CIRCULAR
Repealing certain regulatory legal documents issued by the Minister of Justice
promulgating jointly promulgating in the field of state compensation

Pursuant to the Law on Legislative Documents dated June 22, 2015;
Pursuant to the Government's Decree No. 34/2016/NĐ-CP dated May 14, 2016 detailing certain provisions and measures for implementing the Law on Legislative Acts of Regulations;
Decree No. 96/2017/NĐ-CP dated August 16, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
After reaching consensus with the Minister of National Defense, the Minister of Finance, and the Chief Inspector General, the Minister of Justice issues this Circular to repeal certain regulatory legal documents issued by the Minister of Justice, jointly issued in the field of state compensation;
At the proposal of the Director of the State Compensation Department.
This Circular takes effect from January 25, 2026.
Abolish entirely the following legal normative documents issued by the Minister of Justice and jointly issued:
1. Circular No. 03/2013/TT-BTP dated January 31, 2013 of the Ministry of Justice guiding the implementation of state management over compensation work in administrative management activities;
2. Joint Circular No. 04/2013/TTLT-BTP-BQP dated February 1, 2013 of the Ministry of Justice and the Ministry of National Defense guiding the implementation of state management over compensation work in civil enforcement activities;
3. Joint Circular No. 06/2014/TTLT-BTP-TTCP-BQP dated February 14, 2014 of the Ministry of Justice, the Inspectorate General, and the Ministry of National Defense guiding complaints and the resolution of complaints regarding state compensation in administrative management and civil enforcement activities;
4. Circular No. 13/2015/TT-BTP dated September 29, 2015 of the Ministry of Justice amending and supplementing certain articles of Circular No. 03/2013/TT-BTP dated January 31, 2013 of the Ministry of Justice guiding the implementation of state management over compensation work in administrative management activities;
5. Joint Circular No. 16/2015/TTLT-BTP-BQP dated November 19, 2015 of the Ministry of Justice and the Ministry of National Defense amending and supplementing certain articles of Joint Circular No. 04/2013/TTLT-BTP-BQP dated February 1, 2013 of the Ministry of Justice and the Ministry of National Defense guiding the implementation of state management over compensation work in civil enforcement activities;
6. Joint Circular No. 17/2015/TTLT-BTP-BQP dated December 7, 2015 of the Ministry of Justice and the Ministry of National Defense guiding the implementation of the state's liability for compensation in civil enforcement activities;
7. Joint Circular No. 18/2015/TTLT-BTP-BTC-TTCP dated December 14, 2015 of the Ministry of Justice, the Ministry of Finance, and the Inspectorate General guiding the implementation of the state's liability for compensation in administrative management activities.
Article 2. Transitional Provisions
In cases where compensation claims have been accepted by the compensation settlement authority before the effective date of the Law on State Liability for Compensation No. 10/2017/QH14 but have not yet been resolved or are currently being resolved, the provisions of the Circulars and Joint Circulars specified in Article 1 of this Circular shall continue to be applied for resolution.
Article 3. Implementation Organization
1. This Circular takes effect from September 14, 2018.
2. The Ministry of Justice, the Ministry of National Defense, the Ministry of Finance, the Inspectorate General, agencies responsible for compensation, relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
