Regulations on economic and technical norms for forest inventory and monitoring of forest changes

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Forestry Law dated November 15, 2017;

At the proposal of the Director of the Forest Protection Department;

The Minister of Agriculture and Rural Development issues this Circular to regulate economic and technical norms for forest inventory and monitoring of forest changes.

Article 1. Scope of Regulation and Applicability

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

a) This Circular applies to organizations, individuals, and community groups involved in forest inventory and monitoring of forest changes using state budget funds.

b) It is encouraged to apply the economic and technical norms set forth in this Circular for forest inventory and monitoring of forest changes using non-state budget funds.

Article 2. Interpretation of Terms

In this Circular, the following terms are understood as follows:

Article 2. Economic and Technical Norms for Forest Inventory and Monitoring of Forest Changes are levels of consumption of labor, materials, machinery, and equipment for tasks related to forest inventory and monitoring of forest changes.

Article 3. Adjustment Coefficient (K) is a coefficient used to calculate and adjust labor consumption rates when factors forming economic and technical norms for forest inventory and monitoring of forest changes change.

Article 4. Travel Distance is the distance traveled without using motorized road transport or motorized inland waterway transport to reach the location for conducting forest inventory and monitoring of forest changes.

2. Industrial emission testing must ensure timeliness, accuracy, objectivity, compliance with procedures, and adherence to legal provisions.

Article 5. Content and economic and technical norms for investigating the current status of forests to conduct forest inventory shall be implemented according to the provisions of Circular No. 05/2024/TT-BNNPTNT dated April 19, 2024, issued by the Minister of Agriculture and Rural Development on economic and technical norms for forest investigation (hereinafter referred to as Circular No. 05/2024/TT-BNNPTNT).

Article 6. Economic and technical norms for forest inventory and monitoring of forest changes stipulated in this Circular comply with the contents regarding forest inventory and monitoring of forest changes prescribed in Circular No. 33/2018/TT-BNNPTNT dated November 16, 2018, issued by the Minister of Agriculture and Rural Development on forest investigation, inventory, and monitoring of forest changes (hereinafter referred to as Circular No. 33/2018/TT-BNNPTNT) and Circular No. 16/2023/TT-BNNPTNT dated December 15, 2023, issued by the Minister of Agriculture and Rural Development amending and supplementing certain articles of Circular No. 33/2018/TT-BNNPTNT (hereinafter referred to as Circular No. 16/2023/TT-BNNPTNT). For work items related to forest inventory and monitoring of forest changes not specified in this Circular, the applicable norms shall be determined according to current laws and approved by competent authorities.

Article 7. The application of economic and technical norms must comply with requirements stipulated in standards, regulations, and technical guidelines issued by competent state agencies.

Article 8. Based on the purpose, requirements, scale, and methods of organizing forest inventory and monitoring of forest changes, select the content and apply economic and technical norms in Appendix I and Appendix II attached hereto, ensuring compatibility and avoiding overlap and waste.

Article 9. The exploitation and use of remote sensing imagery in forest inventory and monitoring of forest changes shall be carried out in accordance with the provisions of the law on surveying and mapping.

Article 4. General Provisions

Article 10. Forest inventory shall be conducted in accordance with the provisions of Chapter IV of Circular No. 33/2018/TT-BNNPTNT and Circular No. 16/2023/TT-BNNPTNT. Economic and technical norms for forest inventory are set forth in Appendix I attached hereto.

Article 11. Monitoring of forest changes shall be conducted in accordance with the provisions of Chapter V of Circular No. 33/2018/TT-BNNPTNT and Circular No. 16/2023/TT-BNNPTNT. Economic and technical norms for monitoring of forest changes are set forth in Appendix II attached hereto.

Article 12. High technology, advanced technology, and new technology should be applied in forest inventory and monitoring of forest changes.

Article 13. Based on specific conditions of each area and technical measures, apply the adjustment coefficient (K) to calculate necessary labor consumption for each project item when preparing plans and budgets.

Article 14. Costs and coefficients applied in forest inventory and monitoring of forest changes:

a) Wage rate as prescribed; travel allowance; hazardous and dangerous job allowance; social insurance; health insurance; unemployment insurance; trade union fee;

b) Difficulty coefficient is the factor used to adjust actual field labor rates when workers perform tasks at different levels of difficulty at the site;

c) Labor technical stoppage due to weather conditions for field technical workers.

Article 15. Costs for forest inventory and monitoring of forest changes machinery and equipment shall not exceed 5% of labor costs.

Article 16. Costs for materials, utilities, and communication shall not exceed 5% of labor costs.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

a) To organize dissemination, propaganda; guide implementation of economic and technical norms for forest inventory and monitoring of forest changes nationwide;

b) To issue software for forest inventory and updating forest change data for management and updating forest inventory and change databases in accordance with Clause c, Article 36 of the Forestry Law.

Article 18. Provincial People's Committees shall direct specialized agencies to organize dissemination, propaganda; implement economic and technical norms for forest inventory and monitoring of forest changes at local level.

Article 6. Effectiveness

Article 19. This Circular takes effect from October 24, 2024.

Article 20. Circular No. 102/2000/TT-BNN-KL dated October 2, 2000, issued by the Ministry of Agriculture and Rural Development guiding the preparation of budgets for programs and projects on monitoring forest changes and forestry land will cease to be effective from the date this Circular takes effect.

Article 21. Programs and projects applying economic and technical norms for forest inventory and monitoring of forest changes approved before the date this Circular takes effect shall continue to be implemented until completion. In cases where programs and projects approved need to be adjusted after the date this Circular takes effect, the economic and technical norms for forest inventory and monitoring of forest changes stipulated in this Circular shall be applied.

Article 22. Where legal documents cited for application in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the amended, supplemented, or replaced documents.

5. During the implementation of this Circular, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Agriculture and Rural Development for consideration and resolution./.
