CIRCULAR
Regulations on the Implementation of Rules of Origin in
the Vietnam-Korea Free Trade Agreement

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 19/2006/NĐ-CP dated February 20, 2006, promulgated by the Government detailing the Law on Commerce regarding the origin of goods;

To implement the Vietnam-Korea Free Trade Agreement signed officially on May 5, 2015, in Hanoi, Vietnam, between the Government of the Socialist Republic of Vietnam and the Government of the Republic of Korea;

At the proposal of the Director of the Department of Import-Export;

The Minister of Industry and Trade issues this Circular to regulate the implementation of rules of origin in the Vietnam-Korea Free Trade Agreement.

Article 1. Vietnam-Korea Rules of Origin

Attached to this Circular are the following Appendices to guide the implementation of Chapter 3 of the Rules of Origin and the Certificate of Origin Issuance Procedure in the Vietnam-Korea Free Trade Agreement (hereinafter referred to as the VKFTA):

1. Rules of Origin (Appendix I);

2. Specific Product Rules (Appendix II);

3. Guidelines for Implementing Point 6 of Appendix I (Appendix III);

4. Certificate of Origin Issuance and Verification Process (Appendix IV);

5. Model C/O VK issued by Vietnam (Appendix V);

6. Model C/O KV issued by Korea (Appendix VI);

7. Supplementary Declaration Form for C/O (Appendix VII);

8. Certificate of Origin Filing Guidelines (Appendix VIII); and

9. List of Organizations Issuing Certificates of Origin (Appendix IX).

Article 2. Certificate of Origin Issuance and Verification Procedures

Certificate of Origin issuance and verification procedures shall be carried out in accordance with the provisions set forth in Appendix IV attached to this Circular and Circular No. 06/2011/TT-BCT dated March 21, 2011, of the Ministry of Industry and Trade on the procedures for issuing preferential certificates of origin (amended and supplemented by Circular No. 01/2013/TT-BCT dated January 3, 2013, of the Ministry of Industry and Trade).
