PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 07/2006/QĐ-TTg dated January 10, 2006 of the Prime Minister approving the Socio-Economic Development Program for Particularly Difficult Communes in Ethnic Minority Areas and Mountainous Regions for the period 2006-2010;

Considering the proposal of the Minister, Chairman of the National Ethnic Minorities Committee,

DECISION:

Article 1.

1. Implement certain support policies for services, improvement, and enhancement of people's living standards, and legal assistance to raise legal awareness (hereinafter referred to as support policies for enhancing people's living standards) under the Socio-Economic Development Program for Particularly Difficult Communes in Ethnic Minority Areas and Mountainous Regions for the period 2006-2010 for the following target groups:

a) Poor households according to the poverty standard stipulated in Decision No. 170/2005/QĐ-TTg dated July 8, 2005 of the Prime Minister on issuing the poverty standard applicable for the period 2006-2010, and students who are children of poor households residing in particularly difficult communes and villages within the scope of investment under Phase II of Program 135; Prime Minister on issuing the poverty standard applicable for the period 2006-2010, students from poor households residing in particularly difficult communes, villages, and hamlets in Zone II, which are within the scope of investment under Phase II of Program 135;

b) Particularly difficult communes and villages within the scope of investment under Phase II of Program 135.

Article 2. Support policies to enhance people's living standards include:

a) Supporting children of poor households attending village kindergartens with a monthly subsidy of VND 70,000 per child for nine months per year;

2. Supporting poor households to improve environmental sanitation: providing a one-time support for poor households with materials to upgrade, repair, renovate, build new, or move animal sheds and toilets. The support amount is VND 1,000,000 per poor household.

3. Supporting cultural-information activities: supporting some community activities in particularly difficult communes and villages to promote and disseminate Party and State policies, organize traditional cultural festivals. The support amount for each particularly difficult commune is VND 2,000,000 per year; for each particularly difficult village in the second region is VND 500,000 per year.

4. Supporting legal aid and raising legal awareness among the poor: supporting some activities organizing legal aid clubs at communes; organizing mobile legal aid at particularly difficult communes and villages; providing free legal information (leaflets, audio tapes) to the poor. The support amount for each particularly difficult commune is VND 2,000,000 per year; for each particularly difficult village in the second region is VND 500,000 per year.

Article 3. Sources of Funding

1. Central budget: the supplementary targeted funds from Phase II of Program 135 to the local budget to support the implementation of the policies prescribed in Article 2 of this Decision for communes and villages invested in by the central budget shall be allocated in the annual state budget estimate of the locality.

2. Local budget and mobilized capital, integrated programs and projects on the territory shall allocate funds to implement policies for communes and villages invested in by the local budget and supplement resources to implement the policies prescribed in this Decision in a coordinated manner.

Article 4. Implementation

1. The Committee for Ethnic Minorities shall take the lead and coordinate with the Ministries of Planning and Investment, Finance, Education and Training, Culture, Sports and Tourism, and Justice to guide and direct the organization and implementation of support policies using the capital of Phase II of Program 135; develop annual funding plans for localities, incorporate them into the overall plan of Phase II of Program 135; organize inspections and supervision of policy implementation; incorporate them into the results of implementing Phase II of Program 135, and report periodically. The Prime Minister.

2. The Ministry of Planning and Investment and the Ministry of Finance shall cooperate with the Committee for Ethnic Minorities to allocate annual funding plans for policies, incorporate them into the overall funding allocation plan for Phase II of Program 135, and submit for approval. The Prime Minister.

3. People's Committees of provinces under Program 135 shall have the responsibility to:

a) Direct and organize the implementation of support policies to enhance people's living standards under Phase II of Program 135 in accordance with the guidance of relevant ministries and sectors;

b) Specificize the provisions of central ministries and sectors at the local level, supplement the local budget, and mobilize and integrate programs and projects on the territory to implement policies, ensuring that beneficiaries receive the policies; allocate funds for the implementation of policies for particularly difficult communes and villages invested in by the local budget;

c) Guide the organization to identify, review, and select lists of priority beneficiary households based on democratic, transparent, clear, and fair criteria, ensuring the correct target group;

d) Develop funding plans for policies, incorporate them into the annual plan of Phase II of Program 135;

e) Regularly inspect to ensure that policies reach the correct target group, preventing waste and corruption.

Article 5. This Decision takes effect 15 days after its publication in the Official Gazette.

Article 6. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and Chairpersons of municipal People's Committees directly under the central government shall be responsible for implementing this Decision.
