Amending and Supplementing Certain Articles of Decree No. 87/2024/NĐ-CP dated July 12, 2024 of the Government on Administrative Penalties for Price Management Violations

Based on the Law on Organization of the Government No. 63/2025/QH15;

Based on the Law on Punishment of Administrative Offenses No. 15/2012/QH13, amended and supplemented by Laws Nos. 67/2020/QH14 and 88/2025/QH15;

Based on the Law on Oversight No. 84/2025/QH15;

Based on the Law on Prices No. 16/2023/QH15, amended and supplemented by Law No. 140/2025/QH15;

In accordance with the proposal of the Minister of Finance;

The Government promulgates this Decree amending and supplementing certain articles of Decree No. 87/2024/NĐ-CP dated July 12, 2024 of the Government on Administrative Penalties for Price Management Violations.

Article 1. Amend and Supplement Article 1

Amend the phrase "price inspection authorities, enforcement of price-related laws, valuation" to "price inspection and enforcement, valuation".

Article 2. Amend and Supplement Article 3

1. Add paragraph 9: "9. The handling of administrative offenses in the electronic environment for the field of price management shall be carried out in accordance with the provisions of the Law on Punishment of Administrative Offenses and the implementing regulations thereof; such handling shall be conducted when conditions related to infrastructure, technology, and information are met."

2. Add paragraph 10: "10. The principle for determining the authority to impose administrative penalties and applying remedial measures in price management activities is carried out in accordance with the provisions of the Law on Punishment of Administrative Offenses and the implementing regulations thereof."

3. Add paragraph 11: "11. In case there are other Decrees on administrative penalties for other fields of state administration that have specific provisions regarding the handling of administrative offenses related to prices different from those in this Decree, such specific provisions shall apply."

Article 3. Amend point b of paragraph 2 of Article 26

"b) Civil servants, staff members and persons belonging to the People's Public Security Force, People's Armed Forces, performing official duties and tasks assigned to them."

Article 4. Amend and Supplement Article 27

"Article 27. Authority to impose administrative penalties for inspection
1. Price inspectors of the Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam; price inspectors of the Maritime Inspection Agency of Vietnam; price inspectors of the Civil Aviation Inspection Agency of Vietnam have the authority to impose administrative penalties in the field of prices as follows: a maximum fine of 15,000,000 Vietnamese Dong.
2. Heads of inspection teams of the agencies: Maritime Inspection Agency of Vietnam, Civil Aviation Inspection Agency of Vietnam, State Bank of Vietnam regional offices, provincial public security; heads of inspection teams of military regions, Military Command of Hanoi have the authority to impose administrative penalties in the field of prices as follows:
a) A maximum fine of 75,000,000 Vietnamese Dong;
b) Application of remedial measures prescribed at paragraph 7 of Article 3 of this Decree.
3. Heads of the Maritime Inspection Agency of Vietnam; Heads of the Civil Aviation Inspection Agency of Vietnam; Heads of the National Defense Inspection Agency of military regions; Heads of the National Defense Inspection Agency of the Military Command of Hanoi; Heads of the State Bank of Vietnam regional offices; Heads of provincial public security inspection teams have the authority to impose administrative penalties in the field of prices as follows:
a) A maximum fine of 120,000,000 Vietnamese Dong;
b) Application of supplementary penalty forms prescribed at paragraph b of clause 1 of Article 3 and remedial measures prescribed at paragraph 7 of Article 3 of this Decree.
4. Heads of the Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam; heads of inspection teams established by the Heads of the Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam have the authority to impose administrative penalties in the field of prices as follows:
a) A maximum fine of 150,000,000 Vietnamese Dong;
b) Application of supplementary penalty forms prescribed at paragraph b of clause 1 of Article 3 and remedial measures prescribed at paragraph 7 of Article 3 of this Decree."

Article 5. Amendment and Supplement to Article 28

"Article 28. Authority to Impose Administrative Penalties for Violations of Price Management
1. The Director of the Department responsible for agriculture, plant protection, animal husbandry, veterinary services, quality management of agricultural, forestry, aquatic products, water resources, embankments, disaster prevention and control; the Director of the Food Safety Department, the Director of the Radio Frequency Management Center in each region; the Director of the Maritime and Inland Waterways North Department, the Director of the Maritime and Inland Waterways South Department have the authority to:
a) Impose a maximum fine of 75,000,000 Vietnamese Dong;
b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree.
2. The Director of the Price Management Department; the Director of the Legal Support Department; the Director of the Administrative Justice Department; the Director of the Vietnam Road Department; the Director of the Maritime and Inland Waterways Department of Vietnam; the Director of the Civil Aviation Department of Vietnam; the Director of the Railway Department of Vietnam; the Director of the Vehicle Inspection Department of Vietnam; the Director of the Water Resources Management and Construction Department; the Director of the Land Administration Department; the Director of the Intellectual Property Department; the Director of the Radio Frequency Management Department; the Director of the Telecommunications Department; the Chairman of the National Standards, Metrology and Quality Committee; the Director of the Vocational Education and General Education Department; the Director of the Medical Care Management Department; the Director of the Drug Administration Department; the Director of the Food Safety Department; the Director of the Population Department; the Director of the Disease Prevention Department; the Director of the Industry Department; the Director of the Electricity Department; the Director of the Chemicals Department; the Director of the Industrial Safety and Environmental Protection Department; the Director of the E-commerce and Digital Economy Department; the Chairman of the National Competition Committee; the Director of the Press Department; the Director of the Radio, Television and Electronic Information Department; the Director of the Publishing, Printing and Distribution Department; the Director of the Overseas Labor Management Department; the Director of the Employment Department; the head of an organization under a ministry or agency entrusted with price management tasks within the scope of state administration have the authority to impose administrative penalties for violations in the field of price management as follows:
a) Impose a maximum fine of 150,000,000 Vietnamese Dong;
b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree.
3. The Head of the Inspection Team established by an organization under a ministry or agency responsible for price management, price appraisal within the scope of state administration has the authority to impose administrative penalties as provided in paragraph 1 of this Article.
The Head of the Inspection Team established by the Minister or head of an agency responsible for price management tasks within the scope of state administration has the authority to impose administrative penalties as provided in paragraph 2 of this Article.
4. The Chairman of the People's Committee of a commune, ward, special district under provincial jurisdiction has the authority to impose administrative penalties for violations in the field of price management as follows:
a) Impose a maximum fine of 75,000,000 Vietnamese Dong;
b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree.
5. The Chairman of the People's Committee of a province or centrally-administered city has the authority to impose administrative penalties for violations in the field of price management as follows:
a) Impose a maximum fine of 150,000,000 Vietnamese Dong;
b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree.
6. The Director of the Department has the authority to impose administrative penalties for violations in the field
of price management as follows:
a) Impose a maximum fine of 120,000,000 Vietnamese Dong;
b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree."

Article 6. Amendment and Supplement to Article 29

"Article 29. Authority to Impose Administrative Penalties of Market Supervision Management
The authority of the market supervision management agency personnel to impose administrative penalties as provided in Articles 6, paragraph 1 of Article 7, Articles 8, 10, 11, and 13, and Articles 15 of this Decree is specifically as follows:
1. The market supervisor performing official duties has the authority to impose a maximum fine of 15,000,000 Vietnamese dong.
2. The team leader of the Market Supervision Team under the Market Supervision Bureau of the Department of Commerce has the authority:
a) To impose a maximum fine of 45,000,000 Vietnamese dong;
b) To apply remedial measures as provided in points a, b, c, d, e, and t of paragraph 7 of Article 3 of this Decree.
3. The director of the Market Supervision Bureau under the Department of Commerce, the head of the Business Management Division of the Domestic Market Development Administration has the authority:
a) To impose a maximum fine of 75,000,000 Vietnamese dong;
b) To apply remedial measures as provided in points a, b, c, d, e, and t of paragraph 7 of Article 3 of this Decree.
4. The director of the Domestic Market Development Administration has the authority:
a) To impose a maximum fine of 150,000,000 Vietnamese dong;
b) To apply remedial measures as provided in points a, b, c, d, e, and t of paragraph 7 of Article 3 of this Decree."
Article 7. Amendment and Supplement to Article 30
"Article 30. Authority to Impose Administrative Penalties of the People's Public Security
1. A public security officer performing official duties has the authority to impose a maximum fine of 15,000,000 Vietnamese dong.

2. The commander of the mobile police detachment at the battalion level has the authority:

a) To impose a maximum fine of 30,000,000 Vietnamese dong;
b) To apply remedial measures as provided in paragraph 7 of Article 3 of this Decree.
3. The police station chief, the commander of the mobile police detachment at the battalion level, the waterway team leader, the station chief, and the team leader have the authority:
a) To impose a maximum fine of 45,000,000 Vietnamese dong;
b) To apply supplementary penalties as provided in point b of paragraph 1 of Article 3 and remedial measures as provided in paragraph 7 of Article 3 of this Decree.
4. The chief of the police at the commune level has the authority:
a) To impose a maximum fine of 75,000,000 Vietnamese dong;
b) To apply supplementary penalties as provided in point b of paragraph 1 of Article 3 and remedial measures as provided in paragraph 7 of Article 3 of this Decree.
5. The chief of the border police at the international airport port; the head of the business division under the National Security Department including: Chief of the General Staff Division, Chief of the Catholic Security Division, Chief of the Religious Security Division, Chief of the Ethnic Security Division, Chief of the Counter-Subversion Division, Chief of the Anti-Terrorism Division, Chief of the Social Security Division; the head of the business division under the National Political Security Department including: Chief of the Internal Party and State Organs Protection Division, Chief of the Central Judicial, Legislative, and Social Organizations Security Division, Chief of the Media and Publishing Security Division, Chief of the Healthcare and Education Security Division, Chief of the"
a) The maximum fine shall be up to 75,000,000 Vietnamese đồng;
b) Apply the supplementary penalty measures provided for at Point b of Clause 1 Article 3 and the remedial measures provided for in Clause 7 of this Decree.
5. The Chief of the Border Guard at the International Airport Port; the Heads of Business Units under the National Security Department including: Head of General Staff, Head of Catholic Security, Head of Other Religious Security, Head of Ethnic Security, Head of Counter-Dissident Activities, Head of Counter-Terrorism, Head of Social Security; the Heads of Business Units under the Internal Political Security Department including: Head of Central Party and State Organs Protection, Head of Central Judicial, Legislative, and Political-Social Organizations Security, Head of Media and Publishing Security, Head of Healthcare and Education Security, Head of

a) To impose a maximum fine of 120,000,000 Vietnamese Dong;
b) To apply supplementary penalties as provided in point b of clause 1 Article 3 and remedial measures as stipulated in paragraph 7 Article 3 of this Decree.
6. The Director of Provincial Public Security Department has the authority:
a) To impose a maximum fine of 150,000,000 Vietnamese Dong;
b) To apply supplementary penalties as provided in point b of clause 1 Article 2 and remedial measures as stipulated in paragraph 7 Article 3 of this Decree.
7. The Directors of Political Security Bureau, Economic Security Bureau, Chief of Criminal Investigation Office under Ministry of Public Security, Administrative Order Public Security Bureau Director, Criminal Investigation Bureau for Public Order Crimes Director, Criminal Investigation Bureau for Corruption, Economic Crime, Smuggling, Environmental Crime Director, Narcotics Crime Investigation Bureau Director, Traffic Police Bureau Director, Fire Safety and Rescue Bureau Director, Environment Crime Prevention Bureau Director, High-Tech Crime Investigation and Cybersecurity Protection Bureau Director, Internal Security Bureau Director, Community Detention, Custody, and Criminal Execution Bureau Director, Commander of Mobile Police Force, National Data Center Director, Case Files Bureau Director have the authority:
a) To impose a maximum fine of 150,000,000 Vietnamese Dong;
b) To apply supplementary penalties as provided in point b of clause 1 Article 3 and remedial measures as stipulated in paragraph 7 Article 3 of this Decree."

Article 8. Implementation Provisions

This Decree takes effect from May 20, 2025.

Ministries, heads of agencies at the same level as ministries, heads of agencies under the Government, chairpersons of people's committees of provinces and centrally-run cities, and relevant organizations and individuals shall be responsible for implementing this Decree.

Article 1. Amendment and Supplement to Article 1

Amend the phrase "price inspection authority, price law enforcement inspection, price valuation" to "price inspection and supervision, price valuation".

Article 2. Amendment and Supplement to Article 3

1. Add Paragraph 9

"9. The handling of administrative violations in an electronic environment concerning the management of prices shall be carried out in accordance with the provisions of the Law on Handling Administrative Violations and its implementing regulations; such handling may only occur when technical, infrastructure, and information conditions are met."

2. Add Paragraph 10

"10. The principles for determining the authority to impose administrative penalties and applying remedial measures in price management activities shall be carried out in accordance with the provisions of the Law on Handling Administrative Violations and its implementing regulations."

3. Add Paragraph 11

"11. In cases where other Decrees on administrative penalties for other areas of state management have specific provisions regarding administrative penalties for price violations that differ from those in this Decree, the provisions of such other Decrees shall apply."

Article 3. Amendment to Point b of Paragraph 2 of Article 26

"b) Civil servants, staff members, and persons belonging to the People's Armed Police Force, the People's Army of Vietnam, who are performing official duties or tasks assigned to them."

Article 4. Amendment and Supplement to Article 27

"Article 27. Authority to Impose Administrative Penalties for Inspections

1. Price inspection officers from the following agencies: Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam; Price inspection officers from the Vietnam Maritime Inspection Agency; and Price inspection officers from the Vietnam Air Transport Inspection Agency have the authority to impose administrative penalties in the field of prices as follows: a maximum fine of 15,000,000 Vietnamese dong.

2. Heads of inspection teams from the following agencies: Vietnam Maritime Inspection Agency, Vietnam Air Transport Inspection Agency, regional branches of the State Bank of Vietnam, provincial public security bureaus; heads of inspection teams from military regions, and the Command of the Capital City of Hanoi have the authority to impose administrative penalties in the field of prices as follows:

a) A maximum fine of 75,000,000 Vietnamese dong;

b) Application of remedial measures specified at Paragraph 7 of this Decree.

3. Heads of Vietnam Maritime Inspection Agency; Heads of Vietnam Air Transport Inspection Agency; Commanders of National Defense in military regions; Commanders of National Defense in the Command of the Capital City of Hanoi; heads of regional branches of the State Bank of Vietnam; and provincial public security bureau chiefs have the authority to impose administrative penalties in the field of prices as follows:

a) A maximum fine of 120,000,000 Vietnamese dong;

b) Application of supplementary penalty measures specified at Point b of Paragraph 1 and remedial measures specified at Paragraph 7 of this Decree.

4. Heads of agencies at the same level as ministries: Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam; heads of inspection teams established by the heads of agencies at the same level as ministries: Ministry of National Defense, Ministry of Public Security, State Bank of Vietnam have the authority to impose administrative penalties in the field of prices as follows:

a) A maximum fine of 150,000,000 Vietnamese dong;

b) Application of supplementary penalty measures specified at Point b of Paragraph 1 and remedial measures specified at Paragraph 7 of this Decree."

a) Impose a maximum fine of 150,000,000 Vietnamese Dong;

b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree.

3. The Head of the Inspection Team established by the head of an organization under a ministry or agency responsible for price management, price appraisal within the scope of state administration has the authority to impose administrative penalties as provided in paragraph 1 of this Article.

The Head of the Inspection Team established by the Minister or head of an agency responsible for price management tasks and price appraisal within the scope of state administration has the authority to impose administrative penalties as provided in paragraph 2 of this Article.

4. The Chairman of the People's Committee of a commune, ward, special district under provincial jurisdiction has the authority to impose administrative penalties for violations of price management as follows:

a) Impose a maximum fine of 75,000,000 Vietnamese Dong;

b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree.

5. The Chairman of the People's Committee of a province or centrally administered city has the authority to impose administrative penalties for violations of price management as follows:

a) Impose a maximum fine of 150,000,000 Vietnamese Dong;

b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree.

6. The Director of the Department has the authority to impose administrative penalties for violations of price management as follows:

a) Impose a maximum fine of 120,000,000 Vietnamese Dong;

b) Apply supplementary administrative penalty measures specified in paragraph 1 point b of Article 3 and remedial measures specified in paragraph 7 of Article 3 of this Decree."

Article 6. Amendment and Supplement to Article 29

"Article 29. Authority to Impose Administrative Penalties of Market Supervision Management

The authority of the market supervision management agency personnel who have the authority to impose administrative penalties as provided in Articles 6, paragraph 1 of Article 7, Articles 8, Articles 10, Articles 11, and Articles 13, and Articles 15 of this Decree is specifically as follows:

1. Market Supervision Inspector who is performing official duties has the authority to impose a maximum fine of 15,000,000 Vietnamese Dong.

2. The Team Leader of the Market Supervision Team under the Market Supervision Bureau of the Department of Commerce has the authority:

a) To impose a maximum fine of 45,000,000 Vietnamese Dong;

b) To apply remedial measures as provided in points a, b, c, d, e, and t of paragraph 7 of Article 3 of this Decree.

3. The Director of the Market Supervision Bureau under the Department of Commerce, Head of the Business Management Unit of the Domestic Market Development Administration has the authority:

a) To impose a maximum fine of 75,000,000 Vietnamese Dong;

b) To apply remedial measures as provided in points a, b, c, d, e, and t of paragraph 7 of Article 3 of this Decree.

4. The Director of the Domestic Market Development Administration has the authority:

a) To impose a maximum fine of 150,000,000 Vietnamese Dong;

Article 7. Amendment and Supplement to Article 30

"Article 30. Authority to Impose Administrative Penalties of People's Public Security

1. People's Public Security Officer who is performing official duties has the authority to impose a maximum fine of 15,000,000 Vietnamese Dong.

2. The Head of the Mobile Police Unit at the Detachment level has the authority:

a) To impose a maximum fine of 30,000,000 Vietnamese Dong;

b) To apply remedial measures as provided in paragraph 7 of Article 3 of this Decree.

3. The Police Station Chief, Head of the Mobile Police Unit at the Battalion level, Water Squadron Commander, Post Chief, Team Leader has the authority:

a) To impose a maximum fine of 45,000,000 Vietnamese Dong;

b) To apply supplementary administrative penalties as provided in point b of paragraph 1 of Article 3 and remedial measures as provided in paragraph 7 of Article 3 of this Decree.

4. The Chief of the Police at the Commune level has the authority:

a) To impose a maximum fine of 75,000,000 Vietnamese Dong;

b) To apply supplementary administrative penalties as provided in point b of paragraph 1 of Article 3 and remedial measures as provided in paragraph 7 of Article 3 of this Decree.

5. The Chief of the Border Police at International Airports; Head of the Business Unit under the National Security Department including: Chief of the General Staff, Chief of the Catholic Security Unit, Chief of the Religious Security Unit, Chief of the Ethnic Security Unit, Chief of the Counter-Subversion Unit, Chief of the Anti-Terrorism Unit, Chief of the Social Security Unit; Head of the Business Unit under the Internal Security Administration including: Chief of the Internal Security for Central Party and State Organs, Chief of the Security for Judicial, Legislative, and Political-Social Organizations at the Central Level, Chief of the Media and Publishing Security Unit, Chief of the Healthcare and Education Security Unit, Chief of the

a) To impose a maximum fine of 120,000,000 Vietnamese Dong;

b) To apply supplementary penalties as provided in point b of clause 1 Article 3 and remedial measures as stipulated in paragraph 7 Article 3 of this Decree.

6. The Director of Provincial Public Security Departments have the authority:

a) To impose a maximum fine of 150,000,000 Vietnamese Dong;

b) To apply supplementary penalties as provided in point b of clause 1 Article 2 and remedial measures as stipulated in paragraph 7 Article 3 of this Decree.

7. The Directors of Internal Political Security Bureau, Economic Security Bureau, Criminal Investigation Office Deputy Director of the Ministry of Public Security, Administrative Order Police Bureau, Criminal Investigation Bureau for Administrative Order Crimes, Criminal Investigation Bureau for Corruption, Economic Crime, Smuggling, Environmental Crime, Narcotics Crime Investigation Bureau, Traffic Police Bureau, Fire Safety and Rescue Police Bureau, Environment Crime Prevention Bureau, Cybersecurity and High-Tech Crime Protection Bureau, Internal Security Bureau, Community Detention, Custody, and Criminal Execution Bureau Commanders, Mobile Police Force Commander, National Data Center Director, Case Files Bureau Director have the authority:

a) To impose a maximum fine of 150,000,000 Vietnamese Dong;

b) To apply supplementary penalties as provided in point b of clause 1 Article 3 and remedial measures as stipulated in paragraph 7 Article 3 of this Decree."

Article 8. Implementation Provisions

This Decree shall take effect from May 20th of the current year.

The Ministers, Heads of agencies at the ministerial level, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally-administered cities, and relevant organizations and individuals shall be responsible for implementing this Decree./.
