BASED ON DECREE NO. 178/CP DATED OCTOBER 28, 1994 OF THE GOVERNMENT ON THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF FINANCE;
Pursuant to the Charter on "Investment Management and Construction" issued together with Decree No. 42/CP dated July 16, 1996 of the Government;
Pursuant to Circular No. 65/TC/ĐTPT dated November 2, 1996 of the Ministry of Finance guiding construction project insurance;
Upon the proposal of the Director of the Department of Financial Affairs of Banks and Financial Organizations.
DECISION:
Article 1. Issued together with this Decision is the Supplementary Insurance Fee Schedule for certain construction installation projects to the Construction Insurance Fee Schedule, Installation Insurance Fee Schedule, additional insurance fees, and deductible rates already issued together with Decision No. 663/TC/QĐ-TCNH dated June 24, 1995 of the Ministry of Finance.
Article 2. Amending Article 2 of Decision No. 663 TC/QĐ-TCNH dated June 24, 1995 as follows: Based on ensuring payment capacity, depending on specific time periods, insurance enterprises may proactively adjust the insurance fee rate within 25% compared to the prescribed fee schedule.
Article 3. For construction projects with special characteristics not mentioned or inadequately addressed in the rules and fee schedules issued by the Ministry of Finance, insurance enterprises and investors are permitted to negotiate conditions and fee schedules for special contents to promptly insure the project but must report to the Ministry of Finance for monitoring and management.
Article 4. The insurance fee is calculated in the project budget based on the construction and installation fee schedules that have been issued.
Article 5. This Decision takes effect from the date of signing and shall be applied to insurance enterprises and investors, construction consulting organizations, equipment suppliers, and contractors as stipulated in Decree No. 42/CP dated July 16, 1996 of the Government and Circular No. 65/TC/ĐTPT dated November 2, 1996 of the Ministry of Finance guiding construction project insurance.
Article 6. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and cities are responsible for implementing this Decision to investors under their jurisdiction.
Article 7. The Director of the Department of Financial Affairs of Banks and Financial Organizations, the General Director of the Investment and Development General Department, the Director of the Ministry of Finance Office, and heads of related units are responsible for inspecting and supervising the implementation of this Decision.
