Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Housing dated November 29, 2005;
Pursuant to the Ordinance Amending and Supplementing the Ordinance on Preferential Treatment for Revolution Veterans issued by the Standing Committee of the National Assembly;
Pursuant to Resolution No. 494/NQ-UBTVQH13 dated May 18, 2012 of the Standing Committee of the National Assembly on the results of supervision of policies and laws regarding revolution veterans;
At the proposal of the Minister of Construction;
The Prime Minister issues this Decision to support revolution veterans with housing,
Article 1. Principles of Support
1. Housing support shall be provided to households where revolution veterans or烈士家属目前居住并拥有户籍的家庭,在本决定生效前。
2. Multiple sources of funds shall be mobilized for implementation; the State shall provide support, the community shall assist, households shall contribute and organize the construction of housing.
3. After receiving support, households shall construct new houses or repair and upgrade existing houses, ensuring a minimum usable area of 30 square meters.2 (for single individuals, the usable area may be smaller but not less than 24 square meters);2ensuring "three hard" (solid foundation, solid frame-walls, solid roof).
Article 2. Objectives and Conditions for Support
Households eligible for support under this Decision must meet the following conditions:
1. They are households with revolution veterans recognized by competent authorities, including:
a) Persons who were engaged in revolutionary activities before January 1, 1945;
b) Persons who participated in revolutionary activities from January 1, 1945 to the August Revolution in 1945;
c) Relatives of martyrs;
d) Mothers of Vietnam's Heroic People;
đ) Heroes of the People's Armed Forces;
e) Labor Heroes during the resistance war;
g) War invalids and persons enjoying benefits equivalent to those of war invalids;
h) Invalids of war;
i) Persons participating in anti-war activities affected by toxic chemicals;
k) Persons participating in revolutionary or anti-war activities captured and imprisoned by the enemy;
l) Persons participating in national liberation, defending the country, and performing international duties;
m) Persons who have contributed to the revolution.
2. Households currently living in temporary houses or houses severely damaged (including households previously supported under other policies) to the extent that:
a) Houses must be demolished and rebuilt;
b) Houses must be repaired and the roofs replaced.
Article 3. Support Level
1. Support of VND 60 million per household for the case of building a new house.
1. Provide a subsidy of 40 million VND per household for cases specified in Point a Clause 2 Article 2 of this Decision;
2. Provide a subsidy of 20 million VND per household for cases specified in Point b Clause 2 Article 2 of this Decision.
Article 4. Anticipated profit
1. Provinces and centrally governed cities shall allocate local budget funds to manage and implement the policy at a maximum rate not exceeding 0.5% of the total state budget funds allocated to implement the policy as stipulated.
2. The Ministry of Construction shall be responsible for preparing annual budgets to supplement the regular operating expenses of the Ministry of Construction from the central budget to carry out organizational guidance, inspection, urging, and summarizing the implementation of this Decision.
Article 5. Sources of Funding
1. Central government budget funds and local government budget funds shall support households eligible for support according to the provisions of Clause 1 Article 3 of this Decision at the following ratios:
a) For areas with financial difficulties requiring more than 70% of the 2012 local budget balance supplementary allocation from the central budget, the central government will provide 100% support according to the prescribed level;
b) For areas with financial difficulties requiring between 50% and 70% of the 2012 local budget balance supplementary allocation from the central budget, the central government will provide 95% support, and local governments will provide 5% support according to the prescribed level;
c) For areas with financial difficulties requiring less than 50% of the 2012 local budget balance supplementary allocation from the central budget, the central government will provide 90% support, and local governments will provide 10% support according to the prescribed level;
d) For areas transferring revenue shares to the central budget, the central government will provide 80% support, and local governments will provide 20% support according to the prescribed level.
2. Funds raised from the community, clans, and contributions from supported households.
Article 6. Implementation Methods
1. The People's Committee of communes, towns, and wards (hereinafter referred to as the People's Committee at the commune level) shall compare and compile lists of supported households to report to the People's Committee at the district level; the People's Committee at the district level shall aggregate, inspect, and approve the list of supported households to report to the provincial People's Committee to serve as the basis for formulating and approving plans to support revolution veterans with housing in the province.
2. Allocation of funds for house construction
a) Based on the allocated funds from the central budget, local government budget, and other legally mobilized funds, the provincial People's Committee shall allocate to the district level;
b) Based on the allocation from the People's Committee at the provincial level, the People's Committee at the district level allocates support funds to the commune level.
c) Management, distribution, payment, and settlement of support funds shall be carried out in accordance with the guidelines of the Ministry of Finance.
3. The People's Committee at the commune level shall guide, inspect, urge households to build houses in compliance with the area and quality requirements stipulated in this Decision, and mobilize households to build their own houses. For households in difficult circumstances (elderly, single, disabled, etc.) unable to build their own houses, the People's Committee at the commune level shall organize the construction of houses for these households.
Article 7. Timeframe and Progress
1. In 2013, the People's Committees of provinces and centrally governed cities must complete the basic provision of housing support for households of revolution veterans in accordance with this Decision for approximately 71,000 households (based on the list reported by localities to the supervisory delegation of the Standing Committee of the National Assembly in 2012).
2. In 2014, localities shall continue to implement support in accordance with this Decision for households eligible for support but newly identified, surveyed, and reported in 2013.
Article 8. Implementation
1. Responsibilities of Central Ministries and Sectors
a) Ministry of Construction:
- Take the lead and coordinate with relevant ministries and sectors: Ministry of Finance, Ministry of Labor, Invalids and Social Affairs to guide provinces and centrally governed cities in implementing this Decision; urge, inspect, and regularly compile reports to the Prime Minister.
- Allocate funds from the annual regular budget supplements for the Ministry of Construction to direct, guide, inspect, urge, summarize, and evaluate the implementation of policies.
b) Ministry of Planning and Investment:
Take the lead and coordinate with the Ministry of Finance, the Ministry of Construction, and the Ministry of Labor, Invalids, and Social Affairs to balance and allocate central government budget funds for localities in the 2013 plan and subsequent periods.
c) Ministry of Finance:
Coordinate with the Ministry of Construction to allocate central government budget funds to support the province to assist households eligible for support.
d) The Ministry of Labor, Invalids, and Social Affairs:
Guide the confirmation of individuals as those who have rendered meritorious service to the revolution according to the provisions of the Ordinance on Preferential Treatment for Those Who Have Rendered Meritorious Service to the Revolution, direct the Departments of Labor, Invalids, and Social Affairs at localities to cooperate with the Departments of Construction during the implementation of the policy.
2. Responsibilities of the People's Committees of provinces and centrally governed cities
a) Publicize openly the criteria and standards for eligible recipients, establish lists of households of those who have rendered meritorious service to the revolution receiving housing support within their jurisdiction;
b) Send the approved support plans within their jurisdiction to the Ministry of Construction, the leading agency, and simultaneously send them to the Ministry of Finance for fund allocation;
c) Direct the preparation of budgets, management, distribution, payment, and settlement of support funds in accordance with the guidelines of the Ministry of Finance;
d) Assign the Department of Labor, Invalids, and Social Affairs and the Labor, Invalids, and Social Affairs offices at the district level to cooperate with relevant functional agencies to review, inspect, and ensure that the eligible recipients are correctly identified;
đ) Assign the Department of Construction as the permanent agency of the province to implement the policy as stipulated in this Decision, design some suitable house models for reference and selection by households;
e) Ensure sufficient counterpart funds and management costs to implement the Policy as stipulated in this Decision, direct related agencies and local authorities at all levels to cooperate with organizations and mass movements within their jurisdiction to mobilize community assistance for households of those who have rendered meritorious service to the revolution in housing;
In addition to the funds specified in Article 3 and Article 5 of this Decision, localities may provide additional funding from the local budget based on actual conditions to improve the quality of housing for supported households;
g) Issue inspection and supervision mechanisms to ensure that there is no loss or corruption during the implementation process;
h) Submit monthly brief reports and quarterly periodic reports on the results of policy implementation to the Ministry of Construction and the Ministry of Finance for consolidation and reporting to the Prime Minister;
Article 9. This Decision takes effect from June 15, 2013.
Article 10. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
