CIRCULAR

Regarding the amendment and supplementation of certain provisions on the procedures and processes for animal quarantine and animal products; veterinary hygiene inspection issued together with Decision No. 15/2006/QĐ-BNN dated March 8, 2006 of the Ministry of Agriculture and Rural Development

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Veterinary Law on April 29, 2004; Pursuant to Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Veterinary Law;

Pursuant to Decree No. 119/2008/NĐ-CP dated November 28, 2008 of the Government amending and supplementing certain Articles of Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Veterinary Law;

The Ministry of Agriculture and Rural Development guides the amendment and supplementation of certain provisions on the procedures and processes for animal quarantine and animal products; veterinary hygiene inspection issued together with Decision No. 15/2006/QĐ-BNN dated March 8, 2006 of the Ministry of Agriculture and Rural Development as follows:

1. Clause 4 shall be amended and supplemented as follows:

"Article 4. Animal Quarantine for Transport within a Province

1. Organizations and individuals (hereinafter referred to as the consignor) when transporting a large number of animals out of a district within the province must register for quarantine with the District Veterinary Station under the province or centrally governed city (hereinafter referred to as the District Veterinary Station) as follows:

Declare at least two days in advance if the animals have been subject to mandatory disease prevention measures as prescribed and are still immune; declare at least from fifteen to thirty days in advance if the animals have not been subject to mandatory disease prevention measures as prescribed or are not immune.

2. The registration dossier includes:

a) A quarantine registration form for animal transport according to the prescribed model;

b) A copy of the certificate of disease-free zone or disease-safe premises where the animals originate (if available);

c) A copy of the vaccination certificate and test result report for animal diseases (if available).

3. Pre-inspection before moving the animals to the quarantine isolation area:

a) Check the contents of the registration and related documents as stipulated in Clause 2 of this Article;

b) Based on the disease situation, vaccination results, and test results for animal diseases at the place of origin, the animal quarantine authority prepares conditions for quarantine;

c) Within one working day from receiving a valid quarantine registration dossier, the animal quarantine authority is responsible for confirming the quarantine registration and notifying the location, time, and content of the quarantine process;

d) Inspect compliance with veterinary hygiene conditions for the quarantine isolation area;

đ) Guide the consignor to move the animals to the quarantine isolation area and conduct quarantine immediately on the day the animals are gathered at the quarantine isolation area.

4. Post-inspection after moving the animals to the quarantine isolation area:

a) Verify the quantity and type of animals according to the quarantine registration dossier;

b) Conduct clinical examination and separate weak animals or those showing symptoms of infectious diseases or suspected of being infected;

c) Collect samples for testing diseases as prescribed before transporting animals (for breeding animals or milk-producing animals); diseases as requested by the consignor (if any);

d) Administer vaccinations or apply other preventive measures for diseases listed in the Compulsory Vaccination List for Transported Animals (except for animals intended for slaughter) if the animals do not have a valid vaccination certificate or if the vaccination certificate is invalid; diseases as requested by the consignor (if any);

đ) For animals originating from disease-free zones or premises, there is no need for testing or applying preventive measures for diseases recognized as safe;

e) Eradicate parasites;

f) Mark animals that meet veterinary hygiene standards according to regulations.

5. After completing the quarantine, if the animals meet veterinary hygiene standards, have been vaccinated or had other preventive measures applied and are immune, the animal quarantine officer shall perform the following:

a) Issue a quarantine certificate for animals meeting veterinary hygiene standards within twenty-four hours before transportation. The quarantine dossier provided to the consignor includes: The quarantine certificate; a list of animal identification codes according to regulations;

b) Inspect the veterinary hygiene conditions of the transport vehicle and accompanying equipment;

c) Carry out or supervise the cleaning, disinfection, and decontamination of the transport vehicle and accompanying equipment at least six hours before loading for transportation;

d) On the day of loading, the animal quarantine officer shall perform: Clinical examination of the animals; monitor the loading process onto the transport vehicle; seal the transport vehicle and containers (for animals not marked); guide the consignor to clean, disinfect, and decontaminate the quarantine isolation area and loading site.

6. In cases where the animals do not meet veterinary hygiene requirements, the animal quarantine authority will not issue a quarantine certificate and will handle the situation according to regulations."

a) A customs declaration form for imported goods according to the information criteria specified in Model No. 01 - Declaration Form for Imported Goods attached as Appendix I to Circular No. 39/2018/TT-BTC dated April 20, 2018, issued by the Minister of Finance.

"Article 5. Quarantine of Animal Products for Transport within a Province

1. The consignor when transporting a large volume of animal products out of a district within the province must register for quarantine with the District Veterinary Station as follows:

Declare at least two days in advance before transportation if the animal products have been tested for veterinary hygiene indicators or sent via postal service; seven days if the animal products have not been tested for veterinary hygiene indicators.

2. The registration dossier includes:

a) A quarantine registration form for animal product transport according to the prescribed model;

b) A copy of the test result report for veterinary hygiene indicators of animal products (if available);

c) Other relevant documents (if available).

3. Pre-inspection before moving the animal products to the quarantine isolation area:

a) Check the contents of the quarantine registration and related documents as stipulated in Clause 2 of this Article;

b) Based on the disease situation at the place of origin and the test results for veterinary hygiene indicators, the animal quarantine authority prepares conditions for quarantine;

c) Within one working day from receiving a valid quarantine registration dossier, the animal quarantine authority is responsible for confirming the quarantine registration and notifying the location, time, and content of the quarantine process;

d) Inspect compliance with the regulations on veterinary hygiene conditions for quarantine zones;

đ) Guide the consignor to deliver animal products to the quarantine zone and must conduct quarantine immediately on the day the animal products are concentrated at the designated location.

4. Post-delivery inspection after animal products are brought to the quarantine zone:

a) Verify the quantity and type of animal products according to the consignor's registration documents;

b) Inspect the packaging, storage condition of the products, and perform sensory inspections on the animal products; check the slaughter control stamp and veterinary hygiene test label for fresh slaughtered products;

c) Take samples for testing of veterinary hygiene indicators for animal products that have not been tested according to regulations or do not have a slaughter control stamp or veterinary hygiene test label; as requested by the consignor (if applicable);

d) Decontaminate the consignment according to regulations;

đ) Mark and seal the packaging containing animal products that meet veterinary hygiene standards.

5. After completing the quarantine, if the animal products meet veterinary hygiene standards, the animal quarantine officer shall implement:

a) Issue a quarantine certificate for animal products meeting veterinary hygiene standards within 24 hours before transportation;

b) As stipulated in point b, c Clause 5 Article 4 of this Regulation;

c) On the day of loading, the animal quarantine officer shall carry out: Inspection and supervision of the loading process of animal products onto transport vehicles; sealing the transport vehicle; implementing or supervising the cleaning, decontamination of the quarantine zone and loading area.

6. In case the animal products do not meet veterinary hygiene requirements, the animal quarantine authority will not issue a quarantine certificate and proceed with handling according to regulations.”

3. Article 6 shall be amended and supplemented as follows:

“Article 6. Quarantine of Animals Transported Out of Province

1. When transporting a large number of animals out of province, the consignor must register for quarantine with the Animal Health Sub-Department and conduct quarantine according to Clause 1, 2, 3 Article 4 Section 1 of this Circular;

2. Post-delivery inspection after bringing animals to the quarantine zone:

a) As stipulated in points a, b, đ, e, f Clause 4, Clause 6 Article 4 Section 1 of this Circular;

b) Take samples for testing diseases before transporting animals if the animals have not been tested according to regulations; diseases as required by the consignor (if applicable);

c) Administer vaccines or apply other disease prevention measures: Diseases listed in the mandatory vaccination list when transporting animals if the animals do not have a valid vaccination certificate; diseases as required by the consignor (if applicable).

3. After completing the quarantine, the animal quarantine officer shall implement according to Clause 5, 6 Article 4 Section 1 of this Circular.”

4. Article 7 shall be amended and supplemented as follows:

“Article 7. Quarantine of Animal Products Transported Out of Province

1. Organizations and individuals transporting large quantities of animal products out of province must register for quarantine with the Animal Health Sub-Department and conduct quarantine according to Clause 1, 2, 3 Article 5 Section 2 of this Circular;

2. Post-delivery inspection after bringing animal products to the quarantine zone:

a) As stipulated in points a, b, d, đ Clause 4 Article 5 Section 2 of this Circular;

b) Take samples for testing veterinary hygiene indicators for animal products that have not undergone testing according to regulations; veterinary hygiene indicators as required by the consignor (if applicable).

3. After completing the quarantine, the animal quarantine officer shall implement according to Clause 5, 6 Article 4 Section 2 of this Circular.”

5. Article 10 is amended and supplemented as follows:

“Article 10. Quarantine of Exported Animals

1. When exporting animals, the consignor must register for quarantine with the competent animal quarantine authority according to Clause 1 Article 4 Section 1 of this Circular;

2. The registration dossier includes:

a) As stipulated in Clause 2, Article 4 Section 1 of this Circular;

b) A copy of the consignor’s or importing country’s veterinary hygiene requirements for exported animals (if applicable);

c) A copy of the purchase and sale contract (if applicable);

d) Other relevant documents (if applicable).

3. Pre-inspection before moving the animals to the quarantine isolation area:

a) Inspect the quarantine registration content and related documents in Clause 2 of this Article;

b) Based on the consignor’s or importing country’s veterinary hygiene requirements for exported animals; disease situation, vaccination results, and disease testing results of the animals at the place of origin, the animal quarantine authority prepares the necessary conditions for quarantine;

c) Within one working day from receiving a valid quarantine registration application, the animal quarantine authority is responsible for registering in the quarantine register and notifying the time, location, and content of the quarantine;

d) Implement according to point d, đ Clause 3 Article 4 Section 1 of this Circular.

4. Post-inspection after moving the animals to the quarantine isolation area:

a) As stipulated in points a, b, e, f Clause 4 Article 4 Section 1 of this Circular;

b) Take samples for testing; administer vaccines or apply other disease prevention measures as stipulated in point b, c Clause 2 Article 6 Section 3 of this Circular and other diseases as required by the consignor or importing country.

5. After inspection, the animal quarantine officer shall implement according to Clause 5, 6 Article 4 Section 1 of this Circular;

6. If the consignor or importing country does not require export quarantine, the animal quarantine authority shall conduct quarantine according to Article 4 or Article 6 Section 3 of this Circular depending on the place of origin of the animals.”

6. Article 11 shall be amended and supplemented as follows:

“Article 11. Quarantine of Exported Animal Products

1. When exporting animal products, the consignor must register for quarantine with the animal quarantine authority according to Clause 1 Article 10 Section 5 of this Circular;

2. The registration dossier includes:

a) As stipulated in Clause 2 Article 5 Section 2; point c, d Clause 2 Article 10 Section 5 of this Circular;

b) A copy of the consignor’s or importing country’s veterinary hygiene requirements for exported animal products (if applicable).

3. Pre-inspection before moving the animal products to the quarantine isolation area:

a) Inspect the registration content and related documents in Clause 2 of this Article;

b) Based on the veterinary hygiene requirements for exported animal products of the consignor or exporting country, and the results of veterinary hygiene indicator tests, the animal quarantine authority prepares the necessary conditions for quarantine.

c) Within one working day from the time of receiving a valid quarantine registration file, the animal quarantine agency shall record the quarantine registration and notify the location, time, and content of the quarantine process.

d/ As stipulated in point d, đ Clause 3, Article 5, Section 2 of this Circular.

4. Post-delivery inspection after animal products are brought to the quarantine zone:

a) As stipulated in points a, b, d, e, f Clause 4, Article 5, Section 2 of this Circular;

b) Take samples for testing veterinary hygiene indicators as required by the consignor or exporting country.

5. After inspection, the animal quarantine officer shall act in accordance with the provisions of Clause 5, 6, Article 5, Section 2 of this Circular.

6. In cases where the consignor or importing country does not request export quarantine, the animal quarantine agency shall conduct quarantine in accordance with the provisions of Article 5, Section 2 or Article 7, Section 4 of this Circular depending on the place of origin of the animal products.

7. Article 13 is amended and supplemented as follows:

"Article 13. Quarantine of Animals and Animal Products Exported via Postal Service

1. When exporting animals and animal products via Postal Service, the consignor must register for quarantine with the animal quarantine agency under the Department of Animal Health in accordance with the provisions of Clause 1, 2, Article 10, Section 5 for animals, and Clause 1, 2, Article

11, Section 6 for animal products of this Circular;

2. The contents of quarantine shall be carried out as follows:

a) For animals: Clinical examination; checking the health monitoring book of the animal (if available); conducting tests and vaccinating against diseases as required by the consignor or importing country;

b) For animal products: Sensory examination; conducting tests for veterinary hygiene indicators as required by the consignor or importing country;

c) Guide the consignor to implement the detention and packaging of animals and animal products according to regulations, sealing or marking the shipment, and issuing a quarantine certificate for animals and animal products that meet veterinary hygiene standards, are detained and packaged in accordance with the regulations;

d) Guide the consignor to handle animals and animal products that do not meet veterinary hygiene standards for export.

3. In cases where the consignor or importing country does not request export quarantine, depending on the quantity of animals and the volume of animal products and their place of origin, the animal quarantine agency shall carry out quarantine in accordance with the regulations.

4. Prohibition of export via postal service:

a) Animals and animal products listed in the prohibited export list;

b) Fresh or minimally processed animal products."

8. Article 14 is amended and supplemented as follows:

"Article 14. Registration for Import Quarantine of Animals and Animal Products

1. Consignors who wish to import animals and animal products listed in the quarantine-required animal and animal product list or exotic animals and animal products not yet present in Vietnam shall submit an import quarantine registration file to the Department of Animal Health. The registration file includes:

a) An import quarantine registration form as prescribed;

b) A certified copy of the business registration certificate (for domestic enterprises), or investment permit (for 100 percent foreign-owned or joint venture enterprises);

c) Permission from the relevant management authority as prescribed;

d) Documents related to the import quarantine of animals and animal products;

Within five working days from the date of receipt of a valid file, based on the animal disease situation in the exporting country and the domestic animal disease situation, if the file is valid, the Department of Animal Health shall be responsible for informing the consignor about the animal quarantine agency to perform the quarantine, and simultaneously sending it to the relevant animal quarantine agencies for coordinated implementation of the quarantine.

2. After being informed by the Department of Animal Health regarding the import quarantine, the consignor shall register for quarantine with the animal quarantine agency designated by the Department of Animal Health at least eight days before the goods arrive at the border gate; two days before the goods arrive at the post office.

The import quarantine registration file includes:

a) An import quarantine registration form as prescribed;

b) A reply document from the Department of Animal Health regarding the import quarantine of animals and animal products;

c) A certified copy of the quarantine certificate from the exporting country (if available);

d) Other relevant documents (if applicable).

3. Within one working day from the date of receipt of a valid quarantine registration file, the animal quarantine agency shall notify the consignor of the location, time, and content of the quarantine; inspecting the veterinary hygiene isolation area for the consignment brought to the quarantine isolation area for quarantine."

9. Clause 1, 2, Article 18 shall be amended and supplemented as follows:

"Article 18. Quarantine of Animals and Animal Products Imported via Postal Service

1. The consignor shall submit an import quarantine registration file to the Department of Animal Health in accordance with the provisions of Clause 1, 2, Article 14, Section 8 of this Circular;

2. Within one working day from the date of receipt of a valid file, the animal quarantine agency shall record the quarantine registration and notify the consignor of the location, time, and content of the quarantine process."

10. Article 20 is amended and supplemented as follows:

"Article 20. Registration for Temporary Import Re-export, Transfer of Customs Ports, and Transit through Vietnamese Territory of Animals and Animal Products

1. Consignors who wish to temporarily import re-export, transfer customs ports, or transit through Vietnamese territory of animals and animal products shall submit a quarantine registration file to the Department of Animal Health. The quarantine registration shall be carried out in accordance with the provisions of Clause 1, Article 14, Section 8 of this Circular;

2. After being informed by the Department of Animal Health regarding the import quarantine, the consignor shall register for quarantine with the animal quarantine agency designated by the Department of Animal Health at least four days before the goods arrive at the border gate;

The quarantine registration file includes:

a) A quarantine registration form as prescribed;

b) A reply document from the Department of Animal Health regarding the quarantine of temporarily imported re-exported, transferred customs ports, and transited through Vietnamese territory animals and animal products;

c) A certified copy of the quarantine certificate from the exporting country (if available);

d) Other related documents (if any);

Within one working day from the date of receipt of a valid quarantine file, the animal quarantine agency shall notify the consignor of the location, time, and content of the quarantine process."

11. Effective Date:

This Circular shall take effect 45 days from the date of signature./.
