WHEREAS, Decree No. 17/2008/NĐ-CP dated February 4, 2008 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decision No. 22/2013/QĐ-TTg dated April 26, 2013 of the Prime Minister on supporting revolutionary meritorious persons with housing and Document No. 701/TTg-KTN dated May 23, 2013 of the Prime Minister regarding corrections to the document;

The Minister of Construction hereby issues this Circular to regulate the issuance of real estate brokerage practice certificates; guide the operation of real estate trading floors.

The Minister of Construction issues this Circular guiding the implementation of Decision No. 22/2013/QĐ-TTg dated April 26, 2013 of the Prime Minister on supporting revolutionary meritorious persons with housing,

Article 1. Scope of Regulation and Applicability

1. Scope of Regulation: This Circular regulates matters related to determining the beneficiaries, conditions, methods of support, and the organization and implementation of supporting revolutionary meritorious persons with housing throughout the country (including urban and rural areas) as stipulated in Decision No. 22/2013/QĐ-TTg dated April 26, 2013 of

a) Revolutionary meritorious persons eligible for housing support as prescribed in Decision No. 22/2013/QĐ-TTg;

b) Relevant organizations and individuals.

Article 2. Principles of Support

1. The State directly supports households that have one or more revolutionary meritorious persons whose houses are damaged or leaking, including those who have previously received support under other policies but whose houses are now damaged or leaking, to build new houses or repair existing ones, ensuring improved housing conditions for revolutionary meritorious persons.

2. Housing support for revolutionary meritorious persons must be transparent and fair, avoiding waste, and ensuring equitable and reasonable allocation of resources.

3. Housing support for revolutionary meritorious persons shall be carried out based on the principle of State support and encouragement for community assistance, with household participation in contributions to ensure standard, quality, and suitability with specific household conditions; combining and integrating with central and local investment and support programs to enhance policy effectiveness.

4. Building new houses or repairing houses for revolutionary meritorious persons must meet the following requirements:

a) In cases where houses need to be demolished and rebuilt, the new houses must meet the 3 hard standards (hard foundation, hard frame-wall, hard roof), with a minimum usable area of 30 square meters (for single-person households, the usable area can be less than 30 square meters but not less than 24 square meters), and a lifespan of at least 10 years;

b) In cases where frames-walls need repair and roofs need replacement, after repairs, the houses must meet the 2 hard standards (hard frame-wall, hard roof), with a lifespan of at least 10 years, without requiring compliance with the specified usable area as set forth in Point a of this Clause.

Article 3. Determination of Beneficiaries for Housing Support

Beneficiaries for housing support as prescribed in Decision No. 22/2013/QĐ-TTg must satisfy the following conditions:

1. Being listed in the list of revolutionary meritorious persons managed by the Labor - War Invalids and Social Affairs Office of the district, county, town, or city directly under the province at the time Decision No. 22/2013/QĐ-TTg comes into effect.

2. Living and having permanent residence registration before June 15, 2013 (the date Decision No. 22/2013/QĐ-TTg takes effect) in a house that meets one of the following conditions:

a) The house is severely damaged and needs to be demolished and rebuilt;

b) The house is damaged or leaking and requires repair of the frame-wall and replacement of the roof.

Article 4. Procedures for Establishing and Approving Lists of Housing Support

1. Based on Decision No. 22/2013/QĐ-TTg and this Circular, village, hamlet, residential ward, commune, township, village, phum, soc (collectively referred to as "village") shall organize the dissemination of the main contents of the policy supporting revolutionary meritorious persons with housing under Decision No. 22/2013/QĐ-TTg to all eligible revolutionary meritorious persons within the village. The Village Head shall guide those who meet the conditions for housing support to submit applications (in accordance with the form prescribed in Appendix I attached to this Circular), and the Village Head shall collect the applications and lists and submit them to the People's Committee of the commune, town, or ward (collectively referred to as "Commune-level People's Committee") where the housing is located.

2. The Commune-level People's Committee shall be responsible for establishing a Steering Committee for Implementing Housing Support for Revolutionary Meritorious Persons at the commune level, consisting of representatives from the commune-level government, the All-Vietnam Propaganda Front at the commune level, and the Vietnam Veterans Association, to inspect the current status of housing of each individual who has submitted an application for housing support. After inspection, the Commune-level People's Committee shall establish a list of individuals eligible for housing support within the commune (including the list, quantity, and estimated support capital) according to the form prescribed in Appendix II attached to this Circular and send it to the People's Committee of the district, county, or city under provincial jurisdiction (collectively referred to as "District-level People's Committee").

3. Based on the report of the Commune-level People's Committee, the District-level People's Committee shall direct the Department of Labor, Invalids, and Social Affairs and related departments to review, inspect, and cross-check with the list of revolutionary meritorious persons currently managed, compile, and approve the list of revolutionary meritorious persons eligible for housing support within the district (according to the form prescribed in Appendix III attached to this Circular) and report to the People's Committee of the province or centrally governed municipality (collectively referred to as "Provincial-level People's Committee").

4. On the basis of the report of the District-level People's Committee, the Provincial-level People's Committee shall assign the Construction Department as the permanent agency, coordinating with the Finance Department and the Department of Labor, Invalids, and Social Affairs to inspect and cross-check with the regulations to establish and submit to the Provincial-level People's Committee for approval the Plan for Supporting Revolutionary Meritorious Persons with Housing throughout the province, specifying the number of revolutionary meritorious persons supported, categorized by levels of support, responsibilities of relevant agencies in organizing implementation, and budget estimates for implementing funds. In the provincial plan for supporting revolutionary meritorious persons with housing, it is necessary to clearly define the number and amount of support for revolutionary meritorious persons with housing implemented in 2013 and the number to be implemented after 2013 (if applicable). If the list of revolutionary meritorious persons supported under the plan is less than the number reported by the Provincial-level People's Committee to the Supervision Board of the National Assembly Standing Committee in 2012, capital will be allocated to complete the support in 2013. If the list of revolutionary meritorious persons supported under the plan exceeds the number reported by the Provincial-level People's Committee to the Supervision Board of the National Assembly Standing Committee in 2012, only the number reported to the Supervision Board of the National Assembly Standing Committee in 2012 will be supported in 2013, the remainder will be implemented after 2013; the number of supports in 2013 shall be established in the following priority order: - Households of revolutionary meritorious persons whose houses are at risk of collapse and unsafe for use; - Households where revolutionary meritorious persons are elderly; - Households of revolutionary meritorious persons belonging to ethnic minorities; - Households of revolutionary meritorious persons in difficult circumstances; - Households of revolutionary meritorious persons in areas frequently affected by natural disasters.

5. After approving the Plan for Supporting Revolutionary Meritorious Persons with Housing, the Provincial-level People's Committee shall submit the plan and report (in accordance with the form prescribed in Appendix IV attached to this Circular) to the Ministry of Construction, the Ministry of Planning and Investment, and the Ministry of Finance for consolidation and reporting.

Article 5. Methods for Implementing Construction and Repair of Housing

1. Technical and Quality Requirements:

a) The People's Committee of the province shall direct the Department of Construction to study and design at least three typical housing models, accompanied by investment cost estimates, main material forecasts, suitable with the customs and traditions of each locality, to disseminate and introduce to households for reference and application in building housing.

b) For households of persons who have rendered meritorious service to the revolution, eligible for housing support under Decision No. 22/2013/QĐ-TTg, residing in areas frequently flooded with water levels exceeding 1.5 meters above the ground floor in 14 centrally governed provinces and cities in the North Central Coast and South Central Coast regions (including: Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Ninh Thuan, Binh Thuan), when supported to build new or repair houses according to Decision No. 22/2013/QĐ-TTg, the People's Committee of the commune shall mobilize these households to construct a flood-resistant living area with a minimum floor area of 10 square meters and a height exceeding the usual flood level.

c) Housing for households of persons who have rendered meritorious service to the revolution and received support must ensure environmental hygiene, be fully enclosed, and withstand adverse weather conditions. Households may use typical designs provided by the Department of Construction or refer to traditional and common house models in their locality to select appropriate scales and forms of housing that fit their specific circumstances.

2. Organizational Requirements for Building Housing:

a) After receiving advance funding for housing support according to regulations, households shall organize the construction of housing themselves. In cases where households face difficulties (elderly, single, disabled...) and are unable to construct housing on their own, the People's Committee of the commune shall be responsible for organizing the construction of housing for these households.

b) The People's Committee of the commune shall be responsible for monitoring, supervising, and assisting households during the construction and repair of housing; mobilizing organizations and groups such as the United Front, Women's Union, Veterans' Association, Communist Youth Union to assist households in constructing housing, maximizing community and household resources for labor and local materials like sand, gravel, stone, wood... to reduce construction costs; Upon completion of the foundation and frame-wall construction phase, a Certificate of Completion of Housing Construction by Stage must be established, and upon completion of the entire housing, a Certificate of Completion of Housing Construction for Use (according to the model specified in Appendix V and VI issued together with this Circular) must be established.

3. After completing the construction or repair of housing, if there is a change in the housing area and the supported household has a need, the competent authority shall facilitate the procedures for confirming changes in the housing in the Land Use Right Certificate, Ownership Certificate of Housing and Other Assets Attached to the Land. The time limit for confirming changes in the Land Use Right Certificate, Ownership Certificate of Housing and Other Assets Attached to the Land shall be carried out in accordance with the provisions of the law.

Article 6. Implementation Organization

1. The Ministry of Construction is the permanent agency, leading, coordinating with the Ministries of Planning and Investment, Finance, Labor - Invalids and Social Affairs, Government Office to assist

2. The Ministries and sectors of Planning and Investment, Finance, Labor - Invalids and Social Affairs shall base on the content of Decision No. 22/2013/QĐ-TTg and this Circular, coordinate with the Ministry of Construction to implement tasks and contents within their functions assigned by the Government.

3. Responsibilities of Local Authorities:

a) Responsibilities of the People's Committee of the province:

- Organize the implementation of housing support for persons who have rendered meritorious service to the revolution in accordance with Decision No. 22/2013/QĐ-TTg, suitable with the actual conditions of the locality, ensuring accurate target and purpose support and effectiveness;

- Based on Decision No. 22/2013/QĐ-TTg and the provisions of this Circular, organize the establishment and approval of the Plan for Supporting Persons Who Have Rendered Meritorious Service to the Revolution in Housing throughout the province and submit it to the Ministry of Construction, the Ministry of Planning and Investment, and the Ministry of Finance before August 31, 2013 for consolidation and reporting.

b) Responsibilities of the People's Committee of the district:

- Aggregate and approve the list of persons who have rendered meritorious service and are eligible for housing support in the district;

- Establish a District Steering Committee for Implementing Housing Support for Persons Who Have Rendered Meritorious Service to the Revolution to organize the implementation of housing support;

- Aggregate and report the results of implementing housing support for persons who have rendered meritorious service to the revolution in the communes under its jurisdiction (including the number of households supported, the number of new or repaired houses, the amount of support funds allocated to households, the amount of funds raised from other sources, difficulties, obstacles, and recommendations during the implementation process);

- Inspect, supervise, handle according to its authority or propose competent authorities to handle violations in implementing housing support according to Decision No. 22/2013/QĐ-TTg and this Circular.

c) Responsibilities of the People's Committee of the commune:

- Organize the review and establish a list of households of persons who have rendered meritorious service and are eligible for housing support in the commune;

- Publicly post the list and level of housing support for persons who have rendered meritorious service according to Decision No. 22/2013/QĐ-TTg and this Circular at the office of the People's Committee of the commune;

- Establish a Commune Steering Committee for Implementing Housing Support for Persons Who Have Rendered Meritorious Service to the Revolution to organize the implementation of housing support;

- Organize the establishment of Certificates of Completion of Housing Construction by Stage and Certificates of Completion of Housing Construction for Use (as stipulated in Appendix V and Appendix VI issued together with this Circular);

- Prepare completion files for each household receiving housing support, including:

+ Application for housing support from the household;

+ Certificate of Completion of Housing Construction by Stage (one copy);

+ Certificate of Completion of Housing Construction for Use (one copy);

+ Disbursement vouchers for the support fund.

- Direct and supervise to ensure that households use the housing support funds for the intended purpose, ensuring the quality of newly constructed or repaired housing as prescribed.

- Compile and report to the People's Committee of the district on the results of implementing housing support in the locality (including the number of households that have received support, the number of new houses built or repaired, the amount of support granted to households, and difficulties, obstacles, and recommendations during the implementation process in the locality).

4. The Department of Housing Management and Real Estate Market shall be responsible for assisting the Minister of Construction in guiding, urging, and inspecting the implementation of housing support for those who have rendered meritorious service to the revolution nationwide. It shall compile and report on the implementation situation periodically and propose amendments and supplements to be submitted to the Minister of Construction for consideration and issuance within his authority or reporting.

Article 7. Effective Date

1. This Circular takes effect from July 15, 2013.

2. In the course of implementation, if there are any difficulties, please send comments to the Ministry of Construction for amendment and supplementation within its authority or reporting.
