Decree No. 11/2019/NĐ-CP Amending and supplementing certain provisions of decrees concerning administrative procedures related to the requirement of submitting certified copies of documents under the management functions of the Ministry of Culture, Sports and Tourism.

DECREE

Amending and supplementing certain articles of Decrees
provides for administrative procedures related to the requirement to submit certified copies
of notarized or authenticated documents within the scope of management functions of
Ministry of Culture, Sports and Tourism

Pursuant to the Law on Government Organization dated June 19, 2015;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government issues this Decree amending and supplementing certain articles of Decrees providing for administrative procedures related to the requirement to submit certified copies of notarized or authenticated documents within the scope of management functions of the Ministry of Culture, Sports and Tourism.

1. Point g Clause 6 Article 2 is amended and supplemented as follows:

"g) Article 25 of the Regulation on Cultural Activities and Public Cultural Service Business issued together with Decree No. 103/2009/ND-CP dated January 6, 2009 of the Government is amended and supplemented as follows:"

"2. Documents and procedures for issuing a dance hall business license:"

a) The application package includes:

- Application form for a dance hall business license;

- Certificate of Enterprise Registration: Submit a certified copy or a copy and present the original for verification (in case of direct submission); submit a certified copy (in case of submission through postal service)."

b) One set of documents is required to be submitted.

c) Within the time limit for processing the matter, from the date of receipt of complete and valid documents, the Department of Culture, Sports and Tourism shall be responsible for examining and checking the actual business conditions and issuing the license; if the license is not granted, it must provide a written response stating the reasons.

2. Point i Clause 6 Article 2 is amended and supplemented as follows:

"i) Article 31 of the Regulation on Cultural Activities and Public Cultural Service Business issued together with Decree No. 103/2009/ND-CP dated November 6, 2009 of the Government is amended and supplemented as follows:"

"2. Documents and procedures for issuing a karaoke business license:"

a) The application package includes:

- Application form for a karaoke business license specifying the place of business, number of rooms, and area of each room;

- Certificate of Enterprise Registration/Business Registration Certificate: Submit a certified copy or a copy and present the original for verification (in case of direct submission); submit a certified copy (in case of submission through postal service)."

b) One set of documents is required to be submitted.

c) Within seven working days from the date of receipt of complete and valid documents, the Department of Culture, Sports and Tourism or the People's Committee at the district level authorized to handle the matter shall be responsible for issuing the karaoke business license; if the license is not granted, it must provide a written response stating the reasons.

Article 2. Amends and supplements Decree No. 113/2013/ND-CP dated October 2, 2013 of the Government on fine arts activities

Point c Clause 3 Article 17 is amended and supplemented as follows:

"c) Contract for the use of works or written consent of the owner of the sample work: Submit a certified copy or a copy and present the original for verification (in case of direct submission); submit a certified copy (in case of submission through postal service)."

Article 3. Amend and supplement some articles of Decree No. 181/2013/NĐ-CP dated November 14, 2013, of the Government detailing the implementation of certain provisions of the Advertising Law.

1. Point a Clause 2 Article 20 shall be amended and supplemented as follows:

"a) Foreign advertising enterprises submit directly or through postal service one set of application documents for a License to establish a Representative Office to the People's Committee of the province where the Representative Office is located;"

2. Point b Clause 2 Article 22 shall be amended and supplemented as follows:

"b) License to establish a Representative Office: Submit a certified copy or a copy and present the original for verification (in case of direct submission); submit a certified copy (in case of submission through postal service)."

3. Point b Clause 3 Article 23 shall be amended and supplemented as follows:

"b) Original License to establish a Representative Office that has been issued."

Article 4. Amend and supplement some articles of Decree No. 62/2014/NĐ-CP dated June 25, 2014, of the Government on the awarding of the titles "People's Artist" and "Outstanding Artist" in the field of intangible cultural heritage.

1. Clause 1 Article 11 shall be amended and supplemented as follows:

"1. The individual's application dossier includes:

a) Declaration of achievements for the title of "People's Artist" (Form No. 1), "Outstanding Artist" (Form No. 2);

b) Documents, tapes, discs, photos describing and proving knowledge and skills possessed;

c) Certificates or decisions awarding medals, awards, commendations related to contributions to the preservation of intangible cultural heritage: Submit a copy from the original book or a certified copy or a copy and present the original for verification (in case of direct submission); submit a copy from the original book or a certified copy (in case of submission through postal service)."

2. Clause 1 Article 12 shall be amended and supplemented as follows:

"1. Individuals applying for the award may themselves or authorize (by written authorization) other individuals or organizations to prepare the application dossier and submit one set of the dossier directly or through postal service to the Department of Culture, Sports and Tourism where the individual resides."

Article 5. Amend and supplement Decree No. 89/2014/NĐ-CP dated September 29, 2014, of the Government on the awarding of the titles "People's Artist" and "Outstanding Artist".

Point b Clause 1 Article 13 shall be amended and supplemented as follows:

"b) Decisions awarding prizes specified in Clause 4 Article 8 or Clause 4 Article 9 of this Decree: Submit a copy from the original book or a certified copy or a copy and present the original for verification (in case of direct submission); submit a copy from the original book or a certified copy (in case of submission through postal service)."

Article 6. Amend and supplement Decree No. 133/2018/NĐ-CP dated October 1, 2018, of the Government amending and supplementing some articles of Decree No. 90/2014/NĐ-CP dated September 29, 2014, of the Government on the "Ho Chi Minh Award" and "State Award" in literature and art.

Clause 5 Article 1 shall be amended and supplemented as follows:

"Point c Clause 1 Article 14 shall be amended and supplemented as follows:

"c) Decision awarding the prize or Certificate of the Award for works and projects specified in point b Clause 2 Article 9 and point b Clause 2 Article 10 of this Decree: Submit a copy from the original book or a certified copy or a copy and present the original for verification (in case of direct submission); submit a copy from the original book or a certified copy (in case of submission through postal service);"."

Article 7. Effective Date

This Decree shall take effect from March 15, 2019.

Article 8. Responsibility for Implementation

The Minister of Culture, Sports and Tourism, Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees, and municipal People's Committees under the central government are responsible for implementing this Decree./.
