CIRCULAR

Regulations on collecting, registering, retaining, and publishing information on scientific and technological tasks within the Ministry of National Defense

science and technology in the Ministry of National Defense

Pursuant to the Law on Science and Technology dated June 18, 2013;

Pursuant to the Law on Protecting State Secrets dated November 15, 2018;

Pursuant to the Law on Enacting Legal Normative Documents in 2015 and the Law Amending and Supplementing Certain Provisions of the Law on Enacting Legal Normative Documents enacted in 2020;

Pursuant to the Law on Archives dated November 11, 2011;

Pursuant to Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology in 2013;

Pursuant to Decree No. 11/2014/NĐ-CP dated February 18, 2014 of the Government on scientific and technological information activities;

Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the Military Science Bureau;

The Minister of National Defense issues this Circular regulating the collection, registration, retention, and publication of information on scientific and technological tasks within the Ministry of National Defense.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates procedures, processes, and forms:

1. Collecting information on ongoing scientific and technological tasks.

2. Registering and retaining results of scientific and technological tasks funded by state budget for regular defense expenditure and state budget for science and technology affairs (hereinafter referred to as state budget), including: National-level and Ministry of National Defense-level scientific and technological tasks containing state secrets in the field of national defense, and scientific and technological tasks at the grassroots level implemented by agencies and units under the Ministry of National Defense.

For national-level and Ministry of National Defense-level scientific and technological tasks not containing state secrets in the field of national defense, the registration and retention of results shall be carried out according to Circular No. 14/2014/TT-BKHCN dated June 11, 2014 of the Ministry of Science and Technology regarding the collection, registration, retention, and publication of information on scientific and technological tasks, amended and supplemented by Circular No. 11/2023/TT-BKHCN dated June 26, 2023 of the Ministry of Science and Technology.

3. Collecting information on the application of results from the implementation of scientific and technological tasks conducted by agencies and units under the Ministry of National Defense.

4. Publishing and providing information on: Ongoing scientific and technological tasks; scientific and technological tasks that have been accepted; applications of results from the implementation of scientific and technological tasks conducted by agencies and units under the Ministry of National Defense.

5. Scientific and technological tasks not using state budget:

a) Containing state secrets in the field of national defense shall be collected, registered, retained, and published like those using state budget.

b) Not containing state secrets in the field of national defense shall be implemented in accordance with Article 6, Article 12, and Article 22 of this Circular.

Article 2. Applicability

This Circular applies to agencies, units, organizations, and individuals related to the collection, registration, retention, and publication of information on scientific and technological tasks within the Ministry of National Defense.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Scientific and technological tasks within the Ministry of National Defense are classified into three levels, including: National-level scientific and technological tasks, Ministry of National Defense-level scientific and technological tasks, and grassroots-level scientific and technological tasks.

2. Ongoing scientific and technological tasks are scientific and technological tasks currently being implemented in reality at the time of information provision.

3. Results of implementing scientific and technological tasks are a set of documents about the outcomes obtained from the scientific research and technological development activities of scientific and technological tasks, including: Summary reports of research results; brief reports of research results; product design documents; technology documents; appendices compiling survey data; special topics; maps; diagrams; multimedia materials, and other documents (if any).

4. Registering results of implementing scientific and technological tasks is the act of the leading organization implementing scientific and technological tasks declaring and submitting the results of implementing scientific and technological tasks to the competent authority as prescribed.

Article 4. Scientific and technological tasks containing state secrets in the defense sector

1. The collection, storage, and publication of information on ongoing scientific and technological tasks, as well as the application of results from scientific and technological tasks containing state secrets in the defense sector shall be carried out in accordance with the provisions of the Law on Protecting State Secrets 2018.

2. Based on Decision No. 12/QĐ-TTg dated February 27, 2023 of the Prime Minister promulgating the List of State Secrets in the Defense Sector, the agency or unit primarily responsible for scientific and technological tasks shall have the responsibility to determine the level of secrecy, stamp it accordingly, and send it directly or through military postal service according to the confidential regulations to the competent scientific and technological management agency as prescribed.

3. Registration of results from scientific and technological tasks containing state secrets in the defense sector shall be conducted at the authorized agency as stipulated in Article 9 of this Circular.

Chapter II

COLLECTION, PROCESSING AND UPDATING INFORMATION ON ONGOING SCIENTIFIC AND TECHNOLOGICAL TASKS

SCIENCE AND TECHNOLOGY UNDERWAY

Article 5. Collection of information on ongoing scientific and technological tasks using state budget funds

1. Within thirty working days from the date of signing the contract to implement the scientific and technological task, the organization primarily responsible for the scientific and technological task shall have the responsibility to collect and send the information to the competent scientific and technological management agency as prescribed in Clause 2 and Clause 3 of this Article.

2. Information about each ongoing scientific and technological task using state budget funds shall be compiled into one Form according to Model 1 attached to this Circular, including the following contents:

a) Task name;

b) Level of task management;

c) Degree of confidentiality of the task;

d) Task code (if any);

đ) Information about the organization primarily responsible for the task;

e) Agency managing the task;

g) Information about the task leader;

h) List of individuals mainly participating in implementing the task;

i) Information about organizations collaborating in implementing the task;

k) Objectives and main content of the task;

l) Research field of the task;

m) Economic and social objectives of the task;

n) Research methods;

o) Expected scientific and technological products;

p) Address and scale of expected application;

q) Expected start time; expected end time;

r) Approved implementation budget;

s) Number of approved Decisions; number of Implementation Contracts for the task.

3. Handover of Forms containing information on ongoing scientific and technological tasks using state budget funds shall be as follows:

a) Forms containing information on national-level scientific and technological tasks not containing state secrets in the defense sector shall be sent to the National Science and Technology Information Center under the Ministry of Science and Technology and the Military Science Department under the Ministry of National Defense.

b) Forms containing information on national-level scientific and technological tasks containing state secrets in the defense sector and those under the Ministry of National Defense shall be sent directly or through military postal service to the Military Science Department.

c) Forms containing information on grassroots-level scientific and technological tasks shall be sent directly or through military postal service to the scientific and technological management agencies under the departments and units directly under the Ministry of National Defense. The scientific and technological management agencies under the departments and units directly under the Ministry of National Defense shall consolidate and send directly or through military postal service to the Military Science Department.

d) Forms containing information on scientific and technological tasks funded by state funds at various levels in the science and technology sector shall be sent directly or through military postal service to the scientific and technological management agencies at the same level. These agencies shall send directly or through military postal service to the scientific and technological management agencies under the departments and units directly under the Ministry of National Defense for consolidation and then send directly or through military postal service to the Military Science Department.

4. During the implementation of scientific and technological tasks, if there is any modification or supplementation to any of the information contents in the Form prescribed in Clause 2 of this Article, within fifteen working days from the date of approval of the modification or supplementation, the task management unit shall update the information in the Form for updating information according to Model 2 attached to this Circular and send it directly or through military postal service to the competent scientific and technological management agency as prescribed in Clause 3 of this Article.

Article 6. Collection of information on scientific and technological tasks being implemented without using state budget funds

1. Scientific and technological tasks not using state budget funds, after being reviewed by the competent science and technology management agency, are encouraged to provide information in accordance with Clause 2 and Clause 3 of this Article.

2. Information about each scientific and technological task being implemented without using state budget funds shall be recorded on Form 3 attached to this Circular, including the following contents:

a) Task name;

b) Information about the leading organization of the task (if any);

c) Information about the managing agency of the task (if any);

d) Information about the principal investigator of the task;

đ) List of key individuals participating in implementing the task;

e) Information about organizations collaborating in implementing the task (if any);

g) Objectives and main contents of the task;

h) Research field of the task;

i) Economic and social objectives of the task;

k) Research methods;

l) Expected scientific and technological products;

m) Address and scale of expected application;

n) Expected start time; expected end time;

o) Approved implementation funding.

3. Organizations and individuals implementing scientific and technological tasks under which agencies or units shall directly send or through military postal service the Task Information Form for scientific and technological tasks being implemented without using state budget funds to the science and technology management agency of that agency or unit. Science and technology management agencies under agencies and units subordinate to the Ministry of National Defense shall compile the Task Information Forms for scientific and technological tasks being implemented without using state budget funds and directly send or through military postal service to the Military Science Bureau.

4. During the process of implementing scientific and technological tasks, if there is any modification or supplementation to any of the information contents in the Task Information Form prescribed in Clause 2 of this Article, the organizations and individuals implementing the scientific and technological tasks shall have the responsibility to update the modified or supplemented information in the Task Information Update Form according to Form 4 attached to this Circular and directly send or through military postal service to the science and technology management agency as stipulated in Clause 3 of this Article.

5. Information on scientific and technological tasks not using state budget funds can only be entered into the National Database on Science and Technology after being reviewed by the competent science and technology management agency. Organizations and individuals providing information have the right to access and use the Science and Technology Database in accordance with regulations of the Ministry of National Defense.

Article 7. Format of the Task Information Form for scientific and technological tasks being implemented

1. The Task Information Form for scientific and technological tasks being implemented shall be presented on paper and electronic documents.

2. The paper version of the Task Information Form must be confirmed by the management agency.

3. The electronic version of the Task Information Form must be saved in Rich Text format (.rtf) or Microsoft Word format (.doc or .docx), using Vietnamese Unicode font (Times New Roman) according to Vietnam Standard (TCVN 6909:2001), without password protection.

Article 8. Updating information on ongoing scientific and technological tasks into the Scientific and Technological Database

1. Within fifteen working days from the date of receipt of the Information Form on ongoing scientific and technological tasks, the Military Science Department shall be responsible for compiling, selecting, and updating into the Scientific and Technological Database of the Ministry of National Defense.

2. For ongoing scientific and technological tasks within the Ministry of National Defense that do not contain state secrets in the defense sector, the Military Science Department compiles the Information Form and sends it to the National Scientific and Technological Information Department under the Ministry of Science and Technology to update into the national database on scientific and technological tasks.

Chapter III

REGISTRATION AND PRESERVATION OF THE RESULTS OF TASK IMPLEMENTATION

SCIENTIFIC AND TECHNOLOGICAL

Article 9. Responsibility for registering results and authority to issue Registration Result Certificates for the implementation of scientific and technological tasks

1. Agencies, units, organizations, and individuals primarily implementing national-level and Ministry of National Defense-level scientific and technological tasks containing state secrets in the defense sector, and grassroots-level scientific and technological tasks, shall be responsible for registering the results of the implementation of scientific and technological tasks.

2. The Director of the Military Science Department has the authority to issue Registration Result Certificates for national-level and Ministry of National Defense-level scientific and technological tasks containing state secrets in the defense sector, and grassroots-level scientific and technological tasks.

Article 10. Documents and methods for registering the results of the implementation of scientific and technological tasks using state budget funds

1. Documents for registering results for scientific and technological tasks containing state secrets in the defense sector include:

a) One Application Form for Registering Results of Implementing Scientific and Technological Tasks according to Model 5 attached to this Circular;

b) One Comprehensive Report on the Implementation of Scientific and Technological Tasks (with confirmation from the task's leading unit that it has been completed after management-level acceptance);

c) An electronic version signed with a digital signature or digitized from a paper version, ensuring completeness, integrity, and accuracy of all contents according to the paper version, containing the following data: Comprehensive Report on the Implementation of Scientific and Technological Tasks; Summary Report on the Implementation of Scientific and Technological Tasks and other task-related documents as described and agreed upon in the contract.

2. Documents for registering results for scientific and technological tasks not containing state secrets in the defense sector shall be implemented in accordance with Circular No. 14/2014/TT-BKHCN dated June 11, 2014, and Circular No. 11/2023/TT-BKHCN dated June 26, 2023, of the Ministry of Science and Technology amending and supplementing certain provisions of Circular No. 14/2014/TT-BKHCN.

3. Methods for registering the results of the implementation of scientific and technological tasks:

a) For scientific and technological tasks containing state secrets in the defense sector: Leading units and individuals primarily implementing the scientific and technological tasks shall register directly or send through military postal service (register online on the registration software system of the Military Science Department when permitted by the Ministry of National Defense).

b) For scientific and technological tasks not containing state secrets in the defense sector: Leading units and individuals primarily implementing the scientific and technological tasks shall register online on the registration software system of the Military Science Department. Online registration documents must use the Portable Document Format (.pdf), use Vietnamese Unicode font (Times New Roman) according to Vietnam Standard (TCVN 6909: 2001), signed digitally or digitized from a paper version, ensuring completeness, integrity, and accuracy of all contents according to the paper version.

Article 11. Registration and retention of results from implementing scientific and technological tasks funded by state budget

1. Within forty-five working days from the date when the results of implementing scientific and technological tasks are evaluated and accepted by the management-level scientific council, the organization or individual primarily responsible for implementing such tasks must complete the dossier according to the council's recommendations (if any) and register the research results.

2. The process of receiving and submitting registration dossiers:

a) For scientific and technological tasks containing state secrets in the defense sector: The agency, unit, organization, and individual primarily responsible for implementing the scientific and technological tasks shall be responsible for preparing the dossier in accordance with Clause 1, Article 10 of this Circular and sending it to the Military Science Department for registration of research results.

b) For scientific and technological tasks not containing state secrets in the defense sector: The agency, unit, organization, and individual primarily responsible for implementing the scientific and technological tasks shall be responsible for preparing the dossier in accordance with Clause 2, Article 10 of this Circular and registering online on the Military Science Department’s registration software system.

c) The handover and receipt of valid dossiers shall be recorded on the receipt form for registration results according to Model 7 attached to this Circular. In cases where additional information is required, the primary responsible unit shall complete the dossier within five working days following the request. After registration, the dossier will be retained at the Military Science Department in accordance with regulations on archival work, document confidentiality, and related documents.

d) The competent authority for registration shall examine the dossier and issue a certificate (according to Model 6 attached to this Circular) to the agency or individual primarily responsible for implementing the scientific and technological tasks within fifteen working days from the date of receiving the dossier that meets the conditions stipulated.

3. In cases where scientific and technological tasks are implemented under a research and technology cooperation contract between organizations or individuals within the Ministry of National Defense and those outside the Ministry of National Defense, the agency or individual primarily responsible for implementing the scientific and technological tasks shall register the results in accordance with this Circular or according to the agreement among the parties involved in the implementation of the task (this agreement must be recorded in the cooperation research contract).

4. For results from implementing scientific and technological tasks that have intellectual property protection registration:

a) In cases where the results from implementing scientific and technological tasks have already been registered for intellectual property protection before being officially accepted by the scientific and technological task management agency, the registration of results shall be carried out in accordance with Article 9 of this Circular.

b) In cases where the results from implementing scientific and technological tasks are registered for intellectual property protection after being officially accepted, the registration of results shall be carried out in accordance with Article 9 of this Circular within five working days from the date of filing the application for intellectual property protection registration, but no later than sixty working days from the date of official acceptance.

Article 12. Registration and retention of results from implementing scientific and technological tasks not funded by state budget

1. Results from implementing scientific and technological tasks not funded by state budget are encouraged to be registered and retained at the registration competent authorities specified in Article 9 of this Circular after being recognized by the competent state agency managing science and technology. The registration dossier includes:

One Application Form for Registration of Results from Implementing Scientific and Technological Tasks Not Funded by State Budget according to Model 8 attached to this Circular for each scientific and technological task;

One comprehensive report on the results of implementing the scientific and technological task with confirmation from the agency, unit, organization, or individual primarily responsible and other relevant reports and materials (if any);

One document confirming the results of implementing scientific and technological tasks not funded by state budget issued by the competent state agency managing science and technology.

2. The method of registering results from implementing scientific and technological tasks not funded by state budget shall be conducted either directly or online as prescribed in Clause 3, Article 10 of this Circular. Within fifteen working days from the date of receiving the dossier as stipulated in Clause 1 of this Article, the competent authority for registration shall examine the dossier and issue a Certificate of Registration of Results from Implementing Non-State-Funded Scientific and Technological Tasks (according to Model 9 attached to this Circular) to the organization or individual primarily responsible for implementing the scientific and technological tasks. Information about the results from implementing scientific and technological tasks not funded by state budget can only be entered into the Science and Technology Database after being recognized by the competent state agency managing science and technology. Organizations and individuals who register and submit results have the right to access and use the Science and Technology Database in accordance with regulations of the Ministry of National Defense.

Article 13. Registration of Information on Research Results Purchased with State Budget

1. Research results purchased with state budget must be registered and retained at the competent authority for registration according to the hierarchical procedures as stipulated in Article 9 of this Circular for scientific and technological tasks.

2. Organizations and individuals responsible for registering shall submit one Application Form for Registration of Information on Research Results Purchased with State Budget in accordance with Model 10 attached to this Circular for each scientific and technological task.

3. The competent authority for registration as prescribed in Article 9 of this Circular shall be responsible for issuing a written confirmation of the registration of information on research results purchased with state budget, compiling the information, and updating it into the Database on Research Results Purchased with State Budget.

Article 14. Issuance of Certificate of Registration of Scientific and Technological Task Implementation Results

1. Organizations and individuals completing the registration of implementation results of scientific and technological tasks shall be issued a Certificate of Registration of Scientific and Technological Task Implementation Results.

2. Each implementation result of a scientific and technological task shall be issued one Certificate of Registration of Scientific and Technological Task Implementation Results which will not be reissued; in case of request, the competent authority for registration may consider and issue a copy of the Certificate.

3. The Certificate of Registration of Scientific and Technological Task Implementation Results is one of the bases confirming the completion of scientific and technological tasks by organizations and individuals participating in their implementation and has value as one of the conditions for the following activities:

a) Liquidation of contracts for implementing assigned scientific and technological tasks;

b) Confirmation of the main organization and participants in the implementation of scientific and technological tasks;

c) Confirmation of research works in the dossier for recognition of achievement of scientific titles and conferral of science and technology awards;

d) One of the bases for profit distribution when using, transferring rights to use, transferring ownership, or contributing capital with research and development results.

Article 15. Revocation of Certificate of Registration of Scientific and Technological Task Implementation Results

1. The Certificate of Registration of Scientific and Technological Task Implementation Results of organizations and individuals shall be revoked in the following cases:

a) The content declared in the registration dossier of the implementation results of scientific and technological tasks is not true;

b) Forgery of signatures and seals in the registration dossier.

2. The head of the authority issuing the Certificate of Registration of Scientific and Technological Task Implementation Results as prescribed in Clause 2, Article 9 of this Circular has the authority to revoke the Certificate of Registration of Scientific and Technological Task Implementation Results.

Chapter IV

COLLECTION AND PROCESSING OF INFORMATION ON APPLICATION OF IMPLEMENTATION RESULTS OF SCIENTIFIC AND TECHNOLOGICAL TASKS

CURRENT DUTIES IN SCIENCE AND TECHNOLOGY

Article 16. Collection of Information on Application of Implementation Results of Scientific and Technological Tasks Funded by State Budget

1. Scientific and technological tasks must provide information on the application of implementation results of scientific and technological tasks funded by state budget:

a) Scientific and technological research topics;

b) Scientific research projects;

c) Experimental production projects;

d) Scientific and technological projects.

2. Starting from the date of formal acceptance of the scientific and technological task, every twelve months for five consecutive years, the leading organization of the task or the organization granted ownership and usage rights of the implementation results of the scientific and technological task shall be responsible for reporting on the application of the implementation results of the scientific and technological task in accordance with Model 11 attached to this Circular and sending it to the scientific and technological management authority as prescribed in Clause 3 of this Article.

3. Regulations on submission of the Application Information Form on the Application of Implementation Results of Scientific and Technological Tasks are as follows:

a) The Application Information Form on the Application of National-Level and Ministry of Defense-Level Scientific and Technological Task Implementation Results shall be directly submitted or sent via military mail to the Military Science Bureau;

b) Information on each application of the implementation results of scientific and technological tasks shall be recorded in one Application Information Form, including general information and information according to the type of task implemented;

c) The Application Information Form on the Application of Scientific and Technological Task Implementation Results at the grassroots level shall be sent to the scientific and technological management authority under the agencies and units under the Ministry of Defense. The scientific and technological management authority under the agencies and units under the Ministry of Defense shall be responsible for compiling and sending it to the Military Science Bureau.

4. The head of the agency or unit leading the task or granted ownership and usage rights of the implementation results of the scientific and technological task shall be responsible for the accuracy of the contents of the report on the application of the implementation results of the scientific and technological task.

Article 17. Forms and Methods of Providing Information on the Application of Scientific and Technological Task Results

1. The information form on the application of scientific and technological task results includes paper and electronic versions.

a) The paper version of the information form must be confirmed by the organization in charge of the scientific and technological task or the organization granted ownership and usage rights to the results of the scientific and technological task.

b) The electronic version of the information form must be saved in Rich Text Format (.rtf) or Microsoft Word format (.doc or .docx), using Vietnamese Unicode font (Times New Roman) according to Vietnam Standard (TCVN 6909:2001), without setting a password.

2. The information form on the application of scientific and technological task results shall be sent directly or through military postal service to the science and technology management agency specified in Clause 3, Article 16 of this Circular.

Article 18. Updating Information on the Application of Scientific and Technological Task Results

1. The science and technology management agency of subordinate units under the Ministry of National Defense shall compile and send directly or through military postal service the information forms on the application of scientific and technological task results developed within the year to the Military Science Bureau.

2. The Military Science Bureau shall be responsible for compiling the information forms on the application of scientific and technological task results throughout the Ministry of National Defense to update them into the Ministry of National Defense's Science and Technology Database, and simultaneously select and send them to the National Science and Technology Information Bureau/Ministry of Science and Technology to update into the National Science and Technology Database.

Chapter V

ANNOUNCEMENT OF INFORMATION ON TASKS

SCIENTIFIC AND TECHNOLOGICAL

Article 19. Announcement of Information on Ongoing Scientific and Technological Tasks Using State Budget

1. Within fifteen days from the date of receipt of the information form on ongoing scientific and technological tasks, the Military Science Bureau shall be responsible for compiling, selecting, and announcing the list of ongoing scientific and technological tasks in accordance with regulations.

2. The contents of information on ongoing scientific and technological tasks to be publicly announced on the Ministry of National Defense's military data transmission system include:

a) Task name;

b) The organization in charge of the task;

c) The name of the task leader;

d) Objectives and main content of the task;

đ) Research field;

e) Research methods;

g) Expected results;

h) Expected start and end dates.

3. Before December 15 each year, the science and technology management agencies of subordinate units under the Ministry of National Defense shall send directly or through military postal service the paper and electronic versions of the annual consolidated report on ongoing scientific and technological tasks according to Model 12 attached to this Circular to the Military Science Bureau.

Article 20. Announcement of Information on the Implementation Results of Scientific and Technological Tasks Using State Budget

1. The contents of information on the implementation results of scientific and technological tasks to be publicly announced on the Ministry of National Defense's military data transmission system include:

a) Task name;

b) The organization in charge of the task;

c) Name of the task leader and main participants;

d) Objectives of the task;

đ) Implementation results (summary);

e) Start and end dates;

g) Implementation budget.

2. Before December 15 each year, the science and technology management agencies of subordinate units under the Ministry of National Defense shall send directly or through military postal service the electronic version of the annual consolidated report on scientific and technological tasks that have been accepted and registered for implementation results according to Model 13 attached to this Circular to the Military Science Bureau.

3. The Military Science Bureau shall be responsible for compiling information on scientific and technological tasks at all levels that have been accepted and registered for implementation results in the year; selecting and announcing in accordance with regulations.

Article 21. Publication of Information on the Application of Results from Scientific and Technological Tasks Funded by State Budget

1. Before December 15 each year, scientific and technological management agencies under units directly subordinate to the Ministry of National Defense shall compile reports on scientific and technological tasks applied during the year according to Model 14 attached to this Circular and send them directly or through military postal service in both paper and electronic versions to the Military Science Bureau.

2. The Military Science Bureau shall be responsible for compiling information on the application of results from state budget-funded scientific and technological tasks during the year; select and publish such information in accordance with regulations.

Article 22. Publication of Information on Scientific and Technological Tasks Not Funded by State Budget

Scientific and technological tasks not funded by state budget shall be published in accordance with Articles 19, 20, and 21 of this Circular when there is agreement from the organization or individual primarily responsible for such scientific and technological tasks.

Article 23. Handling Violations

Agencies, units, and individuals primarily responsible for implementing scientific and technological tasks that fail to carry out any of the following contents shall not participate in selecting or receiving direct assignment of grassroots-level, ministry-level, or national-level scientific and technological tasks for at least one year until they complete the required contents as prescribed:

Providing information on ongoing scientific and technological tasks;

Registering and submitting results of completed scientific and technological tasks that have been accepted;

Reporting on the application of results from completed scientific and technological tasks.

Chapter VI

PRESERVATION AND EXPLOITATION OF FILES AND DOCUMENTS ON THE RESULTS OF IMPLEMENTATION

OF REGISTERED SCIENTIFIC AND TECHNOLOGICAL TASKS

Article 24. Authority for Preserving Files on the Results of Implementation of Scientific and Technological Tasks

1. The Military Science Bureau shall preserve files and documents on the results of implementation of scientific and technological tasks at the Ministry of National Defense and national levels for five years. After this period, the files shall be submitted to the National Defense Archives Center.

2. Agencies and units directly subordinate to the Ministry of National Defense shall preserve the results of implementation of scientific and technological tasks at the grassroots level under their management.

3. Research participants shall not preserve files and documents on the results of implementation of scientific and technological tasks.

4. Preservation of files on the results of implementation of scientific and technological tasks shall be carried out in accordance with regulations on archival work, document confidentiality, and related documents.

Article 25. Subjects and Procedures for Exploiting Results of Implementation of Scientific and Technological Tasks at Preserving Agencies

Organizations and individuals within the Ministry of National Defense who require information for commanders or need it for scientific research, initiatives, improvements, and application of scientific and technological achievements may exploit the results of scientific and technological tasks. Procedures and scope of exploitation shall follow current regulations.

Chapter VII

IMPLEMENTING PROVISIONS

Article 26. Effective date

1. This Circular takes effect from February 3, 2025, replacing Circular No. 169/2017/TT-BQP dated July 17, 2017, issued by the Ministry of National Defense on collecting, registering, preserving, and publishing information on scientific and technological tasks within the Ministry of National Defense.

2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulations.

3. Scientific and technological tasks evaluated and accepted by management authorities before this Circular takes effect shall continue to apply Circular No. 169/2017/TT-BQP.

Article 27. Responsibility for Implementation

1. The Chief of the General Staff, the Chief of the Political General Department, heads of agencies and units, and related organizations and individuals are responsible for implementing this Circular.

2. The Director of the Military Science Bureau shall inspect and urge the implementation of this Circular.

3. In case difficulties or obstacles arise during implementation, units and individuals shall promptly report to the Military Science Bureau for consolidation and submission to the Ministry of National Defense for consideration and decision./.
