Article 24Regarding the regime and policies for grassroots voluntary youth corps members in the South who participated in the resistance war from 1965 to 1975

period of resistance from 1965 to 1975

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Youth Law dated November 29, 2005;

The Government promulgates this Decree stipulating the regime and policies for grassroots voluntary youth corps members in the South who participated in the resistance war from 1965 to 1975.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

This Decree stipulates one-time allowance; monthly allowance; funeral allowance and production and business loan policy for grassroots voluntary youth corps members in the South who participated in the resistance war from March 26, 1965 to April 30, 1975 in provinces from Quang Tri to Ca Mau.

Grassroots voluntary youth corps members in the South who participated in the resistance war from March 26, 1965 to April 30, 1975 (hereinafter referred to collectively as grassroots voluntary youth corps members in the South).

Article 2. Subjects Not Subject to Application

1. The subjects specified in Clause 2 of Article 1 of this Decree shall not be entitled to the regimes and policies stipulated in this Decree if they fall under any of the following cases:

a) Have been settled as烈士青年突击队队员在南方参加1965年至1975年抗美救国战争期间的抚恤政策的对象，如果他们属于以下情况之一，则不享受本决定规定的制度和政策：a) 已被认定为烈士；或者去世但没有配偶、父母或子女等法定继承人；

b) Currently serving a fixed-term prison sentence; or convicted of one of the crimes related to national security;

c) Illegally leaving the country, residing abroad illegally, or declared missing by a court; or shirking duties, surrendering, betraying, or being recalled.

2. The subjects specified in Clause 2 of Article 1 of this Decree shall not be entitled to one-time allowance, monthly allowance, and funeral allowance if they fall under any of the following cases:

a) Cases stipulated in Clause 1 of this Article;

b) Currently enjoying retirement benefits, disability benefits, war invalidity benefits, injury benefits, benefits equivalent to those for war invalids, or monthly benefits for persons affected by Agent Orange and working in state agencies or state-owned enterprises funded by the state budget and participating in mandatory social insurance;

c) Subjects who have had their time as voluntary youth corps members counted towards entitlement to allowances under Decision No. 104/1999/QĐ-TTg dated April 14, 1999 of the Prime Minister on certain policies for voluntary youth corps members who completed their tasks during the resistance war; Decision No. 290/2005/QĐ-TTg dated November 8, 2005 of the Prime Minister on regimes and policies for certain individuals directly involved in the resistance war against the United States to save the nation but not yet benefiting from Party and State policies; Decision No. 188/2007/QĐ-TTg dated December 6, 2007 of the Prime Minister amending and supplementing Decision No. 290/2005/QĐ-TTg dated November 8, 2005 of the Prime Minister on regimes and policies for certain individuals directly involved in the resistance war against the United States to save the nation but not yet benefiting from Party and State policies; Decision No. 142/2008/QĐ-TTg dated October 27, 2008 of the Prime Minister on implementing regimes for military personnel who participated in the resistance war against the United States with less than 20 years of service in the military and have been demobilized and returned to their home regions; Decision No. 38/2010/QĐ-TTg dated May 6, 2010 of the Prime Minister amending and supplementing Decision No. 142/2008/QĐ-TTg dated October 27, 2008 of the Prime Minister on implementing regimes for military personnel who participated in the resistance war against the United States with less than 20 years of service in the military and have been demobilized and returned to their home regions; Decision No. 53/2010/QĐ-TTg dated August 20, 2010 of the Prime Minister on regimes for public security officers who participated in the resistance war against the United States with less than 20 years of service in the public security force and have retired and returned to their home regions; and Decision No. 40/2011/QĐ-TTg dated July 27, 2011 of the Prime Minister on regimes for voluntary youth corps members who completed their tasks during the resistance war.

3. The subjects specified in Clause 2 of Article 1 of this Decree shall not be entitled to loan policies if they fall under any of the following cases:

a) Cases stipulated in Clause 1 of this Article;

b) Subjects who have already received production and business loans under Decision No. 40/2011/QĐ-TTg dated July 27, 2011 of the Prime Minister.

Article 3. Conditions for Application

Persons entitled to the regimes and policies stipulated in this Decree must meet the following conditions:

1. Mobilized to participate in the resistance war pursuant to the Resolution of the First Congress of the Revolutionary Youth League of the South dated March 26, 1965.

2. Participated in grassroots voluntary youth corps organizations in the South established by the Revolutionary Youth League of the South or revolutionary authorities at provincial, district, and commune levels under various organizational forms such as battalions, companies, platoons, squads, or units named after geographical locations.

3. Age between 16 and 30 when joining the grassroots voluntary youth corps in the South. In exceptional cases, individuals under 16 years old, in good health, willing to join the grassroots voluntary youth corps in the South, and approved by grassroots voluntary youth corps units may join but must be at least 14 years old.

4. Active at the grassroots level (commune, village, inter-commune, inter-district) from March 26, 1965 to April 30, 1975.

5. Non-concentrated mode of operation.

6. Performing one of the following tasks:

a) Serving as liaison and guide, eliminating enemies, and opposing puppet forces;

b) Conducting enemy propaganda work, organizing communication activities with people of the revolution operating within enemy organizations;

c) Protecting and caring for revolutionary cadres;

d) Directly transporting wounded soldiers, supplying ammunition to regular armed forces and local armed forces;

đ) Directly transporting weapons, food, medicine, and documents from enemy-occupied areas to bases and vice versa;

e) Establishing combat villages and communes, participating in building trenches and roads for the resistance war; destroying infrastructure, means of transportation, and equipment used by the enemy for warfare;

g) Participating in combat support or supporting battlefields upon request from superiors;

h) Participating in other tasks assigned by revolutionary organizations.

Chapter II

PROVISIONS ON REGIME AND POLICY

Article 4. One-time Allowance Regime

1. Young volunteers at grassroots level in the South who meet the conditions stipulated in Article 3 of this Decree shall be entitled to a one-time allowance based on the actual number of years they served as young volunteers at grassroots level. In cases where there are different periods of service or interruptions, these periods will be accumulated for the purpose of calculating the allowance, specifically as follows:

a) From two years up to and including two years, the one-time allowance is 2,500,000 VND;

b) Over two years, from the third year onwards, each additional year adds 800,000 VND.

When calculating the duration for the one-time allowance regime, if there is a fractional month, six months or more will be counted as a full year, less than six months will be counted as half (1/2) a year.

2. In cases where young volunteers at grassroots level in the South have original documents or related documents stipulated in Clause 1, Article 8 of this Decree but do not specify the exact time of participation in the resistance war, they shall be entitled to a one-time allowance of 2,500,000 VND.

3. In cases where young volunteers at grassroots level in the South passed away before this Decree took effect, their dependents shall be entitled to a one-time allowance of 3,600,000 VND.

Article 5. Monthly Allowance Regime

Young volunteers at grassroots level in the South who are no longer capable of working and live alone without support shall be eligible for a monthly allowance of 540,000 VND. This allowance will be adjusted accordingly when the Government adjusts the monthly allowance for young volunteers who completed their tasks during the resistance war as stipulated in Decision No. 40/2011/QĐ-TTg dated July 27, 2011. The Prime Minister.

Article 6. Funeral Allowance Regime

1. When young volunteers at grassroots level in the South pass away, the person handling the funeral shall be entitled to a funeral allowance according to the provisions of the law on social insurance.

2. In cases where young volunteers at grassroots level in the South pass away after this Decree takes effect and have not yet received the one-time allowance or monthly allowance as stipulated in this Decree, the person handling the funeral shall be entitled to a funeral allowance as specified in Clause 1 of this Article.

Article 7. Loan for Production and Business

1. Young volunteers at grassroots level in the South may borrow funds from the Social Policy Bank for production and business to improve their living standards.

2. When applying for a loan, young volunteers at grassroots level in the South must obtain confirmation from the People's Committee of the commune where they are registered as permanent residents that they belong to the group eligible for loans for production and business.

3. The amount of the loan, interest rate, loan term, lending method, and other lending regulations shall be applied similarly to the program for lending to poor households during each period.

4. The handling of risky loan losses shall be carried out in accordance with the Prime Minister's regulations on mechanisms for handling risky loans at the Social Policy Bank.

Chapter III

DOCUMENTATION, PROCEDURES, AND TIME LIMITS FOR REGIME AND POLICY IMPLEMENTATION

Article 8. Documentation for Application of One-time Allowance and Monthly Allowance Regimes

1. Documentation for application of the one-time allowance:

a) A declaration form of the applicant according to Model 1A or the relative of the applicant (in case the applicant has passed away) according to Model 1B attached to this Decree;

b) A copy from the original book, a certified copy, or a copy presented with the original for verification of one of the following documents proving that the individual was a young volunteer at grassroots level in the South: Personal history of civil servants, public officials, or party members declared before 1995 which includes the time of serving as a young volunteer at grassroots level in the South, or certificates issued by competent authorities such as: Certificate of completion of duties by the unit managing young volunteers; Transfer, hospitalization, health certificate; Commendation during the time serving in the young volunteer force; Certificate of participation in the young volunteer force; Assignment, appointment, duty assignment certificate;

c) In cases where the applicant does not have one of the documents specified in point b of this clause, they must have a confirmation letter from at least two witnesses who were directly involved in mobilizing, organizing, and managing young volunteers or comrades-in-arms of young volunteers in units from battalion level downwards recognized as young volunteers according to Model 2 attached to this Decree;

d) In cases where the applicant does not have one of the documents specified in point b of this clause and does not have two witnesses confirming according to the regulation in point c of this clause, the applicant must submit a request according to Model 3A to the People's Committee of the commune where the young volunteer at grassroots level operated, the People's Committee of the commune where the young volunteer at grassroots level operated has the responsibility to confirm according to Model 3B attached to this Decree for applicants who participated in the young volunteer force at grassroots level in the South currently registered as permanent residents in another locality.

2. Documentation for application of the monthly allowance:

a) A declaration form of the applicant according to Model 4 attached to this Decree;

b) One of the documents proving that the individual was a young volunteer at grassroots level in the South as specified in points b, c, and d of Clause 1 of this Article;

c) A health examination certificate according to current regulations.

Article 9. Procedures and time limits for processing one-time allowance and monthly allowance regimes

1. The People's Committee of the commune shall announce on the commune radio station, village chiefs (neighborhood associations, wards, hamlets, villages), and post notices at the commune office regarding the acceptance of applications for processing the allowance regime for grassroots volunteers in the South. The application acceptance period for each round shall be 15 days from the date of announcement.

2. The subject applying for the policy or the relative of the subject (in case the subject has passed away) shall submit one set of application files in accordance with Article 8 of this Decree to the People's Committee of the commune where they are registered as residents.

3. Within five working days from the date of receiving complete application files in accordance with regulations, the People's Committee of the commune shall review and classify the files, organize meetings to determine eligible subjects, and prepare minutes confirming the application files for the allowance regime according to Model No. 5A attached to this Decree. The meeting participants include representatives from the People's Committee, Party Committee, Vietnam Fatherland Front, Association of Former Volunteers, Veterans' Association, Communist Youth Union Ho Chi Minh, Village Chiefs (neighborhood associations, wards, hamlets, villages) where there are subjects applying for the grassroots volunteer allowance regime in the South.

4. Post the results of reviewing the application files for processing the allowance regime for grassroots volunteers in the South according to Model No. 5B attached to this Decree at the People's Committee of the commune office and announce on the commune radio station. The announcement and posting period shall be ten days from the date of the review results of each round. In cases of complaints or reports about the review results, the People's Committee of the commune shall have the responsibility to verify and resolve according to the content of the complaint or report.

5. Within five working days from the end date of posting the review results of the application files, the People's Committee of the commune shall have the responsibility to compile and report to the People's Committee of the district (through the Civil Service Department, accompanied by the subject's file, joint meeting minutes, and posted review results of the application files).

6. For subjects who participated in grassroots volunteer activities in areas without original files or related files, currently registered as residents in other areas, if they request confirmation of their files, the People's Committee of the commune where the subject participated in grassroots volunteer activities shall organize the review process as stipulated in Clause 1, Clause 2, Clause 3, and Clause 4 of this Article. If they meet the conditions, confirm and issue a document according to Model No. 6 attached to this Decree to transfer the file to the People's Committee of the commune where the subject is registered as a resident for processing within their authority.

7. Responsibilities of the People's Committee of the district

Within ten days from the date of receiving complete files in accordance with regulations, the People's Committee of the district shall direct the Civil Service Department to take the lead, coordinate with the Labor, Invalids and Social Affairs Department, the Association of Former Volunteers, the Communist Youth Union Ho Chi Minh at the same level, and relevant agencies and units (if any) to complete the verification of files, review, and compile the results to report to the People's Committee of the province (through the Provincial Civil Service Department, accompanied by the subject's file).

8. Responsibilities of the People's Committee of the province:

a) Within ten days from the date of receiving complete files in accordance with regulations, the Civil Service Department shall take the lead, coordinate with the Labor, Invalids and Social Affairs Department, the Association of Former Volunteers, the Communist Youth Union Ho Chi Minh at the same level, and relevant agencies and units (if any) to complete the review, assessment, compilation, and submission to the People's Committee of the province for issuance of the decision on allowance (according to Model No. 7A, 8A, 9A, accompanied by the consolidated list of subjects applying for the allowance regime according to Model No. 7B, 8B, 9B attached to this Decree);

After the Decision of the People's Committee of the province, within five working days, the Civil Service Department shall transfer the decision along with the subject's application file to the Labor, Invalids and Social Affairs Department to implement the allowance regime and manage and store the file in accordance with regulations;

b) Within five working days from the date of receiving the Decision of the People's Committee of the province on processing the allowance regime for grassroots volunteers in the South, the Labor, Invalids and Social Affairs Department shall complete the compilation of the list of subjects receiving one-time allowances according to Model No. 10 attached to this Decree, accompanied by a document requesting additional budget allocation for one-time allowances sent to the Ministry of Labor, Invalids and Social Affairs. At the same time, organize the implementation of monthly allowance payments to the subjects entitled to the allowance according to current regulations.

Article 10. Documents, procedures, and time limits for funeral assistance

1. Documents of the representative of relatives or the person handling the funeral, including:

a) A copy of the decision granting one-time or monthly allowance benefits of grassroots volunteer youths from the South who have passed away. In cases where they have not yet received the allowance benefit as prescribed in Clause 2, Article 6 of this Decree, submit the announcement of the review result by the People's Committee of the commune according to Model No. 5B prescribed in Clause 4, Article 9 of this Decree;

b) Death certificate.

2. Procedure for implementing funeral assistance:

a) The representative of relatives or the person handling the funeral of grassroots volunteer youths from the South shall submit one set of documents as prescribed in Clause 1 of this Article to the People's Committee of the commune where they are registered as permanent residents;

b) Within five working days from the date of receiving complete documents as prescribed, the People's Committee of the commune shall examine and prepare a request document according to Model No. 11A attached to this Decree, along with the documents sent to the Department of Labor, Invalids, and Social Affairs of the district;

c) Within ten days from the date of receiving complete documents as prescribed transferred by the People's Committee of the commune, the Department of Labor, Invalids, and Social Affairs shall examine, appraise, prepare a request document according to Model No. 11B, along with the list requesting funeral assistance according to Model No. 11C attached to this Decree, and send the documents to the Department of Labor, Invalids, and Social Affairs of the province;

d) Within ten days from the date of receiving complete documents as prescribed transferred by the Department of Labor, Invalids, and Social Affairs, the Department of Labor, Invalids, and Social Affairs of the province shall examine, compile, report to the People's Committee of the province to issue a decision on granting funeral assistance to the relatives or the person handling the funeral of grassroots volunteer youths from the South;

đ) Within ten days from the date of issuing the decision on granting funeral assistance, the Department of Labor, Invalids, and Social Affairs of the district shall be responsible for disbursing the assistance to the relatives or the person handling the funeral of grassroots volunteer youths from the South who have passed away.

Article 11. Documents, procedures, and process for production and business loans

1. The People's Committee of the commune shall be responsible for compiling and confirming the list of grassroots volunteer youths from the South eligible for the policy of production and business loans as prescribed in Article 7 of this Decree according to Model No. 12 attached to this Decree and sending it to the Vietnam Bank for Social Policies.

2. The Vietnam Bank for Social Policies shall be responsible for guiding the documents and procedures for production and business loans for the target group of grassroots volunteer youths from the South to ensure simplicity, convenience, and ease of implementation.

Chapter IV

EXPENSES FOR IMPLEMENTATION AND VIOLATION HANDLING

Article 12. Expenses for implementation of benefits and policies

1. Expenses for implementing one-time allowances; expenses for implementing the policy of production and business loans as prescribed in this Decree shall be guaranteed by the central budget.

2. Expenses for implementing monthly allowances and funeral assistance for the subjects as prescribed in this Decree shall be guaranteed by the local budget.

Article 13. Expenses for management work

1. Content and level of expenditure for management work:

a) Expenditure for disseminating preferential policies for grassroots volunteer youths from the South. The level of expenditure shall be in accordance with current regulations on the dissemination and education of laws;

b) Expenditure for office supplies and printing forms used for professional purposes. The level of expenditure shall be settled based on actual costs within the approved budget by the competent authority;

c) Expenditure for vocational training meetings, mid-term reviews, final summaries; expenditure for inspection and supervision of the implementation of allowance benefits for grassroots volunteer youths from the South. The content and level of expenditure shall be in accordance with current regulations on meeting expenditure and travel expenses;

d) Expenditure for reviewing and appraising documents and expenditure for convening the Commune Review Board. The level of expenditure shall be applied as the expenditure for reviewing and appraising documents for grassroots volunteer youths as prescribed in Decision No. 40/2011/QĐ-TTg dated July 27, 2011; Prime Minister;

đ) Expenditure for remuneration for persons not receiving salary from the state budget performing the task of directly disbursing allowances to grassroots volunteer youths from the South.

2. Sources of expenditure for management work:

a) Expenditure for managing one-time allowance beneficiaries shall be consolidated together with the expenditure for the beneficiaries and guaranteed by the central budget from the funds allocated for the preferential policy for those who have rendered meritorious service to the revolution at a rate of 1.7% of the total expenditure for one-time allowances for beneficiaries;

The Department of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Department of Home Affairs to unify the allocation of management expenditure for relevant agencies and units to use; consolidate and settle management expenditure according to current regulations;

b) Expenditure for managing monthly allowance beneficiaries shall be guaranteed by the local budget;

c) Central-level expenditure for management work (including: expenditure for vocational training; expenditure for inspection and supervision work and other expenditures serving management work) of the Ministry of Home Affairs and the Ministry of Labor, Invalids, and Social Affairs shall be allocated, used, and settled within their annual regular expenditure.

Article 14. Handling Violations

Organizations and individuals who engage in actions that distort or forge documents to receive benefits and policies for grassroots volunteer youths from the South as prescribed in this Decree shall be subject to disciplinary action or criminal liability and must return the amount received; if damage is caused, compensation must be made in accordance with the law.

Chapter V

IMPLEMENTATION AND EFFECTIVE PROVISIONS

Article 15. Implementation Organization

1. The Ministry of Home Affairs shall be responsible for organizing the implementation of the following contents:

a) Take the lead and coordinate with the Vietnam Association of Former Volunteer Youths and related agencies to organize propaganda and dissemination of benefits and policies so that all levels, sectors, grassroots volunteer youths from the South, and their relatives know and implement them;

b) Direct the Home Affairs sector to proactively coordinate with relevant departments and agencies to promptly resolve any difficulties arising in the establishment, confirmation, review, and appraisal of documents for the implementation of one-time and monthly allowance benefits, and submit them to the Chairman of the Provincial People's Committee for decision in accordance with this Decree.

c) Organize mid-term and final reviews on the implementation of the regime and policies for grassroots volunteer youth in the South as stipulated in this Decree.

2. The Ministry of Labor, Invalids, and Social Affairs shall be responsible for organizing the implementation of the following contents:

a) Supplementing the budget for one-time allowances for localities;

b) Directing the Labor, Invalids, and Social Affairs sector to pay one-time allowances, monthly allowances, and implement funeral assistance regimes for grassroots volunteer youth in the South as prescribed.

3. The Ministry of Finance shall be responsible for allocating the annual budget to implement the regimes and policies under the central government's responsibility as stipulated in this Decree.

4. Provincial People's Committees shall be responsible for organizing the implementation of the following contents:

a) Directing relevant departments and localities to organize the implementation of the regimes and policies prescribed in this Decree strictly, democratically, transparently, accurately, conveniently, and without errors or corruption;

b) Inspecting, supervising, and handling individuals and organizations that violate the implementation of regimes and policies for the subjects specified in this Decree within their jurisdiction;

c) Allocating the annual budget to implement the regimes and policies under the local budget's responsibility as stipulated in this Decree.

5. The Vietnam Association of Volunteer Youth shall organize the implementation of the following contents:

a) Cooperating with the Ministry of Home Affairs to organize the dissemination and popularization of the regimes and policies for grassroots volunteer youth in the South as stipulated in this Decree;

b) Guiding levels of the Vietnam Association of Volunteer Youth to cooperate with local agencies and mass organizations to verify and confirm the correct beneficiaries of the policy, preventing falsification or fabrication of files to benefit from the policy.

6. It is requested that the Vietnam Fatherland Front, the Vietnam Veterans Association, and the Communist Youth Union at all levels strengthen propaganda, mobilization, and supervision of the implementation of this Decree.

Article 16. Effectiveness and Responsibility for Implementation

1. This Decree takes effect from November 20, 2017.

2. Ministers, heads of ministerial-level agencies, heads of government agencies, and chairpersons of provincial people's committees directly under the central government are responsible for implementing this Decree./.
