Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 dated December 12, 1997 and the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam dated June 17, 2003;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and Ministerial-Level Agencies;
Pursuant to Decree No. 52/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;
At the proposal of the Director of the Organization and Cadres Department and the Head of the Representative Office in Ho Chi Minh City,
DECISION:
Article 1. This Decision promulgates the "Regulation on the organization and operation of the Representative Office in Ho Chi Minh City" Ho Chi Minh City
Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette, replacing Decision No. 410/1998/QĐ-NHNN9 dated December 3, 1998 of the Governor of the State Bank of Vietnam on the issuance of the Regulation on the organization and operation of the Representative Office of the State Bank of Vietnam in Ho Chi Minh City Ho Chi Minh City.
Article 3. The Heads of the Office, the Directors of the Organization and Cadres Department, the Head of the Representative Office in Ho Chi Minh City, and the Heads of units related to the State Bank of Vietnam are responsible for implementing this Decision. REGULATIONS
1050/2004/QĐ-NHNN dated August 23, 2004
(Issued along with Decision No. The Representative Office in Ho Chi Minh City (hereinafter referred to as the Representative Office) is a unit within the organizational structure of the State Bank of Vietnam, tasked with representing according to the authorization of the Governor of the State Bank of Vietnam, with its headquarters located at No. 17 Ben Chuong Duong Street - District 1 - Ho Chi Minh City of the Governor of the State Bank)
PART I
GENERAL PROVISIONS
Article 1: The Representative Office is a dependent accounting unit, having its own account and seal, operating in accordance with the Accounting Law, other legal regulations, and directives from the Governor of the State Bank of Vietnam. The management of the Representative Office is conducted by the Head of the Representative Office (equivalent to Deputy Director General), assisted by several Deputy Heads of the Representative Office (equivalent to Deputy Director). The Head and Deputy Heads of the Representative Office are appointed by the Governor of the State Bank of Vietnam. The organization and operation of the Representative Office follow the principle of democratic centralism and the head system. Ho Chi Minh City.
The Representative Office has the following tasks and powers:
Article 2: 1/ Coordinating with Departments and Bureaus of the State Bank of Vietnam to organize and implement state policies and industry regulations in the southern region, participating in working groups of the State Bank of Vietnam (when necessary) and preparing relevant content for the Governor of the State Bank of Vietnam to attend meetings of the Government, Ministries, Sectors, or localities in the southern region.
Chapter II
TASKS AND POWERS
Article 3: 2/ Receiving, compiling information from the Banking Information Technology Bureau; Departments and Bureaus of the State Bank of Vietnam, and reports from provincial and city branches in the south. Based on this, conducting research, analysis, evaluation, and proposing measures to the Governor of the State Bank of Vietnam to address issues related to monetary policy and banking operations in southern provinces and cities.
3/ Organizing supervision of asset safety at the Central Treasury located in Ho Chi Minh City.
4/ Organizing the implementation of office work, administrative management, and support for the leadership's guidance and management activities and the operations of working groups of the State Bank of Vietnam when they visit according to programs approved by the Governor of the State Bank of Vietnam.
5/ Implementing reception, external relations, and hosting international delegations, ministries, sectors, and localities visiting the State Bank of Vietnam in Ho Chi Minh City.
6/ Monitoring and implementing policies regarding staff of the unit and retired staff of units based in the headquarters residing in Ho Chi Minh City.
7/ Cooperating with related units to implement security, order, and safety assurance work. Ho Chi Minh City.
8/ Organizing the implementation of property management and accounting, settlement of operational costs of the Representative Office in accordance with state and industry regulations. Ho Chi Minh City.
9/ Performing other tasks assigned by the Governor of the State Bank of Vietnam.
The organizational structure of the Representative Office includes:
- Administrative Management Section;
Chapter III
ORGANIZATIONAL STRUCTURE AND MANAGEMENT
Article 4: - Human Resources Section;
- General Department;
- Financial Section;
- Security Team.
The Representative Office operates under a system combining sections and some online specialists.
Specific tasks and powers of each Section (Team), and online specialists are defined by the Head of the Representative Office.
Tasks and powers of the Head of the Representative Office:
1/ Organizing the implementation of the tasks of the Representative Office as stipulated in Article 3 of this Regulation, being responsible before the Governor of the State Bank of Vietnam and the law for the tasks assigned.
Article 5: 2/ Deciding the program and plan of work of the unit and applying appropriate measures within his authority to complete the assigned tasks.
3/ In personnel management:
Organizing the management and assignment of tasks to civil servants and employees in the unit.
Implementing recruitment, transfer, rotation, appointment, reappointment, training, promotion, reward, punishment, and other policies for civil servants and employees in the unit according to the delegation of authority from the Governor of the State Bank of Vietnam.
4/ Attending coordination meetings in the Southern region of the Government Office. Attending meetings organized by the Government, Ministries, Sectors, and localities in Ho Chi Minh City or southern provinces when authorized by the Governor of the State Bank of Vietnam.
5/ Signing administrative documents within his authority.
Tasks and powers of the Deputy Heads of the Representative Office: 1/ Assisting the Head of the Representative Office in directing and managing certain aspects of the unit's work as assigned and being responsible to the Head of the Representative Office for the results of the tasks assigned.
2/ Acting on behalf of the Head of the Representative Office to sign administrative documents as delegated by the Head of the Representative Office.
Article 6: 3/ When the Head of the Representative Office is absent, a Deputy Head of the Representative Office is authorized to manage the unit's work, being responsible for the matters resolved and reporting back when the Head of the Representative Office is present.
1/ Assist the Director of the Representative Office in directing and managing certain aspects of the unit's work according to the assigned tasks and be responsible to the Director of the Representative Office for the results of the assigned tasks.
2/ Represent the Director of the Representative Office to sign administrative documents according to the assignment of the Director of the Representative Office.
3/ In the absence of the Director of the Representative Office, a Deputy Director of the Representative Office authorized to manage the unit's work, be responsible for the work resolved, and report back when the Director of the Representative Office is present.
Chapter IV
IMPLEMENTING PROVISIONS
Article 7: Amendments and supplements to the provisions of this Regulation shall be decided by the Governor of the State Bank.
