Regarding hazardous and dangerous allowances for officials and civil servants in

public service units under the Ministry of Labor, Invalids, and Social Affairs

THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS

Pursuant to Decree No. 29/2003/NĐ-CP dated March 31, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for civil servants, public officials, and armed forces;

Pursuant to Circular No. 07/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of hazardous and dangerous allowances for officials, civil servants, and employees;

Pursuant to agreements on hazardous and dangerous allowances for officials, civil servants, and employees in the Ministry of Labor, Invalids, and Social Affairs between the Ministry of Finance and the Ministry of Home Affairs;

At the proposal of the Director of the Cadre Organization Department.

DECISION:

Article 1. The hazardous and dangerous allowance rates applicable to officials and civil servants working in public service units under the Ministry of Labor, Invalids, and Social Affairs (nursing homes, convalescent centers for war invalids and veterans, and persons who have rendered meritorious services to the revolution; social welfare centers; orthopedic rehabilitation centers for war invalids and disabled persons; the Institute of Orthopedics and Rehabilitation; Social Education and Labor Centers) shall be as follows:

1. Rate 1, coefficient 0.1.

a) Effective from October 1, 2004, for officials and civil servants indirectly serving patients with mental illness, tuberculosis, infectious diseases, and leprosy;

b) Effective from April 1, 2007, for officials and civil servants:

- Directly examining, treating, detoxifying, rehabilitating, and serving drug addicts;

- Directly serving disabled persons and the elderly;

- Directly serving room hygiene and laundry for residents;

- Directly caring for children under 18 months old;

- Indirectly examining, treating, rehabilitating, and serving people infected with HIV/AIDS.

2. Rate 2, coefficient 0.2.

a) Effective from October 1, 2004, for officials and civil servants:

- Directly examining, treating, and serving patients with skin diseases (syphilis, gonorrhea, genital warts, trichomoniasis, mold, scabies, ringworm);

- Directly treating and caring for patients with paraplegia due to spinal trauma, cerebral hemorrhage, tuberculous meningitis, purulent meningitis, myelitis;

- Directly caring for and treating post-operative patients (within 48 hours) belonging to types I and II surgeries;

- Directly serving ward hygiene and laundry for patients;

- Using high-frequency electric current equipment to treat patients;

- Washing bottles, flasks, and experimental tools contaminated with toxic chemicals and pathogenic microorganisms (must use toxic chemicals for sterilization);

- Conducting biochemical, hematological, and parasitological tests;

- Sterilizing instruments and equipment by steam autoclaving.

b) Effective from April 1, 2007, for officials and civil servants:

- Directly examining, treating, rehabilitating, and serving individuals with ulcerative wounds emitting foul odors (including war invalids, veterans, disabled persons, and the elderly);

- Directly serving paraplegics, children with cerebral palsy, severely disabled persons, and elderly individuals unable to self-care;

- Directly examining, treating, rehabilitating, and serving severely injured war invalids and veterans.

3. Rate 3, coefficient 0.3. Effective from October 1, 2004, for officials and civil servants performing pathological autopsy duties.

4. Rate 4, coefficient 0.4.

a) Effective from October 1, 2004, for officials and civil servants:

- Directly examining, treating, and serving individuals with HIV/AIDS, tuberculosis, mental illness (including mentally ill war invalids and veterans), and infectious diseases;

- Directly examining, treating, and serving drug addicts during detoxification;

- Radiography and fluoroscopy.

b) Effective from April 1, 2007, for officials and civil servants directly examining, treating, rehabilitating, and serving individuals affected by chemical warfare agents.

Article 2. The calculation method and funding sources for hazardous and dangerous allowances shall be implemented according to Circular No. 07/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of hazardous and dangerous allowances for officials, civil servants, and employees.

Article 3. This Decision shall take effect fifteen days after its publication in the Official Gazette. Officials and civil servants in the Ministry of Labor, Invalids, and Social Affairs currently receiving hazardous and dangerous allowances according to Circular No. 6608/BYT-TCCB dated August 22, 2005 of the Ministry of Health guiding the implementation of hazardous and dangerous allowances for officials and civil servants in the health sector shall uniformly switch to implementing this Decision.

Article 4. The Minister, Heads of Ministries equivalent to Ministries having public service units within the field of Labor, Invalids, and Social Affairs; Ministers of related Ministries; Chairpersons of People's Committees of provinces and centrally-administered cities; Heads of public service units under the Ministry of Labor, Invalids, and Social Affairs are responsible for enforcing this Decision./.
