Regulations on code numbers, occupational title standards; criteria and conditions for promotion to higher ranks of occupational titles for construction sector civil servants

Promotion to higher ranks of occupational titles for construction sector civil servants

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Public Service Staff Law dated November 25, 2019;

Pursuant to Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants; Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and capacity building for cadres, civil servants, and civil servants; Decree No. 89/2021/NĐ-CP dated October 18, 2021 of the Government amending and supplementing certain articles of Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and capacity building for cadres, civil servants, and civil servants;

Pursuant to Decree No. 52/2022/NĐ-CP dated August 8, 2022 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Cadre and Civil Servant Department,

The Minister of Construction hereby promulgates this Circular regulating code numbers, occupational title standards; criteria and conditions for promotion to higher ranks of occupational titles for construction sector civil servants.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular regulates code numbers, occupational title standards; criteria and conditions for promotion to Rank II and Rank I for occupational titles of construction sector civil servants including architects and supervising engineers.

Article 2. This Circular applies to construction sector civil servants in public service units participating in construction activities.

Article 3. Code numbers and occupational titles of construction sector civil servants

Clause 1. Group of architect occupational titles, including:

Article 3. General standards for professional ethics

1. Adhering to the Party's guidelines, policies, and State laws.

2. Having a sense of responsibility, always complying with the law; strictly fulfilling all duties of a civil servant in professional activities.

3. Being honest, objective, straightforward, responsible, dedicated, creative, contributing intellectual and talent to the development of the construction industry, economic and social development, ensuring national defense and security; having scientific working methods; keeping state secrets.

Chapter II
OCCUPATIONAL STANDARDS

Section 1
OCCUPATIONAL TITLE OF ARCHITECT

Article 4. Architect Rank I

1. Tasks

Point a) Leading research, formulation, and implementation of national orientation, strategy, and programs in the field of architecture and urban planning;

Point b) Leading the compilation and systematization of design standards and management regulations in the fields of architecture and urban planning;

Point c) Leading the proposal of scientific and technological investment plans and technical management systems suitable for the country's and local socio-economic development situation and direction in architectural design and urban planning work;

Point d) Head of project thesis or leading specialized architectural and urban planning departments of various types of urban planning projects;

Point đ) Head or leading architectural design, leading review of architectural and urban planning designs at all levels of projects; head of establishment of all project groups;

Point e) Leading the compilation and editing of professional and vocational guidance materials in the fields of architecture and urban planning; organizing training, participating in teaching advanced courses for lower-ranked architects;

Point g) Leading or participating in research on national-level, ministry-level, and equivalent scientific research topics, projects, and studies in the unit's specialty.

Clause 2. Professional and vocational competence criteria:

Point a) Understanding the state's policies, development orientation, strategies, and policies on architecture and urban planning; mastering the development orientation and tasks of the architectural and urban planning sector;

Point b) Possessing in-depth knowledge and experience in architectural and urban planning activities;

Point c) Having design capabilities, creative skills, ability to develop design plans and proposals, and research and apply scientific progress to enhance professional and vocational efficiency;

Point d) Having information technology skills, using design/graphic software; being able to use foreign languages.

Clause 3. Education and training criteria:

Point a) Holding a bachelor's degree or higher in architecture, urban planning, or other relevant fields suitable for the construction sector;

Point b) Holding a certificate of training according to the occupational title standards for construction sector civil servants as prescribed.

Article 5. Second-Class Architect

1. Tasks

a) Participate in researching, building, and organizing the implementation of orientations, strategies, and national programs in the field of architecture and construction planning;

b) Organize the compilation and systematization of standards and norms for design and management in the field of architecture and construction planning;

c) Head projects or lead specialized architectural and planning departments of various types of construction planning projects and urban planning projects within the approval authority of provincial People's Committees and district People's Committees; participate in implementing planning projects led by higher-class architects;

d) Head or lead architectural and construction planning design for Class II projects and below; head the preparation of Group B and Group C projects; participate in designing and reviewing designs of projects led by higher-class architects;

đ) Lead or participate in compiling and editing materials and textbooks; participate in training and guiding professional skills in the field of architecture and construction planning for lower-class architects;

e) Lead or participate in researching topics and projects at the ministry level, institutional level, and equivalent levels in the unit's specialty field;

Clause 2. Professional and vocational competence criteria:

a) Understand and promptly update achievements and development trends in the fields of architecture and construction planning both domestically and internationally;

b) Possess professional knowledge and experience in architectural and construction planning activities;

c) Have research and design capabilities; creative skills; ability to participate in developing architectural and construction planning design plans and schemes;

d) Have information technology and design/graphic application skills; be able to use foreign languages;

Clause 3. Education and training criteria:

Point a) Holding a bachelor's degree or higher in architecture, urban planning, or other relevant fields suitable for the construction sector;

Point b) Holding a certificate of training according to the occupational title standards for construction sector civil servants as prescribed.

Article 6. Third-Class Architect

1. Tasks

a) Participate in compiling and systematizing standards and norms for design and management in the field of architecture and construction planning;

b) Participate in projects or specialized architectural and planning departments of various types of construction planning projects and urban planning projects within the approval authority of district People's Committees; participate in implementing planning projects led by higher-class architects;

c) Participate in designing and reviewing architectural and construction planning designs for Class III and IV projects; head the preparation of Group C projects; participate in designing and reviewing designs of projects led by higher-class architects;

d) Participate in researching topics and projects at the institutional level in the unit's specialty field;

Clause 2. Professional and vocational competence criteria:

a) Possess basic knowledge about the profession in architectural and construction planning activities;

b) Have information technology and design/graphic application skills; be able to use foreign languages;

Clause 3. Education and training criteria:

a) Hold a bachelor's degree in architecture, planning, or another relevant field suitable for the construction industry;

Point b) Holding a certificate of training according to the occupational title standards for construction sector civil servants as prescribed.

Section 2
TITLE OF TECHNICAL AUDITOR

Article 7. First-Class Technical Auditor

1. Tasks

a) Lead the research, development, and implementation of legal regulations on project implementation management in construction works;

b) Lead the organization of compiling and systematizing standards, norms, and economic-technical quotas for construction works;

c) Lead the research and proposal of scientific and technological investment solutions, new construction materials, and technical management systems in construction works that are appropriate to the situation, characteristics, and socio-economic development directions of the state and each locality;

d) Head or lead the design and review of all levels of construction works; head or review all groups of projects;

đ) Lead the compilation and editing of materials and textbooks guiding professional skills in construction works; organize training and participate in teaching advanced courses for lower-class technical auditors;

e) Lead or participate in researching topics, projects, and national-level, ministry-level, and equivalent scientific research works in the unit's specialty field;

Clause 2. Professional and vocational competence criteria:

a) Fully understand and promptly update achievements and development trends in construction activities, important advancements in construction technology and materials both domestically and internationally;

b) Possess deep professional knowledge and experience in project implementation management in construction works and construction audit work;

c) Have research capabilities, practical summarization skills, and the ability to propose solutions or participate in developing strategies, policies, and plans for the construction industry and sector;

d) Have basic information technology skills and be able to use foreign languages;

Clause 3. Education and training criteria:

a) Hold a bachelor's degree or higher in architecture, construction, or another relevant field suitable for the construction industry;

b) Hold a certificate for professional career development training for technical auditors as prescribed.

Article 8. Category II Auditor

1. Tasks

a) Participate in researching, drafting, and implementing legal regulations on project management for construction works;

b) Organize the compilation and systematization of standards, norms, and economic-technical quotas for construction works;

c) Serve as head or lead designer, and lead reviewer for design of Class II projects or lower; serve as head for Group B and C project proposals; participate in designing and reviewing designs of projects led by higher category auditors;

d) Lead or participate in compiling and editing materials and textbooks; participate in training sessions to guide professional skills in construction for lower category auditors;

e) Lead or participate in researching topics and projects at the ministry level, institutional level, and equivalent within their field of expertise;

Clause 2. Professional and vocational competence criteria:

a) Timely update achievements and development trends in construction activities, significant advancements in construction technology and materials both domestically and internationally;

b) Possess specialized knowledge and experience in managing project implementation for construction works and construction review work;

c) Have research capabilities and the ability to contribute to building strategies, policies, and development plans for the construction industry;

d) Have basic information technology skills and be able to use foreign languages;

Clause 3. Education and training criteria:

a) Hold a bachelor's degree or higher in architecture, construction, or another relevant field suitable for the construction industry;

b) Hold a certificate for professional career development training for technical auditors as prescribed.

Article 9. Category III Auditor

1. Tasks

a) Participate in compiling and systematizing standards, norms, and economic-technical quotas for construction works;

b) Collect, analyze, evaluate, and compile reports on audit work performance to superiors and follow technical guidance from higher-level management officials within the same system;

c) Participate in designing and reviewing designs of Class III and IV projects; serve as head for Group C project proposals; participate in designing and reviewing designs of projects led by higher category auditors;

d) Participate in researching topics and projects at the institutional level in the unit's specialty field;

Clause 2. Professional and vocational competence criteria:

a) Possess basic knowledge about specialized activities in managing project implementation for construction works and construction review work;

b) Have the ability to propose and conduct scientific research, applying scientific progress to enhance professional and vocational activities;

c) Have basic computer technology skills and be able to use a foreign language;

Clause 3. Education and training criteria:

a) Hold a bachelor's degree in architecture, construction, or another relevant field suitable for the construction industry;

b) Hold a certificate for professional career development training for technical auditors as prescribed.

Article 10. Category IV Auditor

1. Duties

a) Perform routine technical tasks in design and review work according to specific disciplines, repetitive tasks following a defined process;

b) Manage the procedural execution of design and review work within the assigned scope under the guidance of higher category auditors;

c) Carry out other tasks assigned by superiors.

2. Professional and Vocational Competency Standards:

a) Understand basic directions and tasks for developing economic and technical aspects of the industry and unit;

b) Understand administrative procedures, management practices; grasp fundamental issues related to construction management, scientific labor organization, and management information;

c) Possess theoretical knowledge about the specialized field assigned; have the ability to skillfully perform routine technical tasks;

d) Proficiently use office equipment and other tools necessary for task completion.

3. Education and Training Standards:

a) Hold an associate degree or higher in architecture, construction, or another relevant field suitable for the construction industry;

b) Hold a certificate for professional career training as a construction auditor in accordance with regulations.

Chapter III
STANDARDS AND CONDITIONS FOR PROMOTION AND DEMOTION OF PROFESSIONAL TITLES

FOR CONSTRUCTION SPECIALIST CIVIL SERVANTS

Article 11. Basis and principles for organizing promotion examination

The basis and principles for organizing the examination for promotion to the rank of profession title in the Construction specialized field shall be implemented according to the provisions stipulated in Article 31 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government and Clause 38, Article 1 of Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government.

Article 12. Common criteria and conditions for examination

1. Meeting the criteria and conditions prescribed in Clause 16, Article 1 of Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government.

2. Meeting the profession title criteria and conditions of the Construction specialized field at the rank being applied for promotion as specified in this Circular.

3. Meeting the requirements regarding the time holding the profession title, specifically as follows:

a) For staff applying for promotion from Rank II to Rank I must have held the profession title of Construction specialized field at Rank II or equivalent for at least six years, excluding the probation period (if there is non-continuous working time without receiving a lump-sum social insurance payment, it can be accumulated). In cases where equivalent time is calculated, they must have held the profession title of Construction specialized field at Rank II for at least twelve months up to the deadline for submitting registration documents for the promotion examination.

b) For staff applying for promotion from Rank III to Rank II must have held the profession title of Construction specialized field at Rank III or equivalent for at least nine years, excluding the probation period (if there is non-continuous working time without receiving a lump-sum social insurance payment, it can be accumulated). In cases where equivalent time is calculated, they must have held the profession title of Construction specialized field at Rank III for at least twelve months up to the deadline for submitting registration documents for the promotion examination.

Article 13. Criteria and conditions for examination for promotion to the profession title from Rank II to Rank I

Staff in the Construction specialized field applying for promotion from Rank II to Rank I must meet the common criteria and conditions stipulated in Article 12 of this Circular and the specific criteria and conditions as follows:

1. For the profession title of architect, during the time holding the profession title at Rank II and equivalent, achieving one of the following criteria and conditions:

a) Being the head of a project or leading a specialized architectural department, urban planning or being the main participant in at least one project on construction planning or urban planning under the approval authority of the Prime Minister, or two projects on construction planning or urban planning under the approval authority of the provincial People's Committee, or three projects on construction planning or urban planning under the approval authority of the district People's Committee, all of which have been accepted;

b) Being the head or leading the design, leading the review of design or being the main participant in at least one Class I project, or two Class II projects, or three Class III projects, all of which have been accepted;

c) Being the head or being the main participant in at least one Group A project, or two Group B projects, or three Group C projects, all of which have been accepted;

d) Leading or being the main participant in at least one scientific and technological research topic, or one state-level public service project, or two scientific and technological tasks, or two ministry or provincial-level public service projects, all of which have been accepted at a satisfactory level or higher;

đ) Having once achieved the title of National Labor Medalist or having received one third-class Order or twice achieved the title of Labor Medalist at the ministry or sector level and equivalent or higher.

2. For the profession title of technical inspector, during the time holding the profession title at Rank II and equivalent, achieving one of the following criteria and conditions:

a) Being the head or leading the design, leading the review of design or being the main participant in at least one Class I project, or two Class II projects, or three Class III projects, all of which have been accepted;

b) Being the head or reviewing or being the main participant in at least one Group A project, or two Group B projects, or three Group C projects, all of which have been accepted;

c) Leading or being the main participant in at least one scientific and technological research topic, or one state-level public service project, or two scientific and technological tasks, or two ministry or provincial-level public service projects, all of which have been accepted at a satisfactory level or higher;

d) Having once achieved the title of National Labor Medalist or having received one third-class Order or twice achieved the title of Labor Medalist at the ministry or sector level and equivalent or higher.

Article 14. Criteria and Conditions for Promotion from Class III to Class II Professional Title

For construction professionals seeking promotion from Class III to Class II, they must meet the general criteria and conditions stipulated in Article 12 of this Circular and the specific criteria and conditions as follows:

1. For the professional title of architect, during the period holding the Class III professional title or equivalent, they must satisfy one of the following criteria and conditions:

a) Serve as the head of a project or lead a specialized architectural department, planning, or be the main participant in at least one (1) urban planning or construction project under the approval authority of the provincial People's Committee or two (2) such projects under the approval authority of the district People's Committee, all of which have been accepted;

b) Serve as the head of design, lead the review of design, or be the main participant in at least one (1) Class II construction project or two (2) Class III construction projects or three (3) Class IV construction projects that have been accepted;

c) Serve as the head of establishing or be the main participant in at least one (1) Group B project or two (2) Group C projects that have been accepted;

d) Lead or be the main participant in at least one (1) scientific and technological task or one (1) ministry or provincial public service project or two (2) scientific and technological tasks or two (2) grassroots public service projects that have been accepted at a satisfactory level or higher;

đ) Hold a Certificate of Merit from the Minister or the Chairman of the provincial People's Committee or equivalent or higher.

2. For the professional title of construction inspector, during the period holding the Class III professional title or equivalent, they must satisfy one of the following criteria and conditions:

a) Serve as the head of design, lead the review of design, or be the main participant in at least one (1) Class II construction project or two (2) Class III construction projects or three (3) Class IV construction projects that have been accepted;

b) Serve as the head of establishing or be the main participant in at least one (1) Group B project or two (2) Group C projects that have been accepted;

c) Lead or be the main participant in at least one (1) scientific and technological topic or one (1) ministry or provincial public service project or two (2) scientific and technological tasks or two (2) grassroots public service projects that have been accepted at a satisfactory level or higher;

d) Hold a Certificate of Merit from the Minister or the Chairman of the provincial People's Committee or equivalent or higher.

Article 15. Assignment and Delegation of Authority for Promotion of Professional Titles and Management and Utilization of Staff in Public Service Units.

The assignment and delegation of authority for promotion of professional titles and management and utilization of staff in public service units shall be carried out in accordance with the provisions of Clause 17, Article 1 of Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government.

Article 16. Content and Form of Promotion Examination, Determination of Successful Candidates, Notification of Examination Results, Appointment, and Salary Classification for Staff.

The content and form of promotion examination, determination of successful candidates, notification of examination results, appointment, and salary classification for staff shall be carried out in accordance with the provisions of Clauses 19, 20, 21, and 22, Article 1 of Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government.

Chapter IV
IMPLEMENTING PROVISIONS

Article 17. Effective Date

1. This Circular takes effect from February 5, 2025.

2. Repeal Circular Jointly Issued No. 11/2016/TTLT-BXD-BNV dated June 29, 2016 of the Ministry of Construction and the Ministry of Home Affairs on the code number and criteria for professional titles of construction specialists.

3. In case the legal normative documents referred to in this Circular are amended, supplemented, or replaced, implementation shall be in accordance with the amended, supplemented, or replaced legal normative documents.

Article 18. Responsibility for Implementation

1. The Minister, Heads of Ministries Equivalent to Ministries, Heads of Government Agencies; Chairmen of Provincial People's Committees and Central City People's Committees, and related agencies, organizations, and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are arising issues or difficulties, please report to the Ministry of Construction for guidance and clarification./.
