DECISION OF THE PRIME MINISTER

Regarding the preferential allowance system for teachers

directly teaching at public educational institutions

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Education Law dated December 2, 1998;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

Considering the proposal of the Minister of Education and Training, the Minister of Home Affairs, and the Minister of Finance,

DECISION:

Article 1. Scope and Applicability

1. This Decision stipulates the preferential treatment system for teachers who have been directly teaching and have been transferred and classified according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for officials, civil servants, employees, and armed forces personnel at public educational institutions within the national education system and schools, centers, academies under state agencies, the Party, and political-social organizations funded by the State.

2. The preferential allowance system prescribed in this Decision shall not apply to teachers teaching at educational institutions under the Ministry of National Defense, the Ministry of Public Security, and confidential agencies.

Article 2. Amounts of Allowance and Calculation Method

1. The preferential allowance amount for teachers is specified as follows:

a) A 25% allowance rate applies to teachers directly teaching at universities, colleges, academies, training schools of ministries, agencies equivalent to ministries, government agencies, central-level Party organizations, and political-social organizations, and provincial-level political schools (excluding teachers teaching at teacher training schools, teacher departments, and teachers teaching Marxist-Leninist science and Ho Chi Minh Thought courses);

b) A 30% allowance rate applies to teachers directly teaching at secondary schools, high schools, comprehensive technical centers - vocational guidance centers, continuing education centers, vocational training centers in plains, cities, and towns; vocational high schools, vocational training schools; political training centers of districts, urban districts, towns, and provincial-level cities;

c) A 35% allowance rate applies to teachers directly teaching at kindergartens, primary schools in plains, cities, and towns; secondary schools, high schools, comprehensive technical centers - vocational guidance centers, continuing education centers, vocational training centers in mountainous areas, islands, remote regions;

d) A 40% allowance rate applies to teachers directly teaching at teacher training schools, teacher departments (university, college, secondary level), education management and training schools, and teachers teaching political subjects in vocational high schools and vocational training schools;

đ) A 45% allowance level applies to teachers currently directly teaching courses on Marxism-Leninism and Ho Chi Minh Thought in universities and colleges;

e) A 50% allowance rate applies to teachers directly teaching at kindergartens, primary schools in mountainous areas, islands, remote regions.

2. The preferential allowance rates prescribed in Clause 1 of this Article are calculated based on the current salary grade plus leadership position allowances and seniority allowances exceeding the standard range (if applicable).

Article 3. Sources of Funds

The source of funds for paying the preferential allowances as prescribed in this Decision shall be derived from the income generated from the activities of the unit and the budget allocated by the State for public educational institutions.

Article 4. Effective date

1. This Decision takes effect fifteen days after its publication in the Official Gazette.

2. This Decision replaces Decision No. 973/1997/QĐ-TTg dated November 17, 1997 of the Prime Minister regarding the preferential allowance system for teachers directly teaching at state-owned public schools and point a, Clause 4, Article 1 of Decision No. 494/QĐ-TTg dated June 24, 2002 of the Prime Minister approving the Project: "Some Measures to Improve the Quality and Effectiveness of Teaching and Learning Marxist-Leninist Science and Ho Chi Minh Thought Courses in Universities and Colleges, Political Subjects in Vocational High Schools and Vocational Training Schools." 3. The preferential allowance system prescribed in this Decision shall take effect from October 1, 2004.

4. Non-public educational institutions shall base their implementation of the provisions of this Decision on their legitimate income sources.

4. Non-state educational institutions shall apply the provisions of this Decision based on their legitimate sources of income.

Article 5. Guidance and responsibility for implementation

1. The Ministry of Education and Training shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to be responsible for guiding the implementation of this Decision.

2. The ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairpersons of provincial people's committees under the central government, and chairpersons of municipal people's committees directly under the central government shall be responsible for implementing this Decision./.
