RESOLUTION

ADOPTING THE REGULATIONS ON THE OPERATING PROCEDURES OF THE PEOPLE'S COUNCILS AT THE COMMUNE LEVEL, WARD LEVEL, AND SPECIAL ECONOMIC ZONES

                           

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

On the basis of The Constitution of the Socialist Republic of Vietnam has been amended and supplemented by Resolution No. 203/2025/QH15;

On the basis of The Law on the Organization of the National Assembly No. 57/2014/QH13 has been amended and supplemented with some articles according to Law No. 65/2020/QH14 and Law No. 62/2025/QH15;

On the basis of Law on Local Administration Organization No. 72/2025/QH15,

RESOLUTION:

Article 1.

This Resolution adopts the Model Regulations on Operating Procedures of the People's Councils at the commune level, ward level, and special economic zones (collectively referred to as the commune level).

Article 2.

The People's Council at the commune level shall promulgate its own operating regulations in accordance with these Model Regulations, relevant laws, and the actual conditions of the locality.

Article 3.

This Resolution takes effect from the date it is adopted.

2. The People's Council, the Standing Committee of the People's Council, the Committees of the People's Council, the Delegation Groups of the People's Council, the Members of the People's Council, the Office of the People's Council, the People's Committee, and related agencies, organizations, and individuals shall be responsible for implementing this Resolution.

This Resolution was adopted by the Standing Committee of the National Assembly of the Socialist Republic of Vietnam, Session 49, on September 26, 2025.

MODEL REGULATION ON WORK PROCEDURES

OF THE PEOPLE'S COUNCILS AT THE COMMUNE LEVEL, WARD LEVEL, AND SPECIAL ECONOMIC ZONES

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

These Regulations stipulate the principles, systems, forms of operation, procedures, implementation of tasks and powers, and working relationships of the People's Council, the Standing Committee of the People's Council, the Committees of the People's Council, the Delegation Groups of the People's Council, and the Members of the People's Council at the commune level, ward level, and special economic zones (collectively referred to as the commune level).

Article 2. Principles and Systems of Operation of the People's Council at the Commune Level

1. Activities of the People's Council must comply with the Constitution and laws, implement the principle of democratic centralism, transparency, and openness, promote the people's right to self-governance, serve the people, and be subject to the people's supervision, effectively apply information technology and digital transformation.

2. The People's Council operates under a collective system, decides by majority, ensures accountability tied to power control mechanisms. Members of the People's Council are equal in discussion and decision-making on issues within their tasks and powers.

3. The Standing Committee of the People's Council and the Committees of the People's Council are responsible and report the results of their assigned tasks and powers to the same-level People's Council; issue documents within their authority and use the seal of the same-level People's Council to perform their assigned tasks and powers. The Delegation Groups report to the Standing Committee of the People's Council on the results of their assigned tasks.

4. The People's Council maintains close and regular contact with the People's Committee, specialized agencies, administrative organizations under the People's Committee, the Vietnam Fatherland Front Committee at the same level, and related agencies in preparing the agenda and content for the People's Council sessions and in performing their assigned tasks and powers, ensuring compliance with legal provisions.

Article 3. Working Relationships between the People's Council at the Commune Level and the Standing Committee of the People's Council, the People's Committee at the Provincial Level, and Related Agencies

1. The People's Council maintains close and regular contact, implements a reporting system on its activities to the Standing Committee of the People's Council and the People's Committee at the provincial level.

2. The People's Council closely coordinates and regularly exchanges information with the same-level People's Committee and related agencies in preparing the agenda and content for the People's Council sessions, reports, proposals, draft resolutions submitted to the People's Council; resolving issues arising during the implementation of the People's Council resolutions.

3. The People's Council closely collaborates with the Vietnam Fatherland Front Committee and political-social organizations at the same level in promoting and mobilizing the people to participate in building and consolidating the people's administration, organizing the implementation of state policies and laws, supervising and providing social feedback on the activities of the People's Council and the People's Committee; organizing for the Members of the People's Council to meet voters and compile voter opinions and suggestions according to regulations and other related tasks as prescribed by law.

Chapter II
THE PEOPLE'S COUNCIL AT THE COMMUNE LEVEL

Article 4. Sessions of the People's Council

1. The People's Council shall convene at least two regular sessions each year.

At its first session of each term (for the beginning of a term) and at the last session of the previous year (for subsequent years of the term), the People's Council shall decide on the plan to organize regular sessions based on the proposal of the Standing Committee of the People's Council.

2. The People's Council may convene special sessions or emergency sessions when requested by the Standing Committee of the People's Council, the Chairman of the People's Committee at the same level, or at least one-third of the total number of representatives of the People's Council.

Article 5. Preparation for Sessions of the People's Council

Based on legal provisions, directives from competent authorities, and the actual situation of the locality, the Standing Committee of the People's Council shall direct the People's Council Office and the People's Committee, along with relevant committees of the People's Council, to cooperate with the People's Committee and specialized agencies to review the contents intended to be presented at the session.

2. The Standing Committee of the People's Council shall organize a meeting between the Standing Committee of the People's Council, the People's Committee, the Standing Committee of the Vietnam Fatherland Front Committee at the same level, and related agencies to unify the time, content, program, and issues related to the session, and to assign agencies to prepare accordingly.

3. The Standing Committee of the People's Council shall report to the competent authority about the planned time, content, and program of the session as prescribed.

4. The Standing Committee of the People's Council shall issue a notice regarding the planned time, content, and program of the session; the plan for meetings with voters before and after the session (for regular sessions); and the assignment of committees of the People's Council to examine the contents to be presented at the session according to legal provisions and their respective areas of responsibility.

5. The Standing Committee of the People's Council shall coordinate with the People's Committee in preparing documents and organizing sessions of the People's Council.

Article 6. Organization of Sessions of the People's Council

1. The first session of a new term of the People's Council shall be organized no later than 45 days from the date of the election of People's Council representatives; for localities that hold re-elections, additional elections, or postpone the election date, the deadline for organizing the first session shall be calculated from the date of the re-election, additional election, or new election date.

During the term, the Standing Committee of the People's Council shall decide to organize regular sessions no later than 20 days before the opening day of the session. The organization of special sessions or emergency sessions to address urgent matters shall be decided by the Standing Committee of the People's Council.

2. The first session of each term of the People's Council shall be convened by the Standing Committee of the previous term of the People's Council. In case of vacancy in the Standing Committee, the Standing Committee of the provincial level shall designate a convener to convene and chair the session of the People's Council.

3. The proposed agenda of the session of the People's Council shall be sent to the representatives of the People's Council together with the decision to convene the session.

Article 7. Agenda of the Session of the People's Council

The People's Council shall consider and approve the agenda of the session in the following sequence:

1. The Standing Committee of the People's Council shall present the proposed agenda of the session to the People's Council. At the first session of each term of the People's Council, the Standing Committee of the previous term or the convener in case of vacancy shall propose the agenda of the session to the newly elected People's Council for consideration and decision.

2. Representatives of the People's Council shall discuss and provide opinions on the proposed agenda of the session.

3. The Chairperson shall conclude.

4. The People's Council shall vote to approve the agenda of the session.

Article 8. Responsibilities of the Chairperson of the Session and the Chairperson of the Council Meeting

1. The Chairperson managing the session and meetings of the People's Council shall be the Chairman of the People's Council or the convener.

In case the Chairman of the People's Council is absent, the Standing Committee of the People's Council shall assign a Vice-Chairman of the People's Council to chair the session. In case the Standing Committee of the People's Council is absent, the Standing Committee of the provincial People's Council shall designate the Chairperson of the session.

2. The Chairperson of the session and meetings of the People's Council shall be responsible for managing according to the procedures prescribed in this Regulation.

Article 9. Responsibilities of People's Council Deputies at the Session

1. Participate fully in all sessions and meetings of the People's Council. In case they cannot attend the sessions and meetings of the People's Council, they must provide reasons and report to the Chairperson of the session or meeting, while informing the People's Council Office and the People's Committee, except in cases of force majeure.

2. Focus on studying, participating in discussions, contributing opinions on the contents presented at the People's Council session and exercising supervisory rights, questioning, and voting on issues within the duties and powers of the People's Council as stipulated by the Law on Local Administration Organization and other relevant laws.

3. Wear badges and formal attire when performing duties and exercising rights as a People's Council Deputy.

4. Fulfill the obligation to respond to interviews regarding matters within their scope of authority as a People's Council Deputy as prescribed by law.

5. Use and manage session documents (including confidential documents) and closed meeting contents of the People's Council in accordance with the provisions of law.

Article 10. Establishment of Discussion Groups at the Session and Responsibilities of the Group Leader, Deputy Leader, and Group Members

1. Based on actual circumstances, the Standing Committee of the People's Council shall consider and decide to establish Discussion Groups comprising a Group Leader, Deputy Leader, and members who are People's Council Deputies to discuss and reach consensus on the program and content of the session.

2. The Group Leader shall be responsible for organizing the implementation of the session program by the People's Council Deputies and other regulations concerning the session; organizing and managing the activities of the Group according to the assignment of the Chairperson of the session or the Standing Committee of the People's Council. If necessary, the Group Leader may request the Standing Committee of the People's Council to invite representatives of related agencies to attend the Group's discussion session to clarify issues of concern to the People's Council Deputies.

3. The Deputy Leader and Group Members shall fulfill tasks assigned by the Group Leader.

Article 11. Secretarial Work of the People's Council Session

The People's Council Office and the People's Committee shall be responsible for organizing the implementation of secretarial work during the session, including the following contents:

1. Preparing lists of present and absent People's Council Deputies in each meeting and throughout the session;

2. Recording minutes of meetings and sessions;

3. Compiling comprehensively, truthfully, and accurately the opinions of Deputies at each meeting of the session;

4. Assisting the Chairperson of the session in implementing procedures and formalities during the session, providing information and promotional materials about the session, and posting resolutions of the People's Council on the local electronic information website (if available);

5. Performing other tasks assigned by the Chairperson of the session.

Article 12. Documents for the session of the People's Council

1. Documents for the session of the People's Council shall be sent to the Standing Committee of the People's Council, the Committee assigned to examine (through the People's Council Office and the People's Committee) to be delivered to the People's Council deputies at least 15 days before the opening date of the regular session.

The Head of the People's Council Office and the People's Committee shall decide on the circulation of documents at the session after reporting and seeking the opinion of the Chairman of the same-level People's Council. Official documents shall be circulated in paper form or electronic form (except in cases involving state secrets); for normative legal documents, they shall be implemented in accordance with the Law on Enacting Normative Legal Documents and guiding documents.

2. The Standing Committee of the People's Council may provide information and other relevant documents related to the session of the People's Council if requested by the People's Council deputies.

3. The Standing Committee of the People's Council shall decide on the management regime and the posting on the People's Council's electronic information website for documents serving the session of the People's Council in accordance with the provisions of the law.

4. The People's Council Office and the People's Committee shall be responsible for posting session documents that are permitted to be made public on the local electronic information website or publicly posted according to the decision of the Standing Committee of the People's Council.

Article 13. Forms of conducting the session of the People's Council

The People's Council shall consider and decide to organize the session in person (including closed meetings), online, or a combination of in-person and online meetings as proposed by the Standing Committee of the People's Council. Sessions during the session shall be conducted openly, and in the case of closed meetings, they shall be carried out in accordance with the provisions of the law and included in the session program of the People's Council.

Article 14. First session, opening session, closing session of the People's Council

1. At the first session of each term of the People's Council, the Chairman of the previous term of the People's Council or the convener shall chair the sessions of the People's Council until the People's Council elects the new term's Chairman of the People's Council.

2. The opening session shall be organized at the first meeting of the session of the People's Council. Prior to the opening session, the People's Council shall hold a preparatory meeting (if any) to consider and approve the session program and other contents as proposed by the Standing Committee of the People's Council.

The opening session of the People's Council shall implement the following main contents in sequence: flag-raising ceremony, statement of reasons, introduction of delegates; opening speech, guidance speech from higher authorities (if any) and other contents according to the approved session program.

3. The closing session shall be organized after the People's Council has completed all the contents of the approved session program and shall follow the following sequence: the session chairperson delivers the closing speech, flag-raising ceremony.

Article 15. Procedure and process of the People's Council considering and deciding on matters within its duties and powers at the session

Depending on specific content, the People's Council shall consider and decide on matters within its duties and powers according to the following procedure and process:

1. Representatives of agencies, organizations, or individuals with authority shall present draft resolutions, proposals, reports in accordance with regulations or as required by the session chairperson.

2. Representatives of Committees of the People's Council assigned to examine or prepare research opinions shall present examination reports, research reports (if any).

3. The People's Council shall discuss at a plenary meeting or organize discussions in discussion groups as proposed by the session chairperson or the Standing Committee of the People's Council.

4. Agencies, organizations, or individuals presenting draft resolutions, proposals, reports shall be responsible for actively coordinating with the agency in charge of examination and the session secretariat team to build explanatory and adoption reports on the contents discussed at the plenary meeting or group meeting.

5. Voting to pass draft resolutions, proposals, reports at the People's Council meeting shall be carried out as follows:

a) Agencies, organizations, or individuals presenting draft resolutions, proposals, reports shall present explanatory and adoption reports (if any).

b) The People's Council shall discuss the content of draft resolutions, proposals, reports; the session chairperson shall seek the opinions of People's Council deputies on the contents still having different views (if any) before the resolution is passed by the People's Council. In cases where the draft contains important, complex contents or still have different views, requiring additional time for study, adoption, and revision, the People's Council shall decide or, upon the proposal of the agency, organization, or individual with authority, postpone the time for submitting to the People's Council for approval.

c) Deputies of the People's Council shall vote to pass draft resolutions, proposals, reports. Voting can be conducted directly, online, or through other appropriate methods under this Regulation. In cases of voting by secret ballot, after the People's Council conducts the voting, the Ballot Counting Committee shall work and report the voting results to the People's Council.

6. The contents of the session, plenary meetings, and group meetings of the People's Council must be recorded in minutes and signed off in accordance with the regulations.

Article 16. Procedures and formalities for the People's Council to examine and decide on personnel matters within its jurisdiction

1. The procedures and formalities for the People's Council to elect positions shall be carried out as follows:

a) The Standing Committee of the People's Council introduces a list of candidates for the positions of Chairman, Vice-Chairman, and Head of Committees of the People's Council from among the representatives of the People's Council for examination and decision by the People's Council. In cases where the Standing Committee of the People's Council is absent, the Chairperson of the session introduces a list of candidates for the positions of Chairman, Vice-Chairman, and Head of Committees of the People's Council.

In cases where a person self-nominates or is nominated by representatives of the People's Council outside the list introduced by the Standing Committee of the People's Council or the Chairperson of the session (in cases where the Standing Committee of the People's Council is absent), the Standing Committee of the People's Council or the Chairperson of the session shall introduce such candidates to the People's Council for examination and decision;

b) Representatives of the People's Council discuss;

c) The Standing Committee of the People's Council, the Chairperson of the session, or a person designated by the Chairperson of the session reports to the People's Council on explanations and responses to the opinions of representatives of the People's Council (if any);

d) The People's Council votes to approve the list for electing the Chairman, Vice-Chairman, and Head of Committees of the People's Council;

đ) The People's Council elects the Election Supervisory Board according to the introduction of the Chairperson of the session to perform the task of counting ballots at the session in accordance with the provisions of the law and the guidance of the National Assembly Standing Committee;

e) The People's Council elects the Chairman, Vice-Chairman, and Head of Committees of the People's Council by secret ballot;

g) The Election Supervisory Board reports the results of the vote count;

h) The Chairperson of the session or a person designated by the Chairperson of the session introduces to the People's Council the draft resolution confirming the election results;

i) The People's Council discusses the draft resolution;

k) The Chairperson of the session or a person designated by the Chairperson of the session reports to the People's Council on explanations and responses to the opinions of representatives of the People's Council regarding the draft resolution (if any);

l) The People's Council votes to approve the draft resolution.

2. The procedures and formalities for the People's Council to elect positions of the People's Committee shall be carried out as follows:

a) The Chairman of the People's Council introduces a list of candidates for the positions of Chairman, Vice-Chairman, and Member of the People's Committee to the People's Council;

b) The People's Council's election of positions of the People's Committee shall be carried out similarly to the provisions of Clause 1 of this Article.

3. The procedures and formalities for the People's Council to terminate the holding of positions, resign, remove, or dismiss persons elected to positions by the People's Council shall be carried out as follows:

a) The agency or person with authority to introduce candidates to the People's Council for election has the authority to introduce to the People's Council the termination of holding positions, resignation, removal, or dismissal of persons elected to positions by the People's Council;

b) The termination of holding positions, resignation, removal, or dismissal of persons elected to positions by the People's Council shall be carried out similarly to the provisions of Clause 1 of this Article. In cases of termination of holding positions, resignation, or removal, the People's Council shall vote openly and not elect an Election Supervisory Board; in cases of dismissal, voting shall be by secret ballot.

4. The procedures for terminating the duties of a representative of the People's Council shall be carried out as follows:

a) Based on the application for termination of duties submitted by a representative of the People's Council, the Standing Committee of the People's Council examines and introduces to the People's Council for a decision on the termination of duties of a representative of the People's Council. During periods when the People's Council is not in session, the Standing Committee of the People's Council shall examine, decide, and report to the People's Council at the nearest session;

b) The procedures and formalities for introducing to the People's Council the termination of duties of a representative of the People's Council during a session of the People's Council shall be carried out similarly to the provisions of Clause 1 of this Article. The People's Council decides the form of voting; in cases of open voting, there shall be no election of an Election Supervisory Board.

Article 17. Personnel files submitted to the People's Council for decision

1. The file submitted to the People's Council for electing positions of the People's Council and People's Committee includes:

a) A proposal from the agency, organization, or authorized person submitting the People's Council for electing positions of the People's Council and People's Committee;

b) Draft Resolution of the People's Council;

c) Relevant documents on the curriculum vitae, comments, evaluations, and conclusions about personnel from the authorized level as prescribed;

d) Other relevant documents decided by the Standing Body of the People's Council according to the regulations of the authorized agency.

2. The file submitted to the People's Council for resignation, voluntary resignation, removal, or dismissal of positions elected by the People's Council includes:

a) A proposal from the agency, organization, or authorized person submitting the People's Council for considering resignation, voluntary resignation, removal, or dismissal of persons holding positions elected by the People's Council, accompanied by a resignation letter or voluntary resignation letter (if applicable);

b) Draft Resolution of the People's Council regarding resignation, voluntary resignation, removal, or dismissal of persons holding positions elected by the People's Council;

c) Disciplinary documents (if applicable) or opinions of the authorized level;

d) Other related documents (if any).

3. The file submitted to the People's Council for termination of duties as a representative of the People's Council includes:

a) A resignation letter from the representative of the People's Council and related documents;

b) A proposal from the Standing Body of the People's Council;

c) Draft Resolution of the People's Council regarding termination of duties as a representative of the People's Council.

4. The file submitted to the People's Council for removal or dismissal of representatives of the People's Council includes:

a) The report of the People's Council Standing Committee;

b) Draft Resolution of the People's Council regarding removal or dismissal of representatives of the People's Council;

c) Disciplinary documents (if applicable) or opinions of the authorized level;

d) Opinion document of the Standing Committee of the Vietnam Fatherland Front at the location where the representative of the People's Council participates in the Representative Group (if applicable);

đ) Opinion document of the Representative Group where the representative of the People's Council participates (if applicable).

Article 18. Information on the session of the People's Council

1. The Office of the People's Council and People's Committee is responsible for publicly posting the Resolutions of the People's Council on the People's Council's electronic information website, except as otherwise provided by law.

2. News agencies may be invited to attend and report on the session of the People's Council according to the decision of the Standing Body of the People's Council.

Chapter III
STANDING BODY OF THE PEOPLE'S COUNCIL AT THE COMMUNE LEVEL

Article 19. Working System and Forms

1. The Standing Body of the People's Council convenes regular meetings once a month or extraordinary meetings as needed upon the proposal of the Chairman of the People's Council. The meeting must ensure attendance of at least two-thirds of the total number of members of the Standing Body of the People's Council.

2. The Standing Body of the People's Council discusses collectively and decides by majority. Decisions of the Standing Body of the People's Council must be approved by more than half of the total number of members of the Standing Body of the People's Council. In case of equal votes, the opinion of the Chairman of the People's Council who has voted will prevail, including cases where opinions are sought in writing; work is carried out within the scope of authority, in accordance with the procedures and formalities stipulated by law and this Regulation.

3. The Standing Body of the People's Council is responsible and reports its work to the People's Council; issues documents within its authority and uses the seal of the People's Council to perform assigned tasks and powers.

Members of the Standing Body of the People's Council are individually responsible before the Standing Body of the People's Council for the implementation of assigned tasks and powers.

4. The Standing Body of the People's Council works through the following forms:

a) Regular sessions, extraordinary sessions;

b) Seeking opinions in writing;

c) Conferences;

d) Work delegations;

đ) Other forms of activities as prescribed by law.

Article 20. Regular Meeting of the People's Council

1. The Chairman of the People's Council decides on the time, agenda, content, form, composition, convening, and chairing of the regular meeting of the People's Council.

2. The Standing Committee of the People's Council assigns the Committees of the People's Council to review and provide opinions on the contents presented at the regular meeting of the People's Council.

3. The Office of the People's Council and the People's Committee are responsible for advising on the content and agenda of the meeting, recording the minutes of the meeting; leading the completion of notifications and conclusions of the meeting, keeping the files and documents of the meeting.

4. In necessary cases, based on actual circumstances or upon the proposal of members of the Standing Committee of the People's Council, relevant agencies, organizations, or individuals, the Chairman of the People's Council reviews and decides to adjust the agenda of the meeting.

5. Based on the agenda of the regular meeting of the Standing Committee of the People's Council, the People's Committee and relevant agencies, organizations, or individuals prepare the contents to be presented at the meeting according to the assignment of the Standing Committee of the People's Council, ensuring quality and time as prescribed. Documents and materials serving the meeting are sent to the Office of the People's Council and the People's Committee for the Standing Committee of the People's Council to study before organizing the meeting.

6. The procedure for conducting the regular meeting of the Standing Committee of the People's Council is carried out as follows:

a) The chairperson of the meeting makes an opening speech and suggests topics for discussion.

b) The head of the agency or organization presenting the draft resolution, report, or proposal presents the motion for the draft resolution, report, or proposal for the Standing Committee of the People's Council to review and provide opinions.

c) The Committee of the People's Council presents the audit report or research opinion (if any).

d) The Standing Committee of the People's Council discusses.

đ) Invited delegates attending the meeting may make statements (if any).

e) The head of the agency or organization presenting the draft resolution, report, or proposal makes further statements and clarifications regarding the opinions of the Standing Committee of the People's Council on issues with differing views (if any).

g) The chairperson concludes.

7. The Standing Committee of the People's Council considers and decides on inviting the press to attend and report on the content of the meeting (if any).

Article 21. Conclusion Document of the Regular Meeting of the Standing Committee of the People's Council

1. Based on the conclusion of the chairperson of the meeting, the Office of the People's Council and the People's Committee lead and coordinate with the Committee of the People's Council assigned to audit the drafting of the notification of the Standing Committee of the People's Council's conclusion (if any) for the chairperson of the meeting (in case it is the Chairman of the People's Council) to review and decide or for the chairperson of the meeting (in case it is the Vice-Chairman of the People's Council) to review and provide opinions before submitting to the Chairman of the People's Council for review and decision.

2. The Standing Committee of the People's Council issues the Notification of the Conclusion document and sends it to relevant agencies, organizations, or individuals for implementation (if any).

Article 22. Procedure and Formalities for the Standing Committee of the People's Council to Provide Opinions and Decide by Written Document

1. In cases where a meeting cannot be organized (due to natural disasters, epidemics, or other emergency situations) or depending on the nature and content submitted to the Standing Committee of the People's Council (such as: deciding the number of members of the Committees of the People's Council; approving lists and the resignation of Deputy Chairmen and Members of the Committees of the People's Council among representatives of the People's Council upon the proposal of the Chairman of the People's Council; participating comments, reports of the Standing Committee of the People's Council; approving resignation from positions held by those elected by the People's Council during periods when the People's Council is not in session...), the Standing Committee of the People's Council itself or upon the proposal of the agency in charge of the content to be decided, decides to seek opinions of the Standing Committee of the People's Council by written document.

2. The documents and materials submitted to the Standing Committee of the People's Council for review, providing opinions, and making decisions by written document include:

a) Request letter or Motion of the agency seeking opinions.

b) Draft resolution or reply document of the Standing Committee of the People's Council on the content sought for opinions; written ballot (if any).

c) Draft conclusion of the Standing Committee of the People's Council (if any).

d) Other related documents (if any).

3. The procedure for the Standing Committee of the People's Council to review and provide opinions by written document is carried out as follows:

a) The Office of the People's Council and the People's Committee send the documents and materials for the Standing Committee of the People's Council to review, provide opinions, and make decisions by written document to the members of the Standing Committee of the People's Council, while sending them to the Committee of the People's Council for auditing (if necessary).

b) Based on the documents and materials and the audit opinions of the Committee of the People's Council (if any), members of the Standing Committee of the People's Council provide opinions on the draft resolution, proposal, report, and written ballot, and return them to the Office of the People's Council and the People's Committee for consolidation.

c) The Office of the People's Council and the People's Committee consolidate the voting results and opinions of the members of the Standing Committee of the People's Council and report to the Standing Committee of the People's Council and send them to the Committee of the People's Council assigned to audit (if any).

d) The agency proposing has the responsibility to study, adopt, clarify, and revise the draft resolution, proposal, and report.

đ) The Committee of the People's Council assigned to audit or the Office of the People's Council and the People's Committee conduct a review and submit to the Chairman of the People's Council for signing and issuing the resolution of the Standing Committee of the People's Council when the conditions are met as prescribed.

Article 23. Responsibilities of the Chairman of the People's Council, Vice Chairmen of the People's Council, and Members who are Heads of Committees of the People's Council

1. Responsibilities of the Chairman of the People's Council:

a) Implementing tasks and powers as prescribed by the Constitution, the Law on Organization of Local Administration, relevant laws, and this Regulation;

b) Leading and directing the implementation of tasks and powers of the Standing Committee of the People's Council;

c) The Chairman of the People's Council shall be individually responsible to the Standing Committee of the People's Council for the implementation of assigned tasks and powers; collectively responsible to the People's Council for the implementation of tasks and powers of the Standing Committee of the People's Council.

2. The Vice Chairmen of the People's Council shall implement tasks and powers as assigned by the Chairman of the People's Council; be individually responsible to the Chairman of the People's Council for the implementation of assigned tasks and powers; collectively responsible for the implementation of tasks and powers of the Standing Committee of the People's Council.

3. Members who are Heads of Committees of the People's Council shall implement tasks and powers as assigned by the Standing Committee of the People's Council; collectively responsible for the implementation of tasks and powers of the Standing Committee of the People's Council; individually responsible to the Standing Committee of the People's Council for the implementation of tasks and powers assigned by the Standing Committee of the People's Council.

Article 24. Information and Reporting System of the Standing Committee of the People's Council

1. Implementing the reporting system of the People's Council and the Standing Committee of the People's Council to the Standing Committee of the People's Council, the Provincial People's Committee, and other agencies as prescribed by law.

2. Providing information to the public and making public through mass media and electronic information websites about the organization and activities of the People's Council and the Standing Committee of the People's Council; about the resolution of citizens' opinions and suggestions.

3. The Standing Committee of the People's Council may request agencies to provide information to serve the activities of the People's Council and the Standing Committee of the People's Council.

4. The Standing Committee of the People's Council decides on the authority, content, and provision of information to the press before each press conference (if held). The spokesperson is responsible under the law, to the Chairman of the People's Council, and the Standing Committee of the People's Council for the content of statements and information provided to the press.

Chapter IV
COMMITTEES OF THE PEOPLE'S COUNCIL AT THE COMMUNE LEVEL

Article 25. Working System and Form

1. Committees of the People's Council operate under a collective decision-making system based on majority rule; implementing tasks within their authority according to the procedures and formalities stipulated by law and this Regulation.

2. Committees of the People's Council shall be accountable and report their work to the People's Council and the Standing Committee of the People's Council (periodic or ad hoc reports); issue documents and use the seal of the People's Council to perform assigned tasks and powers.

3. Committees of the People's Council operate through regular meetings, extraordinary meetings, requesting opinions in writing, organizing conferences, organizing working delegations, and other forms of activity as prescribed by law.

Article 26. Scope and fields of responsibility of Committees of the People's Council

Based on specific conditions of the locality, the People's Council and the Standing Committee of the People's Council shall assign the scope and fields of responsibility of the Committees of the People's Council to ensure comprehensive coverage of the tasks and powers of the People's Council and the Standing Committee of the People's Council as prescribed by law.

The People's Council and the Standing Committee of the People's Council may refer to the assignment of the scope and fields of responsibility of the Committees in the following manner:

1. The Economic-Finance Committee of the People's Council shall be responsible for the following fields: planning, urban planning, development of technical infrastructure and social infrastructure within the area, plans, investment, finance, budget, linkage, cooperation between administrative units; land, natural resources, environment, agriculture, forestry, fisheries, industry, trade, services, tourism, construction, and transportation at the local level;

2. The Culture-Social Committee of the People's Council shall be responsible for the following fields: organization and enforcement of the Constitution and laws; organizational structure and building of state administration; education, health, culture, society, physical education, and sports; science, technology, information, innovation, digital transformation; national defense, security, ethnic groups, and religions at the local level.

Article 27. Procedures and formalities for reviewing draft resolutions, reports, and draft decrees of Committees of the People's Council

1. At least 15 days before the opening day of the session of the People's Council, the agency, organization, or individual submitting the draft decree, proposal, or report must send the dossier of the draft decree, proposal, or report to the Committee of the People's Council assigned to review it. The dossier of the draft decree, proposal, or report sent for review shall be carried out in accordance with the Law on Legislative Documents, other relevant regulations, and the requirements of the Standing Committee of the People's Council.

2. The Committee of the People's Council shall organize a plenary meeting to review the resolution, proposal, or report assigned according to the following procedures:

a) A representative of the agency, organization, or individual submitting the draft decree, proposal, or report shall present;

b) A representative of the Committee shall present the review report or the Committee's opinion (if any);

c) The Committee shall discuss collectively;

d) A representative of the related agency or organization shall express opinions;

đ) A representative of the agency, organization, or individual submitting the draft decree, proposal, or report shall express opinions (if any);

e) The chairperson of the meeting shall conclude;

g) The Committee shall vote collectively.

3. The review report must clearly reflect the viewpoint of the reviewing agency on issues within the scope of the review as prescribed by the Law on Legislative Documents and guiding documents; it must be sent to the Standing Committee of the People's Council at least five working days before the opening day of the People's Council session, and simultaneously must be sent to the agency submitting the draft decree, proposal, or report.

Article 28. Organization of plenary meetings of Committees of the People's Council and consideration by written opinion

1. The Chairman of the Committee of the People's Council decides to convene a plenary meeting to consider, discuss, and decide on matters within its authority or matters assigned by the Standing Committee of the People's Council; assigns the Deputy Chairman or Member of the Committee to draft contents for the plenary meeting of the Committee or prepare the Committee's response to agencies.

2. The procedure for organizing a plenary meeting of the Committee of the People's Council is implemented similarly to the provisions of Clause 2 of Article 27 of this Regulation.

3. Based on the conclusions of the plenary meeting of the Committee, the Chairman assigns the Deputy Chairman or Member of the Committee to coordinate with the civil servant assisting the Committee of the People's Council to complete draft documents that have been commented on during the meeting according to their authority, submit them to the Chairman for examination and decision.

4. In cases where a plenary meeting of the Committee of the People's Council cannot be organized (due to natural disasters, epidemics, or other emergencies), or depending on the nature and content, the Chairman of the Committee of the People's Council considers and decides on seeking opinions in writing.

The procedures and formalities for the Committee of the People's Council to consider and give opinions in writing are as follows:

a) The Chairman of the Committee of the People's Council assigns the Deputy Chairman or Member of the Committee to study and draft the Committee's document;

b) The Deputy Chairman or Member of the Committee assigned the task of studying sends the dossier, documents, and request for opinions to the members of the Committee of the People's Council for examination, giving opinions, and voting in writing;

c) The Deputy Chairman or Member of the Committee of the People's Council assigned the task of studying compiles the opinions and votes of the Committee members, completes the draft document, and reports to the Chairman for examination and decision to sign and issue;

d) The Chairman of the Committee of the People's Council signs the document and sends it to the Standing Committee of the People's Council and related agencies and organizations;

đ) The submitting agency has the responsibility to study, adopt, explain, and revise the draft resolution, proposal, or report (if any).

Article 29. Responsibilities of the Chairman, Deputy Chairmen, and Members

1. Responsibilities of the Chairman:

a) Perform the tasks and powers of the Chairman as prescribed by relevant laws within the field under the Board's responsibility, and the tasks assigned by the Standing Committee of the People's Council;

b) Be responsible for overall direction, management, and operation of the Board; bear collective responsibility before the People's Council and the Standing Committee of the People's Council regarding the Board's activities; bear individual responsibility before the Board and the Standing Committee of the People's Council regarding the performance of the Chairman's duties and powers;

c) Represent the Board to present reports before the People's Council and the Standing Committee of the People's Council;

d) Provide information about the Board's activities to news agencies (if requested);

đ) Process incoming and outgoing documents of the Board;

e) Sign documents of the Board.

2. Responsibilities of the Deputy Chairman:

a) Perform tasks and powers according to the division of responsibilities by the Chairman;

b) Bear collective responsibility before the People's Council and the Standing Committee of the People's Council regarding the Board's functions and tasks; bear individual responsibility before the Chairman and the Board regarding the performance of assigned duties and powers;

c) Sign documents of the Board according to the division of responsibilities by the Chairman.

3. Responsibilities of Members:

a) Perform tasks and powers according to the division of responsibilities by the Chairman or Deputy Chairman;

b) Bear collective responsibility before the People's Council and the Standing Committee of the People's Council regarding the performance of the Board's duties and powers; bear individual responsibility regarding the performance of assigned duties and powers by the Chairman and Deputy Chairman.

Chapter V
DELEGATION OF PEOPLE'S COUNCIL MEMBERS AT THE COMMUNE LEVEL

Article 30. Responsibilities of the Delegation of People's Council Members

1. Perform tasks and powers as prescribed by laws, guidelines of the Standing Committee of the National Assembly, relevant laws, and assignments by the Standing Committee of the People's Council.

2. Conduct supervision on issues assigned by the People's Council or the Standing Committee of the People's Council according to the Law on Supervisory Activities of the National Assembly and People's Councils and implementing regulations.

3. Organize meetings between People's Council members and voters, collect opinions and suggestions from voters prior to the People's Council session.

Article 31. Responsibilities of the Head and Deputy Heads of the Delegation of People's Council Members

1. Responsibilities of the Head of the Delegation of People's Council Members:

a) Direct and be generally responsible for the activities of the Delegation of People's Council Members before the People's Council and the Standing Committee of the People's Council;

b) Chair and direct meetings of the Delegation; sign documents of the Delegation on behalf of the Delegation of People's Council Members;

c) Maintain regular contact with the Standing Committee of the People's Council, the Standing Committee of the Vietnam Fatherland Front at the same level, and related agencies and organizations.

2. The Deputy Head of the Delegation of People's Council Members shall perform tasks and powers when assigned by the Head.
