THE MINISTER OF INDUSTRY AND TRADE

Pursuant to Resolution No. 01/2007/QH12 dated July 31, 2007 of the National Assembly of the Socialist Republic of Vietnam, the twelfth session, first meeting, concerning the organizational structure of the Government and the number of Deputy Prime Ministers of the Government for the twelfth term;

Pursuant to the Agreement between the Ministry of Industry and Trade of the Socialist Republic of Vietnam and the Ministry of Commerce of the Kingdom of Cambodia signed on November 5,  2007 in Phnom Penh, Cambodia;

Implementing the guidance of the Prime Minister in Document No. 1176/VPCP-QHQT dated November 21, 2007 regarding the agreement on Cambodian agricultural products imported into Vietnam;

At the proposal of the Director of the Import-Export Department;

DECISION:

Article 1. Apply the tariff quota for importation in 2008 and 2009 for two groups of goods originating from Cambodia with a preferential special import tax rate of 0% (zero percent), including:

- In 2008: 150,000 tons of rice paddy and milled rice (equivalent to milled rice) and 3,000 tons of dried tobacco leaves.

- In 2009: 200,000 tons of rice paddy and milled rice (equivalent to milled rice) and 3,000 tons of dried tobacco leaves.

The commodity codes and conversion ratios are set forth in Appendix I attached to this Decision.

Article 2. Vietnamese traders are entitled to import rice paddy, milled rice, and dried tobacco leaves under the tariff quota and enjoy the preferential special import tax rate of 0%. Specifically, only traders holding import licenses for tobacco raw materials issued by the Ministry of Industry and Trade in accordance with Circular No. 04/2006/TT-BTM dated April 6, 2006 of the Ministry of Trade (now the Ministry of Industry and Trade) are permitted to import dried tobacco leaves; the quantity imported shall be deducted from the import license for tobacco raw materials issued by the Ministry of Industry and Trade.

Article 3. Goods mentioned in Article 1 of this Decision must have a Certificate of Origin Form S (C/O form S) issued by the authorized authority of Cambodia in accordance with regulations, and be cleared through the border gates listed in Appendix II attached to this Decision. Customs procedures for importing goods are handled at the customs office where the import procedures are carried out according to the principle of automatic retroactive deduction (the total quantity of goods imported at the preferential special import tax rate is reduced by the quantity imported of each item).

Article 4. This Decision takes effect fifteen days after its publication in the Official Gazette./.
