 On the basis of the Law on Encouragement of Competition and Rewarding Excellence, Decree No. 121/2005/NĐ-CP dated September 30, 2005 of the Government detailing and guiding the implementation of the Law on Encouragement of Competition and Rewarding Excellence, and Circular No. 01/2007/TT-VPCP dated July 31, 2007 of the Government Office guiding the implementation of Government Decree No. 121/2005/NĐ-CP, the State Bank guides the rewarding of cadres with long-term dedication to the banking industry as follows:

Chapter I. RECIPIENTS AND CRITERIA FOR REWARDING:

1. Cadres and civil servants who have held positions from Deputy Department Director and equivalent or higher in the banking industry, now preparing for retirement, have retired, or have passed away, having made many achievements and contributions during their tenure to the revolutionary cause of the nation and the banking industry, meeting the criteria stipulated in Government Decree No. 121/2005/NĐ-CP dated September 30, 2005 but not yet recognized by the state.

2. Cadres and civil servants who have been awarded Labor Medals, Independence Medals, or Ho Chi Minh Medals for their work achievements, now compared to the criteria stipulated in Government Decree No. 121/2005/NĐ-CP, if the form of reward is only at the level already received before, will not be considered for further rewards for long-term dedication; In cases where they meet the criteria for a higher level of reward than previously received, procedures for proposing rewards for long-term dedication will be carried out.

Chapter II. SOME SPECIFIC PROVISIONS:

1- The calculation of criteria and time served in position for individuals with long-term dedication in the banking industry shall be implemented according to the provisions at points c, d, e, and g, Clause 2, Section II, Circular No. 01/2007/TT-VPCP dated July 31, 2007 of the Government Office guiding the implementation of Government Decree No. 121/2005/NĐ-CP dated September 30, 2005, detailing and guiding the implementation of certain articles of the Law on Encouragement of Competition and Rewarding Excellence.

2- For equivalent positions:

a- Equivalent to Minister is: Governor of the National Bank of Vietnam and Governor of the State Bank of Vietnam.

b- Equivalent to Deputy Minister is: Deputy Governor of the National Bank of Vietnam and Deputy Governor of the State Bank of Vietnam.

c- Equivalent to Department Director is: .

 - Leadership and management positions appointed by competent authorities and currently receiving leadership position allowances ranging from 0.9 to 1.25 (or a leadership position allowance of 0.8 according to Government Decree No. 25/CP dated May 23, 1993).

 - Leadership and management positions appointed by competent authorities and classified according to the salary scale with monthly salaries of 533, 576, and 621 dong according to Government Decree No. 235/HĐBT dated September 18, 1995 of the Council of Ministers.

- Leadership and management positions appointed by competent authorities and classified as Department Director positions before 1985.

       d- Equivalent to Deputy Department Director is:

 - Leadership and management positions appointed by competent authorities and currently receiving leadership position allowances of 0.8 (or a leadership position allowance of 0.6 according to Government Decree No. 25/CP dated May 23, 1993).

 - Leadership and management positions appointed by competent authorities and classified according to the salary scale with monthly salaries of 474, 513, and 555 dong according to Government Decree No. 235/HĐBT dated September 18, 1985 of the Council of Ministers.

 - Leadership and management positions appointed by competent authorities and classified as Deputy Department Director positions before 1985.

 e- Equivalent to Provincial Department Director is: Director of the State Bank Branch in provinces and centrally-administered cities.

Chapter III. AWARD FILES AND PROCEDURES FOR AWARDS:

1. Responsibilities for Proposing Awards:

a) For retired or deceased officials:

- The head of the unit managing the official before retirement or death shall be responsible for processing the award proposal. In cases where the last working unit of the official has been dissolved or merged, the head of the unit taking over the responsibilities of that unit shall be responsible for processing the award proposal.

 - For retired or deceased leaders of the State Bank of Vietnam, the Personnel Department shall be responsible for preparing the award proposal file.

b) For cadres preparing to retire:

 - The head of the unit shall prepare the award proposal file for officials within the unit who meet the criteria.

 - For State Bank of Vietnam leaders preparing to retire, the State Bank of Vietnam Office shall be responsible for processing the award proposal for those meeting the specified criteria.

2. Documentation for the proposal of awards includes:

a) For retired or deceased officials:

 The files include:

- A report from the head of the unit;

 - An individual achievement report, confirmed by the head of the unit (according to the attached model).

 * In cases where a deceased official meets the award criteria, the unit shall proactively coordinate with the Personnel Department to complete the award proposal file.

b) For cadres preparing to retire:

The documents include:

 - A report from the head of the unit or units assigned the task of preparing the award proposal file;

 - An individual achievement report, confirmed by the head of the unit (according to the attached model);

 - Minutes of the meeting of the Unit's Competition and Award Council (except in cases of awards for the State Bank of Vietnam leadership).

3. Quantity and Time for Submitting Files:

 - The files shall be prepared in five copies (four original copies and one photocopied copy) and submitted to the Competition and Award Department.

- Time for submitting files: From January 1st to August 30th each year.

4. Procedures for Award Review:

4.1- The Competition and Award Department shall be responsible for receiving award proposal files from units and obtaining confirmation from the Personnel Department on the following contents:

 + The duration of holding the position by the person proposed for an award;

+ Disciplinary measures, reasons, and time of disciplinary action (if any);

4. 2- After obtaining confirmation on the above contents from the Personnel Department, the Competition and Award Department shall proceed with the following procedures:

 + For retired or deceased officials: compile, submit to the Party Committee of the State Bank of Vietnam for preliminary review before submitting to the Secretary of the Party Committee - Governor of the State Bank of Vietnam for decision.

+ For officials preparing to retire: implement according to Article 33 of the Competition and Award Regulations of the Banking Industry issued together with Decision No. 40/2006/QĐ-NHNN dated August 17, 2006 of the Governor of the State Bank of Vietnam.

5. Award Funding and Presentation:

5.1- Award funding shall be implemented according to Article 70 of Decree No. 121/2005/NĐ-CP dated September 30, 2005 of the Government.

5.2- Organize presentations and posthumous awards for long-serving officials in the banking industry at meetings or annual summary meetings of the proposing units.

Chapter IV. IMPLEMENTATION:

1. Responsibilities of Heads of Units:

- Disseminate and implement this document to all officials, civil servants, employees, and workers in the unit. Inform officials under management before retirement or families of deceased officials to check against the award criteria and conditions; guide officials in preparing achievement reports and prepare achievement reports for deceased officials.

- Complete the award proposal file and bear responsibility for the accuracy of the award proposal file.

2. Responsibilities of the Competition and Award Department:

- Carry out procedures for award reviews.

- Serve as the focal point for resolving complaints regarding the awarding of long-serving officials in the banking industry.

3. Responsibilities of the Personnel Department:

 - Confirm in writing the duration of holding the position and disciplinary measures, reasons, and time of disciplinary action (if any) and equivalent positions of the person proposed for an award.

 - Coordinate with the Retired Bank Officials Association to implement the awarding of long-serving officials in the banking industry.

- Coordinate with related units to resolve complaints (if any) regarding the awarding of long-serving officials in the banking industry.

4. Responsibilities of the Accounting and Finance Department:

 - Allocate appropriate funding for awards in accordance with current regulations.

- Implement cash awards according to state and State Bank of Vietnam regulations.
