CIRCULAR
REGULATIONS ON PROCEDURES FOR CONFIRMING THE REPORT OF INLAND WATERWAYS
Circular No. 69/2014/TT-BGTVT dated November 27, 2014 of the Minister of Transport on procedures for confirming the report of inland waterways was effective from February 1, 2015 and amended and supplemented by:
Circular No. 09/2025/TT-BXD dated June 13, 2025 of the Minister of Construction amending and supplementing certain articles of circulars under the management of the Ministry of Construction related to organizational restructuring, implementation of two-level local administration, and decentralization to local administration, which took effect from July 1, 2025.
Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Inland Waterway Administration,
The Minister of Transport issues this Circular regulating the procedures for confirming the report of inland waterways.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates the procedures for confirming the report of inland waterways made by the master or person in charge of the vessel when the inland waterway vessel, sea vessel, or fishing vessel encounters an accident or incident on inland waterways and within port waters or inland waterway terminals.
Article 2. Applicability
This Circular applies to masters, persons in charge of vessels, competent authorities for confirming the report of inland waterways, and other relevant agencies, organizations, and individuals.
Article 3. Legal value of the report of inland waterways
1. A report of inland waterways confirmed in accordance with the procedures prescribed in this Circular has evidentiary legal value when resolving disputes related thereto.
2. A report of inland waterways confirmed in accordance with the procedures prescribed in this Circular does not exempt the master or person in charge of the vessel from legal responsibility for other matters related thereto.
Article 4. Language in the preparation and confirmation of the report of inland waterways
The report of inland waterways shall be prepared and confirmed in Vietnamese or English; in case the report of inland waterways is prepared in English, upon request of the competent authority for confirming the report of inland waterways, the master or person in charge of the vessel must submit a Vietnamese translation thereof.
Chapter II
PROCEDURES FOR CONFIRMING THE REPORT OF INLAND WATERWAYS
Article 5. Authority for confirming the report of inland waterways
[2]The maritime police or the People's Committee nearest to the location where the accident or incident occurred is the authority for confirming the report of inland waterways.
Article 6. Time limit for submitting the report of inland waterways for confirmation
1. In case the inland waterway vessel, sea vessel, or fishing vessel encounters an accident or incident within port waters or inland waterway terminals, the report of inland waterways must be submitted to the maritime police or the nearest People's Committee within 48 (forty-eight) hours after the occurrence of the accident or incident.
2. In case the inland waterway vessel, sea vessel, or fishing vessel encounters an accident or incident on inland waterways (outside port waters or inland waterway terminals), the report of inland waterways must be submitted to the competent state authority specified in Article 5 of this Circular no later than three working days from the time of the accident or incident or from the time the inland waterway vessel, sea vessel, or fishing vessel arrives at the first port or inland waterway terminal after the accident or incident.
3. In case the accident or incident involves cargo in the cargo hold, the report of inland waterways must be submitted to the competent state authority specified in Article 5 of this Circular before opening the cargo hold. In case the accident or incident occurs with cargo during loading operations (after the cargo hold has been opened), the provisions of Clause 2 of this Article shall apply.
4. In case it is impossible to submit the report of inland waterways within the time limits specified in Clauses 1, 2, and 3 of this Article, the reason for the delay must be clearly stated in the report of inland waterways.
Article 7. Procedure for Confirmation of Inland Waterway Report
When submitting the confirmation of the inland waterway report to the competent state agency as prescribed in Article 5 of this Circular, the ship captain or the vessel operator or the person authorized by the ship captain or the vessel operator must submit and present the following documents:
1. Documents to be submitted for sea vessels:
a) Inland waterway report according to the model prescribed in the Appendix attached to this Circular (02 copies);
b) Extracts from the Logbook related to the incident (02 copies);
c) Extracts from the Chart related to the incident (02 copies).
2. Documents to be submitted for inland waterway vessels and fishing vessels:
a) Inland waterway report according to the model prescribed in the Appendix attached to this Circular (02 copies);
b) Copy of the Self-drawn Sketch describing the location where the accident or incident occurred, with attached images if available (02 copies).
3. Documents to be presented (originals):
a) For sea vessels: the documents prescribed at points b and c of Clause 1 of this Article;
b) For inland waterway vessels and fishing vessels: the documents prescribed at point b of Clause 2 of this Article.
4. As for the inland waterway report, in addition to the signature of the ship captain or the vessel operator and the stamp of the sea vessel, inland waterway vessel, or fishing vessel (if there is a stamp), it must also have the signature of the chief engineer or one seaman as a witness.
5. Besides the number of inland waterway reports prescribed at point a of Clause 1 and point a of Clause 2 of this Article, the ship captain or the vessel operator may request additional copies with the same content if deemed necessary.
Article 8. Confirmation of Inland Waterway Report
1. When the ship captain or the vessel operator or the person authorized by the ship captain or the vessel operator submits and presents all the documents prescribed in Article 7 of this Circular, the competent authority shall confirm the inland waterway report on the inland waterway report form.
2. The confirmation of the inland waterway report includes the following contents:
a) Date and time of receipt of the inland waterway report;
b) Confirmation of the submission of the inland waterway report;
c) Name, position, and signature of the person confirming the inland waterway report;
d) Stamp of the authority confirming the inland waterway report.
3. The deadline for confirming the inland waterway report shall not exceed 02 working hours, counted from the time when all valid documents as prescribed in Article 7 of this Circular are received.
4. The authority confirming the inland waterway report retains 01 set of documents prescribed in Clause 1 and Clause 2 of Article 7 of this Circular, and returns the remaining documents to the ship captain or the vessel operator.
Article 9. Supplementary Inland Waterway Report
1. The ship captain or the vessel operator has the right to prepare a supplementary inland waterway report if deemed necessary.
2. A supplementary inland waterway report must also be submitted to the competent authority for confirmation. The procedure for confirming a supplementary inland waterway report is similar to the procedure for confirming an inland waterway report.
Chapter III
IMPLEMENTING PROVISIONS
[5]Article 10. Effective Date
This Circular takes effect from February 1, 2015.
Article 11. Responsibility for Implementation
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Inland Waterways Administration, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.

Decree No. 144/2025/NĐ-PC dated June 12, 2025 of the Government stipulates on decentralization and delegation in the field of state management by the Ministry of Construction;
At the proposal of the Director of the Legal Department;
The Minister of Construction issues Circulars to amend and supplement certain articles of Circulars under the state management of the Ministry of Construction related to organizational restructuring, implementation of two-level local administration, and delegation to local administration.
[2] This provision is amended and supplemented pursuant to Clause 1, Article 15 of Circular No. 09/2025/TT-BXD amending and supplementing certain provisions of Circulars under the Ministry of Construction's administrative management related to organizational restructuring, implementation of two-level local administration, and decentralization to local administration, which takes effect from July 1, 2025.
[3] The term “Department of Inland Waterway Transport” is replaced by the term “Waterway Police or the nearest People's Committee” pursuant to Clause 3, Article 15 of Circular No. 09/2025/TT-BXD amending and supplementing certain provisions of Circulars under the Ministry of Construction's administrative management related to organizational restructuring, implementation of two-level local administration, and decentralization to local administration, which takes effect from July 1, 2025.[4] This clause is amended and supplemented pursuant to Clause 2, Article 15 of Circular No. 09/2025/TT-BXD amending and supplementing certain provisions of Circulars under the Ministry of Construction's administrative management related to organizational restructuring, implementation of two-level local administration, and decentralization to local administration, which takes effect from July 1, 2025.
[5] Articles 31, 32, and 33 of Circular No. 09/2025/TT-BXD amending and supplementing certain provisions of Circulars under the Ministry of Construction's administrative management related to organizational restructuring, implementation of two-level local administration, and decentralization to local administration, which takes effect from July 1, 2025, are stipulated as follows:
“Article 31. Effective Date
1. This Circular takes effect from July 1, 2025.
Article 32. Responsibilities of Agencies
. Ministry of Construction
1a) Guide provincial People's Committees in implementing tasks as prescribed in this Circular;
b) Carry out inspection and supervision over tasks that have been decentralized to local administrations in accordance with the law.
2. Local People's Committees at all levels
a) Provincial People's Committees shall be responsible for allocating resources and conditions to organize the implementation of tasks as prescribed in this Circular; direct and guide village People's Committees in performing their duties and powers as prescribed. In case of difficulties or issues arising during the implementation, report to the Ministry of Construction for timely resolution and removal;
b) Village People's Committees shall be responsible for organizing the implementation of assigned tasks and powers as stipulated in this Circular.
Article 33. Transitional Provisions
1. Documents and papers issued and granted by competent authorities before July 1, 2025, which remain valid or within their validity period, shall continue to be applied and used according to the law until they expire or are amended, supplemented, replaced, abolished, revoked, or recalled by the authority receiving the functions, tasks, and powers or by the competent authority.
2. For matters and administrative procedures related to two-level local administration:
Matters and administrative procedures of district-level local administrative agencies currently being processed for individuals, organizations, and businesses, if not completed by July 1, 2025, or completed before July 1, 2025 but subsequently require further handling, the Chairman of the provincial People's Committee has the authority and responsibility to assign the relevant village-level local administrative agency where the individual resides or where the organization or business is located to continue processing to ensure uninterrupted work and no impact on normal social activities, citizens, and businesses; in cases involving more than two newly formed village administrative units or complex content, the Chairman of the provincial People's Committee has the authority and responsibility to directly handle or assign specialized agencies or other administrative agencies under his own People's Committee to continue processing to ensure uninterrupted work and no impact on normal social activities, citizens, and businesses.
3. For matters and administrative procedures related to task and authority decentralization
Matters and administrative procedures received by the competent authority before July 1, 2025, shall continue to be handled by the authority that received them according to the legal regulations at the time of receipt. If returned for completion, send the file to the authority designated by this Circular to continue processing the administrative procedure according to this Circular.
4. Transitional provisions for the content stipulated in Article 6 of this Circular:
a) For water supply projects with a service area spanning the administrative boundaries of two or more villages, the provincial People's Committee is the competent authority in the agreement to implement water supply services already signed with the water supplier;
b) For water supply projects with a service area within the administrative boundary of one village, the village People's Committee is the competent authority in the agreement to implement water supply services already signed with the water supplier.
5. Transitional provisions for the content stipulated in Article 10 of this Circular.
a) The level of construction projects approved for investment before July 1, 2025, shall be determined according to the law at the time of approval;
b) In cases where construction projects have been submitted to specialized construction agencies for review or adjustment of feasibility studies for investment construction, design after the basic design before July 1, 2025, and meet the review conditions, the determination of the project level and application of the project level in managing investment construction activities shall be determined according to the law at the time of submission for review.
b) In cases where construction projects or works have been submitted to specialized agencies for construction review or adjustment review of the feasibility study report for investment construction, design before July 1, 2025, and meet the conditions for review, the determination of the level of the work and the application of the work level in managing investment construction activities shall be determined according to the provisions of the law at the time of submission for review.
c) In the case where construction projects have design adjustments before July 1, 2025, but do not change the level of importance, capacity scale, or structural scale, the project grade shall be determined according to the provisions of the law at the time of the investment decision; in the case where construction projects have design adjustments before July 1, 2025, and such adjustments change the level of importance, capacity scale, or structural scale, the project grade shall be determined according to the provisions of this Circular./.
