DECREE

Regulations on special allowances, preferential allowances, responsibility allowances, and hazardous, dangerous, and harmful allowances for vocational education teachers

in public institutions

Pursuant to the Law on Organization of the Government dated December 25, 2001;

WHEREAS,Law onJune 2024;vocational training on November 27, 2014;

Pursuant to the proposal of the Minister of Labor, Invalids and Social Affairs.

The Government promulgates this Decree on special allowances, preferential allowances, responsibility allowances, and hazardous, dangerous, and harmful allowances for teachers in public vocational education institutions.uThis Decree stipulates the special allowance system for integrated teaching teachers, teachers who are national artisans, and persons with high-level vocational skills teaching practical subjects; preferential allowances and responsibility allowances for teachers teaching disabled students; hazardous, dangerous, and harmful allowances for teachers directly teaching practical subjects in vocational education centers, technical colleges, and public colleges (hereinafter referred to as public vocational education institutions), with fixed-term or indefinite-term employment contracts.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. Integrated teaching means teaching both theoretical and practical components within a single lesson/module/unit/course.

Article 2. Interpretation of Terms

In this Decree, the following terms are understood as follows:

2. Persons with high-level vocational skills are those holding National Vocational Skill Certificates at level 4 or above, or Master Craftsmen at levels 5/6, 6/7 or above.

3. Public vocational education institutions and classes exclusively for disabled students are public vocational education institutions and classes where 70% or more of the students are disabled.

4. Inclusive classes are classes within public vocational education institutions where between 5% and less than 70% of the students are disabled.

Article 3. Source of funds for allowances

The funds for the allowances prescribed in this Decree shall be provided from the state budget and legitimate sources according to current regulations of public vocational education institutions.

REGULATIONS ON ALLOWANCES FOR TEACHERS IN PUBLIC VOCATIONAL EDUCATION INSTITUTIONS

Chapter II

SPECIAL ALLOWANCE FOR INTEGRATED TEACHING TEACHERS, TEACHERS WHO ARE NATIONAL ARTISANS, AND PERSONS WITH HIGH-LEVEL VOCATIONAL SKILLS TEACHING PRACTICAL SUBJECTS

Article 4. Conditions for entitlement

Section 1

Teachers engaged in integrated teaching, teachers who are outstanding national artisans, or persons with high-level vocational skills teaching practical subjects in public vocational education institutions.

Article 5. Allowance rate

Teachers specified in Article 4 of this Decree shall receive a special allowance at a rate of 10% of their current salary plus leadership position allowance and seniority allowance exceeding the ceiling (if applicable).

Article 6. Calculation and payment

1. Special allowances are calculated based on the number of hours spent on integrated teaching and practical teaching.

2. Special allowances are paid together with monthly salaries and are not used to calculate contributions or benefits under social insurance.

PREFERENTIAL ALLOWANCE AND RESPONSIBILITY ALLOWANCE FOR TEACHERS TEACHING DISABLED STUDENTS

Article 7. Conditions for entitlement

1. Full-time teachers teaching disabled students in public vocational education institutions exclusively for disabled students or classes exclusively for disabled students in public vocational education institutions.

2. Part-time teachers teaching disabled students in classes exclusively for disabled students in public vocational education institutions.

Section 2

3. Full-time teachers teaching disabled students in inclusive classes for disabled students in public vocational education institutions.

4. Part-time teachers teaching disabled students in inclusive classes for disabled students in public vocational education institutions.

Article 7. Conditions for enjoyment

1. Full-time teachers teaching persons with disabilities in vocational education establishments exclusively for persons with disabilities or specialized classes for persons with disabilities in public vocational education establishments.

2. Part-time teachers teaching persons with disabilities in specialized classes for persons with disabilities in public vocational education establishments.

3. Full-time teachers teaching persons with disabilities in integrated classes for persons with disabilities in public vocational education establishments.

4. Part-time teachers teaching persons with disabilities in integrated classes for persons with disabilities in public vocational education establishments.

Article 8. Rate of Allowance

1. Teachers specified in Clause 1, Article 7 of this Decree shall be entitled to a job responsibility allowance at a rate of 0.3 compared to the basic salary and a preferential teaching allowance for disabled students at a rate of 70% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable).

2. Teachers specified in Clause 2, Article 7 of this Decree shall be entitled to a job responsibility allowance at a rate of 0.3 compared to the basic salary and a preferential teaching allowance for disabled students at a rate of 40% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable).

3. Teachers specified in Clause 3, Article 7 of this Decree shall be entitled to a job responsibility allowance at a rate of 0.2 compared to the basic salary and a preferential teaching allowance for disabled students at the following rates:

a) A rate of 35% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 5% to less than 10% of students being persons with disabilities;

b) A rate of 40% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 10% to less than 20% of students being persons with disabilities;

c) A rate of 45% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 20% to less than 30% of students being persons with disabilities;

d) A rate of 50% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 30% to less than 40% of students being persons with disabilities;

đ) A rate of 55% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 40% to less than 50% of students being persons with disabilities;

e) A rate of 60% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 50% to less than 60% of students being persons with disabilities;

g) A rate of 65% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 60% to less than 70% of students being persons with disabilities.

4. Teachers specified in Clause 4, Article 7 of this Decree shall be entitled to a job responsibility allowance at a rate of 0.2 compared to the basic salary and a preferential teaching allowance for disabled students at the following rates:

a) A rate of 5% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 5% to less than 10% of students being persons with disabilities;

b) A rate of 10% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 10% to less than 20% of students being persons with disabilities;

c) A rate of 15% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 20% to less than 30% of students being persons with disabilities;

d) A rate of 20% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 30% to less than 40% of students being persons with disabilities;

đ) A rate of 25% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 40% to less than 50% of students being persons with disabilities;

e) A rate of 30% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 50% to less than 60% of students being persons with disabilities;

g) A rate of 35% of the current salary plus leadership position allowance and seniority allowance exceeding the framework (if applicable), applicable to integrated classes with from 60% to less than 70% of students being persons with disabilities.

5. Full-time teachers responsible for teaching persons with disabilities who are entitled to job responsibility allowances and preferential teaching allowances for persons with disabilities as stipulated in Clauses 1 and 3 of this Article shall not be entitled to preferential allowances as prescribed in Decision No. 244/2005/QĐ-TTg dated October 6, 2005 of the Government Prime Minister on preferential allowances for teachers directly teaching in public educational institutions.

6. Part-time teachers responsible for teaching persons with disabilities who are entitled to job responsibility allowances and preferential teaching allowances for persons with disabilities as stipulated in Clauses 2 and 4 of this Article shall simultaneously be entitled to preferential allowances as prescribed in Decision No. 244/2005/QĐ-TTg dated October 6, 2005 of the Government Prime Minister on preferential allowances for teachers directly teaching in public educational institutions.

Article 9. Calculation and Enjoyment

1. The allowance for non-specialist teachers teaching persons with disabilities as stipulated in Clause 2 and Clause 4 of Article 8 of this Decree shall be calculated based on the actual number of hours teaching persons with disabilities.

2. The allowances for teachers as stipulated in Clauses 1, 2, 3, and 4 of Article 8 of this Decree shall be paid together with monthly salaries and shall not be used to calculate contributions or benefits under social insurance.

Section 3

ALLOWANCE FOR HEAVY WORK, TOXIC SUBSTANCES, AND DANGEROUS CONDITIONS

FOR PRACTICAL TEACHING TEACHERS

Article 10. Conditions for Enjoyment

1. Practical teaching teachers, integrated teaching teachers (hereinafter referred to collectively as practical teaching teachers) teaching in practical training rooms, workshops of public vocational education institutions, enterprises, production and business establishments, service providers with heavy, toxic, or dangerous trades shall enjoy the allowance if they have one of the following heavy, toxic, or dangerous factors:

a) Direct contact with toxic substances, toxic gases, toxic dust; teaching in environments prone to infection and transmission of infectious diseases as prescribed;

b) Teaching in environments subject to high pressure or low oxygen levels, places that are excessively hot or cold beyond permissible standards;

c) Teaching trades that generate significant noise or are located in areas with continuous high-frequency vibrations exceeding safety and hygiene standards;

d) Teaching in environments with radiation, radiation beams, or electromagnetic fields exceeding permissible standards.

2. The list of heavy, toxic, and dangerous trades shall be specified by the Ministry of Labor, Invalids, and Social Affairs.

Article 11. Allowance Levels

The allowance for heavy work, toxic substances, and dangerous conditions shall be calculated based on the base salary level and includes the following levels:

1. Level 0.1 applies to practical teaching teachers in trades with one of the heavy, toxic, or dangerous factors as stipulated in Clause 1 of Article 10 of this Decree.

2. Level 0.2 applies to practical teaching teachers in trades with two of the heavy, toxic, or dangerous factors as stipulated in Clause 1 of Article 10 of this Decree.

3. Level 0.3 applies to practical teaching teachers in trades with three of the heavy, toxic, or dangerous factors as stipulated in Clause 1 of Article 10 of this Decree.

4. Level 0.4 applies to practical teaching teachers in trades with four heavy, toxic, or dangerous factors as stipulated in Clause 1 of Article 10 of this Decree.

Article 12. Calculation and Enjoyment

1. The allowance for heavy work, toxic substances, and dangerous conditions shall be calculated based on the actual number of hours teaching in heavy, toxic, or dangerous trades.

2. The allowance for heavy work, toxic substances, and dangerous conditions shall be paid together with monthly salaries and shall not be used to calculate contributions or benefits under social insurance.

Chapter III

IMPLEMENTING PROVISIONS

Article 13. Effective Date

1. This Decree takes effect from January 1, 2016.

2. The provisions regarding allowances for practical teaching teachers in heavy, toxic, and dangerous trades and allowances for teachers teaching persons with disabilities in public vocational education institutions as stipulated in Articles 5, 6, 7, 9, 10, and 11 of Decree No. 43/2008/NĐ-CP dated April 8, 2008 of the Government detailing and guiding the implementation of Article 62 and Article 72 of the Vocational Training Law; the provisions regarding preferential policies and allowances for teachers in public vocational education institutions as stipulated in Clauses 1 and 2 of Article 7 of Decree No. 28/2012/NĐ-CP dated April 10, 2012 of the Government detailing and guiding the implementation of certain articles of the Persons with Disabilities Law shall cease to be effective from the date this Decree takes effect.

Article 14. Implementation Organization

1. The Minister of Labor, Invalids, and Social Affairs, the Minister of Education and Training, and the Minister of Finance shall guide the implementation of this Decree.

2. All ministers, heads of ministerial-level agencies, heads of central government agencies, Chairpersons of provincial and municipal People's Committees, and related agencies shall be responsible for implementing this Decree./.
