Prescribing the code number and standards for the occupational titles of construction professionals

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, public officials, and armed forces personnel; Decree No. 17/2013/ND-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, public officials, and armed forces personnel;

Pursuant to Decree No. 62/2013/ND-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

The Minister of Construction and the Minister of Home Affairs issue this Joint Circular prescribing the code number and standards for the occupational titles of construction professionals.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Joint Circular stipulates the code number, standards for occupational titles, and appointment and grading according to occupational titles for construction professionals, including the architect and supervising engineer occupational titles.

Article 2. This Joint Circular applies to construction professionals working in public service units involved in construction activities.

Article 2. Code Number and Classification of Occupational Titles for Construction Professionals

Clause 1. The group of architect occupational titles includes:

Article 3. Professional ethics standards for construction industry officials

1.    Possess a sense of responsibility, always comply with the law; always fulfill all duties of an official in professional activities.

2.     Be honest, objective, straightforward, responsible, dedicated, creative, contribute intellectual and talent to the development of the construction industry, economic and social development, ensuring national defense and security; have scientific working methods; keep state secrets.

Chapter II

OCCUPATIONAL STANDARDS

Section 1

OCCUPATIONAL TITLE OF ARCHITECT

Article 4. First-Class Architect - Code: V.04.01.01

1. Tasks

a)     Lead research, develop and implement orientation, strategy, national programs in the field of architecture and urban planning;

b)    Lead the organization of compiling and systematizing design standards and management regulations in the fields of architecture and urban planning;

c)    Lead the proposal of investment science and technology solutions and technical management systems in architectural design and urban planning work suitable to the situation, characteristics, and direction of economic and social development of the state and each locality;

d)    Head or lead specialized subjects of various urban planning projects; head or lead design, lead review of designs at all levels of projects; head the establishment of all project groups;

đ) Organize basic research, development research, application research in the fields of architecture and urban planning;

e)    Lead or participate in implementing national-level and ministry-level scientific research topics or equivalent in the fields of architecture and urban planning;

g)     Lead the preparation of content for domestic and international professional seminars;

h)      Lead the compilation and editing of professional training materials and textbooks in the fields of architecture and urban planning; participate in teaching advanced courses for lower-ranked architects.

2.    Training and upgrading standards:

a)     Hold a bachelor's degree or higher in architecture or urban planning relevant to the scope of tasks;

b)      Have a foreign language proficiency level of 4 or higher as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language competence framework for Vietnam (hereinafter referred to as Circular No. 01/2014/TT-BGDĐT);

c)    Have computer skills meeting the basic information technology usage standard as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on information technology usage standards (hereinafter referred to as Circular No. 03/2014/TT-BTTTT);

d)     Hold a certificate for upgrading according to the first-class architect job title criteria.

3.    Professional and vocational capability standards:

a)     Master the viewpoints, policies, and guidelines of the Party and state laws on architecture and urban planning; understand the orientation and tasks of architectural and urban planning development;

b)     Understand economic and technical information both domestically and internationally, be familiar with production conditions and technological levels generally and specifically within the industry; grasp and promptly follow achievements and trends in the fields of architecture and urban planning, important advancements in architecture and urban planning both domestically and internationally;

c)     Have in-depth knowledge and experience in architectural and urban planning activities and basic knowledge of related engineering disciplines;

d)    Have the ability to conduct research, summarize practical experiences, and propose solutions or participate in building strategies, policies, and plans for industry development;

đ) Have led or reviewed specialized subjects in at least one of the following projects:

-    One inter-provincial urban planning project;

-    Two provincial urban planning projects;

-    Three inter-district urban planning projects;

-    Five district urban planning projects;

-    Five general urban planning projects for special function zones.

Or have headed or led design, review, or audit of at least two Class I projects or three Class II projects.

Or have led (or been a key participant) in at least one national-level scientific and technological topic or one national-level public service project (or led at least two ministry-level or provincial-level scientific and technological topics or two ministry-level or provincial-level public service projects) in the fields of architecture and urban planning, which have been accepted at a satisfactory level or higher.

4. Promotion to the first-class architect job title

An official promoted from the second-class architect job title to the first-class architect job title must meet all provisions in Articles 2 and 3 of this Law and have held the second-class architect job title or equivalent for a minimum of six years, including at least two years in the most recent period holding the second-class architect job title.

Article 5. Second-Class Architect - Code: V.04.01.02

1. Tasks

a) Advise and assist state management agencies in researching, developing, and implementing orientations, strategies, and national programs in the field of architecture and construction planning;

b) Organize the compilation and systematization of design standards and management regulations in the fields of architecture and construction planning;

c) Participate in researching proposals for scientific and technological investment plans and technical management systems in architectural design and construction planning work that are suitable to the situation, characteristics, and development directions of the national economy and society, as well as those of each locality;

d) Head or lead specialized subjects of various types of provincial regional planning projects, inter-district regional planning projects, district regional planning projects, general construction planning projects for special function zones with population equivalent to cities of type II or lower, detailed construction planning projects for special function zones, rural construction planning projects; head or lead design, lead review of design for class II projects or lower; head preparation of group B and group C projects;

đ) Participate in basic research, development research, and application research in the fields of architecture and construction planning;

e) Participate in implementing national-level research topics; lead or participate in implementing ministry-level or grassroots-level scientific research topics in the fields of architecture and construction planning;

g) Participate in preparing content for domestic and international specialized and vocational seminars;

h) Lead or participate in compiling and editing professional and vocational materials and textbooks in the fields of architecture and construction planning for lower-ranked architects according to the requirements for developing grassroots forces; participate in teaching courses to enhance the qualifications of lower-ranked architects;

2.    Training and upgrading standards:

a)     Hold a bachelor's degree or higher in architecture or urban planning relevant to the scope of tasks;

b) Possess a foreign language proficiency level of grade 3 or higher as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Possess computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT;

d) Hold a certificate for training according to the criteria for the profession of second-class architect;

3.    Professional and vocational capability standards:

a)     Master the viewpoints, policies, and guidelines of the Party and state laws on architecture and urban planning; understand the orientation and tasks of architectural and urban planning development;

b) Be familiar with domestic economic and technical information, understand production situations and technological levels generally and specifically within the industry; promptly update achievements and development trends in the fields of architecture and construction planning, important advancements in architecture and planning both domestically and internationally;

c) Have knowledge and experience in architectural and construction planning activities and fundamental knowledge of a related engineering specialty;

d) Have the ability to conduct research, summarize practical experiences, and propose solutions or participate in building strategies, policies, and development plans for the industry and field;

đ) Has led or reviewed specialized subject designs or been a key participant in at least one of the following projects:

- One provincial construction planning project;

- Two inter-district regional planning projects;

- Three district construction planning projects;

- Three general construction planning projects for special function zones;

Or has led or reviewed architectural design or been a key participant in at least one class II project or five class III projects;

Or has led (or been a key participant) in at least one science and technology research topic or one ministry-level or provincial-level public service project (or has led at least two grassroots-level science and technology research tasks or two grassroots-level public service projects) in the fields of architecture and planning, which have been accepted at a satisfactory level or higher;

4. Promotion to the rank of Second-Class Architect

A civil servant promoted from the rank of Third-Class Architect to the rank of Second-Class Architect must fully meet the provisions of Clauses 2 and 3 of this Article and have held the rank of Third-Class Architect or equivalent for a minimum of nine years, including at least three years in the most recent period holding the rank of Third-Class Architect.

Article 6. Architect Level III - Code: V.04.01.03

1. Duties

a) Participate in implementing national orientations, strategies, programs in the field of architecture and construction planning;

b) Participate in compiling and systematizing design standards and management regulations in the field of architecture and construction planning;

c) Participate in implementing planning or design projects, preparing project proposals under the leadership of higher-level architects; head planning projects or lead specialized subjects of regional county planning, district zoning planning, detailed construction planning for special function areas, rural construction planning; head or lead design, lead review of design for Class III and IV projects; head preparation of Group C project proposals;

d) Participate in basic research, development research, application research in the field of architecture and construction planning;

đ) Participate in implementing scientific research topics at the ministry level; lead or participate in implementing scientific research topics at the institutional level in the field of architecture and construction planning;

e) Participate in preparing content for professional and vocational seminars both domestically and internationally;

g) Participate in compiling and editing professional and vocational teaching materials in the field of architecture and construction planning according to the requirements for developing grassroots forces;

2.    Training and upgrading standards:

a) Hold a bachelor's degree in architecture or construction planning relevant to the scope of duties;

b) Possess a foreign language proficiency level of grade 2 or higher as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Possess computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT;

d) Hold a certificate for training in accordance with the job title standard for Architect Level III;

3. Qualifications regarding professional expertise and skills:

a) Understand basic viewpoints, policies, and guidelines of the Party and state laws on architecture and construction planning; grasp basic orientations and tasks for the development of architecture and planning in the industry;

b) Understand basic economic and technical information domestically, production conditions, technological levels generally and specifically within the industry; have knowledge about achievements and development trends in the field of architecture and planning, important architectural and planning advancements domestically;

c) Have basic professional knowledge in architectural and construction planning activities;

d) Have the ability to propose and conduct scientific research, apply scientific progress to enhance the effectiveness of professional and vocational activities;

đ) Have the ability to collaborate with colleagues in professional and vocational activities.

Section 2

TITLE OF CONSTRUCTION TECHNICAL AUDITOR

Article 7. Technical Auditor Level I - Code: V.04.02.04

1. Tasks

a) Lead the research, development, and implementation of legal regulations on project implementation management in construction works;

b) Lead the organization of compiling and systematizing standards, norms, and economic-technical quotas for construction works;

c) Lead the proposal and research of investment science and technology schemes, new building materials, and technical management systems in construction projects suitable for the situation, characteristics, and socio-economic development directions of the state and each locality;

d) Head or lead design, lead review of design for all levels of projects; head preparation or review and audit all groups of project proposals;

đ) Organize basic research, development research, and application research in the field of construction projects and project investment management;

e) Lead or participate in implementing national-level, ministry-level, and equivalent scientific research topics in construction projects and project investment management;

g) Lead preparation of content for professional and vocational seminars both domestically and internationally;

h) Lead compilation and editing of professional and vocational teaching materials in construction projects; participate in teaching advanced courses for lower-level technical auditors;

2.    Training and upgrading standards:

a) Hold a bachelor's degree in architecture or construction or higher relevant to the scope of duties;

b) Possess a foreign language proficiency level of grade 4 or higher as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Possess computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT;

d) Hold a certificate for training in accordance with the job title standard for Technical Auditor Level I;

3.    Professional and vocational capability standards:

a) Proficiently understand the viewpoints, policies, and guidelines of the Party and state laws in construction activities; proficiently understand the orientations and tasks for the development of the construction industry;

b) Thoroughly understand domestic and international economic and technical information, thoroughly understand production conditions, technological levels generally and specifically within the industry; keep up-to-date with achievements and development trends in construction activities, important technological and building material advancements domestically and internationally;

c) Have in-depth knowledge and experience in project investment management, construction review and audit work, and basic knowledge of some related technical fields;

d)    Have the ability to conduct research, summarize practical experiences, and propose solutions or participate in building strategies, policies, and plans for industry development;

đ) Have the ability to conduct and direct research on ministry-level and institutional-level scientific topics directly teach and transmit knowledge to staff in the same specialty;

e) Have been the head or lead designer, reviewer, or auditor of at least two (2) Class I projects or three (3) Class II projects;

Or have led (or been a key participant) in at least one (1) scientific and technological topic or one (1) national-level public service project (or led at least two (2) ministry-level scientific and technological topics or two (2) ministry-level public service projects) in the field of architecture, planning, and construction projects that have been accepted at a satisfactory level or higher.

4. Promotion to the Title of Technical Auditor Level I

A civil servant must meet all the provisions of Articles 2 and 3 of this Article and have held the position of Technical Auditor Level II or equivalent for a minimum of six (6) years, including at least two (2) years in the most recent period holding the position of Technical Auditor Level II.

Article 8. Category II Auditor - Code: V.04.02.05

1. Duties:

a) Advise and propose to state management agencies on researching, drafting, and implementing legal regulations concerning the management of construction project implementation;

b) Organize the compilation and systematization of standards, norms, and economic-technical construction cost estimates;

c) Participate in researching and proposing scientific and technological investment schemes, new building materials, and technical management systems for construction projects that are suitable to the current situation, characteristics, and development directions of the national economy and each locality;

d) Serve as the head or lead designer, and lead the review of design for Class II projects and below; serve as the head in preparing Group B and Group C project proposals;

đ) Participate in basic research, developmental research, and application research in the field of construction projects and project investment management;

e) Participate in implementing national-level scientific research topics; lead or participate in implementing ministry-level and grassroots-level scientific research topics in the field of construction projects and project investment management;

g) Participate in preparing content for domestic and international specialized seminars and workshops;

h) Participate in compiling and editing professional training materials and guides for lower-level auditors according to the requirements for developing grassroots forces; participate in teaching in advanced training courses for lower-level auditors;

2.    Training and upgrading standards:

a) Hold a bachelor's degree in architecture or construction or higher relevant to the scope of duties;

b) Possess a foreign language proficiency level of Grade 3 or higher as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Possess computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT;

d) Hold a certificate for training according to the criteria for the position of Category II Auditor;

3. Professional and vocational capability standards:

a) Understand the viewpoints, policies, and guidelines of the Party and the state's policies and laws in construction activities; be well-versed in the orientation and tasks of the construction industry;

b) Be familiar with domestic economic-technical information, understand production conditions and technological levels generally and within the industry; promptly grasp achievements and development trends in construction activities, significant advancements in technology and building materials both domestically and internationally;

c) Have knowledge and experience in project investment construction management, appraisal, and review work, and fundamental knowledge of a related engineering specialty;

d) Possess research and practical summary capabilities;

đ) Have the ability to conduct and direct research on ministry-level scientific topics, directly teach, and impart knowledge to staff in the same specialty;

e) Have served as the head or lead designer, appraiser, or reviewer of at least one Class II project or five Class III projects;

Or have been the lead (or main participant) in at least one ministry-level or provincial-level scientific and technological topic or project, or two grassroots-level scientific and technological tasks or projects in the fields of architecture, planning, and construction projects that have been accepted at a satisfactory level or higher;

4. Promotion to the position of Category II Auditor

To be promoted from the position of Category III Auditor to Category II Auditor, a civil servant must fully meet the provisions of Clauses 2 and 3 of this Article and have held the position of Category III Auditor for a minimum of nine years, including at least three years in the most recent period.

Article 9. Grade III Technical Inspector - Code: V.04.02.06

1. Duties:

a) Participate in compiling and systematizing standards, norms, and economic-technical quotas for construction works;

b) Participate in researching and proposing investment options for new scientific and technological materials, construction materials, and technical management systems suitable for the national and local economic and social development situation, characteristics, and directions;

c) Collect, analyze, evaluate, and compile reports on the implementation of technical inspection work to be submitted to superiors and follow technical guidance from higher-level supervisory officials within the same system;

d) Participate in designing and reviewing designs of projects led by higher-grade technical inspectors; lead or participate in designing and reviewing designs of Class III and Class IV projects; lead the preparation of Group C project proposals;

đ) Participate in basic research, developmental research, and application research in the field of construction projects and project investment management;

e) Participate in implementing state-level and ministry-level scientific research topics; lead or participate in implementing foundation-level scientific research topics in the field of construction project management and investment;

g) Participate in preparing content for domestic and international specialized seminars and workshops;

h) Participate in compiling and editing professional manuals and training materials for lower-grade technical inspectors according to the requirements for developing grassroots forces;

2.    Training and upgrading standards:

a) Hold a bachelor's degree in architecture or construction related to the scope of duties performed;

b) Possess language proficiency equivalent to at least level 2 of the initial level as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Possess computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT;

d) Hold a certificate for upgrading to the standard of a Grade III Technical Inspector position;

3. Professional and vocational competence standards:

a) Understand the Party's viewpoints, policies, and guidelines in construction activities; grasp the basic orientation and tasks of the construction industry's development;

b) Have basic knowledge of domestic economic and technical information, understand the production situation and technological level generally and specifically in the construction industry; possess knowledge of achievements and trends in construction activities, important advancements in construction technology and materials domestically;

c) Have basic professional knowledge in project investment management, construction review and verification work, and fundamental knowledge of a related engineering specialty;

d) Have the ability to propose and conduct scientific research, apply scientific progress to enhance the effectiveness of professional and vocational activities;

đ) Have the ability to collaborate with colleagues in professional and vocational activities.

4. Promotion to the Grade III Technical Inspector position

A staff member must meet all the provisions set out in Clauses 2 and 3 of this Article and have held the Grade III Technical Inspector position or an equivalent position for a minimum of three years, including at least one year in the most recent period holding the Grade III Technical Inspector position.

Article 10. Grade IV Technical Inspector - Code: V.04.02.07

1. Duties

a) Perform routine technical tasks in design, review, and verification work according to specific disciplines, recurring tasks following a defined process;

b) Carry out management tasks for the implementation of design, review, and verification processes within the assigned scope under the guidance of higher-grade technical inspectors.

2. Education and Training Standards

a) Hold a diploma in construction engineering or a related field;

b) Possess language proficiency at level 1 or above as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Achieve basic computer skills standards for information technology usage as stipulated in Circular No. 03/2014/TT-BTTT;

3.    Professional and vocational capability standards:

a) Understand the basic direction and tasks of economic and technical development of the industry and unit;

b) Have theoretical knowledge about the professional and vocational fields assigned for technical inspection; have the ability to skillfully perform routine technical tasks;

c) Understand administrative procedures and management practices; grasp basic issues regarding construction management, scientific labor organization, and management information.

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING ACCORDING TO PROFESSIONAL TITLESSPECIALIST CIVIL SERVICE POSITIONS IN CONSTRUCTION

Article 11. Principles for Appointment to Professional Titles

1.     The appointment to professional titles for construction specialists must be based on their current job positions, expertise, and vocational qualifications, and must fully meet the standards stipulated in this Circular.

2.    The appointment from the current rank of civil servant to a corresponding professional title in the construction industry shall not be combined with salary grade promotion or professional title advancement for civil servants.

Article 12. Authority for Appointment

1.    The Ministry of Home Affairs, in collaboration with the Ministry of Construction, decides on the appointment and salary grading for professional titles of construction civil servants at Level I.

2.    The Minister, Head of a ministry-level agency, or agency under the Government, Chairman of provincial People's Committees, or municipal People's Committees directly under the Central Government decides on the appointment and salary grading for professional titles of construction civil servants at Level II.

3.     The Minister, Head of a ministry-level agency, or agency under the Government, Chairman of provincial People's Committees, or municipal People's Committees directly under the Central Government decides or delegates authority to the head of the immediate superior unit of the public service entity (or delegates authority to the head of the public service entity in cases where the public service entity is subordinate to a ministry-level agency, agency under the Government, or provincial People's Committee, or municipal People's Committees directly under the Central Government) to appoint and grade salaries for professional titles of construction civil servants at Level III.

4.    The head of a public service entity appoints professional titles for construction civil servants at Level IV.

Article 13. Situations for Appointment to Professional Titles

1. Continuation for construction civil servants:

Civil servants who have been appointed to the ranks of architect and estimator according to Decision No. 429/TCCP-VC dated June 6, 1993, issued by the Minister - Chief of the Personnel Organization Department of the Government (now the Ministry of Home Affairs), regarding the issuance of vocational standards for the ranks of construction civil servants; Decision No. 78/2004/QĐ-BNV dated November 3, 2004, issued by the Minister of Home Affairs, regarding the issuance of a list of civil servant ranks and civil servant grades, are now appointed to the professional titles of architect and estimator as stipulated in this Joint Circular, as follows:

a) Professional title of architect:

Appoint to the professional title of architect Level I (code V.04.01.01) for civil servants currently holding the rank of senior architect (code 12.087);

Appoint to the professional title of architect Level II (code V.04.01.02) for civil servants currently holding the rank of principal architect (code 12.088);

Appoint to the professional title of architect Level III (code V.04.01.03) for civil servants currently holding the rank of architect (code 12.089).

b) Professional title of estimator:

Appoint to the professional title of estimator Level I (code V.04.02.04) for civil servants currently holding the rank of senior estimator (code 12.84);

Appoint to the professional title of estimator Level II (code V.04.02.05) for civil servants currently holding the rank of principal estimator (code 12.85);

Appoint to the professional title of estimator Level III (code V.04.02.06) for civil servants currently holding the rank of estimator (code 12.086);

Appoint to the professional title of estimator Level IV (code V.04.02.07) for civil servants currently holding the rank of technical assistant (code 13.096).

2. Promotion of professional titles and transfer from other professional titles to professional titles for construction civil servants shall be carried out in accordance with Circular No. 12/2012/TT-BNV dated December 18, 2012, issued by the Ministry of Home Affairs, concerning professional titles and changes in professional titles for civil servants.

Article 14. Salary Grading

1. The occupational titles of architect and technical inspector stipulated in this Circular shall apply the salary scale for professional and vocational staff of state-run units as set forth in Scale 3 issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and armed forces personnel, as follows:

a) The occupational title of Class I architect and Class I technical inspector shall apply the public official salary coefficient type A3, group A1 (from coefficient 6.20 to coefficient 8.00);

a) The occupational title of Class II architect and Class II senior technical inspector shall apply the public official salary coefficient type A2, group A2.1 (from coefficient 4.40 to coefficient 6.78);

b) The occupational title of Class III architect and Class III technical inspector shall apply the public official salary coefficient type A1 (from coefficient 2.34 to coefficient 4.98);

c) The occupational title of Class IV technical inspector shall apply the public official salary coefficient type B (from coefficient 1.86 to coefficient 4.06).

2. Salary grading upon completion of probationary period and appointment to the recruited occupational title:

After completing the probationary period as prescribed and being appointed to the occupational title by the competent authority managing public officials, the following salary grading shall be implemented in the appointed occupational title:

a) In case of having a doctoral degree in a relevant field corresponding to the occupational standards, the individual shall be graded at level 3, coefficient 3.00 of the Class III architect occupational title (code V.04.01.03), Class III technical inspector occupational title (code V.04.02.06);

b) In case of having a master's degree in a relevant field corresponding to the occupational standards, the individual shall be graded at level 2, coefficient 2.67 of the Class III architect occupational title (code V.04.01.03), Class III technical inspector occupational title (code V.04.02.06);

c) In case of having a bachelor's degree in a relevant field corresponding to the occupational standards, the individual shall be graded at level 1, coefficient 2.34 of the Class III architect occupational title (code V.04.01.03), Class III technical inspector occupational title (code V.04.02.06);

d) In case of having a college degree in a relevant field corresponding to the occupational standards, the individual shall be graded at level 2, coefficient 2.06 of the Class IV technical inspector occupational title (code V.04.02.07);

đ) In case of having a secondary vocational degree in a relevant field corresponding to the occupational standards when recruited, the individual shall be graded at level 1, coefficient 1.86 of the Class IV technical inspector occupational title (code V.04.02.07);

3. The salary grading of public officials into the occupational titles according to this Circular for those who have been graded into the architect and technical inspector ranks as stipulated in Decision No. 78/2004/QĐ-BNV dated November 3, 2004 of the Minister of Home Affairs on the list of civil servant and public official ranks and Decree No. 204/2004/NĐ-CP dated November 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and armed forces personnel shall be carried out as follows:

a) In case the public official meets the conditions for appointment to the occupational titles of architect and technical inspector and has the same grade coefficient as the old rank, the grading shall be parallel to the current grade and percentage of seniority allowance exceeding the ceiling (if applicable) enjoyed in the old rank (including the time for the next grade increase review or seniority allowance exceeding the ceiling if applicable in the old rank) into the newly appointed occupational title.

b) In case the public official with a college degree was assigned to the A0 public official category under Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government and is now appointed to the Class IV technical inspector occupational title (code V.04.02.07), the grading of the Class IV technical inspector occupational title shall be based on the years of service with mandatory social insurance contributions according to the national wage scale (excluding the probationary period) as follows:

Starting from level 2 of the Class IV technical inspector occupational title, every two years (full 24 months), the individual will be promoted to the next grade (if there are gaps in the contribution period without enjoying social insurance benefits, they will be accumulated). If during the working period, there is a year where the tasks are not completed or disciplinary action is taken, the regular grade increase review period will be extended according to regulations.

After transferring to the Class IV technical inspector occupational title as mentioned above, if the salary coefficient assigned in the Class IV technical inspector occupational title plus the seniority allowance exceeding the ceiling (if applicable) is lower than the salary coefficient enjoyed in the old rank, the individual will continue to enjoy the difference coefficient retained to match the salary coefficient (including seniority allowance exceeding the ceiling, if applicable) enjoyed in the old rank. This retained difference coefficient will be enjoyed throughout the period the public official is graded in the Class IV technical inspector occupational title. Thereafter, if the public official (meeting the conditions and standards of the Class III technical inspector occupational title) is promoted to a higher occupational title, the retained difference coefficient will be added to the current salary coefficient (including seniority allowance exceeding the ceiling, if applicable) to grade into the new occupational title upon promotion and cease to enjoy the retained difference coefficient from the date of receiving salary in the new occupational title.

4. Promotion to a higher occupational title for architects and technical inspectors shall be carried out after being appointed to the architect and technical inspector occupational titles as stipulated in this Joint Circular and implementing salary grading according to Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding salary grading when upgrading, transferring, or changing the category of civil servants and public officials.

Chapter IV

IMPLEMENTING PROVISIONS

Article 15. Implementation Organization

1. This Joint Circular serves as the basis for the recruitment, utilization, and management of training and development of the cadre of construction sector civil servants in public service units.

2. The heads of public service units directly managing and utilizing civil servants shall be responsible for:

a) Reviewing job positions within their unit, developing plans to appoint occupational titles of construction sector civil servants within their authority, and submitting them for review and decision by competent authorities or deciding according to delegated authority.

b) Deciding on the appointment of occupational titles of construction sector civil servants corresponding to their authority or delegated authority after the appointment plan has been approved by the competent authority.

3. Authorities managing and utilizing civil servants shall be responsible for creating conditions for civil servants who have been appointed to the ranks of architect and technical inspector as stipulated in Decision No. 429/TCCP-VC dated June 6, 1993, issued by the Minister - Head of the Government Organizational and Cadre Affairs Department (now the Ministry of Home Affairs) regarding the issuance of vocational standards for the ranks of construction sector civil servants; Decision No. 78/2004/QD-BNV dated November 3, 2004, issued by the Minister of Home Affairs regarding the issuance of a list of civil servant ranks and civil servant positions, now being appointed to the occupational titles of architect and technical inspector as stipulated in this Joint Circular, to supplement any missing criteria according to the regulations of each occupational title.

4. Ministries, ministerial-level agencies, government agencies, provincial people's committees, and municipal people's committees under the central government shall be responsible for:

a) Directing subordinate units under their jurisdiction to implement the appointment of occupational titles and salary grading for construction sector civil servants;

b) Approving plans for the appointment of occupational titles and salary grading for construction sector civil servants in public service units under their jurisdiction from current civil servant positions to corresponding construction sector civil servant occupational titles as stipulated in this Joint Circular; resolving any issues arising during the process of appointing occupational titles and salary grading according to their authority;

c) Deciding on the appointment of occupational titles and salary grading for construction sector civil servants under their management to corresponding construction sector civil servant occupational titles in public service units according to their authority;

d) Annually reporting the results of the appointment of occupational titles and salary grading for construction sector civil servants under their jurisdiction to the Ministry of Construction and the Ministry of Home Affairs before December 31.

Article 16. Effective Date

1. This Joint Circular takes effect from August 12, 2016.

2. Non-public service units may apply the provisions of this Joint Circular for the recruitment, utilization, and management of personnel engaged in construction work.

3. Abolish Decision No. 429/TCCP-VC dated June 6, 1993, issued by the Minister - Head of the Government Organizational and Cadre Affairs Department (now the Ministry of Home Affairs) regarding the issuance of vocational standards for the ranks of construction sector civil servants.

4. Abolish the provisions concerning the list of architect and technical inspector ranks issued together with Decision No. 78/2004/QD-BNV dated November 3, 2004, issued by the Minister of Home Affairs regarding the issuance of a list of civil servant ranks and civil servant positions.

Article 17. Responsibility for Implementation

1. Ministers, heads of ministerial-level agencies, heads of government agencies; Chairpersons of provincial people's committees and municipal people's committees under the central government, and related agencies, organizations, and individuals shall be responsible for implementing this Joint Circular.

2. In the course of implementation, if any issues arise or difficulties occur, they are requested to report to the Ministry of Construction for consolidation and coordination with the Ministry of Home Affairs to examine and resolve them./.
