Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 31/2018/NĐ-CP dated March 8, 2018 of the Government detailing the Law on Foreign Trade Management regarding the origin of goods;

Implementing the Exchange Note for Amending Specific Product Rules set out in Appendix 3-A of the Vietnam-Korea Free Trade Agreement signed by the Minister of Industry and Trade of Vietnam and the Minister of Trade, Industry and Energy of Korea on December 22, 2021;

At the proposal of the Director of the Department of Import-Export;

The Minister of Industry and Trade issues this Circular amending and supplementing certain provisions of Circular No. 40/2015/TT-BCT dated November 18, 2015 of the Minister of Industry and Trade stipulating the implementation of Rules on Origin under the Vietnam-Korea Free Trade Agreement (hereinafter referred to as Circular No. 40/2015/TT-BCT).

Article 1. Amending and Supplementing Certain Provisions of Circular No. 40/2015/TT-BCT

1. Replacing Clause 2, Article 1 of Circular No. 40/2015/TT-BCT as follows:

Replacing the Specific Product Rules (Annex II) at Clause 2, Article 1 of Circular No. 40/2015/TT-BCT with the Annex attached hereto.

2. Amending and Supplementing Article 2 of Circular No. 40/2015/TT-BCT as follows:

"The procedures for issuing and checking the VK Certificate of Origin shall be implemented in accordance with the provisions of Annex IV issued together with this Circular, Decree No. 31/2018/NĐ-CP dated March 8, 2018 of the Government detailing the Law on Foreign Trade Management regarding the origin of goods, and Circular No. 05/2018/TT-BCT dated April 3, 2018 of the Minister of Industry and Trade stipulating the origin of goods."

Article 2. Implementation clause

1. This Circular takes effect from August 10, 2022.

2. In cases where the legal documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulations./.
