DECREE
Regulations on Support Policies to Address Animal Diseases
On the basis of Law on Government Organization dated February 18, 2025;
On the basis of Law on Local Administration Organization dated February 19, 2025;
On the basis of Law on Veterinary Medicine dated June 19, 2015;
On the basis of Law on State Budget Management dated June 25, 2015;
On the basis of Law on Aquaculture dated November 21, 2017;
On the basis of Law on Livestock Raising dated November 19, 2018;
At the proposal of the Minister of Agriculture and Rural Development;
The Government issues this Decree to regulate support policies to address animal diseases.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Decree stipulates the following policies:
a) Support for production facilities that must destroy animals and animal products due to animal diseases listed in the List of Animal Diseases Required to Declare an Epidemic or the List of Zoonotic Diseases or newly emerging infectious diseases in Vietnam as defined by law.
b) Support for individuals participating in addressing animal diseases.
Article 2. Measures to prevent and control animal diseases shall be implemented in accordance with laws on livestock raising and veterinary medicine.
Article 2. Applicability
This Decree applies to:
1. Production facilities as specified in Clause 1 of Article 3 of this Decree.
2. Individuals participating in addressing animal diseases as specified in Clause 2 of Article 3 of this Decree.
3. Agencies, units, organizations, and individuals related to the implementation of this Decree.
Article 3. Explanation of Terms
2. Self-generated and self-consumed electricity is electricity produced and consumed by an organization or individual to serve their own needs.
1. Production facilities include individuals, households, cooperatives, cooperatives unions, people's armed forces agencies and units (excluding enterprises under the people's armed forces) engaged in livestock raising, aquaculture, and breeding and rearing aquatic seedlings.
2. Individuals participating in addressing animal diseases are those directly involved in tasks to prevent and control one or more animal diseases as specified in Clause 1 of Article 1 of this Decree, assigned or mobilized by competent state agencies based on the nature and scale of the epidemic to perform one or more of the following activities:
a) Statistics; confirmation of losses caused by animal diseases;
b) Handling disease outbreaks; sampling; post-mortem examination, diagnosis, testing of animal diseases; investigation and verification of animal diseases; capturing, holding, transporting, and destroying animals and animal products;
c) Vaccination, sanitation, disinfection, and sterilization to prevent and control animal diseases;
d) Stationing at checkpoints, posts, and stations to monitor animal diseases.
Article 4. Principles of Support
1. The State provides partial compensation for losses caused by animal diseases, without full compensation.
2. Support shall be conducted openly, transparently, promptly, and appropriately according to conditions, correct recipients, and standards, consistent with local realities, preventing abuse of policy, corruption, and waste.
3. In cases where production facilities and individuals participating in addressing animal diseases simultaneously meet different levels of support within the same support content as prescribed in this Decree and relevant laws, they shall receive the highest level of support.
Chapter II
SUPPORT POLICIES, PROCEDURES, AND PROCEDURAL REQUIREMENTS FOR ADDRESSING ANIMAL DISEASES
Article 5. Conditions for Support
1. Production facilities with animals and animal products that must be destroyed due to animal diseases as specified in Clause 1 of Article 1 of this Decree and fall into one of the following situations:
a) For declared epidemics: Having animals and animal products that must be destroyed according to the law in epidemic zones, threatened zones, and buffer zones;
b) For situations not yet meeting the conditions for declaring an epidemic: Having animals and animal products in the first infected site with positive test results for diseases listed in the List of Animal Diseases Required to Declare an Epidemic or the List of Zoonotic Diseases, or animals in subsequent infected sites within the same commune (as defined by the Law on Local Administration Organization) confirmed by the competent authority to be infected or showing signs of infection for the disease with positive test results in the first infected site;
c) For newly emerging diseases in Vietnam not yet meeting the conditions for declaring an epidemic: Having a document from the competent authority as defined by the Law on Veterinary Medicine confirming the new infectious agent.
2. Individuals participating in addressing animal diseases must be assigned or mobilized in writing by competent state agencies.
Article 6. Level of support for production facilities
1. For terrestrial animal production facilities:
a) Cattle, buffalo, horse, goat: VND 50,000 per kg live weight;
b) Sheep, sika deer: VND 55,000 per kg live weight;
c) Pig: VND 40,000 per kg live weight;
d) Chicken, duck, goose, swan goose, pigeon: VND 35,000 per kg live weight;
đ) Quail: VND 20,000 per kg live weight;
e) Ostrich: VND 50,000 per kg live weight;
g) Poultry eggs (chicken, duck, goose, swan goose, pigeon, quail, ostrich): VND 20,000 per kg;
2. For aquatic animal production facilities:
a) Lobster seedlings: VND 10,000 per individual;
b) Shrimp seedlings (whiteleg shrimp, black tiger shrimp) from post-larvae stage 12 onwards: VND 10,000,000 per million individuals;
c) Fish seedlings (marine fish, catfish, traditional fish, trout, coldwater fish): VND 10,000 per kg;
d) Area for extensive shrimp farming (rice-shrimp farming, ecological shrimp farming, forest shrimp farming, integrated shrimp farming): VND 9,000,000 per hectare;
đ) Area for semi-intensive and intensive shrimp farming: VND 12,000,000 per hectare;
e) Area for whiteleg shrimp farming: VND 20,000,000 per hectare (stocking density from 50 to 100 individuals per square meter);2VND 30,000,000 per hectare (stocking density from over 100 to 250 individuals per square meter);2VND 50,000,000 per hectare (stocking density from over 250 individuals per square meter);2);
g) Area for traditional fish and native species farming: VND 10,000,000 per hectare;
h) Area for intensive catfish farming: VND 50,000,000 per hectare;
i) Area for intensive trout farming: VND 30,000,000 per hectare;
k) Coldwater fish (trout, salmon) intensive farming: VND 20,000 per kg;
l) Freshwater aquaculture in cages and rafts: VND 5,000 per kg;
m) Marine aquaculture in cages and rafts: VND 10,000 per kg.
Article 7. Level of support for persons participating in disease control of animals
1. Persons not receiving salary from the state budget, during the time they are mobilized to participate in disease prevention and control, shall be supported at VND 400,000 per person per working day; VND 500,000 per person per rest day, holiday, or festival day.
2. Persons receiving salary from the state budget, during the time they are assigned or mobilized to participate in disease prevention and control, shall be supported at VND 150,000 per person per working day; VND 300,000 per person per rest day, holiday, or festival day.
Article 8. Source of funds for implementation and principles of central government support to local budgets
1. Sources of funds
a) State budget, including: Central budget, local budget;
b) Contributions, sponsorships from domestic and foreign organizations and individuals, international organizations, and other lawful financial sources as prescribed by law.
2. Principles of central government support to local budgets
a) For localities receiving supplementary balance transfers from the central budget, the level of support from the central budget to implement policies as stipulated in Article 6 and Clause 1 of Article 7 of this Decree shall be determined according to the ratio of supplementary balance transfer to total balanced expenditure of the local budget, wherein: 80% of the state budget support level will be provided for localities with a ratio of 50% or more; 60% of the state budget support level will be provided for localities with a ratio from 30% to less than 50%; 30% of the state budget support level will be provided for localities with a ratio below 30%;
b) For localities not receiving supplementary balance transfers from the central budget, the local budget must ensure the funding for policy implementation;
c) The ratio of supplementary balance transfer to total balanced expenditure of the local budget as stipulated in points a and b of this clause shall be determined based on the annual state budget revenue and expenditure forecast approved by the National Assembly;
d) In cases where, after utilizing local resources, including: contributions, sponsorships, and other lawful financial sources as stipulated in point b of Clause 1 of this article, 50% of the provincial contingency reserve fund allocated at the beginning of the year by the Prime Minister, and 70% of the remaining balance of the provincial financial reserve fund at the beginning of the year have not ensured the local budget guarantee as stipulated in points a and b of this clause, the central budget will supplement the difference to ensure that localities have sufficient funds for implementation.
3. Other provisions
a) In cases where the total amount of damage compensation and support for persons participating in disease control of animals as stipulated in Clause 1 of Article 7 of this Decree in a year is under VND 100 billion: Provincial cities directly under the central government shall proactively use their local budget to implement, and the central budget will not provide support;
b) Mobilization, utilization, settlement, and final accounting of support funds from the source of funds as stipulated in point b of Clause 1 of this article shall be carried out in accordance with the provisions of law;
c) Agencies and units assigned or mobilized to participate in disease control of animals as stipulated in Clause 2 of Article 7 of this Decree shall use the budget allocated by the competent authority to support their personnel participating in disease control of animals;
d) The central budget shall ensure funding for agencies and units under the People's Armed Forces (excluding enterprises under the People's Armed Forces) engaged in livestock breeding, aquaculture, production, and seedling cultivation affected by animal diseases as prescribed in this Decree.
Article 9. Procedures for Supporting Production Units Damaged by Animal Diseases
1. The procedures for supporting production units damaged by animal diseases, except for cases stipulated in Clause 2 of this Article, shall be implemented as follows:
a) When destroying animals and animal products as prescribed in Clause 1 of Article 5 of this Decree, the People's Committee of the commune where the production takes place shall prepare a destruction record according to Form No. 1a for terrestrial animals and animal products or Form No. 1b for aquatic animals as specified in the Appendix attached to this Decree.
b) Within thirty days from the end date of the destruction of animals and animal products at the epidemic site, the production unit shall submit one set of application documents to the People's Committee of the commune either directly, online, or through postal services.
c) Contents of the application documents: Request for support according to each type of production unit as specified in Forms No. 2a and No. 2b as provided in the Appendix attached to this Decree.
In case of direct submission or submission through postal services, the application documents must be original copies. In case of online submission, it shall be carried out in accordance with Government Decree No. 45/2020/NĐ-CP dated April 8, 2020 on implementing administrative procedures in an electronic environment.
d) Receiving Application Documents
In case of direct submission: At the time of receiving the application documents, the People's Committee of the commune shall examine and check the accuracy and completeness of the documents; if the documents are incomplete or inaccurate, the production unit shall be guided to complete the documents in accordance with regulations.
In case of submission through postal services: Within three working days from the date of receipt of the documents, the People's Committee of the commune shall examine and check the accuracy and completeness of the documents; if the documents are incomplete or inaccurate, the production unit shall be guided to complete the documents in accordance with regulations.
In case of online submission: Within one working day from the date of receipt of the documents, the People's Committee of the commune shall check and notify about the acceptance or request for corrections and supplements to the documents.
e) Reviewing Conditions, Application Documents, and Announcing Review Results
The People's Committee of the commune shall establish a Review Team. The Review Team shall consist of at least five members, with the representative of the leadership of the People's Committee of the commune serving as the team leader.
Monthly, the Review Team shall organize at least one review session for application documents requesting support that have been received in that month. The review period shall not exceed seven days from the date of organizing the review. The Review Team shall conduct reviews based on the support conditions prescribed in Clause 1 of Article 5 of this Decree.
Within three days from the end of the review, the People's Committee of the commune shall publicly announce the Summary Table of Support Proposals for Production Units Damaged by Diseases according to Form No. 3a for terrestrial animals and Form No. 3b for aquatic animals as specified in the Appendix attached to this Decree at the office of the People's Committee of the commune where the production takes place, and simultaneously inform via local media. The public announcement period shall be five days, during which the People's Committee of the commune shall notify in writing to production units that do not meet the support conditions and specify the reasons.
If there are objections or reflections during the public announcement period, within five days from the end of the public announcement period, the People's Committee of the commune shall issue a written response and specify the reasons.
Within ten days from the end of the public announcement period, the People's Committee of the commune shall prepare the support file, issue the Decision on Support according to Form No. 4a as specified in the Appendix attached to this Decree. The support file shall include: The support request document of organizations and individuals; the Summary Table of Support for Production Units Damaged by Diseases according to Form No. 3a for terrestrial animals and Form No. 3b for aquatic animals as specified in the Appendix attached to this Decree.
The People's Committee of the commune shall organize the payment of support to organizations and individuals who meet the support conditions. In case of insufficient funds for support, the People's Committee of the commune shall send a document requesting the People's Committee of the province to supplement funds in accordance with regulations.
f) For provinces and centrally governed cities eligible for support from the central budget to implement financial support for production units, based on the results of expenditures from state budget sources of localities (confirmed by the State Treasury), the People's Committee of the province shall issue a document sent to the Ministry of Finance and the Ministry of Agriculture and Rural Development requesting supplementation according to their authority or submitting to the competent authority for supplementation from the central budget to the local budget in accordance with regulations.
2. The Ministry of National Defense and the Ministry of Public Security shall stipulate detailed procedures for supporting agencies and units damaged by animal diseases under the management of the people's armed forces.
Article 10. Procedures for Supporting Individuals Participating in Eradicating Animal Diseases
1. For individuals participating in eradicating animal diseases without salary from the state budget:
Based on the mobilization document for individuals participating in eradicating animal diseases and the attendance sheet, the People's Committee of the commune shall compile the support fund monthly according to Form No. 3c, issue the Decision on Support according to Form No. 4b as specified in the Appendix attached to this Decree, and organize the payment of support.
2. For individuals participating in eradicating animal diseases with salary from the state budget:
Agencies and units shall base their actions on assigned tasks to implement the payment of support to individuals participating in eradicating animal diseases in accordance with Point c, Clause 3 of Article 8 of this Decree and other relevant laws.
Chapter III
IMPLEMENTATION AND EFFECTIVE PROVISIONS
Article 11. Responsibilities of central agencies
1. Ministry of Agriculture and Rural Development:
a) Take the lead and coordinate with the Ministry of Finance and relevant agencies to guide, inspect, audit, and supervise localities in implementing this Decree;
b) Organize propaganda and dissemination of the contents of this Decree to affected entities;
c) Summarize and report on the implementation status and results of this Decree.
2. Ministry of Finance:
a) Based on the provisions of this Decree and reports on state budget expenditures from localities (confirmed by the State Treasury), the Ministry of Finance shall supplement within its authority or submit to the competent authority for supplementation from the annual central government budget reserve for each locality according to the support principles stipulated in Clause 2, Article 8 of this Decree;
b) In cases where additional resources are needed to promptly implement disease prevention and control measures but the required documentation has not been fully completed, based on the request of the provincial People's Committee, the Ministry of Finance shall supplement within its authority or submit to the competent authority for supplementation to the local budget at 70% of the anticipated central government support level to ensure sufficient resources for local disease prevention and control policies. After the locality reports on the results of state budget expenditures (confirmed by the State Treasury), the Ministry of Finance shall supplement within its authority or submit to the competent authority for supplementation to the localities for the remaining support funds or recover any excess funds previously supplemented based on the actual support provided to eligible recipients.
3. Ministry of National Defense, Ministry of Public Security:
a) Guide procedures and formalities for providing support to agencies and units under the people's armed forces;
b) Implement disease prevention and control measures in accordance with the law.
4. The Vietnam Fatherland Front at all levels shall take the lead and coordinate with political-social organizations and relevant agencies to monitor the implementation of the damage compensation policy for animal diseases as stipulated in this Decree.
5. Relevant ministries and ministerial-level agencies shall implement support for disease prevention and control in accordance with their functions and responsibilities as stipulated in this Decree.
Article 12. Responsibilities of Provincial People's Committees
1. Direct, organize the implementation, inspection, supervision, and evaluation of the policy implementation as stipulated in this Decree at the locality level and regularly report results as prescribed.
2. Direct the delegation of authority to local competent agencies to implement, aggregate needs, review applications, approve support funding, inspect, and supervise policy implementation.
3. Based on the budget balance capacity, other legitimate financial sources, production characteristics, and actual conditions at the locality, laws on local administrative organization, and state budget laws, the provincial People's Committee shall submit to the same-level People's Council for decision:
a) Support levels for animals and animal products not specified in Article 6 of this Decree;
b) Support levels for animals and animal products specified in Article 6 of this Decree to suit local conditions but not exceeding 1.5 times the support levels prescribed in this Decree;
c) Support for small and medium-sized enterprises according to the support levels prescribed in this Decree;
d) Support levels for individuals participating in disease control efforts in the locality suitable to local conditions but not exceeding twice the support levels prescribed in Article 7 of this Decree.
4. Ensure the funding specified in point a, point c, Clause 3 of this Article and the additional funding beyond the provisions of Articles 6 and 7 of this Decree, which will not be supported by the central government budget.
5. Aggregate and report requests for central government support, send them to the Ministry of Finance and the Ministry of Agriculture and Rural Development, and bear responsibility for the accuracy of the reported data.
6. Organize the dissemination of the contents of this Decree to various levels, sectors, organizations, and individuals involved in livestock breeding and aquaculture activities in the province. Direct the People's Committees at the commune level to publicly disclose the policy and support levels through mass media and in villages, ensuring direct support reaches production bases affected by livestock breeding and aquaculture losses.
7. Organize the development of the locality's disease prevention and control plan; approve and allocate funding and resources to implement the plan, paying particular attention to ensuring resources (fuel, materials, equipment, protective gear, hiring machinery and vehicles) for the destruction, capture, and compulsory slaughter of animals and animal products due to disease outbreaks.
8. At the end of the disease outbreak period or year-end, submit a written report on the implementation results to the Ministry of Agriculture and Rural Development, the Ministry of Finance, and related ministries and agencies for consolidation and reporting to the Prime Minister according to their respective functions and responsibilities.
9. The Chairpersons of the People's Committees of provinces and centrally-administered cities are responsible before the law, the Government, and the Prime Minister for organizing support, inspecting, and supervising disease prevention and control support measures within their jurisdiction.
Article 13. Responsibilities of beneficiaries from the state budget
1. Production facilities must provide complete information and data as required by competent authorities and in accordance with the law; they shall be responsible under the law for the accuracy and honesty of the information and documents submitted for support.
2. Persons participating in controlling animal diseases shall be responsible for complying with the requirements of assigned agencies and units and the provisions of the law.
Article 14. Transitional Provisions
1. For applications for damage compensation due to animal diseases that have been received by competent authorities but not yet supported before this Decree takes effect, the compensation shall be implemented according to the provisions of Decree No. 02/2017/NĐ-CP dated January 9, 2017 of the Government on mechanisms and policies to support agricultural production to restore production in areas affected by natural disasters and epidemics.
2. For applications for support in preventing and controlling animal diseases that have been received by competent authorities but not yet supported before this Decree takes effect, the compensation shall be implemented according to the provisions of Decision No. 719/QĐ-TTg dated June 5, 2008 of the Prime Minister on policies to support prevention and control of livestock and poultry diseases and Decision No. 1442/QĐ-TTg dated August 23, 2011 of the Prime Minister amending and supplementing certain articles of Decision No. 719/QĐ-TTg dated June 5, 2008 on policies to support prevention and control of livestock and poultry diseases.
3. The principle of central budget support for local budgets for damages caused by animal diseases as stipulated in Decree No. 02/2017/NĐ-CP dated January 9, 2017 of the Government on mechanisms and policies to support agricultural production to restore production in areas affected by natural disasters and epidemics shall continue to be implemented until December 31, 2025.
Article 15. Implementation Provisions
1. This Decree takes effect from July 25, 2025.
2. Clause 2, Article 8 of this Decree shall take effect from January 1, 2026.
3. The following documents shall cease to be effective from the date this Decree takes effect:
a) Decree No. 02/2017/NĐ-CP dated January 9, 2017 of the Government on mechanisms and policies to support agricultural production to restore production in areas affected by natural disasters and epidemics, except for the provisions of Article 14 of this Decree.
b) Decision No. 719/QĐ-TTg dated June 5, 2008 of the Prime Minister on policies to support prevention and control of livestock and poultry diseases;
c) Decision No. 1442/QĐ-TTg dated August 23, 2011 of the Prime Minister amending and supplementing certain articles of Decision No. 719/QĐ-TTg dated June 5, 2008 on policies to support prevention and control of livestock and poultry diseases.
4. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial People's Committees and relevant organizations and individuals shall be responsible for implementing this Decree.
