Issued Article 24Prescribing the retention period for records and specialized documents
related to natural resources and environment natural resources and environmentg
Pursuant to the Law on Archives dated November 11, 2011;
Pursuant to Decree No. 01/2013/NĐ-CP dated January 3, 2013 of the Government detailing the implementation of certain provisions of the Law on Archives;
Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to the Government Decree No. 102/2008/NĐ-CP, September 15, 2008, on the collection, management, exploitation, and utilization of data on natural resources and the environment;
Pursuant to Circular No. 09/2011/TT-BNV dated June 3, 2011 of the Ministry of Home Affairs prescribing the retention period for records and documents commonly formed in the activities of agencies and organizations;
At the proposal of the Director of the Department of Information Technology and the Head of the Legal Department;
The Minister of Natural Resources and Environment issues this Circular prescribing the retention period for specialized records and documents related to natural resources and environment.
Article 1. Scope of Regulation and Applicability
Article 1. This Circular prescribes the retention period for groups of specialized records and documents related to natural resources and environment formed during the operation of agencies and organizations within the fields of natural resources and environment (hereinafter referred to as records and documents).
Article 2. This Circular applies to agencies and organizations under the natural resources and environment sector, including units under the Ministry of Natural Resources and Environment; Provincial Departments of Natural Resources and Environment under centrally governed cities and provinces; District Natural Resources and Environment Offices; environmental and natural resources management units at commune level; agencies and organizations under other ministries and sectors but with the responsibility to retain and archive specialized natural resources and environment records and documents (hereinafter referred to as units).
Article 2. Interpretation of Terms
Point 1. Clause 1. "Specialized records related to natural resources and environment" refers to a set of interrelated documents concerning a specific issue, event, or object, or having common characteristics such as the type of document name; issuing agency or organization; time or other features, formed during the operation of agencies and organizations performing tasks in the field of natural resources and environment.
Point 2. Clause 2. "Specialized documents related to natural resources and environment" refers to information carriers formed during the operation of agencies and organizations performing tasks in the field of natural resources and environment. Documents include: statistical data, summaries, reports; investigation, survey, evaluation results; approved plans and programs; results of issuance, extension, revocation of various permits and related contents; compensation damage resolution results; program and project outcomes; specimens, maps, charts, films, photographs, drawings, and other information carriers; national reference systems; basic survey point systems, dedicated basic survey points; geographic information systems.
Point 3. Clause 3. "Documents to be permanently retained" refer to documents that have significance and utility value independent of time.
Point 4. Clause 4. "Documents to be retained for a limited period" refer to documents not falling under the circumstances prescribed in Clause 3 of this Article and are determined to have a retention period of less than 70 years.
Article 3. Records and documents requiring retention
Clause 1. Records and documents requiring retention are original or primary copies organized or hosted by the unit, or by the unit responsible for retention and archiving. In cases where the original or primary copy is no longer available, they may be replaced by a legally certified copy.
Clause 2. Records and documents in a particular field shall be retained according to the retention period applicable to that field.
Clause 3. Records and documents must be classified and arranged in accordance with regulations.
Clause 4. Records and documents requiring retention are divided into two main categories as follows:
Subpoint a. Permanently retained records and documents.
Subpoint b. Records and documents retained for a limited period.
Clause 5. Documents that have lost their value and need to be removed and destroyed are those containing duplicate information or have exceeded the retention period as prescribed and are no longer necessary for practical operations, scientific research, or historical purposes.
Clause 6. Records and documents concerning various fields of natural resources and environment that are not subject to destruction and are to be permanently retained and not listed in the retention period regulations accompanying this Circular include the following records and documents:
Subpoint a. Records and documents with historical significance collected before 1945 in the northern region and before 1975 in the southern region;
Subpoint b. Records and documents collected at any time relating to the protection of Vietnam's national sovereignty along its borders with neighboring countries and on islands under Vietnam's sovereignty.
Article 4. Preservation Period for Records and Documents
1. The preservation period for records and documents is the necessary time to store records and documents from the date the work ends, or from the date the project is settled.
2. The preservation period for records and documents formed in activities related to natural resources and the environment of units is specified as follows:
a) Permanent preservation period: Is the duration of existence of records and documents until they self-destruct and cannot be restored.
b) Limited preservation period: Is the determined duration of existence of records and documents according to regulations.
Article 5. Regulations on Preservation Period for Records and Documents
Regulations on the preservation period for specialized records and documents related to natural resources and the environment formed during the operation of units apply to the following groups of records and documents:
Group 1. Records and documents relating to land management.
Group 2. Records and documents relating to water resources.
Group 3. Records and documents relating to geology and minerals.
Group 4. Records and documents relating to the environment.
Group 5. Records and documents relating to meteorology, hydrology, and climate change.
Group 6. Records and documents relating to surveying, mapping, and remote sensing.
Group 7. Records and documents relating to the sea and islands.
Article 6. Application of Preservation Period for Specialized Records and Documents Related to Natural Resources and the Environment
1. The preservation period for specialized records and documents related to natural resources and the environment is used to determine the preservation period for specialized records and documents in the fields managed by the Ministry of Natural Resources and Environment.
2. Units base this Circular to classify records and documents according to the record and document catalog and apply the preservation period for each record and document as prescribed. In cases where some records and documents have not been specified with a preservation period for specialized records and documents related to natural resources and the environment, units shall apply the preservation period for equivalent records and documents, while compiling a list to report to the Ministry of Natural Resources and Environment through the Information Technology Department for supplementation.
3. For records and documents that have exceeded their preservation period, the Record Value Determination Council of the unit shall examine and evaluate to destroy them according to regulations, if necessary, the preservation period may be extended.
Article 7. Implementation Provisions
This Circular takes effect from July 15, 2013.
Article 8. Implementation organization
Units with functions and tasks of managing and storing specialized records and documents related to natural resources and the environment shall organize the completion, classification, and arrangement of specialized records and documents in accordance with this Circular to meet requirements for preservation, storage, exploitation, and effective and economical use.
Heads of subordinate units under the Ministry, Directors of Provincial Departments of Natural Resources and Environment, and relevant units are responsible for implementing this Circular./.
