Amending and supplementing some articles of Decree No. 94/2008/NĐ-CP dated August 22, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Vietnam Social Security

concerning the functions, tasks, powers, and organizational structure of the Vietnam Social Security

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the General Director of the Vietnam Social Security,

DECREE

Article 1. Amending and supplementing some articles of Decree No. 94/2008/NĐ-CP dated August 22, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Vietnam Social Security as follows:

1. Amending and supplementing Article 7 as follows:

"Article 7. The organizational structure of the Vietnam Social Security at the central level

1. Social Insurance Policy Implementation Board.

2. Health Insurance Policy Implementation Board.

3. Collection Board.

4. Department of Finance.

5. Department of Registration and Cards.

6. Propaganda Board.

7. International Cooperation Board.

8. Inspection Board.

9. Motivation and Reward Board.

10. Department of Planning and Finance.

11. Organization and Cadre Board.

12. Legal Affairs Board.

13. Fund Investment Board.

14. Pharmacy and Medical Supplies Department.

15. Office.

16. Institute of Social Insurance Science.

17. Information Center.

18. Archive Center.

19. Health Insurance Appraisal and Multiline Payment Center.

20. Vocational Training School.

21. Social Insurance Newspaper.

22. Social Insurance Magazine.

The organizations prescribed from Clause 1 to Clause 15 of this Article are organizations assisting the General Director; the organizations prescribed from Clause 16 to Clause 22 of this Article are affiliated units.

Organizations assisting the General Director may establish subordinate departments.

The General Director shall prescribe the functions, tasks, powers, organizational structure, allocate personnel quotas, appoint, dismiss, and remove heads and deputy heads of heads of organizations under the Vietnam Social Security and Deputy Heads of Departments under organizations assisting the General Director.

The number of deputy heads of organizations under the Vietnam Social Security shall not exceed three persons.

The head of affiliated units shall appoint, dismiss, and remove heads and deputy heads of subordinate departments according to the position standards issued by the competent authority and comply with the appointment and dismissal procedures for officials issued by the General Director of the Vietnam Social Security.

2. Amend and supplement Clause 3 of Article 9 as follows:

"3. The Director of the Social Security of the province shall appoint, dismiss, and remove the Director and Deputy Director of the Social Security of the district according to the position standards issued by the competent authority and comply with the appointment and dismissal procedures for officials issued by the General Director of the Vietnam Social Security. The number of Deputy Directors of the Social Security of the district shall not exceed two persons; the number of Deputy Directors of the Social Security of the district in Ho Chi Minh City and Hanoi shall not exceed three persons."

Article 2. Effectiveness

This Decree takes effect from February 5, 2012.

Article 3. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, Management Boards, and the General Director of the Vietnam Social Security are responsible for implementing this Decree./.
