CIRCULAR

Issuing the Statistical Indicators System for the Civil Service Sector

On the basis of Law on Statistics dated November 23, 2015; Law Amending and Supplementing Certain Provisions and the National Statistical Indicator Catalogue of the Law on Statistics dated November 12, 2021;

On the basis of Decree No. 94/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;

On the basis of Decree No. 47/2020/NĐ-CP dated April 9, 2020 of the Government on management, connection, and sharing of digital data of state agencies;

On the basis of Decree No. 94/2022/NĐ-CP dated November 7, 2022 of the Government stipulating the content of statistical indicators within the national statistical indicator system and the process of compiling gross domestic product, provincial gross domestic product, and municipal gross domestic product;

On the basis of Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Civil Affairs;

At the proposal of the Director of the Department of Planning and Finance;

The Minister of Civil Affairs issues this Circular to issue the Statistical Indicators System for the Civil Service Sector.

Article 1. Scope of Regulation

This Circular stipulates the Statistical Indicators System for the Civil Service Sector, including the catalog of statistical indicators and the content of statistical indicators.

Article 2. Applicability

This Circular applies to agencies and organizations implementing civil service sector statistics work and other related agencies, organizations, and individuals.

Article 3. Statistical Indicators System for the Civil Service Sector

1. The Statistical Indicators System for the Civil Service Sector is a collection of statistical indicators to collect statistical information serving the management work of state agencies in evaluating, forecasting situations, formulating strategies, policies, and developing plans for the civil service sector at different periods; meeting the demand for statistical information about the civil service sector from organizations and individuals requiring such information; it serves as a basis for establishing the civil service sector's statistical reporting system.

2. The Statistical Indicators System for the Civil Service Sector includes statistical indicators reflecting the situation regarding administrative organization, public services, local government, state officials, civil servants, and public employees; training and development of officials, civil servants, and public employees; internal audit of the civil service sector; non-governmental organizations; international cooperation in the civil service sector; commendation and reward; religion; and state archival affairs.

3. The Statistical Indicators System for the Civil Service Sector includes:

a) The Catalog of Statistical Indicators for the Civil Service Sector (Annex I)

b) The Content of Statistical Indicators for the Civil Service Sector (Annex II)

Article 4. Organization of Implementation

1. The Department of Planning and Finance, Ministry of Civil Affairs shall take the lead and coordinate with relevant units based on the Statistical Indicators System for the Civil Service Sector to develop the civil service sector's statistical reporting system, statistical survey programs, and compile statistical data within the civil service sector's statistical indicators system, national statistical indicators, gender development statistical indicators, and sustainable development statistical indicators of Vietnam within the civil service sector to submit to the Minister of Civil Affairs for issuance.

2. Heads of Ministries, ministerial-level agencies, governmental agencies, Chairpersons of People's Committees of provinces and centrally governed cities, Heads of units under and directly under the Ministry of Civil Affairs, and related organizations and individuals are responsible for implementing this Circular.

Article 5. Effective Date

This Circular takes effect from January 30, 2023, replacing Circular No. 03/2017/TT-BNV dated May 19, 2017 of the Minister of Civil Affairs issuing the Statistical Indicators System for the Civil Service Sector./.

01. ADMINISTRATIVE ORGANIZATION

0101. Number of administrative units

1. Definition, calculation method

- Administrative units of the Socialist Republic of Vietnam include:

+ Provinces and centrally governed cities (hereinafter referred to collectively as provincial level);

+ Districts, towns, counties, and cities under provinces and centrally governed cities (hereinafter referred to collectively as district level);

+ Commune, ward, town (hereinafter referred to collectively as commune level);

+ Special administrative-economic unit.

- The number of administrative units at each level (provincial level, district level, commune level, and special administrative-economic unit) is the number of existing administrative units at the time of statistics for each provincial level, district level, commune level, and special administrative-economic unit nationwide.

- The total number of administrative units at all levels (provincial level, district level, commune level, and special administrative-economic unit) is the total number of existing administrative units at the time of statistics for provincial level, district level, commune level, and special administrative-economic unit nationwide.

1. Definition, calculation method

An administrative organization is an organization entrusted with the function of advising the head of the agency or organization in performing state management tasks or implementing state management tasks in a specific sector or field, or advising on internal management work of the agency or organization, and established in accordance with the law.

Administrative organizations include:

a) Administrative organizations established and directly directed and managed by the Prime Minister's decision.

b) Administrative organizations of ministries and ministerial-level agencies (hereinafter referred to as ministries), including:

- Office, inspection body, department, bureau, general bureau, and equivalent organizations within the organizational structure of the ministry;

- Office, inspection body (if any), department, bureau, and equivalent organizations within the organizational structure of the general bureau and equivalent general bureaus (hereinafter referred to as general bureaus);

0103. Number of villages and residential wards

1. Definition, calculation method

- Village, hamlet, village group... (collectively referred to as village) and residential ward, neighborhood, block... (collectively referred to as residential ward) are self-governing organizations of community residents living in a common area within a commune, ward, town (hereinafter referred to collectively as commune level); places where direct and extensive democracy is implemented to promote various forms of self-management activities, organize the people to implement the policies and guidelines of the Party, laws of the State, and tasks assigned by superiors.

- Villages and residential wards are not administrative levels but are directly managed by the commune, ward, town authorities. Villages are established in communes, residential wards are established in wards and towns, and in urban areas and collective housing areas of agencies within the commune when they meet the conditions stipulated by law.

- The number of villages and residential wards is the number of existing villages and residential wards at the time of statistics for each commune, ward, town nationwide.

0201. Number of People's Council representatives

1. Definition, calculation method

The People's Council is the state power organ at the local level, representing the will, aspirations, and right to mastery of the people, elected by the local people, accountable to the local people and higher state agencies. Representatives of the People's Council represent the will and aspirations of the local people; closely connect with voters, subject to voter supervision, implement the system of meeting and reporting to voters about their own activities and those of the People's Council, respond to voter requests and complaints; examine and urge the resolution of complaints and appeals.

The number of People's Council representatives is the number of representatives elected during the election of People's Councils at all levels (provincial, district, commune) in one term.

b) Local authorities include: People's Councils and People's Committees at all levels. For urban local authorities that do not organize district or ward People's Councils, these councils will not be included.

1. Definition, calculation method

Cadres are Vietnamese citizens elected, approved, or appointed to hold positions or titles for a term in the agencies of the Communist Party of Vietnam, State, political-social organizations at central, provincial, and municipal levels (hereinafter referred to as provincial level), at district, town, city, and provincial city levels (hereinafter referred to as district level), within the establishment and receiving salary from the state budget. (Clause 1, Article 4 of the 2008 Civil Servant Law).

Civil servants are Vietnamese citizens recruited and appointed to ranks, positions, or titles corresponding to job positions in the agencies of the Communist Party of Vietnam, State, political-social organizations at central, provincial, and district levels; in agencies and units under the People's Army that are not officers or professional military personnel, defense workers; in agencies and units under the People's Public Security that are not officers or non-commissioned officers serving on a professional basis, public security workers, within the establishment and receiving salary from the state budget. (Clause 1, Article 1 of the Law Amending and Supplementing Certain Provisions of the Civil Servant Law and the Public Official Law).

The number of cadres and civil servants from district level upwards is the total number of people satisfying the above concepts.

1. Definition, calculation method

Commune cadres are Vietnamese citizens elected to hold positions for a term in the Standing Committee of People's Council, People's Committee, Secretary, Deputy Secretary of the Party Committee, head of political-social organizations; commune-level civil servants are Vietnamese citizens recruited to hold a professional position or post under the commune-level People's Committee, within the establishment and receiving salary from the state budget. (Clause 3, Article 4 of the 2008 Civil Servant Law).

Non-professional staff are those who only participate in public work during part of their working time. Based on the guidance of the Central Committee, the provincial People's Committee stipulates the framework for the number and allowance levels for non-professional staff in the grassroots political system (including village chiefs) (Resolution 17-NQ/TW dated March 18, 2002 of the Central Committee of the Communist Party of Vietnam).

The number of cadres, civil servants, and non-professional staff at commune level is the total number of people satisfying the above concepts and regulations.

The average annual income of a cadre or civil servant is the total reported annual income of all cadres and civil servants currently working divided by the total number of cadres and civil servants currently working at the reporting year.

Public officials are Vietnamese citizens recruited based on job positions, working in public service units under employment contracts, receiving salary from the public service unit's wage fund according to the law. (Article 2 of the 2010 Public Official Law).

Defense public officials are those engaged in technical and professional work under the People's Army's establishment, assigned to professional titles; performing tasks at research, education and training, cultural, medical, and other public service units under the Ministry of National Defense. (Clause 3, Article 3 of the 2015 Law on Professional Military Personnel, Defense Workers, and Public Officials).

The number of public officials is the total number of public officials currently working and receiving salary from the public service unit's wage fund according to the law at the time of statistics.

The number of officials, civil servants, and public employees to be evaluated and classified in terms of quality is the total number of officials, civil servants, and public employees who meet the conditions and standards for conducting such evaluations and classifications according to the provisions of the Law on Officials and Civil Servants, the Law on Public Employees, and the Government Decree on the evaluation and classification of quality of officials, civil servants, and public employees.
