CIRCULAR
Regulations on the Implementation of Inspection Conclusions by the People's Public Security Forces
Pursuant toLaw on Inspection No. 84/2025/QH15 dated June 25, 2025;
Pursuant to the Law on the People's Public Security No. 37/2018/QH14 dated November 20, 2018 amended and supplemented by Law No. 21/2023/QH15, Law No. 30/2023/QH15, Law No. 38/2024/QH15, Law No. 52/2024/QH15, and Law No. 86/2025/QH15;
Pursuant to Decree No.Decree No. 216/2025/NĐ-CP dated August 5, 2025 of the Government detailing certain provisions and guiding the implementation of the Law on Inspection;
Pursuant to Decree No. 273/2025/NĐ-CP dated October 16, 2025 of the Government on organization and inspection activities of the People's Public Security Forces;
Pursuant to Decree No. 02/2025/NĐ-CP dated February 18, 2025 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Public Security; Decree No. 11/2025/NĐ-CP dated July 1, 2025 of the Government amending and supplementing certain articles of Decree No. 02/2025/NĐ-CP dated February 18, 2025 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Public Security;
At the proposal of the Inspector General of the Ministry of Public Security;
The Minister of Public Security promulgates this Circular on the Implementation of Inspection Conclusions by the People's Public Security Forces.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the responsibilities of agencies, organizations, and individuals in implementing inspection conclusions, decisions on handling inspections, monitoring, urging, and inspecting the implementation of inspection conclusions and decisions on handling inspections by the People's Public Security Forces and the responsibilities of public security units and localities.
Article 2. Applicability
1. Officers and non-commissioned officers of the People's Public Security Forces (hereinafter referred to collectively as cadres).
2. Public security units and localities.
3. Inspection agencies within the People's Public Security Forces include:
a) Inspectorate of the Ministry of Public Security;
b) Inspectorate of provincial and municipal public security forces; Inspectorate of the Prison Administration Police Bureau; Inspectorate of the Fire Prevention and Control Police Bureau (hereinafter referred to collectively as Inspectorate of public security units and localities).
4. Heads of inspection agencies within the People's Public Security Forces include: Inspector General of the Ministry of Public Security; Inspector General of public security units and localities.
5. Team leaders and members of inspection teams.
6. Inspected entities.
7. Heads of agencies, units, and organizations directly managing inspected entities.
8. Agencies, organizations, and individuals related to the implementation of inspection conclusions and decisions on handling inspections.
Chapter II
RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, AND INDIVIDUALS IN THE IMPLEMENTATION OF INSPECTION CONCLUSIONS
DECISIONS ON HANDLING INSPECTIONS
DECISION ON INSPECTION HANDLING
Article 3. Responsibilities of inspection agencies within the People's Public Security Forces
1. The Inspectorate of the Ministry of Public Security shall be responsible for:
a) Implementing the tasks prescribed in this Circular and the laws on inspection in the implementation of inspection conclusions and decisions on handling inspections within its jurisdiction;
b) Advising and organizing the implementation of directives from the leadership of the Ministry of Public Security regarding the contents of inspection conclusions;
c) Monitoring, urging, and inspecting the implementation of inspection conclusions, decisions on handling inspections, directive documents, and recommendations for implementing inspection conclusions;
d) Proposing or implementing measures to handle violations by inspected entities, agencies, organizations, and individuals related to the implementation of inspection conclusions (if applicable);
đ) Notifying in writing the agencies, units, and organizations directly managing inspected entities, and related agencies, organizations, and individuals about the results of monitoring, urging, and inspecting the implementation of inspection conclusions, recommendations, and decisions on handling inspections;
e) Performing other tasks as prescribed by law.
2. The Inspectorate of public security units and localities shall be responsible for:
a) Assisting the Director of provincial and municipal public security forces, the Chief of the Prison Administration Police Bureau, and the Chief of the Fire Prevention and Control Police Bureau (collectively referred to as the Head of the same-level public security force) in performing the tasks prescribed in this Circular and the laws on inspection in the implementation of inspection conclusions and decisions on handling inspections within their jurisdiction;
b) Implementing directives from the Head of the same-level public security force regarding the contents of inspection conclusions within their jurisdiction;
c) Reporting the results of monitoring, urging, and inspecting the implementation of inspection conclusions issued by themselves and the results of implementing directives or recommendations for the contents of inspection conclusions and decisions on handling inspections by competent authorities to the Head of the same-level public security force for consolidation and reporting as required;
d) Performing the tasks as specified in points c, d, đ, and e of Clause 1 of this Article.
Article 4. Responsibilities of the Heads of Inspection Agencies within the People's Public Security and the Heads of Public Security at the Same Level
1. The Inspector General of the Ministry of Public Security shall be responsible for directing and organizing the implementation of tasks prescribed in Clause 1 of Article 3 of this Circular and relevant laws on inspection.
2. The Inspectors of Public Security Units and Localities shall be responsible for:
a) Recommending the Head of Public Security at the same level to direct the implementation of inspection conclusions within the authority of the Head of Public Security at the same level;
The recommendation document must be sent simultaneously with the inspection conclusion, proposing methods, measures, and deadlines for implementing the recommendations contained in the inspection conclusion within the authority of the Head of Public Security at the same level.
b) Directing and organizing the implementation of tasks prescribed in Clause 2 of Article 3 of this Circular and relevant laws on inspection;
c) Promptly handling the results of monitoring, urging, and inspecting the implementation of inspection conclusions and decisions on inspection handling;
d) Timely reporting the results of implementing inspection conclusions and decisions on inspection handling to the Head of Public Security at the same level.
3. The Head of Public Security at the same level shall be responsible for:
a) Within 15 days from the date of receipt of the inspection conclusion and the recommendation document of the Inspector of Public Security Units and Localities, the Head of Public Security at the same level must issue a directive document or provide a directive opinion in the proposal document of the inspection agency according to the provisions of Clause 2 of Article 53 of the Inspection Law;
b) Considering and resolving difficulties and obstacles in implementing inspection conclusions and decisions on inspection handling.
Article 5. Responsibilities of the Inspected Object, Heads of Agencies, Units, and Organizations Directly Managing the Inspected Object, and Relevant Agencies, Organizations, and Individuals in Implementing Inspection Conclusions
1. The inspected object shall be responsible for implementing the contents of the inspection conclusion as prescribed in Clause 1 of Article 54 of the Inspection Law.
2. Within 15 days from the date of publicizing the inspection conclusion, based on the content of the inspection conclusion, decision on inspection handling, and the organization's implementation document of the inspection conclusion, the Head of the Agency, Unit, or Organization directly managing the inspected object shall be responsible for implementing the contents prescribed in Clause 2 of Article 54 of the Inspection Law.
3. The inspected object, the Head of the Agency, Unit, or Organization directly managing the inspected object, and relevant Agencies, Organizations, and Individuals involved in implementing the inspection conclusion shall be responsible for reporting the results of implementing the inspection conclusion to the competent authority and the Head of the Inspection Agency within the People's Public Security with the authority to resolve.
Chapter III
MONITORING, URGING, AND INSPECTING THE IMPLEMENTATION OF
INSPECTION CONCLUSIONS AND DECISIONS ON INSPECTION HANDLING
Article 6. Subjects of Monitoring and Urging
The subjects of monitoring and urging the implementation of inspection conclusions shall be carried out in accordance with the provisions of Clause 2 of Article 66 of Decree No. 216/2025/NĐ-CP.
Article 7. Forms of Monitoring and Urging
1. The activity of monitoring the implementation of inspection conclusions and decisions on inspection handling shall be conducted through summarizing the results of implementing inspection conclusions reported by the monitoring subject according to the deadline specified in the inspection conclusion or sending a document requesting the monitoring subject to report on the implementation of the inspection conclusion and decision on inspection handling and providing information and documents for verification.
2. The activity of urging the implementation of inspection conclusions and decisions on inspection handling shall be conducted through sending a document to the inspected object, the agency, unit, or organization directly managing the inspected object, and relevant agencies, organizations, and individuals involved in implementing the inspection conclusion and decision on inspection handling when the urging subject does not report or reports incompletely on the implementation of the inspection conclusion and decision on inspection handling.
In necessary cases, the Head of the Inspection Agency within the People's Public Security may assign officers or working groups to work with the inspected object, the Head of the Agency, Unit, or Organization directly managing the inspected object, and relevant agencies, organizations, and individuals involved in implementing the inspection conclusion and decision on inspection handling to guide and urge the implementation.
Article 8. Content of monitoring and urging
The content of monitoring and urging the implementation of inspection conclusions and decisions on handling inspections shall be carried out in accordance with the provisions stipulated in Article 67 of Decree No. 216/2025/NĐ-CP.
Article 9. Report on the results of monitoring and urging
After receiving the report on the results of implementing the inspection conclusions and decisions on handling inspections from the monitored entity, within 15 days, the staff assigned to monitor and urge the implementation of inspection conclusions and decisions on handling inspections shall, based on the content of monitoring and urging, submit a written report to the head of the inspection agency under the People's Public Security directly managing about the results of monitoring and urging the implementation of inspection conclusions and decisions on handling inspections.
The head of the inspection agency under the People's Public Security shall decide on continuing or terminating the monitoring and urging or deciding to conduct a check based on the content of the report.
Article 10. Basis for inspection, decision to inspect, time limit for inspection
1. The head of the inspection agency under the People's Public Security decides to inspect the implementation of inspection conclusions and decisions on handling inspections when there is one of the bases prescribed in Clause 1 of Article 68 of Decree No. 216/2025/NĐ-CP.
2. The decision to inspect includes the contents prescribed in Clause 2 of Article 68 of Decree No. 216/2025/NĐ-CP.
3. The implementation of inspection and the time limit for inspection shall be carried out in accordance with the provisions of Clause 3 of Article 68 and Clause 1 of Article 69 of Decree No. 216/2025/NĐ-CP.
Article 11. Content of inspection
The content of inspection shall be carried out in accordance with the provisions of Clause 2 of Article 69 of Decree No. 216/2025/NĐ-CP.
Article 12. Report on the results of inspection
1. Within the latest 15 days from the date of completion of the inspection, the Head of the Inspection Team or the staff assigned to carry out the inspection shall be responsible for reporting the results of the inspection to the head of the inspection agency under the People's Public Security directly managing to report to the head of the same-level Public Security.
2. The report on the results of the inspection includes the contents prescribed in Clause 2 of Article 70 of Decree No. 216/2025/NĐ-CP.
Article 13. Handling the results of inspection
1. Based on the report on the results of the inspection, the head of the inspection agency under the People's Public Security shall handle the results of the inspection in accordance with the provisions of Clause 1 of Article 71 of Decree No. 216/2025/NĐ-CP.
2. In cases where the inspection conclusions, decisions on handling inspections, directives, or recommendations for implementing inspection conclusions and decisions on handling inspections contain contents that cannot be implemented, it shall be reported to the head of the same-level Public Security for consideration and decision.
Article 14. Establishment and management of files for monitoring, urging, and inspection
1. The head of the inspection agency under the People's Public Security assigns staff to establish and manage files for monitoring, urging, and inspecting the implementation of inspection conclusions and decisions on handling inspections. The assigned staff shall be responsible for:
a) Establishing the file within 15 days from the date the inspection conclusion is published or sent to the inspected entity;
b) Collecting information and documents related to the implementation of inspection conclusions, requests, recommendations, and decisions on handling inspections;
c) Completing the file after the head of the inspection agency issues a written notice to terminate monitoring, urging, and inspection.
2. Information and documents collected during the process of monitoring, urging, and inspection are part of the files for monitoring, urging, and inspecting the implementation of inspection conclusions and decisions on handling inspections and can only be provided or made public upon permission from the head of the inspection agency under the People's Public Security.
3. The storage and management of files for monitoring, urging, and inspecting the implementation of inspection conclusions shall be carried out in accordance with the regulations of the Minister of Public Security on the work of storing common documents formed in the People's Public Security.
Chapter IV
IMPLEMENTING PROVISIONS
Article 15. Effective Date
This Circular takes effect from November 25, 2025, and replaces Circular No. 29/2019/TT-BCA dated August 30, 2019, issued by the Minister of Public Security on the implementation of inspection conclusions in the People's Public Security.
Article 16. Responsibility for Implementation
1. The Inspectorate of the Ministry of Public Security shall be responsible for monitoring, guiding, inspecting, and urging the implementation of this Circular.
2. Heads of units under the Ministry, Directors of provincial and municipal public security services, organizations, and individuals related to this matter shall be responsible for implementing this Circular.
During the implementation of this Circular, if there are difficulties or obstacles, local public security units, agencies, and organizations concerned shall report to the Ministry of Public Security (through the Inspectorate of the Ministry of Public Security) for timely guidance./.
