Article adjusting temporary regulations on management of termination charges and traffic limits for inbound international IP telephone calls
to Vietnam

Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;
Pursuant to Decision No. 217/2003/QĐ-TTg dated October 27, 2003 of the Prime Minister on managing service charge prices for postal and telecommunications services;
At the proposal of the Director of the Department of Planning and Finance,
DECISION:
Article 1.
1. The termination charge for international IP telephone services of inbound international IP telephone calls to Vietnam is the rate that foreign operators pay to Vietnamese enterprises authorized to provide international IP telephone services to terminate such calls in Vietnam.
2. Enterprises providing international IP telephone services shall actively negotiate and agree on the termination charge for international IP telephone services with foreign partners based on the floor rate for the termination charge for international IP telephone services prescribed by the Ministry of Posts and Telecommunications.
3. The floor rate for the termination charge for international IP telephone services applicable from June 1, 2005 is 0.17 USD per minute, regardless of whether the call is made to a fixed network or mobile network in Vietnam. On this basis, enterprises shall negotiate and agree with foreign partners on specific termination rates for international IP telephone services but they must not be lower than the floor rate prescribed by Posts and Telecommunications.
Article 2.
1. Enterprises providing international IP telephone services shall be allocated traffic limits for inbound international IP telephone calls to Vietnam based on the number of Points of Presence (POP) developed in provinces and centrally-administered cities as follows:
- From 1 to 4 POPs: 4 million minutes/month;
- From 5 to 8 POPs: 5 million minutes/month;
- From 9 to 12 POPs: 7 million minutes/month;
- From 13 to 18 POPs: 9 million minutes/month;
- From 19 to 25 POPs: 11 million minutes/month;
- From 26 to 30 POPs: 12 million minutes/month;
- From 31 to 35 POPs: 13 million minutes/month;
- 36 POPs and above: 14 million minutes/month;
For the month of January each year, the traffic limit will be increased by 30%.
2. The traffic limit prescribed in Clause 1 of this Article applies to all enterprises and covers all inbound international IP telephone traffic to Vietnam of the enterprise, regardless of whether the traffic terminates at a fixed network or mobile network, in provinces where the enterprise has developed POPs or not.
3. Enterprises shall report to the Ministry of Posts and Telecommunications the number of POPs currently in operation and the introduction of new POPs into service so that the Ministry of Posts and Telecommunications can periodically publish this information for enterprises.
4. Enterprises are permitted to proactively offset traffic within their quota between months within a quarter (calculated according to the Gregorian calendar from January 1 to December 31).
5. Based on fluctuations in total international telephone traffic (IP and PSTN) to Vietnam, and the number of enterprises providing international IP telephone services, the Ministry of Posts and Telecommunications will announce adjustments to the quota in line with market fluctuations.
Article 3. Supplementary connection charges.
1. For international IP telephone traffic exceeding the quota (calculated quarterly), in addition to the basic connection charges under current regulations, enterprises providing international IP telephone services must pay supplementary connection charges at specific rates as follows:
+ ./ 17 cents for the portion of traffic exceeding the quota up to 10%.
+ ./ 20 cents for the portion of traffic exceeding the quota from 10% to 20%.
+ ./ 25 cents for the portion of traffic exceeding the quota from 20% to 30%.
+ ./ 28 cents for the portion of traffic exceeding the quota over 30%.
2. The management and collection mechanisms for supplementary connection charges shall be implemented in accordance with the Postal and Telecommunications Ordinance and guidelines issued by the Ministry of Finance.
Article 4. Traffic reports
1. By the latest on the 20th day of each month, enterprises are responsible for reporting to the Ministry of Posts and Telecommunications the traffic data for international PSTN and IP telephone networks originating from Vietnam to international destinations and vice versa for the previous month for provinces, centrally-administered cities, dedicated networks, and nationwide mobile networks. Enterprises failing to report fully and on time will have their traffic quota for the following month reduced by 3%.
2. Based on the reports submitted by enterprises, the Ministry of Posts and Telecommunications will periodically publish quarterly the traffic data for international PSTN and IP telephone networks originating from Vietnam to international destinations and vice versa.
Article 5. This Decision takes effect from June 1, 2005. All previous provisions contrary to this Decision are hereby abolished.
