Regulations on the Aggregate Statistical Reporting System for Labor, Invalids, and Social Affairs

Pursuant to the Statistics Law No. 04/2003/QH11 dated June 17, 2003;
Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;
Pursuant to the Decree No. 40/2004/NĐ-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Law on Statistics;
Pursuant to Decision No. 43/2010/QĐ-TTg dated June 2, 2010 of the Prime Minister promulgating the National Statistical Indicators System;
Pursuant to Decision No. 56/2011/QĐ-TTg dated October 14, 2011 of the Prime Minister promulgating the National Gender Development Indicators;
Pursuant to Decision No. 15/2014/QĐ-TTg dated February 17, 2014 of the Prime Minister promulgating the Reporting System for Comprehensive Statistics applicable to Ministries and Sectors;
To implement Circular No. 30/2011/TT-LDTBXH dated October 24, 2011 issued by the Minister of Labor, Invalids, and Social Affairs on the system of statistical indicators for the Labor, Invalids, and Social Affairs sector;
At the proposal of the Director of the Department of Planning and Finance;
The Minister of Labor, Invalids, and Social Affairs hereby promulgates this Circular stipulating the Aggregate Statistical Reporting System for Labor, Invalids, and Social Affairs.
Article 1. The Aggregate Statistical Reporting System for Labor, Invalids, and Social Affairs
The Aggregate Statistical Reporting System for Labor, Invalids, and Social Affairs consists of a set of forms, information contents, and instructions for filling out the forms detailed in the Appendix attached hereto.
Article 2. Subjects Implementing the Aggregate Statistical Reporting on Labor, Invalids, and Social Affairs
The subjects implementing the Aggregate Statistical Reporting on Labor, Invalids, and Social Affairs (hereinafter referred to as reporting units) are the Departments of Labor, Invalids, and Social Affairs of provinces and centrally-administered cities and the General Departments, Bureaus, Directorates, and Inspectors under the Ministry of Labor, Invalids, and Social Affairs.
Article 3. Contents of Reports and Reporting Forms
1. The reporting forms are detailed in Appendix 01 attached hereto.
2. The contents of the reports must be fully filled out in the reporting forms according to the guidelines set forth in Appendix 02 attached hereto.
Article 4. Deadline for Reporting and Date of Submission of Reports
1. The reporting period is one year, from January 1 to December 31 of the reporting year.
2. The Departments of Labor, Invalids, and Social Affairs of provinces and centrally-administered cities shall submit their reports no later than January 15 of the following year according to the postmark (except where the reporting form requires otherwise).
3. Departments, Bureaus, Inspectorates under the Ministry shall compile statistical information and send it to the Department of Planning and Finance and the Information Center no later than January 31 of the following year of the reporting year.
Article 5. Forms of Reporting
1. Reports must be prepared in both written form and electronic data file format in Microsoft Excel spreadsheet.
2. Written reports must bear the signature and stamp of confirmation of the head of the reporting unit.
Article 6. Implementation
1. The Department of Planning and Finance shall take the lead in guiding units in implementing the reporting system; compiling and publishing periodic statistical information as prescribed.
2. The General Departments, Bureaus, Directorates, and Inspectors under the Ministry shall take the lead in establishing the basic statistical reporting systems; urge localities and units to implement the statistical reporting systems within their areas of administrative supervision; compile statistical information to be submitted to the Department of Planning and Finance and the Information Center in accordance with the regulations (the forms provided by these units are similar to those of the localities and include additional breakdowns by 63 provinces and centrally-administered cities).
3. The Directors of the Departments of Labor, Invalids, and Social Affairs, heads of relevant agencies and organizations, within their respective jurisdictions, are responsible for monitoring, inspecting, and urging the timely, accurate, and complete collection, compilation, and reporting of statistical data.
Article 7. Effectiveness
1. This Circular takes effect from April 25, 2015.
2. In case of difficulties during implementation, the reporting units shall report to the Ministry of Labor, Invalids, and Social Affairs for consolidation and resolution./.
