Gia Vien, Nam Ninh, My Lam, Tu Nghia, Phu My, Duc Pho, Tien Hoang, Quang Ngai, Dong Nai town (Cat Tien district, Lam Dong province).

Article 16.- Functions of the buffer zone:

- Contribute to the sustainable conservation of Cat Tien National Park

- Enhance the conservation values of the buffer zone itself

- Create additional opportunities for ecosystem exchange and expansion for animal and plant populations to develop

- Provide conditions and benefits for communities living in the buffer zone through the conservation of Cat Tien National Park

- Improve economic and social conditions and the environment in the buffer zone, reduce harmful impacts that deplete natural resources in Cat Tien National Park

Article 17.- Responsibilities for managing and protecting the buffer zone:

1/ General principles:

State responsibilities for forest and forestry land management, responsibilities for managing and protecting the buffer zone of relevant state agencies, local People's Committees at all levels, and specialized state management organizations are based on the Law on Forest Protection and Development; Decision No. 245/1998/QD-TTg dated December 21, 1998 of the Prime Minister on implementing state management responsibilities at various levels regarding forests and forestry land; Decision No. 08/2001/QD-TTg dated January 11, 2001 of the Prime Minister on issuing the Regulation on Specialized Forest Management, and other state legal documents.

2/ Responsibilities for managing and protecting the buffer zone:

a) For organizations, households, and individuals who are forest owners granted forests and forestry land in areas with natural forests within the buffer zone of Cat Tien National Park, they have the responsibility:

- When planning, developing management, protection, development, and utilization plans for forests and forestry land, they must proactively consult with Cat Tien National Park to reach consensus before submitting to the competent authority for approval.

- Before implementing approved plans, the forest owner must notify Cat Tien National Park for convenient coordination and supervision.

- All activities in the buffer zone must comply with the specialized forest management regulations, aiming to support the forest protection work of Cat Tien National Park. Certain activities not permitted in the buffer zone include:

+ Hunting, trapping, and fishing of wild animals

+ Exploitation of forest products

+ Clearing forests for shifting cultivation and farms

+ Construction of architectural works and roads

+ Causing loud noise and environmental pollution.

b) For buffer zones within areas with resident communities:

b.1: Responsibilities:

- The People's Committee of buffer zone communes shall cooperate with the Cat Tien National Park to effectively carry out forest protection work: preventing external entities from entering the Cat Tien National Park to exploit forest products, hunt animals...; promoting and mobilizing local residents in the buffer zone to actively participate in forest protection.

- All economic and social development activities of the locality must not affect the management and protection of the Cat Tien National Park.

- People's Committees at all levels within the buffer zone shall not process household registration for people moving from other places to reside in the buffer zone and strictly prohibit illegal activities related to the exploitation, processing, trading, buying, selling, and transporting of forest products within the buffer zone.

b.2 Benefits of the community in the buffer zone:

The State shall create conditions for the community living in the buffer zone to benefit from the protection of the Park and the buffer zone, including:

- Investment projects and preferential policies to develop the economy and society in the buffer zone

- Participating with the Cat Tien National Park in organizing popular activities and coordinating to organize tourism service activities to increase income.

- Prioritizing recruitment of local children from the buffer zone area to work at the Cat Tien National Park.

c) Responsibilities of the Cat Tien National Park:

- Monitoring and inspecting activities in the buffer zone related to forest management and protection. Upon discovering violations, they shall prepare reports and require the cessation of such activities or collaborate with relevant agencies to complete files (for cases exceeding their authority) to report and submit to competent authorities for examination according to the law.

- Cooperating with organizations, households, and individuals in the buffer zone to develop plans for managing, protecting, developing forests, using forests and forest land in accordance with regulations; promoting policies related to the buffer zone and benefits derived from protecting the national park.

- Participating and supporting local authorities in building and developing the economy to stabilize the livelihoods of communities residing in the buffer zone.

- Developing plans and organizing annual peripheral zone meetings to strengthen cooperation between local authorities and the Cat Tien National Park in forest protection work.

Chapter VI

IMPLEMENTING PROVISIONS

Article 18.- This regulation shall take effect fifteen days from the date of issuance of the Decision. Previous provisions contrary to this regulation shall be abolished.

Article 19.- The Cat Tien National Park, organizations, households, and individuals must comply with the provisions of this regulation. Those who achieve outstanding results will be rewarded. Violators will be dealt with according to the law depending on the nature and severity of the violation.

The Director of the Cat Tien National Park is responsible for disseminating this regulation to all officials in the Park to be aware of and implement it.

Article 20.- During implementation, if there are any unreasonable aspects, the Director of the Cat Tien National Park shall submit a written proposal for the Ministry to study and amend and supplement to align with current Party and State mechanisms and policies.
