Amending and Supplementing Certain Articles of Circular No. 21/2021/TT-BLĐTBXH dated December 15, 2021 by the Minister of Labour, War Invalids and Social Affairs on Detailed Provisions for Certain Articles of the Law on Vietnamese Workers Engaging in Employment Abroad under Contract
Based on the Law on Vietnamese Workers Engaging in Employment Abroad under Contract No. 69/2020/QH14;
Based on Decree No. 25/2025/NĐ-CP of the Government on Functions, Powers, Tasks, and Organizational Structure of the Ministry of Home Affairs;
Based on Decree No. 128/2025/NĐ-CP of the Government on Delegation and Hierarchical Management in State Administration Matters;
Based on Resolution No. 66.16/2026/NQ-CP of the Government on Streamlining Administrative Procedures Related to Production and Business Activities;
In accordance with the proposal by the Director of the Overseas Labour Management Department;
The Minister of Home Affairs promulgates this Circular amending and supplementing certain articles of Circular No. 21/2021/TT-BLĐTBXH dated December 15, 2021 by the Minister of Labour - Invalids and Social Affairs on Detailed Provisions for Certain Articles of the Law on Vietnamese Workers Engaging in Employment Abroad under Contract.
Article 1. Amending and Supplementing Certain Articles of Circular No. 21/2021/TT-BLĐTBXH dated December 15, 2021 by the Minister of Labour - Invalids and Social Affairs on Detailed Provisions for Certain Articles of the Law on Vietnamese Workers Engaging in Employment Abroad under Contract
1. Amend and supplement Article 4 as follows: "Article 4. Detailed Content of Labour Supply Contract The detailed content of the labour supply contract according to market, industry, occupation, and job shall be stipulated as follows: a) For industries, occupations, and jobs in the Japanese market as specified in Appendix II attached hereto; b) For industries, occupations, and jobs in the Taiwanese (China) market as specified in Appendix III attached hereto; c) For industries, occupations, and jobs in the South Korean market as specified in Appendix IV attached hereto; d) For industries, occupations, and jobs in the Western Asia, Central Asia, and Africa markets as specified in Appendix V attached hereto; e) For industries, occupations, and jobs in the European and Oceanian markets as specified in Appendix VI attached hereto; f) For industries, occupations, and jobs in the American market as specified in Appendix VII attached hereto; g) For industries, occupations, and jobs in the Chinese, Macao (China), and Southeast Asian markets as specified in Appendix VIII attached hereto; h) For international maritime labour as specified in Appendix IX attached hereto. 2. The labour supply contract shall be agreed upon by the service provider and the recipient employer but must ensure the minimum conditions stipulated in paragraph 1 of this Article."
2. Amend and supplement Article 5 as follows: "Article 5. Documentation Proving Compliance with the Labour Laws of the Receiving Country for Vietnamese Workers Going Abroad 1. For the Malaysian market and the Taiwanese (China) market, the documentation proving compliance is one copy of the Approval Certificate for Recruitment of Vietnamese Labour Force issued by the Vietnamese Mission in Malaysia or Taiwan (China). 2. For the Japanese market and the South Korean nearshore fishing vessel crew programme: a) In case the recipient employer is an employer, the documentation proving compliance is one copy of the business license or other equivalent document issued by the competent authority to the employer indicating the business scope that matches the industry, occupation, and job for which foreign labour recruitment is being conducted, accompanied by a Vietnamese translation; b) In case the recipient entity is a human resources service organization, the documentation proving compliance is one copy of the business license or confirmation issued by the competent authority in the receiving country to the human resources service organization indicating its business scope including human resources services, accompanied by a Vietnamese translation or a list of managing bodies and organizations authorized to recruit skilled interns, specific skills labourers, and foreign labour for skill development provided by the Japanese authorities according to the cooperation agreement already signed (for the Japanese market). 3. For other countries and territories: In case the recipient employer is an employer, the documentation proving compliance includes: a) One copy of the business license or equivalent document issued by the competent authority to the employer indicating the business scope that matches the industry, occupation, and job for which foreign labour recruitment is being conducted, accompanied by a Vietnamese translation; b) One copy of the document from the competent authority in the receiving country authorizing the employer to recruit foreign labour or a list of industries, occupations, and jobs permitted for foreign labour recruitment according to the regulations of the receiving country, accompanied by a Vietnamese translation. 4. For countries and territories specified in paragraph 3 of this Article: In case the recipient entity is a human resources service organization, the documentation proving compliance includes: a) One copy of the business license or equivalent document issued or confirmed by the competent authority to the human resources service organization indicating its business scope including human resources services, accompanied by a Vietnamese translation; b) One copy of the cooperation agreement or request for recruitment of Vietnamese labour from the employer to the human resources service organization, accompanied by a Vietnamese translation; c) Documentation proving compliance with respect to employers as specified in paragraph 3 of this Article."
3. Amend and supplement Article 7 as follows: "Article 7. Ceiling Price for Services under Brokerage Contracts 1. The ceiling price for services under brokerage contracts shall be determined by agreement between the service provider enterprise and the intermediary organization or individual, but shall not exceed half a month's salary based on the labor contract of the employee for each twelve months of work. In the case where the labor contract has a term of at least thirty-six months, the ceiling price for services under brokerage contracts shall not exceed one and a half months' salary based on the labor contract of the employee. 2. The ceiling price for services under brokerage contracts for certain markets, industries, professions, or specific jobs is specified in Appendix X attached to this Circular."
Article 2. Replace some appendices and forms of Decree No. 21/2021/TT-BLĐTBXH, which have been amended and supplemented by Decree No. 02/2024/TT-BLĐTBXH
1. Replace: Appendices II, III, IV, V, VI, VII, VIII, IX, X, and XI attached to Decree No. 21/2021/TT-BLĐTBXH (which have been amended and supplemented into Appendices II, III, IV, V, VI, VII, VIII, IX, X, and XI of Decree No. 02/2024/TT-BLĐTBXH) with Appendices II, III, IV, V, VI, VII, VIII, IX, X, and XI attached to this Circular;
2. Replace: Form No. 1 in Appendix I attached to Decree No. 21/2021/TT-BLĐTBXH (which have been amended and supplemented into Form No. 17, Clause 1, Article 17 of Circular No. 09/2025/TT-BNV) with Form No. 1 attached to this Circular;
3. Replace: Forms Nos. 2 and 3 in Appendix I attached to Decree No. 21/2021/TT-BLĐTBXH (which have been amended and supplemented into Forms Nos. 2 and 3 of Appendix I of Decree No. 02/2024/TT-BLĐTBXH) with Forms Nos. 2 and 3 in Appendix I attached to this Circular;
4. Replace: Forms Nos. 4 and 6 in Appendix I attached to Decree No. 21/2021/TT-BLĐTBXH with Forms Nos. 4 and 6 in Appendix I attached to this Circular;
5. Replace: Form No. 5 in Appendix I attached to Decree No. 21/2021/TT-BLĐTBXH (which have been amended and supplemented into Form No. 39 attached to Circular No. 08/2023/TT-BLĐTBXH) with Form No. 5 in Appendix I attached to this Circular;
6. Replace: Appendices XII, Forms Nos. 2, 3 and 4 in Appendix XIII attached to Decree No. 21/2021/TT-BLĐTBXH with Appendices XII, Forms Nos. 2, 3 and 4 in Appendix XIII attached to this Circular;
7. Replace: Form No. 1 in Appendix XIII attached to Decree No. 21/2021/TT-BLĐTBXH (which have been amended and supplemented into Form No. 1 of Appendix I of Decree No. 02/2024/TT-BLĐTBXH) with Form No. 1 in Appendix XIII attached to this Circular.
Article 3. Transitional Provisions
1. Contracts for the dispatch of Vietnamese workers to work abroad and related agreements that have been signed and the worker has already departed before the effective date of this Circular shall continue to be implemented until the end of the contract. Contracts for the dispatch of Vietnamese workers to work abroad and related agreements that have been signed but the worker has not yet departed on or after the effective date of this Circular shall continue to be implemented in accordance with the signed contract provided that the rights of the worker are no less favorable than those stipulated in this Circular or the regulations of the receiving country.
2. Labor dispatch contracts that have been registered and approved by the Ministry of Home Affairs, and where the workers have not yet departed on or after the effective date of this Circular, shall continue to be valid if their content is different from those stipulated in this Circular; such labor dispatch contracts must be amended, supplemented, or newly signed.
Article 4. Implementation Rules
1. This Circular shall take effect from June 30, 2026.
2. The following amendments and supplements to Clause 17 of Decree No. 09/2025/TT-BNV are as follows: "Clause 17. Implementation of the duty to receive and issue documents approving the preparation of labor force for service enterprises. 1. The document preparing the labor force shall be in accordance with Form No. 01 attached hereto. 2. A copy of the request document from the foreign entity receiving labor or a cooperation agreement between a Vietnamese enterprise and the foreign entity receiving labor, accompanied by a Vietnamese translation; including the following basic contents: a) The number of workers that the Vietnamese enterprise needs to prepare, their occupation, gender (if applicable); b) Requirements for the level of education, skills, and language proficiency of the workers; c) Basic information about employment abroad (proposed occupation, proposed place of work, proposed salary, proposed term of labor contract): d) The anticipated time frame for recruitment. 3. Documentation proving that a foreign entity has been granted permission to recruit foreign labor by relevant authorities: a) In the case where the foreign entity is an employer, documentation shall be one copy of a business license or equivalent document issued by the competent authority, accompanied by a Vietnamese translation: b) In the case where the foreign entity is a job placement service organization, documentation shall be one copy of a business license or equivalent document issued or confirmed for the job placement service organization indicating its scope of business including job placement services, accompanied by a Vietnamese translation."
3. The following documents are hereby repealed: Repeal Decree No. 02/2024/TT-BLĐTBXH dated February 23, 2024, which amended and supplemented certain provisions of Circular No. 21/2021/TT-BLĐTBXH dated December 15, 2021, issued by the Minister of Labor, War Invalids and Social Affairs, providing detailed regulations for certain provisions of the Law on Vietnamese Workers Working Abroad under Contract.
4. In the course of implementing this Circular, if any difficulties or obstacles arise, it is requested that relevant agencies, enterprises, and workers report to the Ministry of Home Affairs for timely guidance.

2.19. Enjoy other rights and fulfill other obligations as provided by law.

Article 3: Rights and Obligations of the Sending Party
3.1. To collect service fees as specified in Clause 2.4 of this Contract.
3.2. Organize educational guidance for workers, ensuring a duration of 74 periods according to regulations.
3.3. Agree with the worker on skill and language training requirements as requested by the receiving party.
3.4. Coordinate with the receiving party to complete documentation and procedures for the legal entry and exit of the worker, and their arrival at the workplace.
3.5. Ensure that the worker signs a labor contract with the employer under terms consistent with this Contract.
3.6. Coordinate with the foreign receiving party to support workers in remitting wages and lawful income back to Vietnam in accordance with relevant laws.
3.7. Manage and protect the legal rights and interests of the worker during their work abroad.
3.8. Coordinate with the receiving party to organize and guide the worker's entry and exit from the country according to the signed contract.
3.9. Assist workers or their family members in processing procedures for enjoying insurance benefits as stipulated by the receiving country, the Overseas Employment Support Fund according to regulations, and other government support policies (if applicable).
3.10. Compensate the worker and the guarantor (if any) for damages caused by the sending party in accordance with Article 6 of this Contract, the guarantee contract (if any), and relevant legal provisions.
3.11. Demand compensation from the worker or guarantor for damages as agreed upon in Article 6 of this Contract, the guarantee contract (if any), and relevant legal provisions.
3.12. Terminate the Labor Dispatch Contract according to applicable laws.
3.13. Enjoy other rights and fulfill other obligations as prescribed by law.
Article 4: Time of Departure
4.1. The sending party shall be responsible for transporting the worker abroad for work within 180 days from the date of their successful selection to work abroad, as per the commitment letter from the sending party.
4.2. During the period specified in Clause 4.1, if the worker no longer wishes to work abroad, the sending party shall return the documents (passport, resume, certificates, etc.) and the worker must bear any costs incurred for the worker's departure procedures: transportation fees from Vietnam to the workplace, language training fees, vocational skills training fees, passport fees, visa application fees, medical examination fees, etc.
4.3. If the period specified in Clause 4.1 has expired and the sending party still has not transported the worker abroad, the sending party must clearly inform the worker of the reasons. In case the worker no longer wishes to work abroad, within 15 days from the date the worker informs them of their lack of interest in working abroad, the sending party shall return all documents retained by the worker and refund any fees paid by the worker to the sending party, including service fees, contributions to the Overseas Employment Support Fund, transportation fees from Vietnam to the workplace, visa application fees, etc.; and the sending party will process the refund of any security deposit (if applicable) for the worker.
4.4. In case of force majeure (natural disasters, epidemics, wars, political instability, or emergencies), leading to the worker no longer wishing to work abroad after 180 days from their successful selection and/or the sending party not being able to transport the worker abroad, the sending party must return all documents to the worker, refund the service fees, and any unexpended amounts. For expenditures already made in accordance with regulations, the sending party will refund the worker according to the agreement between the worker and the sending party.

Article 8: Termination of Contract
8.1. This Contract may be terminated under one of the following circumstances:
The worker no longer has a desire to work abroad;
The sending party fails to send the worker to work abroad within 180 days from the date of the worker's selection;
The worker breaches the labor contract or leaves without permission to engage in illegal employment;
Other cases as provided by Vietnamese and foreign laws.
8.2. Depending on the reason leading to early termination of the labor contract, both parties will consider negotiating the termination of the Contract, specifically as follows:
In case of force majeure preventing further performance of the Contract (such as war, natural disasters, and other events beyond the reasonable control of the parties), both parties shall jointly address any remaining issues and the sending party may consider providing support to the worker based on current legal provisions;
If the worker's contract is terminated and they return home before the scheduled time without fault by the worker, the sending party has the responsibility to pay the amounts due according to regulations and compensate the worker as agreed;
If the worker's contract is terminated and they must return home before the scheduled time due to their own fault, the worker shall be responsible for compensating the foreign receiving entity and the sending party for any losses caused by the worker.

The maximum service fee charged by the foreign party (Taiwanese employment service company) from the employee is 1,500 New Taiwan Dollars per month.

2. Basic knowledge of Vietnamese law and the receiving country's labor laws (duration: 07 periods, including: 07 theoretical periods)
a) Vietnamese law: provisions related to workers going abroad under the Labor Code; Law on Vietnamese Workers Going Abroad Under Contract and relevant guiding documents; provisions on mandatory social insurance contributions, contributions to the Overseas Employment Support Fund; provisions on entry and exit; provisions of the Civil Code and regulations concerning complaints and appeals in the field of sending workers abroad under contract.
b) Receiving country's law: provisions related to immigration, entry and exit for foreign workers; working conditions; insurance schemes (social insurance, health insurance, accident insurance...); medical services, reproductive health care; compensation for foreign workers; violations of law and penalties; traffic safety regulations;

a) Contract for sending workers abroad (service company, organization, individual investor sends workers abroad signs with the worker); vocational training contract abroad (Vietnamese company signs with the worker regarding vocational training and skill enhancement).

d) Rights, obligations, and responsibilities of each party in fulfilling the terms of the contract.
The company shall disseminate to workers the content of various contracts suitable for their form of going abroad.
4. Skills in spending, saving, and remitting money while working abroad (duration: 04 periods, including: 03 theoretical periods, 01 practical period)
a) Planning expenses abroad, determining needs and desires in spending, risk funds;
b) Planning the use of savings: investing in education, repaying debts, building houses, starting businesses, etc.;
c) Safe channels for remitting money home, formal and informal transfer services, advantages and disadvantages.
5. Labor discipline, occupational safety and health (duration: 12 periods, including: 06 theoretical periods, 06 practical periods)
a) Workplace labor rules;
b) Guidance on safety and occupational hygiene regulations:
c) Personal protective equipment and usage methods;
d) Types of workplace accidents; occupational diseases and prevention measures;

a1) Ways to handle and procedures for resolving issues arising in the labor relationship with the employer; with company recruiters or service providers who send workers abroad or authorized by the company;
a2) Interaction with co-workers at the factory (Vietnamese workers, foreign workers, and local residents).

Provide and guide contact numbers and addresses of Vietnamese embassies/consulates abroad, enterprise management representatives, police, fire services, emergency hotlines of relevant receiving country agencies, overseas citizen protection and legal entity support hotline, phone numbers for reporting to the Department of Laborers' Overseas Management, complaint resolution channels... so that workers can use them when needed. 13.
