Regulations on Support Policies for Agricultural Production to Restore
Production in Areas Damaged by Natural Disasters and Plant Pests
Pursuant to the Law on Government Organization dated June 19, 2015; and the Law Amending and Supplementing Certain Provisions of the Law on Government Organization and the Law on Local Administration dated November 22, 2019;
Pursuant to the Law on Organization of Local Administration dated June 19, 2015;
Pursuant to the Law on Natural Disaster Prevention and Control dated June 19, 2013; the Law amending and supplementing certain articles of the Law on Natural Disaster Prevention and Control and the Law on Dike Construction dated June 17, 2020;

The Government promulgates this Decree stipulating support policies for agricultural production to restore production in areas damaged by natural disasters and plant pests.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates support policies for crop seeds, livestock, aquaculture, forestry, salt production, or part of initial production costs to restore agricultural production in areas damaged by natural disasters and plant pests.
Article 2. Applicability
This Decree applies to agencies, organizations, and individuals in Vietnam; foreign organizations and individuals engaged in supporting agricultural production to restore production in areas damaged by natural disasters and plant pests in Vietnam.
Article 3. Principles of Support
1. The State shall provide partial support for the cost of crop seeds, forestry, livestock, aquaculture, salt production, or part of initial production costs (excluding compensation for losses).
2. Support shall be timely, directly provided in cash or in kind such as seeds, animals, or materials. Seeds, animals, or materials provided as support must meet quality standards and be suitable to local ecological and actual conditions.
3. Support must be transparent, fair, appropriate in amount, and targeted at the right recipients.
4. In cases where multiple support policies apply to the same content and time period, the production entity may only receive the highest level of support from one policy.
Chapter II
SUPPORT POLICIES FOR AGRICULTURAL PRODUCTION TO RESTOREPRODUCTION IN AREAS DAMAGED BY NATURAL DISASTERS,
PLANT PESTS
Article 4. Recipients of Support
Individuals, households, farm owners, cooperative groups, cooperatives, cooperative unions, and units under the People's Armed Forces (excluding businesses under the People's Armed Forces) that engage in crop cultivation, forestry, animal husbandry, aquaculture, salt production (hereinafter referred to as production entities) damaged by natural disasters and plant pests.
Article 5. Levels of Support for Damage Caused by Natural Disasters and Plant Pests
1. Level of support for crops damaged by natural disasters and plant pests
a) Rice area:
From planting to 10 days: damage exceeding 70% of the area, support 6,000,000 VND/ha; damage between 30% and 70% of the area, support 3,000,000 VND/ha;
From planting over 10 days to 45 days: damage exceeding 70% of the area, support 8,000,000 VND/ha; damage between 30% and 70% of the area, support 4,000,000 VND/ha;
From planting over 45 days: damage exceeding 70% of the area, support 10,000,000 VND/ha; damage between 30% and 70% of the area, support 5,000,000 VND/ha.
b) Transplanted rice area:
Damage exceeding 70% of the area, support 30,000,000 VND/ha; damage between 30% and 70% of the area, support 15,000,000 VND/ha.
c) Other annual crop area:
Seedling stage (from planting to 1/3 of the growth period): damage exceeding 70% of the area, support 6,000,000 VND/ha; damage between 30% and 70% of the area, support 3,000,000 VND/ha;
Growth stage (over 1/3 to 2/3 of the growth period): damage exceeding 70% of the area, support 10,000,000 VND/ha; damage between 30% and 70% of the area, support 5,000,000 VND/ha;
Harvesting stage (over 2/3 of the growth period): damage exceeding 70% of the area, support 15,000,000 VND/ha; damage between 30% and 70% of the area, support 7,500,000 VND/ha.
d) Perennial crop area:
Plantation during the basic construction phase: damage exceeding 70% of the area, support 12,000,000 VND/ha; damage between 30% and 70% of the area, support 6,000,000 VND/ha;
Plantation during the commercial phase with yield loss but no tree death: damage exceeding 70% of the area, support 20,000,000 VND/ha; damage between 30% and 70% of the area, support 10,000,000 VND/ha;
Plantation during the commercial phase with tree death or assessed as non-recoverable: damage exceeding 70% of the area, support 30,000,000 VND/ha; damage between 30% and 70% of the area, support 15,000,000 VND/ha;
Seedlings in the nursery phase derived from material harvested from parent trees or parent nurseries: damage exceeding 70% of the area, support 60,000,000 VND/ha; damage between 30% and 70% of the area, support 30,000,000 VND/ha.
2. Level of support for forestry damaged by natural disasters and plant pests
a) Area of forest trees and non-timber forest products planted on new forest land up to half of the harvesting cycle: damage exceeding 70%, support 8,000,000 VND/ha; damage between 30% and 70%, support 4,000,000 VND/ha.
b) Area of forest trees and non-timber forest products planted on forest land over half of the harvesting cycle, and large timber plantation areas over three years old: damage exceeding 70%, support 15,000,000 VND/ha; damage between 30% and 70%, support 7,500,000 VND/ha.
c) Area of seedling nurseries and genetic stock forests: damage exceeding 70%, support 20,000,000 VND/ha; damage between 30% and 70%, support 10,000,000 VND/ha.
d) Area of seedlings in the nursery phase:
Fast-growing species with a nursery age under 12 months: damage exceeding 70%, support 40,000,000 VND/ha; damage between 30% and 70%, support 20,000,000 VND/ha.
Slow-growing species with a nursery age under 12 months: damage exceeding 70%, support 60,000,000 VND/ha; damage between 30% and 70%, support 30,000,000 VND/ha.
3. Level of support for aquaculture damaged by natural disasters (including semi-intensive and intensive aquaculture, fish breeding)
a) Semi-intensive and intensive aquaculture in ponds (lakes/caves): support 60,000,000 VND/ha for damaged aquaculture area.
b) Aquaculture in tanks, cages, and rafts: support 30,000,000 VND/100 m3 for damaged aquaculture volume.
c) Aquaculture in other forms: support 15,000,000 VND/ha for damaged aquaculture area.
4. Level of support for livestock damaged (dead or missing) by natural disasters
a) Poultry (chickens, ducks, geese, swans, pigeons) up to 28 days old, supported from VND 15,000 per head to VND 30,000 per head; over 28 days old, supported from VND 31,000 per head to VND 45,000 per head.
b) Quails up to 28 days old, supported from VND 3,000 per head to VND 5,000 per head; over 28 days old, supported from VND 6,000 per head to VND 10,000 per head.
c) Pigs up to 28 days old, supported from VND 500,000 per head to VND 600,000 per head; over 28 days old, supported from VND 610,000 per head to VND 1,500,000 per head; breeding sows and boars in operation, supported VND 3,000,000 per head.
d) Female calves for milk production up to six months old, supported from VND 2,000,000 per head to VND 4,000,000 per head; dairy cows over six months old, supported from VND 4,100,000 per head to VND 12,000,000 per head.
đ) Buffalo, beef cattle, horses up to six months old, supported from VND 1,500,000 per head to VND 3,000,000 per head; over six months old, supported from VND 3,100,000 per head to VND 7,000,000 per head.
e) Saiga antelopes, sheep, goats, ostriches: supported from VND 1,000,000 per head to VND 2,500,000 per head.
g) Rabbits up to 28 days old, supported from VND 30,000 per head to VND 50,000 per head; over 28 days old, supported from VND 51,000 per head to VND 70,000 per head.
h) Bee colonies (hives): supported from VND 300,000 per hive to VND 500,000 per hive.
5. The level of support for salt production damaged by natural disasters (including areas currently in production or areas where salt has been collected on the field).
Salt production area: damaged over 70%, supported VND 4,000,000 per hectare; damaged from 30% to 70%, supported VND 3,000,000 per hectare.
6. In cases where support is provided in the form of seedlings, animals, or physical goods, the level of support is converted equivalently to monetary support based on prices at the time of support.
Article 6. Procedures and responsibilities for implementing support
1. Procedures and responsibilities for implementing support for agencies and units under the People's Armed Forces shall be carried out according to the guidelines of the Ministry of National Defense and the Ministry of Public Security.
2. Procedures and responsibilities for implementing support for damage caused by natural disasters and plant pests, except for the case stipulated in Clause 1 of this Article:
a) Responsibilities of the Commune People's Committee
The Chairman of the Commune People's Committee establishes a Joint Inspection Team to work with production facilities to conduct statistics and assess the extent of damage, reporting to the Commune People's Committee for resolution.
The Inspection Team includes representatives of the Commune People's Committee, representatives of some political and social organizations in the locality, and representatives of villages and residential wards. If necessary, the Chairman of the Commune People's Committee may decide to invite representatives of the District People's Committee to join the Inspection Team. The Inspection Team works with production facilities to organize statistics and assess the extent of damage, specific needs for support, and reports to the Commune People's Committee.
The Commune People's Committee compiles and reports to the District People's Committee according to the form attached as an appendix to this Decree.
b) Responsibilities of the District People's Committee
Based on the report of the Commune People's Committee, the District People's Committee organizes verification and decides on support within its authority, or compiles and reports to the Provincial People's Committee according to the form attached as an appendix to this Decree.
c) Responsibilities of the Provincial People's Committee
Based on the report of the District People's Committee, the specialized agency on agriculture and rural development under the Provincial People's Committee is responsible for verification, submitting to the Provincial People's Committee for approval and allocation of local budget and other legitimate financial sources to promptly meet the needs for support to restore production in areas affected by natural disasters and plant pests as prescribed in this Decree.
Article 7. Resources and Principles for Financial Support
1. Sources of support
a) Central budget.
b) Local budget.
c) Other lawful financial sources as prescribed by law.
2. Principles for financial support from the central budget to the local budget
a) For localities receiving additional budget balance supplements from the central budget: the central budget will support at 80% of the state budget support level as stipulated in Article 5 of this Decree.
b) For localities with a redistribution rate of revenue shares to the central budget not exceeding 20%: the central budget will support at 70% of the state budget support level as stipulated in Article 5 of this Decree.
c) For localities with a redistribution rate of revenue shares to the central budget ranging from over 20% to 60%: the central budget will support at 50% of the state budget support level as stipulated in Article 5 of this Decree.
d) The remaining localities shall be covered by the local budget.
đ) The redistribution rate of revenue shares to the central budget as specified in points a, b, c, and d of this clause shall be determined according to the Resolution of the National Assembly on the annual allocation of the central budget.
3. Other provisions
a) In cases where the portion of the local budget guaranteed under points a, b, and c of Clause 2 of Article 7 of this Decree exceeds the resources of the locality including other lawful financial sources as stipulated in point c of Clause 1 of this Article, 50% of the local budget reserve estimate assigned at the beginning of the year and 70% of the initial balance of the provincial financial reserve fund, the central budget will supplement the difference to ensure that provinces have sufficient resources to implement. b) The central budget will ensure funding support for agencies and units under the People's Armed Forces engaged in agricultural planting, forestry, animal husbandry, aquaculture, salt production affected by natural disasters and plant diseases up to the maximum level prescribed in this Decree.
Article 8. Responsibilities of Ministries and Equivalent Agencies
Chapter III
IMPLEMENTATION AND EFFECTIVE PROVISIONS
1. Ministry of Agriculture and Rural Development
To take the lead and coordinate with the Ministry of Finance and relevant ministries and sectors to urge, inspect, supervise, and resolve issues arising during the implementation of this Decree.
a) Based on the provisions of this Decree and reports on the results of expenditures from the state budget of localities, the Ministry of Finance will supplement or propose to competent authorities to supplement from the annual central budget reserve for each locality according to the support principles set out in Clause 2 of Article 7 of this Decree.
2. Ministry of Finance
b) In cases where additional resources are needed to promptly support losses due to natural disasters and plant diseases but the required documentation has not been fully completed, based on the proposal of the Provincial People's Committee, the Ministry of Finance will supplement or propose to competent authorities to supplement the local budget by 70% of the estimated central budget support to ensure the locality has sufficient resources to implement loss support policies due to natural disasters and plant diseases. After the locality reports on the results of expenditures from the state budget (confirmed by the State Treasury), the Ministry of Finance will supplement or propose to competent authorities to supplement the localities with the remaining support funds or recover any excess funds supplemented based on the actual support provided to the beneficiaries as prescribed.
3. Vietnam Fatherland Front Committees at all levels shall take the lead and coordinate with political-social organizations and related agencies to monitor the implementation of agricultural production support to restore production in areas affected by natural disasters and plant diseases.
4. Relevant ministries and equivalent agencies shall, based on their functions and responsibilities, implement agricultural production support to restore production in areas affected by natural disasters and plant diseases as prescribed in this Decree.
1. Direct the organization of statistics and assessment of losses caused by natural disasters and plant diseases, proactively implement support work from the local budget and other lawful financial sources to promptly address the aftermath of natural disasters and plant diseases to restore agricultural production in affected areas; compile and report needs for support to the Ministry of Finance for consolidation and reporting to the Prime Minister in accordance with the law, and bear responsibility for the accuracy of the reported data, while sending the report to the National Civil Defense Steering Committee for overall consolidation as prescribed.
Article 9. Responsibilities of the Provincial People's Committee
2. Direct specialized agencies, district and commune people's committees to implement direct support to production establishments affected by natural disasters and plant diseases in accordance with the principles stipulated in Article 3 of this Decree.
3. Based on the budget balancing capacity, other lawful financial sources, production characteristics, and actual conditions in the locality, laws on local administration organization, and state budget laws, the provincial people's committee shall submit to the provincial People's Council for decision:
a) Specific support levels for each type of crop, forestry, aquaculture, livestock, and salt production as stipulated in Clauses 1, 2, 3, 4, and 5 of Article 5 of this Decree.
b) Higher support levels than those stipulated in Clauses 1, 2, 3, 4, and 5 of Article 5 of this Decree for each type of crop, forestry, aquaculture, livestock, and salt production, but not exceeding 1.5 times.
c) Support levels for types of crops, forestry, aquaculture, livestock, and salt production not specified in Clauses 1, 2, 3, 4, and 5 of Article 5 of this Decree.
d) Support for small and medium enterprises at the support level prescribed in this Decree.
đ) Utilize the local budget and other lawful financial sources to support cases specified in points c and d of this clause and the difference exceeding the level prescribed in Clauses 1, 2, 3, 4, and 5 of Article 5 of this Decree.
4. Direct the district and commune people's committees to publicly announce the support policy and level through mass media and in the locality, ensuring direct support reaches production establishments engaged in agricultural planting, forestry, animal husbandry, aquaculture, and salt production affected by losses as prescribed. Commune people's committees shall be responsible for publicly announcing the list of recipients of support funds as prescribed.
4. Direct the People's Committees at the district and commune levels to publicly announce policies and support levels through mass media and locally, ensuring direct assistance reaches production bases engaged in crop cultivation, forestry, animal husbandry, aquaculture, and salt production that have suffered losses as prescribed. The People's Committee at the commune level shall be responsible for publicly announcing lists of recipients of support funds in accordance with regulations.
5. Upon completion of each disaster period, plant pest outbreak, or at year-end, report to the Ministry of Agriculture and Rural Development, the Ministry of Finance, and the National Civil Defense Steering Committee (for damage caused by natural disasters) the results of implementation according to the form attached and promulgated with this Decree for consolidation and reporting. The Prime Minister.
6. The Chairperson of the People's Committees of provinces and centrally governed cities shall be responsible under the law, the Government, and the Prime Minister for organizing support for agricultural production to restore production in areas damaged by natural disasters and plant pests within their jurisdiction.
Article 10. Responsibilities of entities benefiting from the state budget
1. Provide complete information and data on losses caused by natural disasters and plant pests as required by competent authorities.
2. Be responsible under the law for the accuracy and honesty of information and data on losses.
Article 11. Transitional Provisions
Losses due to natural disasters occurring from September 1, 2024, which have not been supported according to the provisions of Government Decree No. 02/2017/NĐ-CP dated January 9, 2017, on mechanisms and policies to support agricultural production to restore production in areas damaged by natural disasters and epidemics, shall be implemented according to the provisions of this Decree.
Article 12. Implementation Provisions
1. This Decree takes effect from February 25, 2025.
2. This Decree replaces Government Decree No. 02/2017/NĐ-CP dated January 9, 2017, on mechanisms and policies to support agricultural production to restore production in areas damaged by natural disasters and epidemics.
Provisions regarding support for prevention and control of animal diseases continue to be implemented according to the provisions of Government Decree No. 02/2017/NĐ-CP dated January 9, 2017, on mechanisms and policies to support agricultural production to restore production in areas damaged by natural disasters and epidemics until new regulations by the Government on support for prevention and control of animal diseases are issued.
3. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of the People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Decree.
