REGULATIONS ON ECONOMIC AND TECHNICAL STANDARDS FOR SERVICES ORGANIZING CULTURAL AND ART ACTIVITIES; COMMUNITY ART CONTESTS, PERFORMANCES, AND FESTIVALS; MOBILE PUBLICITY; AND VISUAL PROPAGANDA TO SERVE POLITICAL TASKS

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on entrusting tasks, placing orders, or tendering for the provision of products and services using state budget funds from regular funding sources;
Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering goods or services, or tendering for the provision of public products and services using state budget funds from regular expenditure;
Pursuant to Decree No. 01/2023/NĐ-CP dated January 16, 2023 of the Government providing for the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Director of the Department of Cultural Institutions;
The Minister of Culture, Sports and Tourism issues this Circular to regulate economic and technical standards for services organizing cultural and art activities; community art contests, performances, and festivals; mobile publicity; and visual propaganda to serve political tasks.
Article 1. Scope of Regulation and Applicability
1. This Circular stipulates economic and technical standards for the following services that utilize state budget funds:
a) Organizing cultural and art activities: mass art programs aimed at serving political tasks;
b) Organizing community art contests, performances, and festivals;
c) Mobile publicity: organizing art contests and festivals for mobile publicity teams;
d) Organizing visual propaganda to serve political tasks: art contest for propaganda posters; propaganda poster exhibitions; construction of visual propaganda clusters.
2. This Circular applies to organizations, units, and agencies organizing the services specified in Clause 1 of this Article (hereinafter referred to as public service services) and other related organizations and individuals.
Article 2. General Provisions on Economic and Technical Standards
1. The economic and technical standards set forth in this Circular represent the maximum levels required to complete the provision of public service services.
2. Economic and technical standards refer to the levels of consumption of factors such as labor, materials, machinery, and equipment used to complete a unit of product or a specific amount of work within a particular condition of public service services.
3. Determination of job titles
a) Job titles in the labor cost component of the standard table shall be applied according to Circular No. 03/2022/TT-BVHTTDL dated July 7, 2022 of the Minister of Culture, Sports and Tourism on job code, qualification criteria, and salary grade for specialized cultural institution staff; Circular No. 02/2023/TT-BVHTTDL dated February 21, 2023 of the Minister of Culture, Sports and Tourism on job code, qualification criteria, and salary grade for cultural propaganda staff; and Circular No. 10/2023/TT-BVHTTDL dated August 9, 2023 of the Minister of Culture, Sports and Tourism guiding positions, management and professional job titles, and personnel structure in public institutions under the cultural, sports, and tourism sector.
b) In cases where job titles in the labor cost component are not included in Circular No. 03/2022/TT-BVHTTDL, Circular No. 02/2023/TT-BVHTTDL, and Circular No. 10/2023/TT-BVHTTDL, they shall be applied according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, public officials, and armed forces; Decree No. 117/2016/NĐ-CP dated July 21, 2014 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, public officials, and armed forces; Decree No. 111/2022/NĐ-CP dated December 30, 2022 of the Government on contracts for certain types of work in administrative agencies and public institutions, or equivalent conversion based on positions approved by competent authorities.
Article 3. Content of economic and technical norms
1. The content of economic and technical norms includes:
a) Labor costs: direct and indirect labor time necessary for average workers to complete the provision of a service. Direct labor cost is the time spent on each stage of the public service service, measured in workdays (8 hours). Each workday corresponds to the working time of one worker as prescribed by labor laws. Indirect labor cost is calculated as 15% of the total direct labor cost in the same standard table;
b) Machinery and equipment usage costs: necessary usage time of each type of machinery and equipment to provide public service services. Machinery and equipment costs in the standard are calculated in terms of usage shifts, with each shift corresponding to one workday (8 hours) as prescribed by labor laws;
c) Material usage costs: specific quantities of various materials directly used to provide public service services. Material costs in the standard are calculated in terms of specific quantities of each material. Ancillary material costs are calculated as 10% of the total material costs in the same standard table.
2. The structure of economic and technical standards includes:
a) Name of the norm;
b) Description of work content: the main work stages to implement the provision of public services;
c) Norm table, including:
- Labor costs: job title and labor grade, unit of measurement for labor cost and the standard labor cost value;
- Machinery and equipment usage costs: name of machinery and equipment, unit of measurement for usage cost and the standard usage cost value;
- Material usage cost: name and specification of material, unit of labor cost measurement and standard usage cost value;
- Normative value: the numerical value of actual time spent on labor, machinery and equipment usage, and material usage during the provision of public services;
- Notes: are instructions on how to calculate standards under different technical conditions (if any) or to complete a workload different from the unit of measurement in the Standard Table.
3. The economic and technical standards specified in this Circular include:
a) Appendix I: Economic and Technical Standards for Services Organizing Cultural and Art Activities;
b) Appendix II: Economic and Technical Standards for Services Organizing Community Art Contests, Performances, and Festivals;
c) Appendix III: Economic and Technical Standards for Mobile Publicity Services;
d) Appendix IV: Economic and Technical Standards for Services Organizing Visual Propaganda to Serve Political Tasks.
Article 4. Organization of Implementation
Based on the economic and technical standards stipulated in this Circular, ministries, sectors, and central agencies shall consider and decide on applying specific economic and technical standards suitable for the conditions of public service service providers under their jurisdiction.
Article 5. Effective Date
1. This Circular takes effect from December 25, 2024.
2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.
3. During the implementation process, if any difficulties arise, agencies, units, organizations, and individuals shall report to the Ministry of Culture, Sports and Tourism (through the Department of Cultural Institutions) for consideration and resolution./.
