Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, which has been amended and supplemented by Decree No. 101/2020/NĐ-CP dated August 28, 2020 of the Government;
Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Minister of Natural Resources and Environment;
The Prime Minister promulgates this Decision stipulating the functions, tasks, powers, and organizational structure of the General Department of Meteorology and Hydrology under the Ministry of Natural Resources and Environment.
Article 1. Position and Functions
1. The General Department of Meteorology and Hydrology is an organization under the Ministry of Natural Resources and Environment, performing the function of advising and assisting the Minister of Natural Resources and Environment in state management and enforcement of laws on meteorology and hydrology throughout the country; managing and organizing the implementation of public service activities within the scope of state management of the General Department in accordance with the provisions of the law.
2. The General Department of Meteorology and Hydrology has legal personality, bears the State Emblem seal, maintains a separate account; its headquarters is located in Hanoi City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. To the Minister of Natural Resources and Environment:
a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees, resolutions of the Government; draft decisions, directives of the Prime Minister; mechanisms, policies, and other documents within the scope of management of the General Department;
b) Strategies, plans, long-term, medium-term, annual development programs, projects, proposals, important national tasks on meteorology and hydrology;
c) National technical standards, national technical regulations, economic-technical norms within the scope of management of the General Department.
2. To provide professional guidance within the scope of management of the General Department.
3. To organize propaganda, dissemination, education on laws, and enhance community awareness about areas within the scope of management of the General Department.
4. To guide, inspect, and organize the implementation of regulatory documents, mechanisms, policies, strategies, plans, programs, projects, proposals, tasks within the scope of management of the General Department; annually monitor, evaluate, and compile the situation of state management of meteorology and hydrology throughout the country in accordance with the provisions.
5. On the management of the meteorological and hydrological station network:
a) Managing meteorological and hydrological observation, investigation, survey activities; managing and guiding meteorological and hydrological activities for construction projects required to conduct observations and provide meteorological and hydrological information and data according to the law;
b) Reviewing contents related to meteorology and hydrology in planning, design of key national construction projects and in planning, design of construction projects and investment projects according to the law; reviewing construction, renovation, upgrading projects of meteorological and hydrological facilities of the Ministry of Natural Resources and Environment as assigned by the Minister of Natural Resources and Environment;
c) Building, managing, and operating the national meteorological and hydrological station network; organizing meteorological and hydrological observation, investigation, and survey activities;
d) Managing the quality of meteorological and hydrological measurement instruments according to the law on metrology and meteorology and hydrology;
đ) Organizing the protection of meteorological and hydrological facilities within the national meteorological and hydrological station network.
6. On forecasting, warning, and broadcasting weather and climate disaster warnings, excluding natural forest fires:
a) Managing weather and climate forecasting, warning, and broadcasting activities, weather and climate disaster warnings, and risk levels; guiding the provision and use of weather and climate forecasting, warning information, and weather and climate disaster warnings according to the law;
b) Inspecting, supervising, and evaluating the quality of weather and climate forecasting, warning, and broadcasting activities, weather and climate disaster warnings, and risk levels according to the law;
c) Reviewing and submitting to the Minister of Natural Resources and Environment for decision-making on issuing, extending, suspending, or revoking permits for weather and climate forecasting and warning activities according to the law;
d) Reviewing and submitting to the Minister of Natural Resources and Environment for approval within their authority or submitting to competent authorities for approval of weather modification plans; organizing implementation or supervising post-approval implementation;
đ) Organizing reviews of tsunami warning scenarios for Vietnam as assigned by the Minister of Natural Resources and Environment;
e) Building, managing, and operating the national weather and climate forecasting and warning system; organizing weather and climate forecasting, warning, and broadcasting activities, weather and climate disaster warnings, and risk levels; zoning disaster risks; forecasting and assessing climate, hydrology, marine conditions, wind potential, solar energy, waves, hydropower to serve command, operation, exploitation, and production of non-renewable and renewable energy according to the law;
g) Organizing the development, review, and submission to the Minister of Natural Resources and Environment for publication of national climate standards and assessments; building and implementing the National Climate Services Framework for Vietnam based on the Global Climate Services Framework;
h) Building radio and television programs on weather and climate forecasting, warning, and disaster warnings according to the law.
7. On meteorological and hydrological information and data:
a) Managing and guiding the storage, utilization, and use of meteorological and hydrological information and data according to the law;
b) Managing and guiding the integration of climate change monitoring results into strategies, plans that must be integrated according to the law;
c) Organizing the collection of information for disaster risk assessment, zoning, monitoring, and supervision; monitoring and guiding the provision and verification of the origin of meteorological and hydrological information and data within the scope of management according to the law;
d) Organize and implement activities related to the storage, exploitation, and use of meteorological and hydrological information and data; build and manage the national meteorological and hydrological database; monitor climate change.
đ) Organize, receive, and utilize meteorological and hydrological information and data provided by ministries, sectors, localities, organizations, and individuals in accordance with the provisions of the law; receive feedback information on meteorological and hydrological forecasts, warnings, and disaster risk levels from ministries, sectors, localities, organizations, and individuals in accordance with the provisions of the law.
e) Build, operate, and manage the information system serving meteorological and hydrological surveys, forecasts, and early warning systems for natural disasters within the national meteorological and hydrological network.
8. Organize research, application, and transfer of science and technology in meteorological and hydrological activities in accordance with the provisions of the law.
9. Regarding international cooperation:
a) Manage and guide the exchange of meteorological and hydrological information and data with international organizations, foreign organizations, and individuals in accordance with the provisions of the law.
b) Implement the exchange of meteorological and hydrological information and data with international organizations, foreign organizations, and individuals in accordance with the provisions of the law.
c) Submit to competent state agencies for approval participation in international organizations, signing or joining international treaties on meteorology and hydrology; serve as the national focal point for participating in the World Meteorological Organization (WMO), Typhoon Committee, ASEAN Sub-Committee on Physical Hydro-Meteorology (ASCMG); serve as the focal point for participating in international forums and implementing international treaties on meteorology and hydrology according to the division of labor by the Minister of Natural Resources and Environment.
d) Cooperate with international organizations in the exchange of experts, training, and capacity building for high-quality human resources in meteorology and hydrology.
đ) Organize and implement other international cooperation activities in meteorology and hydrology within the scope of authority.
10. Manage, guide, and oversee meteorological and hydrological activities of ministries, sectors, localities, organizations, and individuals in accordance with the provisions of the law.
11. Guide, inspect, and organize the implementation of activities serving public services in meteorology and hydrology in accordance with the provisions of the law.
12. Inspect and resolve complaints and reports regarding meteorology and hydrology within the scope of authority.
13. Implement administrative reform in accordance with the program and plan of administrative reform of the Ministry of Natural Resources and Environment; practice thrift; prevent and combat corruption and waste within the management scope of the General Department.
14. Manage organizational structure, civil servants, officials, and employees in accordance with the provisions of the law and the delegation of the Minister of Natural Resources and Environment; implement remuneration policies, awards, disciplinary measures, and participate in specialized and vocational training for civil servants, officials, and employees under the management of the General Department in accordance with the provisions of the law and the delegation of the Minister of Natural Resources and Environment.
15. Manage finance, assets, and other resources delegated by the Ministry of Natural Resources and Environment and in accordance with the provisions of the law.
16. Manage and organize the implementation of investment projects in the field of meteorology and hydrology in accordance with the delegation of the Minister of Natural Resources and Environment.
17. Perform other tasks assigned by the Minister of Natural Resources and Environment.

7. National Meteorological and Hydrological Network Center.
8. National Meteorological and Hydrological Forecasting Center.
9. Information and Data Center for Meteorology and Hydrology.
10. Meteorological and Hydrological Technology Center.
11. Marine Survey Center.
12. Hydrological and Meteorological Survey Federation.
13. Northern Mountain Region Meteorological and Hydrological Station.
14. Red River Delta and North Central Region Meteorological and Hydrological Station.
15. North Central Coast Meteorological and Hydrological Station.
16. Central Vietnam Meteorological and Hydrological Station.
17. South Central Coast Meteorological and Hydrological Station.
18. Southern Vietnam Meteorological and Hydrological Station.
19. Central Highlands Meteorological and Hydrological Station.
In this Article, organizations specified from Clause 1 to Clause 6 are organizations assisting the Director of the General Department of Meteorology and Hydrology in performing state management functions; organizations specified from Clause 7 to Clause 19 are public service units serving the state management functions of the General Department.
The Office of the General Department of Meteorology and Hydrology has three departments.
Article 4. Leadership of the General Department
1. The General Department of Meteorology and Hydrology shall have a Director and not more than four Deputy Directors appointed and relieved from office by the Minister of Natural Resources and Environment in accordance with the provisions of the law.
2. The Director of the General Department of Meteorology and Hydrology shall be responsible to the Minister of Natural Resources and Environment and to the law for all activities of the General Department. The Deputy Directors of the General Department of Meteorology and Hydrology shall be responsible to the Director and to the law for the areas of work assigned to them.
3. The Director of the General Department of Meteorology and Hydrology shall submit to the Minister of Natural Resources and Environment regulations on the functions, tasks, powers, and organizational structure of subordinate organizations; appoint and relieve from office leadership and management positions within the General Department in accordance with the provisions of the law and the delegation of the Minister of Natural Resources and Environment.
Article 5. Effective Date
1. This Decision shall take effect from June 15, 2023.
2. This Decision replaces Decision No. 03/2018/QĐ-TTg dated January 23, 2018 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Meteorology and Hydrology under the Ministry of Natural Resources and Environment.
Article 6. Transitional Provisions
The Meteorological and Hydrological Observation Center, High Altitude Meteorological Station, Information and Data Center for Meteorology and Hydrology, Meteorological and Hydrological Journal, Meteorological and Hydrological Technology Application Center, Marine Affairs Center, Northwest Region Meteorological and Hydrological Station, Northeast Region Meteorological and Hydrological Station, Red River Delta Region Meteorological and Hydrological Station, North Central Coast Region Meteorological and Hydrological Station shall continue to operate in accordance with current regulations until the Decision stipulating the functions, tasks, powers, and organizational structure of these units as provided in Clauses 7, 9, 10, 11, 13, and 14 of Article 3 issued by the Minister of Natural Resources and Environment takes effect.
Article 7. Responsibility for Implementation
The Minister of Natural Resources and Environment, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government, and the Director of the General Department of Meteorology and Hydrology shall be responsible for implementing this Decision.
