Pursuant to Decree No. 06/2012/NĐ-CP dated February 2, 2012 of the Government amending and supplementing certain articles of decrees on civil status, marriage and family, and notarization;
Pursuant to Decree No. 06/2012/NĐ-CP dated February 2, 2012 amending and supplementing certain provisions of decrees on household registration, marriage, and family relations and notarization;
Pursuant to Decree No. 24/2013/NĐ-CP dated March 28, 2013 of the Government detailing implementation of certain provisions of the Law on Marriage and Family regarding marital and family relations involving foreign elements;
Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
At the proposal of the Director of the Department of Household Registration, Nationality, and Notarization;
The Minister of Justice hereby issues the Circular amending and supplementing certain provisions of Circular No. 08.a/2010/TT-BTP dated March 25, 2010 of the Ministry of Justice on promulgation and guidance for recording, storing, and using household registration books and forms and Circular No. 05/2012/TT-BTP dated May 23, 2012 of the Ministry of Justice amending and supplementing certain provisions of Circular No. 08.a/2010/TT-BTP.
Article 1. Amending and supplementing certain provisions of Circular No. 08.a/2010/TT-BTP dated March 25, 2010 of the Ministry of Justice on promulgation and guidance for recording, storing, and using household registration books and forms (hereinafter referred to as Circular No. 08.a/2010/TT-BTP) and Circular No. 05/2012/TT-BTP dated May 23, 2012 of the Ministry of Justice amending and supplementing certain provisions of Circular No. 08.a/2010/TT-BTP (hereinafter referred to as Circular No. 05/2012/TT-BTP) as follows:
1. Amending Clause 1 of Article 1 of Circular No. 05/2012/TT-BTP as follows:
“1. Article 3 is amended as follows:
"Article 3. Issuing household registration books and forms
Issuing five types of household registration books and sixty-nine types of household registration forms according to the list attached to this Circular.
The size of the five types of household registration books and sixty-nine types of household registration forms shall be uniformly used with paper size (210 x 297mm).”
2. Amending Clause 1 of Article 4 of Circular No. 08.a/2010/TT-BTP as follows:
“1. The Ministry of Justice prints and distributes five types of household registration books and five types of original forms, including:
a) Five types of household registration books used for registering household events as prescribed in Decree No. 158/2005/NĐ-CP dated December 27, 2005 of the Government on household registration and management (hereinafter referred to as Decree No. 158/2005/NĐ-CP), Decree No. 06/2012/NĐ-CP dated February 2, 2012 amending and supplementing certain provisions of decrees on household registration, marriage, and family relations and notarization (hereinafter referred to as Decree No. 06/2012/NĐ-CP) and Decree No. 24/2013/NĐ-CP dated March 28, 2013 of the Government detailing implementation of certain provisions of the Law on Marriage and Family regarding marital and family relations involving foreign elements (hereinafter referred to as Decree No. 24/2013/NĐ-CP) according to Section A of List I attached to this Circular.
b) Five types of original forms printed in color with patterns including:
- Three types of original forms (Birth Registration Certificate, Marriage Certificate, Death Registration Certificate) used for registering household events as prescribed in Decree No. 158/2005/NĐ-CP and Decree No. 06/2012/NĐ-CP, according to Section B of List I attached to this Circular.
- Two types of original forms (Marriage Certificate; Decision Recognizing Adoption) used for registering marriage; adoption involving foreign elements as prescribed in Decree No. 24/2013/NĐ-CP, according to Section C of List I attached to this Circular.”
3. Amending Clause 2 of Article 1 of Circular No. 05/2012/TT-BTP as follows:
“2. Clause 2 of Article 4 is amended as follows:
"2. Posting on the Ministry of Justice’s website 64 black-and-white household registration forms without patterns (including remaining original forms; all copies, declaration forms, and other forms), including:
a) Forty household registration forms used for registering household events as prescribed in Decree No. 158/2005/NĐ-CP and Decree No. 06/2012/NĐ-CP, according to Section A of List II attached to this Circular.
b) Nine household registration forms used for registering household events as prescribed in Decree No. 24/2013/NĐ-CP, according to Section B of List II attached to this Circular.
c) Fifteen declaration forms used for registering household events according to Section C of List II attached to this Circular.
Household registration offices and individuals requesting registration can access the Ministry of Justice’s website (www.moj.gov.vn) to print and use these 64 forms free of charge. For areas without internet access, the Department of Justice will organize printing and distribution of these household registration forms free of charge to meet local needs.”
4. Amending Point a of Clause 6 of Article 6 of Circular No. 08.a/2010/TT-BTP as follows:
"a) Clearly indicate the type of action such as re-registration, issuance of a new original Birth Registration Certificate or entry into the book of birth registered at the competent authority abroad."
5. Amending Clause 5 of Article 8 of Circular No. 08.a/2010/TT-BTP as follows:
"5. Note column: Clearly indicate the type of action such as re-registration."
Article 2. Issuing the List of Forms and forms attached to this Circular as follows:
1. Issuing the List of Forms to replace the List of Forms attached to Circular No. 08.a/2010/TT-BTP and Circular No. 05/2012/TT-BTP.
2. Issuing eight forms to replace eight forms issued with Circular No. 08.a/2010/TT-BTP as follows:
a) Marriage Certificate (original): form TP/HTNNg-2013-KH.1 replaces form TP/HTNNg-2010-KH.2;
b) Marriage Certificate (copy): form TP/HTNNg-2013-KH.1.a replaces form TP/HTNNg-2010-KH.2.a;
c) Decision Recognizing Adoption (original): form TP/HTNNg-2013-CMC.1 replaces form TP/HTNNg-2010-CMC.2;
d) Decision Recognizing Adoption (copy): form TP/HTNNg-2013-CMC.1.a replaces TP/HTNNg-2010-CMC.2.a;
đ) Declaration Form for Marriage Registration: form TP/HT-2013-TKĐKKH replaces form TP/HT-2010-KH.1;
e) Declaration Form for Issuance of Certificate of Marital Status: form TP/HT-2013-TKXNHN replaces form TP/HT-2010-XNHN.1;
f) Declaration Form for Registration of Activities of Counseling and Supporting Foreign Element Marriages and Families: form TP/HTNNg-2013-TKTVHT replaces form TP/HTNNg-2010-KH.3;
g) Certificate of registration for counseling and supporting marriage and family with foreign elements: form TP/HTNNg-2013-TVHT replacing form TP/HTNNg-2010-KH.5.
3. Issue the form Declaration for recording in household register of marriage registered at competent authority abroad: form TP/HT-2013-TKGCKH replacing form TP/HT-2012-TKGSHT issued together with Circular No. 05/2012/TT-BTP.
4. Supplement four additional household registration forms including:
a) Decision recognizing the act of acknowledging parent-child relationship (original): form TP-NG/HT-2013-CMC.1 (used at diplomatic missions);
b) Decision recognizing the act of acknowledging parent-child relationship (copy): form TP-NG/HT-2013-CMC.1.a (used at diplomatic missions);
c) Declaration for recording in household register of the act of acknowledging parent-child relationship resolved by competent authority abroad: form TP/HT-2013-TKGCCMC;
d) Certificate of marital status (issued to Vietnamese citizens residing in Vietnam who register marriage with foreigners at competent authority abroad): form TP/HTNNg-2013-XNTTHN.
Article 3. Implementation Provisions
1. This Circular takes effect from July 5, 2013.
2. Repeal the Personal History Form (for the person expected to head the Marriage Support Center): model TP/HTNNg-2010-KH.4 issued together with Circular No. 08.a/2010/TT-BTP.
3. In the course of implementation, if there are any difficulties, please report to the Ministry of Justice for timely guidance./.
