JOINT CIRCULAR

REGULATIONS ON CODES AND STANDARDS FOR PROFESSIONAL TITLES OF SPECIALIZED CULTURAL HERITAGE FUNCTIONARIES

Pursuant to the Cultural Heritage Law Law No. 28/2001/QH10 dated June 29, 2001 and the Law Amending and Supplementingprovisions of Circular No. 24/2015/TT-BTTTT dated August 18, 2015 of the Minister of Information and Communications Article of the Cultural Heritage Law No. 32/2009/QH12 dated June 18, 2009;

Pursuant to the Law on Public Servants No. 58/2010/QH12 dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, employment, and management 2. This Circular applies to vocational education teachers in vocational education institutions, vocational education activity institutions, and vocational education and general education centers; other relevant agencies, organizations, and individuals.

Article 2. Yoga training and competition is a mandatory sports activity with guided training.within the scope and organizational structure of the Ministry of Culture, Sports and Tourism and the Minister of Home Affairs promulgates this Joint Circular regulating codes and standards Provincial public libraries have professional and vocational units to implement activities according to the following groups of tasks:

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

a) Technical and vocational task group: carry out tasks related to building, processing, organizing, and preserving information resources; guide, advise, and support the development of library networks; for professional titles of specialized cultural heritage functionaries.1. This Joint Circular stipulates codes, standards for professional titles, and appointment and grading according to professional titles for specialized cultural heritage functionaries.2. This Joint Circular applies to specialized cultural heritage functionaries working in public service units.1. Supplementing Point 6a following Article 6 of Circular No. 02/2019/TT-BVHTTDL dated July 5, 2019 of the Minister of Culture, Sports and Tourism on the procedures for legal expertise regarding copyright and related rights as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 4. Cultural Heritage Officer Level II - Code: V.10.05.16

a) Participate in building and implementing planning, programs, projects, and plans of the unit regarding the protection and promotion of cultural heritage values; participate in inventorying and documenting intangible cultural heritage;

Chapter II

OCCUPATIONAL STANDARDS

b) Participate in summarizing, evaluating, and proposing improvements to perfect procedures and regulations concerning various aspects of professional and technical activities related to the protection and promotion of cultural heritage values;

1. Duties:

c) Develop exhibition outlines introducing cultural heritage, conservation plans for historical sites, organize and implement thematic exhibitions at museums ensuring scientific processes and contents after approval by competent authorities;

d) Plan and organize promotional and educational activities at museums and historical sites; directly conduct promotional work for research and tour groups requiring specialized knowledge;

đ) Develop content for training programs and participate in training lower-level functionaries;

e) Lead or participate in research topics at the ministry, sector, or provincial level concerning the protection and promotion of cultural heritage values.

a) Hold a bachelor's degree or higher in a relevant field of cultural heritage;

b) Possess foreign language proficiency at Level 3 (B1) as specified in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the Foreign Language Competency Framework for Vietnam or possess a certificate in ethnic languages for positions requiring ethnic language usage;

2. Qualifications regarding education and training:

c) Meet basic information technology competency standards as specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Information Technology Competency Standards;

d) Hold a certificate for the qualification standard of Cultural Heritage Officer Level II.

c) Possess analytical and comprehensive capabilities in areas under management;

d) Lead or participate in at least one project, program, or research topic at the ministry, sector, or provincial level that has been accepted and rated as satisfactory or better or applied.

3. Qualifications regarding professional expertise and skills:

b) Have in-depth knowledge of professional practices in cultural heritage protection and promotion;

c) Have the ability to analyze, synthesize, systematize, and propose policy recommendations, draft regulatory documents, proposals, and programs for cultural heritage protection and promotion;

4. Promotion to the position of Cultural Heritage Officer Level II:

A functionary promoted from the position of Cultural Heritage Officer Level III to Cultural Heritage Officer Level II must meet all requirements set out in Clause 2 and Clause 3 of this Article and have at least nine years of experience in the position of Cultural Heritage Officer Level III or equivalent, including at least two consecutive years in the position of Cultural Heritage Officer Level III.

4. Promotion to the rank of Cultural Heritage Officer Level II:

A civil servant promoted from the rank of Cultural Heritage Officer Level III to the rank of Cultural Heritage Officer Level II must fully meet the provisions of Clause 2 and Clause 3 of this Article and have at least 09 (nine) years of service in the rank of Cultural Heritage Officer Level III or equivalent, including at least 02 (two) consecutive years in the most recent period holding the rank of Cultural Heritage Officer Level III.

Article 5. Heritage Officer Grade III - Code: V.10.05.17

1. Duties:

a) Establish object files, site files, intangible cultural heritage files that meet scientific standards; analyze and preliminarily determine the value of objects, sites, and intangible cultural heritage in accordance with officially recognized scientific conclusions to prepare for decisions on the inclusion of objects in storage or registration in the initial inventory book; compile lists and document intangible cultural heritage;

b) Participate in developing exhibition outlines introducing cultural heritage; plans for repairing, restoring sites, and constructing new or repairing museums;

c) Participate in developing content and implementing promotional and educational activities at museums and sites;

d) Inspect and evaluate the condition of objects, propose preservation, repair, and arrangement plans for objects in storage according to the prescribed system;

đ) Participate in developing content for vocational training programs for lower-grade staff;

e) Participate in research topics related to the protection and enhancement of cultural heritage values within the unit;

g) Participate in developing proposals for the conservation and enhancement of the value of intangible cultural heritage;

2. Qualifications regarding education and training:

c) Meet basic information technology competency standards as specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Information Technology Competency Standards;

b) Possess language proficiency level A2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or possess ethnic language certificates for positions requiring the use of ethnic languages;

c) Possess analytical and comprehensive capabilities in areas under management;

d) Hold a certificate for training in the qualifications of a Heritage Officer Grade III;

3. Qualifications regarding professional expertise and skills:

a) Understand the Party's guidelines, state policies, and strategies for development in the field of cultural heritage protection and enhancement;

b) Have knowledge about the protection and enhancement of cultural heritage values;

c) Possess analytical and synthesis capabilities concerning issues within the scope of management;

4. Promotion to the position of Heritage Officer Grade III

Staff members promoted from the position of Heritage Officer Grade IV to Heritage Officer Grade III must fully comply with the provisions of Clause 2 and Clause 3 of this Article and have worked in the position of Heritage Officer Grade IV for a minimum of two years for those with a college degree or a minimum of three years for those with a secondary vocational degree;

Article 6. Heritage Officer Grade IV - Code: V.10.05.18

1. Duties:

a) Perform regular technical tasks at the unit, capable of participating in establishing site, object, tangible cultural heritage files, and activities such as: preserving objects, technical drawing of sites and objects, casting inscriptions, filming, photographing for documentation of cultural heritage to contribute to recognizing cultural heritage;

b) Receive and implement technical instructions from specialized technical staff;

c) Effectively carry out assigned object repair plans;

2. Qualifications regarding education and training:

a) Hold a secondary vocational degree or higher in a relevant field of cultural heritage;

b) Possess language proficiency level A1 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or possess ethnic language certificates for positions requiring the use of ethnic languages;

c) Possess basic information technology skills as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on Information Technology Skill Standards;

3. Qualifications regarding professional expertise and skills:

a) Understand legal regulations regarding the protection of objects in museums and sites;

b) Possess the ability to receive and implement technical guidance on the protection of objects in museums and sites;

c) Have knowledge about the protection and enhancement of cultural heritage values;

Chapter III

APPOINTMENT AND SALARY GRADING ACCORDING TO PROFESSIONAL TITLES

Article 7. Principles for appointment and salary classification according to occupational titles for cultural heritage professionals

1. The appointment to occupational titles for cultural heritage professionals must be based on the job positions and specialized professional tasks currently undertaken by the professional and in accordance with Article 8 of this Joint Circular.

2. When appointing from the current rank of civil servant to the occupational title of cultural heritage professional, such appointment shall not combine with an increase in salary grade or promotion in the occupational title of civil servant.

Article 8. Cases of appointment to occupational titles for cultural heritage professionals

Civil servants who have been appointed to ranks of cultural heritage professionals under Decision No. 428/TCCP-VC dated June 2, 1993, issued by the Minister - Head of the Personnel Organization Department of the Government (now the Minister of Home Affairs) promulgating the standards for the ranks of civil servants in the Cultural and Information sector, may now be appointed to the occupational titles of cultural heritage professionals as stipulated in this Joint Circular, as follows:

1. Appointment to the occupational title of Cultural Heritage Officer Grade II (code V.10.05.16) for those currently holding the rank of Senior Museum Officer (code 17.165).

2. Appointment to the occupational title of Cultural Heritage Officer Grade III (code V.10.05.17) for those currently holding the rank of Museum Officer (code 17.166).

3. Appointment to the occupational title of Cultural Heritage Officer Grade IV (code V.10.05.18) for those currently holding the rank of Museum Technical Officer (code 17.167).

Article 9. Salary Grading Method

1. The occupational titles of cultural heritage professionals specified in this Joint Circular shall apply the Specialized Professional Salary Scale for State-run Public Institutions' Staff (Table 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the salary system for cadres, civil servants, public officials, and armed forces personnel, as follows:

a) The occupational title of Cultural Heritage Officer Grade II shall apply the salary coefficient of Category A2, Group 2 (A2.2), ranging from salary coefficient 4.00 to 6.38;

b) The occupational title of Cultural Heritage Officer Grade III shall apply the salary coefficient of Category A1, ranging from salary coefficient 2.34 to 4.98;

c) The occupational title of Cultural Heritage Officer Grade IV shall apply the salary coefficient of Category B, ranging from salary coefficient 1.86 to 4.06.

2. Determination of salary upon completion of the probation period and appointment to a professional position:

After completing the probationary period as prescribed and being appointed to an occupational title by the competent authority managing the staff, the following salary grading within the newly appointed occupational title shall be implemented:

a) In case of having a doctoral degree with a relevant field of study in cultural heritage, the salary grade 3, with a salary coefficient of 3.00, of the Cultural Heritage Officer Grade III (code V.10.05.17) shall be assigned;

b) In case of having a master's degree with a relevant field of study in cultural heritage, the salary grade 2, with a salary coefficient of 2.67, of the Cultural Heritage Officer Grade III (code V.10.05.17) shall be assigned;

c) In case of having a bachelor's degree in a relevant field of study in cultural heritage, the salary grade 1, with a salary coefficient of 2.34, of the Cultural Heritage Officer Grade III (code V.10.05.17) shall be assigned;

d) In case of having an associate degree in a relevant field of study in cultural heritage, the salary grade 2, with a salary coefficient of 2.06, of the Cultural Heritage Officer Grade IV (code V.10.05.18) shall be assigned;

đ) In case of having a secondary vocational degree in a relevant field of study in cultural heritage, the salary grade 1, with a salary coefficient of 1.86, of the Cultural Heritage Officer Grade IV (code V.10.05.18) shall be assigned.

3. The salary assignment to occupational titles for staff as stipulated in Clause 1 of this Article for staff who have been assigned salaries to ranks of cultural heritage professionals under Decision No. 428/TCCP-VC dated June 2, 1993, issued by the Minister - Head of the Personnel Organization Department of the Government (now the Minister of Home Affairs) promulgating the standards for the ranks of civil servants in the Cultural and Information sector, Decision No. 78/2004/QĐ-BNV dated November 3, 2004, of the Minister of Home Affairs on the issuance of the List of Ranks of Civil Servants and Staff, and Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the salary system for cadres, civil servants, public officials, and armed forces personnel shall be carried out as follows:

a) In cases where staff meet the conditions for appointment to the occupational title of cultural heritage professional and have the same salary grade coefficient as their previous rank, they shall be assigned the same salary grade and percentage of seniority allowance exceeding the ceiling (if applicable) currently enjoyed at their previous rank (including the time for the next salary grade review or the seniority allowance exceeding the ceiling if applicable at the previous rank) to the newly appointed occupational title.

Example 1: Mr. Nguyen Van A was appointed and ranked as a Museum Officer (rank code 17.166), grade 4, salary coefficient 3.33 since July 1, 2013. Now he meets the conditions and is appointed by the competent authority to the occupational title of Cultural Heritage Officer Grade III (code V.10.05.17), then he shall be assigned grade 4, salary coefficient 3.33 of the Cultural Heritage Officer Grade III from the date of the decision; the time for the next salary grade review shall be counted from July 1, 2013.

b) In cases where staff with an associate degree in cultural heritage were assigned to the salary category A0 upon recruitment according to Decree No. 204/2004/NĐ-CP, and are now appointed to the occupational title of Cultural Heritage Officer Grade IV (code V.10.05.18), the salary grading within the occupational title of Cultural Heritage Officer Grade IV shall be based on the years of service with mandatory social insurance contributions according to the state-prescribed salary scale (excluding the probationary period) as follows:

Starting from grade 2 of the Cultural Heritage Officer Grade IV, every two years (24 months) thereafter, one salary grade will be assigned (if there are interrupted periods without enjoying social insurance benefits, these periods can be accumulated). In cases where there are years during which the performance targets were not met or disciplinary actions were taken, the time for the next salary grade review will be extended according to the regular salary grade review system.

After transferring to the salary grade for the profession title of Heritage Officer Grade IV mentioned above, if the salary coefficient assigned at the profession title of Heritage Officer Grade IV plus any seniority allowance exceeding the ceiling (if applicable) is lower than the salary coefficient already enjoyed at the old rank, then the difference coefficient shall be retained to equalize the salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) currently enjoyed at the old rank. This retained difference coefficient shall be enjoyed throughout the entire period during which the civil servant is assigned a salary grade at the profession title of Heritage Officer Grade IV. Subsequently, if the civil servant is promoted to a higher profession title, this retained difference coefficient shall be added to the salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) currently enjoyed to assign a salary grade at the newly appointed profession title upon promotion, and the retention of the difference coefficient shall cease from the date of receiving the salary at the new profession title.

Example 2: Mr. Nguyen Van B, with a college degree in cultural heritage management, was recruited as a civil servant at Museum A, contributing to social insurance since June 1, 2005, and has been assigned Level 4, with a salary coefficient of 3.03 of Category A0 civil servants since December 1, 2014. During his tenure, he consistently fulfilled his tasks and was not disciplined. Now, he is appointed to the profession title of Heritage Officer Grade IV (code V.10.05.18) by the competent authority, the assignment of salary grade within the profession title of Heritage Officer Grade IV will be as follows:

Mr. Nguyen Van B's service time from June 1, 2005, excluding the six-month probationary period, starts from Level 2 of the profession title of Heritage Officer Grade IV, and every two years, he is promoted one level. By December 1, 2013, Mr. Nguyen Van B was assigned Level 6, with a salary coefficient of 2.86 of the profession title of Heritage Officer Grade IV; the time enjoying the new salary grade at the profession title of Heritage Officer Grade IV begins on the date of signing the decision; the next salary grade review period starts from December 1, 2013; simultaneously, he enjoys a retained difference coefficient of 0.17 (3.03 - 2.86).

On December 1, 2015 (after two years), Mr. Nguyen Van B meets the conditions to regularly advance to Level 7, with a salary coefficient of 3.06 of the profession title of Heritage Officer Grade IV, and continues to enjoy the retained difference coefficient of 0.17 (total salary coefficient received is 3.23).

4. The promotion of civil servants in the cultural heritage field shall be carried out after being appointed to the profession title of civil servant in the cultural heritage field as stipulated in this Circular and implementing salary assignment according to the guidance provided in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs guiding salary assignment when advancing to a higher rank, changing ranks, or changing types of civil servants.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from March 1, 2016.

2. Abolish the provisions on professional standards for ranks of civil servants in the museum field as stipulated in Decision No. 428/TCCP-VC dated June 2, 1993, issued by the Minister - Head of the Organizational and Cadre Department of the Government Office, and the List of Ranks of Civil Servants in the Museum Field attached to Decision No. 78/2004/QĐ-BNV dated November 3, 2004, issued by the Minister of the Ministry of Home Affairs.

Article 11. Implementation Organization

1. This Circular serves as the basis for implementing the recruitment, utilization, and management of civil servants in the cultural heritage field working in public institutions.

2. Non-public organizations, institutions, and non-profit enterprises may apply the provisions of this Circular to recruit, utilize, and manage personnel working in the cultural heritage field.

3. Civil servants who have been appointed to the ranks of civil servants in the museum field according to Decision No. 428/TCCP-VC dated June 2, 1993, issued by the Minister - Head of the Organizational and Cadre Department of the Government Office (now the Minister of the Ministry of Home Affairs) promulgating professional standards for the ranks of civil servants in the Culture and Information sector, now can be appointed to the profession titles of civil servants in the cultural heritage field as stipulated in this Circular. The competent authority managing and utilizing civil servants shall be responsible for creating conditions for these civil servants to supplement the missing criteria of the appointed profession titles in the cultural heritage field.

4. The heads of public institutions directly managing and utilizing civil servants shall be responsible for:

a) Reviewing job positions in their units, developing plans for appointing profession titles in the cultural heritage field within their jurisdiction, submitting them to the competent authority for examination and decision-making or deciding according to their delegated authority;

b) Deciding on the appointment of profession titles in the cultural heritage field corresponding to public institutions according to their authority or delegated authority after the plan for appointing profession titles has been approved by the competent authority.

5. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and centrally-administered city People's Committees have the responsibility:

a) Directing subordinate units under their management to implement the appointment of profession titles and salary assignment for civil servants in the cultural heritage field;

b) Approving plans for the appointment of profession titles and salary assignment for civil servants in the cultural heritage field transitioning from current civil servant ranks to corresponding profession titles in the cultural heritage field as stipulated in this Circular; resolving issues within their authority during the process of appointing profession titles and salary assignment;

c) Deciding on the appointment of profession titles and salary assignment for civil servants in the cultural heritage field under their management to corresponding profession titles in institutions under their management;

d) Annually reporting the results of the appointment of profession titles and salary assignment for civil servants in the cultural heritage field under their management to the Ministry of Culture, Sports and Tourism, and the Ministry of Home Affairs.

Article 12. Responsibility for Implementation

1. The Minister, head of a ministerial-level agency, head of a government-affiliated agency; Chairpersons of provincial and centrally-administered city People's Committees shall be responsible for implementing this Joint Circular.

2. In the course of implementation, if there are any difficulties, please reflect them to the Ministry of Culture, Sports and Tourism for consolidation and coordination with the Ministry of Home Affairs to examine and resolve.
