Decision No. 117/2007/QĐ-TTg amends and supplements certain articles of Decision No. 118/TTg and Article 3 of Decision No. 20/2000/QĐ-TTg on supporting persons who have rendered meritorious service to the revolution in improving their housing conditions. DECISION OF THE CHAIRMAN OF THE GOVERNMENT
Amending and supplementing some articles of Decision No. 118/TTg dated February 27, 1996 of the Chairman of the Government on supporting persons who have rendered meritorious service to the revolution to improve their housing conditions and Article 3 of Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Chairman of the Government on supporting persons who participated in the revolutionary activities before August 1945 to improve their housing conditions Pursuant to the Merit Support Law for Persons Who Have Rendered Meritorious Service to the Revolution dated June 29, 2005; Considering the proposals of the Minister of Construction, the Minister of Labor, Invalids and Social Affairs, the Minister of Finance, and the Minister of Natural Resources and Environment, Amending and supplementing some articles of Decision No. 118/TTg dated February 27, 1996 of the Chairman of the Government on supporting persons who have rendered meritorious service to the revolution to improve their housing conditions as follows: 1. Amending and supplementing Clause 1, Article 1 of Decision No. 118/TTg:
PRIME MINISTER
Based on the Law on the Organization of the Government dated December 25, 2001;
"1. The subjects eligible for support to improve their housing under this Decision include:
b) Persons who participated in revolutionary activities from January 1, 1945 to before the August 19, 1945 general uprising;
DECISION:
Article 1. c) Dependents of martyrs;
d) Mothers of Vietnam's Heroic Soldiers;
đ) National Defense Hero, Labor Hero;
a) Persons who were engaged in revolutionary activities before January 1, 1945;
e) War invalids, persons enjoying benefits equivalent to war invalids;
g) Veterans;
h) Persons participating in the resistance against chemical warfare;
i) Persons participating in revolutionary activities or resistance activities who were captured and imprisoned by the enemy;
k) Persons participating in national liberation resistance, protecting the country, and performing international duties;
l) Persons who have contributed to the revolution."
2. Amending and supplementing Point c, Clause 2, Article 2 of Decision No. 118/TTg:
"c) Subjects eligible for support to improve their housing under this Decision, if purchasing state-owned housing, shall be fully supported for land use fees for multi-story houses with multiple households.
In case of purchasing state-owned housing which is a single-story house or a multi-story house with a single household, they will be partially or fully supported for land use fees according to specific levels as follows:
- Mothers of Vietnam's Heroic Soldiers; National Defense Hero, Labor Hero; war invalids, persons enjoying benefits equivalent to war invalids, war invalids type B, veterans, with a disability rate of 81% or higher due to injury or illness; dependents of martyrs receiving monthly maintenance allowances are fully supported for land use fees.
- Persons participating in the resistance against chemical warfare; war invalids, persons enjoying benefits equivalent to war invalids, war invalids type B, veterans, with a disability rate of 61% to 80% are supported 90% of the land use fees.
- War invalids, persons enjoying benefits equivalent to war invalids, war invalids type B, with a disability rate of 41% to 60% due to injury or illness are supported 80% of the land use fees.
- Dependents of martyrs specified in Clause 1, Article 14 of the Merit Support Law for Persons Who Have Rendered Meritorious Service to the Revolution; war invalids, persons enjoying benefits equivalent to war invalids, war invalids type B, with a disability rate of 21% to 40%; persons contributing to the revolution receiving monthly allowances; persons contributing to the revolution awarded the "National Commendation" Memorial Medal or the "Contributed to the Country" Certificate, persons contributing to the revolution in families awarded the "National Commendation" Memorial Medal or the "Contributed to the Country" Certificate are supported 70% of the land use fees.
- Persons participating in revolutionary activities or resistance activities who were captured and imprisoned; persons participating in national liberation resistance, protecting the country, and performing international duties awarded the First-Class Resistance Medal or the First-Class Victory Medal are supported 65% of the land use fees.
The above levels of support are calculated within the residential land quota defined by the People's Committee of the province or centrally governed city and based on the land use fees that the supported person must pay."
Amending and supplementing Article 3 of Decision No. 20/2000/QĐ-TTg dated February 3, 2000 of the Chairman of the Government on supporting persons who participated in revolutionary activities before the August 1945 revolution to improve their housing conditions as follows:
"Article 3. Persons joining revolutionary organizations during the period from January 1, 1945 to before the August 19, 1945 general uprising, as stipulated in Article 10 of the Merit Support Law for Persons Who Have Rendered Meritorious Service to the Revolution 2005, shall be supported by the State as follows:
1. In cases where they purchase state-owned rented housing under Decree No. 61/CP, they are exempt from land use fees for multi-story houses with multiple households or are reduced by 80% of the land use fees for single-story houses and multi-story houses with a single household, but the area for calculating the reduction amount does not exceed the residential land quota defined by the People's Committee of the province or centrally governed city.
In cases where the family has lost a member who is eligible for support under this provision, the surviving spouse is entitled to the support standard mentioned above. If both spouses are eligible for support, they are entitled to 100% support for land use fees.
Article 2. The above levels of support are calculated within the residential land quota defined by the People's Committee of the province or centrally governed city and based on the land use fees that the supported person must pay.
The land use fee reduction level stipulated in this Article also applies to cases supported through the form of allocating land for housing or recognizing residential land.
2. In cases where persons eligible for support to improve their housing have not lived in state-owned rented housing or have returned it to the State or have not been exempted or reduced land use fees when the State allocates land for housing, if they are still alive, they will be supported with VND 25,000,000 (twenty-five million dong). In cases where the eligible person has a spouse, the support will be implemented as follows:
a) In cases where the eligible person under this provision has passed away, the surviving spouse is entitled to the support standard of VND 25,000,000 (twenty-five million dong)."
The levels of support mentioned above are calculated within the residential land standard set by the People's Committee of the province or centrally governed city and are based on the amount of land use fee that the person receiving support must pay.
The reduction in the land use fee stipulated in this Article also applies to cases where support is provided in the form of allocating land for housing or recognizing residential land.
2. In the case where a person eligible for support to improve their housing has not lived in state-owned rental housing from before until now, or if they have rented but returned it to the State or have not been exempted or reduced in land use fees when the State allocates land for housing, then such person will be supported with VND 25,000,000 (twenty-five million) if they are still alive. If the person eligible for support is married, the support shall be implemented according to the following provisions:
a) In the event that a person eligible for support under this Article has passed away, the surviving spouse shall be entitled to the support standard of VND 25,000,000 (twenty-five million).
b) In cases where both the husband and wife are subjects regulated under this Article and both are still alive on the date this Decision takes effect, each person shall be supported with VND 25,000,000 (twenty-five million) dong;
The Ministry of Finance shall take the lead and coordinate with the Ministry of Planning and Investment to balance and allocate sufficient funds from the state budget to implement support for the subjects specified in this Clause.
Article 3. The land use fee for the case of allocating land for housing shall be calculated based on the land price list issued by the People's Committee of the province or centrally governed city pursuant to Decree No. 188/2004/NĐ-CP dated November 16, 2004 of the Government on the method of determining land prices and the framework of land prices for various types of land.
The land price and the amount of land use fee for the case of selling state-owned housing to tenants shall be implemented according to the provisions at point a, Clause 2 of Resolution No. 23/2006/NQ-CP dated September 7, 2006 on certain measures to accelerate the progress of selling state-owned housing to tenants as stipulated in Decree No. 61/CP dated July 5, 1994 of the Government.
Article 4. This Decision shall take effect fifteen days after its publication in the Official Gazette. This Decision shall not apply to cases that have completed the purchase of state-owned housing or been allocated land for housing. All previous regulations contrary to this Decision are hereby abolished.
Article 5. Ministers, heads of ministerial-level agencies, heads of government agencies, and Chairpersons of Provincial People's Committees and Municipal People's Committees directly under the Central Government shall be responsible for enforcing this Decision.
