On the basis of Civil Servants Law dated November 13, 2008;
Pursuant to Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government stipulating recruitment, utilization and management of civil servants;
Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Considering the proposal of the Director of the Civil Servant - Public Official Department;
||| The Minister of Home Affairs issues a Circular to specify titles, grade codes, responsibilities, tasks, and professional standards for specialized civil servants in the administrative sector as follows.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
||| This Circular specifies titles, grade codes, responsibilities, tasks, and professional standards for specialized civil servants in the administrative sector.
Article 2. Applicability
||| This Circular applies to cadres and civil servants in the administrative sector working in Party organizations, state agencies, and political-social organizations at central, provincial, district levels, and public institutions (hereinafter referred to as administrative agencies and organizations).

Article 4. General Standards on Moral Qualities
||| a) Possessing firm political conviction, steadfast in Marxism-Leninism and Ho Chi Minh Thought, thoroughly understanding the Party's policies and guidelines; loyal to the country and the Constitution of the Socialist Republic of Vietnam; protecting national interests and the people's benefits;
||| b) Fulfilling all duties of a civil servant as prescribed by law; strictly adhering to assigned tasks by superiors; abiding by laws, maintaining discipline and order; setting a good example by following internal regulations and rules of the agency;
c) Devoted, responsible, honest, truthful, impartial, and exemplary in performing public duties; courteous, cultured, and proper in communication and service to the people;
||| d) Living a healthy lifestyle, being modest, united; practicing thrift, honesty, integrity, and impartiality; not using public affairs for personal gain; avoiding bureaucracy, corruption, waste, and negativity;
e) Continuously have a sense of learning and training to improve moral qualities, competence, and capabilities.
Chapter II
DUTIES, TASKS AND PROFESSIONAL STANDARDS
||| SPECIALIZATION OF ADMINISTRATIVE CIVIL SERVANT GRADES
||| Article 5. Senior Specialist Grade
1. Responsibilities
||| This is the highest level of administrative civil servant with high professional requirements in one or more fields within administrative agencies and organizations at provincial level or higher, responsible for leading the formulation, synthesis, and planning of macro policies and strategies according to industry or region; organizing and implementing management systems and policies.
2. Tasks
||| a) Leading the development and improvement of institutional frameworks or legal documents, economic and social policies, strategic projects, programs, and plans of significant political, economic, security, defense, cultural, and social importance at the national level, or comprehensive socio-economic plans at the provincial level;
||| b) Organizing and directing the implementation, guidance, and inspection of professional management systems and proposing effective measures and solutions; directly executing specific tasks when assigned by superiors in special cases;
c) Organize summaries, evaluations, and propose amendments to enhance the effectiveness of management work;
||| d) Leading research on topics, projects, and scientific studies at the ministry or provincial level to innovate and improve management mechanisms, enhance the effectiveness of operations of agencies and organizations, serving the implementation of the Party's policies and state laws;
||| đ) Leading the compilation and construction of professional guidance materials for the industry or field; organizing specialized training, vocational training, or dissemination of knowledge and experience in the industry or field;
3. Professional Qualification Standards
||| a) Profoundly understanding the Party's policies and guidelines, the direction of development, strategies, and policies of the industry or field;
||| b) Proficient in the system of administrative management knowledge, management of the industry or field, and legal provisions regarding the civil service system;
||| c) Understanding the situation and trends in the development of the industry or field both domestically and internationally; organizing research to serve management and information processing;
||| d) Having the ability to propose, advise on policy formulation, lead the drafting of legislative projects, ordinances, proposals, programs related to professional work in the industry or field to be submitted to competent authorities for consideration and decision;
||| đ) Mastering and controlling skills in drafting, presenting, defending, and organizing the implementation of projects, proposals, and programs related to state administration;
||| e) Having the ability to analyze, synthesize, systematize, and propose methods to perfect or resolve practical issues within the scope of management according to the industry or field or region;
||| g) Having the ability to organize and direct the application of scientific and technological progress to improve and enhance the quality and efficiency of work in the industry or field or region;
||| h) For civil servants applying for promotion to the Senior Specialist grade, they must have led the drafting and submission for approval of at least two legal documents or have led the research and construction of at least two scientific projects or programs at the ministry or industry level that were successfully reviewed, or have led the construction of at least two specialized or comprehensive economic, cultural, or social projects or programs at the provincial level that were evaluated as successful;
||| i) Having experience in the administrative or civil service sector or in leadership and management activities. Civil servants applying for promotion to the Senior Specialist grade must have held the Principal Specialist grade or equivalent for at least five years (60 months), including at least two years (24 months) in the Principal Specialist grade;
4. Educational and Training Standards
d) To have computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Minister of Information and Communications on the Standard for Information Technology Usage or equivalent or higher.
||| b) Holding a degree in Advanced Political Theory;
||| c) Holding a certificate in advanced civil service management training for the Senior Specialist grade;
||| d) Holding a language proficiency certificate at the equivalent of Level 4 of the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the Vietnamese Foreign Language Competency Framework of six levels;
||| đ) Holding a computer proficiency certificate meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Ministry of Information and Communications on the Standard for Information Technology Usage Skills.
Article 6. Senior Specialist Rank
1. Responsibilities
Is an administrative civil servant with high professional requirements in one or several fields within administrative agencies and organizations at the district level or higher, responsible for performing complex tasks within the agency or unit; advising on, compiling, and organizing the implementation of policies and regulations according to the sector, field, or locality.
2. Tasks
a) Leading or participating in researching, drafting, and implementing strategies, systems, and policies; perfecting institutional mechanisms for state management in the professional field nationwide or at the provincial or district level;
b) Leading the research and drafting of management regulations for the sector, field, or locality;
c) Organizing, guiding, monitoring, and inspecting the implementation of professional systems and policies; proposing measures to enhance the effectiveness of sectoral or local management;
d) Leading or participating in organizing the implementation of professional activities; drafting reports and statistics, managing archival files, performing procedural tasks; summarizing, evaluating, and perfecting management mechanisms and policies;
đ) Lead in researching topics and projects on professional management, improving content, and enhancing the effectiveness of management methods;
e) Directly perform public duties and other tasks assigned by superiors.
3. Professional Qualification Standards
a) Proficient in the Party's guidelines and State laws; the political system, organizational structure of state agencies, civil service systems, and professional knowledge and skills in the managed sector or field;
b) Leading the development and perfection of institutions; drafting guiding legal documents; developing projects and programs; assessing economic and social impacts of policies to be issued;
c) Skilled in drafting administrative documents according to format, procedures, and authority; presenting and defending proposals; effectively managing assigned tasks;
d) Organizing the implementation of systems, policies, and management regulations in the sector, field, or locality; implementing and proposing inspection and evaluation measures;
e) Organizing coordination, inspections, and summaries of policy enforcement in the sector, field, or locality;
f) Understanding the situation and trends in the domestic and international sectors or fields of work; organizing research to serve management and processing management information;
g) For civil servants applying for promotion to the Senior Specialist rank, they must have led the drafting of at least one legal document or led the research and drafting of at least one scientific project, program, or topic at the ministry, sector, provincial, or district level, which has been approved and evaluated as satisfactory by the competent authority;
h) Having experience in the administrative, civil service field, or leadership and management activities. Civil servants applying for promotion to the Senior Specialist rank must have held the Specialist rank or equivalent for at least five years (60 months), including at least three years (36 months) as a Specialist;
4. Educational and Training Standards
d) To have computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Minister of Information and Communications on the Standard for Information Technology Usage or equivalent or higher.
b) Holding a training certificate in national administration management at the Senior Specialist rank;
c) Holding a foreign language certificate at level 3 of the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training, or holding a certificate in a native language for positions requiring the use of a native language;
d) Holding an information technology certificate meeting the basic standard for using information technology as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the Standard for Using Information Technology.
Article 7. Clerk Rank
1. Responsibilities
Is an administrative civil servant with basic professional requirements in one or several fields in administrative agencies and organizations at district level or higher, responsible for advising, compiling, and implementing systems and policies according to the sector, field, or locality.
2. Tasks
a) Develop plans, master plans, specific regulations to implement state management tasks within the sector or field; participate in building mechanisms and specific decisions for each management content as prescribed by law, suitable to actual conditions;
b) Study and resolve issues within authority or advise on matters to be decided by competent authorities; coordinate with colleagues to perform related tasks;
c) Guide, monitor, urge, inspect, and propose measures to ensure the implementation of management regulations or decisions achieves results;
d) Participate in inspections, collect information, statistics, manage files, archive data and figures to serve strict, accurate, and principled state management work;
đ) Proactively coordinate with related units and cooperate with other civil servants to carry out tasks, act within authorized powers and responsibilities;
e) Summarize situations, conduct analysis and evaluation of work effectiveness, and report to superiors;
g) Collect public opinions on issues related to the assigned field to study and propose to superiors. Directly execute official duties, tasks, and perform other tasks assigned by superiors.
3. Professional Qualification Standards
a) Master legal provisions, system of policies of the sector or field, and basic knowledge about the assigned professional field;
b) Understand clear objectives and subjects of management, the system of principles and mechanisms of the assigned professional field; understand basic issues about psychological science, management science; scientific management organization;
c) Clearly understand the process of developing plans, decisions, and have knowledge about the assigned sector or field; have skills in drafting documents and presenting assigned research and advisory issues;
d) Have methods of research, summarization, and proposal, improvement of management practices; have ability to work independently or in groups; have ability to implement tasks ensuring progress, quality, and effectiveness;
đ) Understand practical, socio-economic aspects of management in the assigned field; grasp development trends of the sector or field domestically;
e) Civil servants who take the examination to upgrade to the Clerk rank must have held the Cadre Trainee rank or equivalent for a minimum of three years (36 months). In case they hold the Staff rank, they must have held the Staff rank or equivalent for a minimum of five years (60 months).
4. Educational and Training Standards
d) To have computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Minister of Information and Communications on the Standard for Information Technology Usage or equivalent or higher.
b) Hold a certificate of training in state management for the Clerk rank;
c) Hold a foreign language certificate at level 2 equivalent to the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training, or hold a certificate in ethnic languages for positions requiring the use of ethnic languages;
d) Holding an information technology certificate meeting the basic standard for using information technology as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the Standard for Using Information Technology.
Article 8. Cadre Trainee Rank
1. Responsibilities
Is an administrative civil servant performing technical vocational tasks in administrative agencies and organizations, responsible for assisting leadership, management, or supporting and serving civil servants at higher ranks and carrying out statistical, compilation, and reporting tasks as assigned by superiors.
2. Tasks
a) Participate, support, and serve the implementation of official activities and tasks, including specific tasks such as developing and implementing plans and operational schemes based on management regulations and rules of the sector, field, or locality;
b) Carry out assigned tasks; analyze, evaluate effectiveness, and report promptly according to management requirements and goals;
c) Identify and propose solutions to timely adjust deficiencies in the execution of official duties by management objects, ensuring the implementation of systems and policies, management decisions are strictly enforced, closely monitored, and effective;
d) Participate in establishing and implementing file management systems, organizing the archiving of documents and data accurately and completely as required by tasks.
3. Professional Qualification Standards
a) Understand principles, systems, procedures, and vocational guidance, management objectives of the sector or field; direct leadership policies;
b) Be familiar with principles, procedures, and administrative vocational processes of the state machinery;
c) Understand the nature and characteristics of management object activities and management practices;
d) Draft vocational guidance documents and participate in their implementation according to superior directives;
đ) Know how to use office equipment and other devices;
e) Civil servants taking the examination to upgrade to the Cadre Trainee rank must have held the Staff rank or equivalent for a minimum of three years (36 months).
4. Educational and Training Standards
a) Hold a diploma from a college or higher education institution in a relevant major suitable for job requirements;
b) Hold a certificate of training in state management for the Cadre Trainee rank;
c) Hold a foreign language certificate at level 1 equivalent to the Vietnamese Foreign Language Competency Framework as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training;
d) Holding an information technology certificate meeting the basic standard for using information technology as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications regarding the Standard for Using Information Technology.
Article 9. Staff Rank
1. Responsibilities
Is the administrative civil servant rank performing enforcement and execution tasks in administrative agencies and organizations at the district level and above, responsible for serving the activities of such agencies and organizations.
2. Tasks
a) Assigned to handle specific tasks such as photocopying, reproducing documents and materials; receiving, registering, and transferring incoming and outgoing documents according to the agency's regulations.
b) Checking the format of documents and reporting back to direct leadership on documents with incorrect formats.
c) Strictly implementing confidentiality rules related to document work within the agency or organization.
d) Performing other service tasks such as security, driving, service, reception, technical work, and other tasks assigned by superiors.
3. Professional Qualification Standards
a) Understanding the organizational structure, functions, and responsibilities of the agency and its subordinate units.
b) Having knowledge of simple document-related business operations or other required business operations based on job position requirements; properly executing regulations on receipt and transfer of documents and materials.
c) Mastering confidentiality rules relevant to document work within the agency.
d) Proficiently using equipment and techniques for printing and copying documents and office devices.
4. Educational and Training Standards
a) Graduated from a vocational college or higher with a major suitable for the job position requirements. Except for drivers who must have a valid license issued by the competent authority.
b) Holding certificates for training in relevant business operations if the job position or task requires it.
Chapter III
IMPLEMENTING PROVISIONS
Article 10. Implementation Organization
Ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees under the central government, and related agencies shall base their recruitment, utilization, and management of administrative civil servants on the provisions of this Circular.
Article 11. Effective Date
1. This Circular takes effect from December 1, 2014.
2. Repeal Decision No. 414/TCCP-VC dated May 29, 1993, of the Government Organizational and Cadre Affairs Board (now the Ministry of Home Affairs) regarding the issuance of business standards for administrative civil servant ranks.
3. Repeal the ranks and rank codes specified in Decision No. 78/2004/QĐ-BNV dated November 3, 2004, of the Ministry of Home Affairs concerning the issuance of the list of civil servant ranks and staff ranks, specifically as follows:
a) Typing Technician (rank code 01.005)
b) Typing Clerk (rank code 01.006)
c) Technical Clerk (rank code 01.007)
d) Document Clerk (rank code 01.008)
đ) Service Clerk (rank code 01.009)
e) Official Driver (rank code 01.010)
g) Security Guard (rank code 01.011).
Civil servants currently holding the ranks mentioned in Clause 3 of this Article shall be transferred to the Staff Rank (rank code 01.005) as stipulated in Article 9 of this Circular.
Article 12. Responsibility for Implementation
1. Ministers, heads of ministerial-level agencies, government-affiliated agencies, Chairpersons of provincial People's Committees under the central government, and related agencies and individuals shall be responsible for implementing the provisions of this Circular.
2. Any difficulties encountered during implementation should be reported to the Ministry of Home Affairs for guidance or consideration and resolution.
