CIRCULAR

Issuing economic and technical standards for land planning and utilization plans

The Government issues this Decree on management and development of industrial clusters.

Pursuant to Decree No. 43/2014/NĐ-CP dated May 15, 2014 of the Government detailing implementation of certain provisions of the Land Law;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director General of the Land Administration General Department, the Planning Department Director, and the Legal Affairs Department Director;

The Minister of Natural Resources and Environment issues the Circular on Economic and Technical Standards for Land Planning and Utilization Plans,

Article 1. Scope of Regulation

Accompanying this Circular are the Economic and Technical Standards for Land Planning and Utilization Plans according to the procedures for establishing and adjusting land planning and utilization plans as stipulated in Circular No. 29/2014/TT-BTNMT dated June 2, 2014 issued by the Minister of Natural Resources and Environment detailing the establishment and adjustment of land planning and utilization plans.

Article 2. Effective Date

1. This Circular takes effect from May 7, 2015.

2. This Circular replaces Circular No. 06/2010/TT-BTNMT dated March 15, 2010 issued by the Minister of Natural Resources and Environment regarding economic and technical standards for establishing and adjusting land planning and utilization plans.

Article 3. Transitional Provisions

For projects that have been approved for budget estimates before the effective date of this Circular, they shall be implemented as follows:

1. For work volumes completed before the effective date of this Circular, the provisions of Circular No. 06/2010/TT-BTNMT shall apply.

2. For work volumes not yet commenced, the budget estimate shall be adjusted according to the provisions of this Circular and submitted to the competent authority for approval.

The Head of the Ministry’s Office, Heads of Departments, Director of the Vietnam Registration Agency, Heads of agencies, units, and individuals related to this Circular shall be responsible for its enforcement.

1. Ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees under central cities, units under the Ministry of Natural Resources and Environment, and related organizations and individuals are responsible for implementing this Circular.

2. The General Department of Land Administration shall be responsible for inspecting the implementation of this Circular.

3. Departments of Natural Resources and Environment shall assist provincial People's Committees and municipal People's Committees directly under the Central Government in implementing this Circular at local levels.

ANY DIFFICULTIES OR OBSTACLES ENCOUNTERED DURING THE IMPLEMENTATION OF THIS CIRCULAR SHALL BE REPORTED PROMPTLY TO THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT FOR REVIEW AND RESOLUTION./.
