PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Ordinance No. 12/2003/PL-UBTVQH11 on Food Safety and Hygiene dated July 26, 2003;
Considering the proposal of the Minister of Agriculture and Rural Development,
DECISION:
Article 1. Issuing certain support policies for developing production, processing, and consumption of safe vegetables, fruits, and tea until 2015, with the main contents as follows:
I. OBJECTIVES
1. Target by 2010
a) At least 20% of vegetable area, 20% of fruit tree area, and 25% of tea area in concentrated safe production areas meet the requirements of safe production according to Good Agricultural Practices (VIETGAP);
b) At least 30% of total vegetable and fruit products and 40% of total tea products consumed domestically, used as raw materials for processing and export, are certified and announced as products produced and processed according to safe production procedures: VIETGAP and Hazard Analysis and Critical Control Points (HACCP) system.
2. Target by 2015
The indicators mentioned in points a and b of Clause 1 of Section I of this Article reach 100%.
II. SCOPE AND SUBJECTS OF APPLICATION
The scope and subjects applying the support policies for developing safe vegetable, fruit, and tea production, processing, and consumption under this Decision include:
1. Basic survey and terrain investigation to identify regions meeting conditions for safe vegetable, fruit, and tea production;
2. Investment in safe vegetable, fruit, and tea production;
3. Investment in safe vegetable, fruit, and tea processing and consumption;
4. Certification and announcement of safe vegetable, fruit, and tea production and processing according to VIETGAP and HACCP systems;
5. Organizations, individuals, and households investing in the development of safe vegetable, fruit, and tea production, processing, and consumption.
III. SOME POLICIES
1. State budget investment:
a) Basic survey and terrain investigation to identify concentrated safe production regions that meet the requirements of safe production according to Good Agricultural Practices (VIETGAP).
The Chairman of the People's Committee of provinces and centrally governed cities shall define the scale of concentrated safe production regions suitable to land conditions, crops, and local socio-economic development planning.
b) Construction and improvement of infrastructure: transportation, irrigation canals, primary drainage, pumping stations, low-voltage power supply.
2. Local budget support for investment in wholesale markets, storage facilities, trade promotion, transfer of advanced vegetable, fruit, and tea safety techniques; certification of safe vegetable, fruit, and tea production facilities.
Specific levels of support shall be determined by the People's Committee of provinces and centrally governed cities and submitted to the People's Councils of these provinces and cities for decision.
3. The Ministry of Agriculture and Rural Development and the People's Committees of provinces and centrally governed cities shall allocate annual budgets to support seeds and agricultural extension services in concentrated safe vegetable, fruit, and tea production regions according to Decree No. 56/2005/NĐ-CP dated April 26, 2005 of the Government on agricultural and fishery extension and Decision No. 17/2006/QĐ-TTg dated January 20, 2006 of the Prime Minister on continuing the implementation of Decision No. 225/1999/QĐ-TTg dated December 10, 1999 on the seed breeding program for plants, livestock, and forestry up to 2010.

a) Organizations and individuals investing in safe vegetable, fruit, and tea production shall be prioritized for land leasing or allocation with payment for land use according to the Land Law at concentrated safe production regions and shall enjoy the highest discounts on land use fees and rental prices according to current regulations.
b) The Chairman of the People's Committee of provinces and centrally governed cities, within their authority and local budget, shall issue policies to encourage and create conditions for land users to implement "land consolidation and exchange," lease, transfer, accumulate land to form concentrated safe production regions; issue policies to support capital and other policies for safe vegetable, fruit, and tea production, processing, and consumption in their respective areas.
c) Encourage farmers to use their land use rights to contribute capital shares or joint venture, associate with enterprises engaged in safe vegetable, fruit, and tea production, processing, and consumption.
Article 2. Implementation
1. The People's Committees of provinces and centrally governed cities shall be responsible for directing and implementing the development of safe vegetable, fruit, and tea production, processing, and consumption within their jurisdictions; deciding concentrated safe production, processing, and consumption regions; issuing support policies for safe vegetable, fruit, and tea production, processing, and consumption; allocating funds and implementing investment support for safe vegetable, fruit, and tea production, processing, and consumption within their jurisdictional authority.
2. The Ministry of Agriculture and Rural Development shall take the lead and coordinate with the People's Committees of provinces and centrally governed cities to direct the development of safe vegetable, fruit, and tea production and processing nationwide; guide the conditions, organization, and activities of certification organizations for safe vegetable, fruit, and tea production according to VIETGAP; supervise food safety quality of safe vegetables, fruits, and tea in production, processing, and consumption; issue criteria for infrastructure in concentrated safe vegetable, fruit, and tea production regions meeting VIETGAP production requirements; allocate funds and implement investment support for safe vegetable, fruit, and tea production and processing within the Ministry's authority.
3. The Ministry of Finance and the Ministry of Planning and Investment shall study and submit to the Government for supplementing the field of safe vegetable, fruit, and tea production and business into the List of sectors eligible for investment incentives according to the provisions of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain Articles of the Investment Law.
Article 3. This Decision shall take effect 15 days from the date of publication in the Official Gazette.
Article 4. The Ministers of the Ministries of Agriculture and Rural Development, Planning and Investment, Finance, Industry and Trade, Health, Science and Technology, Natural Resources and Environment, and the Chairmen of the People's Committees of provinces and centrally governed cities are responsible for enforcing this Decision./.
