Pursuant to the Law on Medical Examination and Treatment dated November 23, 2009;

Pursuant to the Law on Medicines dated June 14, 2005; Decree No. 79/2006/NĐ-CP dated August 9, 2006 of the Government detailing a number of articles of the Law on Medicines;

Pursuant to the Law on Health Insurance dated November 14, 2008; Decree No. 62/2009/NĐ-CP dated July 27, 2009 of the Government detailing and guiding the implementation of a number of articles of the Law on Health Insurance;

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Circular Joint No. 09/2009/TTLT-BYT-BTC dated August 14, 2009 of the Ministry of Health and the Ministry of Finance guiding the implementation of health insurance;

The Ministry of Health guides the amendment and supplementation of some provisions of Circular No. 31/2011/TT-BYT dated July 11, 2011 as follows:

Article 1. Amending and supplementing some provisions of Circular No. 31/2011/TT-BYT as follows:

1. The list of new drugs issued together with this Circular shall be amended and supplemented as follows:

a) Adjusting the name of the drug:

Adjusting the active ingredient name "glycerophosphic acid" in the composition of drug serial number 1116 in the list of new drugs to "glycerophosphoric acid".

b) Adjusting the level of use for some drugs:

- Drugs used up to hospitals of Class II: Milrinon, injection form (serial number 553, column 2); Desoxycorticosterone acetate, injection form (serial number 580, column 2);

- Drugs used up to hospitals of Class III and Class IV:

+ Dimedron, injection form (serial number 87, column 2);

+ Hydroxyzine, oral form (serial number 93, column 2);

+ Potassium chloride, intravenous infusion form (serial number 583, column 2);

+ Idoxuridine, eye drops (serial number 923, column 2);

+ Phloroglucinol + trimethylphloroglucinol, injection form (serial number 992, column 2).

- Drugs used up to multi-specialty clinics and other healthcare facilities:

+ Lidocaine (hydrochloride), topical form (serial number 12, column 2);

+ Sodium chloride + potassium chloride + sodium citrate + glucose powder, oral form (serial number 1076, column 2).

2. Supplementing Clause 7a following Clause 7 as follows:

"Clause 7a: Transitional Provisions

For medicines within the scope of payment by the Health Insurance Fund as stipulated in Decision No. 05/2008/QĐ-BYT dated February 1, 2008 and Circular No. 02/2010/TT-BYT dated January 15, 2010, the Health Insurance Fund will continue to pay until the existing stock of medicines won from tender procurement and signed contracts with suppliers before August 25, 2011 is exhausted."

Article 2. Effective Date

This Circular takes effect from July 23, 2012.

During the process of implementation, if there are difficulties or obstacles, please report them to the Ministry of Health for consideration and resolution./.
