The Minister of Agriculture and Rural Development issues this Circular guiding the content of investment and investment support to implement the task of "Developing seed production" pursuant to Clause 2, Section III, Article 1 of Decision No. 703/QĐ-TTg dated May 28, 2020 of the Prime Minister approving the Program for Research and Seed Production to Serve Agricultural Sector Restructuring during the period of 2021-2030.
Article 1. Scope of Regulation
This Circular guides the content of investment and investment support from economic public funds to implement the task of "Developing seed production" pursuant to Clause 2, Section III, Article 1 of Decision No. 703/QĐ-TTg dated May 28, 2020 of the Prime Minister approving the Program for Research and Seed Production to Serve Agricultural Sector Restructuring during the period of 2021-2030.
Article 2. Applicability
1. State management agencies, public service units at central and local levels (hereinafter referred to as units) have functions and tasks of managing, researching, and producing agricultural, forestry, livestock, and aquaculture seeds.
2. Enterprises, cooperatives, cooperative groups, households, and individuals (hereinafter referred to as organizations and individuals) research and produce agricultural, forestry, livestock, and aquaculture seeds.
Article 3. Explanation of Terms
In this Circular, the following terms are defined as follows:
1. For the field of crop cultivation
a) The concept of annual plants, parent plants, and parent plant gardens is defined in Clauses 8, 18, and 19 of Article 2 of the Crop Cultivation Law 2018.
b) Author's variety (for annual plants) is the initial variety created by the author.
c) Parent variety is the variety derived from parent plants, parent plant gardens, or equivalent sources.
d) Super foundation seed is seed produced from author's seed or regenerated according to the super foundation seed regeneration process and meets quality standards as prescribed.
đ) Parent line/variety is the line/variety used to produce F1 hybrid seed.
e) Clean seed is seed free from certain dangerous diseases specific to each type of crop.
2. For the field of animal husbandry
The concepts of new animal breeds, parent stock, and breeding stock are defined in Clauses 11, 17, and 19 of Article 2 of the Animal Husbandry Law 2018.
3. For the field of forestry
The concepts of seedling forest, seed garden, superior tree (mother tree), parent tree, and parent tree garden are defined in Clauses 6, 7, 8, 9, and 10 of Article 3 of Circular No. 30/2018/TT-BNNPTNT dated November 16, 2018 of the Minister of Agriculture and Rural Development stipulating the list of major forestry crops; recognition of varieties and sources of varieties; management of major forestry crop propagation materials.
4. For the field of aquaculture
a) Parent stock is stock that has been domesticated, crossed, selected, or created for the production of commercial aquaculture seed.
b) Clean aquaculture seed is seed free from diseases specified in Appendix I attached to Circular No. 04/2016/TT-BNNPTNT dated May 10, 2016 of the Minister of Agriculture and Rural Development stipulating disease prevention and control in aquatic animals.
Article 4. Content of Investment
The State budget invests in the following activities:
1. Importing and purchasing rights to new varieties
Investing in units for importing and purchasing rights to new varieties of agricultural, forestry, livestock, and short-term aquatic species (or annual) that are not yet available or insufficiently present in the country.
2. Selecting and recognizing superior varieties
Investing in units, organizations, and individuals for selecting and recognizing superior varieties. Superior varieties must be handed over to owners for management and exploitation after being recognized by competent authorities for serving breeding purposes.
3. Caring for mother orchards, seedling forests, and nurseries
Investing in units, organizations, and individuals for caring for seedling forests, nurseries, mother orchards, or equivalent facilities (depending on different types of crops, there may be different terms used); for annual agricultural crops, this includes costs for planting new ones.
4. Importing and perfecting production technology processes for seeds
a) Investing in units for importing production technology for agricultural, forestry, and aquatic seed varieties according to the value of transferred copyright.
b) Investing in units, organizations, and individuals for perfecting production technology processes for agricultural, forestry, and aquatic seed varieties.
5. Training and instructing production technology processes for seeds
Investing in domestic and international short-term training for civil servants, employees involved in seed management, research, and production; workers directly participating in project seed implementation activities.
6. Seed quality management
Investing in units for building seed databases; applying information technology for seed management; testing and certifying seed quality; inspecting and supervising the enforcement of seed laws; short-term training on seed management; promoting the use of new and high-quality standard seeds.
Article 5. Content of Investment Support
The State budget supports investment for units, organizations, and individuals to carry out the following activities:
1. Producing seed varieties at various levels
a) Crop cultivation: Supporting costs for producing original seed varieties, super parent seed varieties, leading varieties, or equivalent (depending on different crop types, there may be different terms used), disease-free seeds, parent lines for producing F1 hybrid seeds, and producing F1 hybrid seeds.
b) Forestry: Supporting costs for propagating forestry trees through tissue culture methods; labor costs for harvesting seeds from superior trees, seedling forests, and nurseries to produce tree seedlings.
c) Livestock breeding: Supporting technical operation costs; feed costs for parent stock and breeding stock; costs for purchasing semen, breeding materials, and artificial insemination for livestock.
d) Aquaculture: Supporting costs for producing parent stock; producing disease-free aquatic seed.
2. Perfecting breeding technology processes for livestock
Supporting technical operation costs and concentrate feed costs for livestock to perfect breeding technology processes.
3. Other support contents
a) Supporting the hiring of foreign experts when complex technologies requiring high expertise cannot be carried out by domestic experts.
b) Supporting project management costs for investors.
c) Supporting costs for monitoring and supervising the implementation of the Program.
4. Specific levels of support under Clauses 1, 2, and 3 of this Article shall be implemented in accordance with the guidelines of the Ministry of Finance.
Article 6. Investment methods and investment support
Units, organizations, and individuals receiving state budget investment or investment support through projects or budgets decided by the competent authority or approved by the delegated authority shall be governed thereby.
Article 7. Implementation Organization
The Planning Department is the lead unit assisting the Minister of Agriculture and Rural Development to monitor and compile difficulties encountered during the implementation of this Circular; coordinating with relevant units to propose solutions for these difficulties.
Article 8. Implementation clause
1. This Circular takes effect from October 4, 2021.
2. In case the legal documents cited and applied in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replacing documents.
3. During the implementation of this Circular, if there are any difficulties, units, organizations, and individuals shall report them in writing to the Ministry of Agriculture and Rural Development for consideration and resolution./.
