Guidelines for implementing wage and salary allowances for workers, staff, and officials constructing hydropower projects

Based on Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale, salary table, and allowance system in state-owned enterprises, and Circular No. 107/TB-VPCP dated May 11, 2007 of the Government Office, after exchanging opinions with relevant ministries and sectors, the Ministry of Labor, Invalids, and Social Affairs provides guidelines for implementing wage and salary allowance systems for workers, staff, and officials constructing hydropower projects as follows:
I. SCOPE AND APPLICABLE OBJECTS:
Article 1. Scope of Application:
The scope of application includes workers, staff, and officials directly involved in constructing the following hydropower projects:
a. Huội Quảng Hydropower Project located in Son La and Lai Chau provinces;
b. Bản Chát Hydropower Project located in Lai Chau province;
c. Sê San 4 and An Khê - Ka Nak Hydropower Projects located in Gia Lai province;
d. Đồng Nai 3 Hydropower Project located in Dak Nong province;
e. Sông Ba Hạ Hydropower Project located in Phu Yen and Gia Lai provinces;
f. Sông Tranh II Hydropower Project located in Quang Nam province.

a. Workers, staff, and officials directly involved in constructing the project;
b. Workers, staff, and officials under the Project Management Board directly involved in constructing the project;
c. Workers, staff, and officials providing consulting and design services directly working at the project site;
d. Workers, staff, and officials directly involved in surveying to serve the technical design of the project.
The objects specified in points c and d above shall not apply to those receiving attraction allowances and hazardous and dangerous work allowances already agreed upon in Document No. 3608/LĐTBXH-TL dated October 25, 2004, and Document No. 2807/LĐTBXH-TL dated August 29, 2005, of the Ministry of Labor, Invalids, and Social Affairs regarding the allowance system for workers and staff involved in surveying electrical projects.
II. APPLIED REGIME
1. Wage and Salary Allowance System:
a. Minimum Wage:
- Prior to October 1, 2005, the general minimum wage of VND 290,000/month as stipulated in Decree No. 203/2004/NĐ-CP dated December 14, 2004, of the Government shall be applied;
- From October 1, 2005, to September 30, 2006, the minimum wage of VND 350,000/month as stipulated in Decree No. 118/2005/NĐ-CP dated September 15, 2005, of the Government shall be applied;
From October 1, 2006, the minimum wage of VND 450,000/month as stipulated in Decree No. 94/2006/NĐ-CP dated September 7, 2006, of the Government shall be applied.
b. Job Grade Wage:
- Job grade: determined for each specific job according to the basic construction cost estimate standard issued by the Ministry of Construction;
- Job grade wage: calculated based on the corresponding wage coefficient of each specific job grade according to the aforementioned cost estimate standard.
c. Salary Allowance System:
Regional allowance: If the construction project or its component lies within a certain administrative unit (district, commune), then the regional allowance rate applicable to that administrative unit shall be applied.
- Attraction allowance, applying a rate of 30% of the job grade wage, position wage, or specialized wage.
- Mobility allowance, applying a rate of 0.4 times the general minimum wage.
d. Job grade wage and the allowances mentioned in points b and c above shall be calculated as follows:
- For construction work volume completed before October 1, 2004, including wages and allowances for workers, staff, and officials involved in surveying, designing, and consulting, the A6 wage scale, Group IV, issued along with Decree No. 26/CP dated May 23, 1993, shall be applied; the allowance system according to Joint Circular No. 03/2001/TTLT-BLĐTBXH-BTC-UBĐTMN dated January 18, 2001, guiding the implementation of the regional allowance system; Circulars No. 16/LĐTBXH-TT and 19/LĐTBXH-TT dated June 2, 1993, guiding the implementation of the attraction allowance and mobility allowance systems.
For construction work volume carried out from October 1, 2004, onwards, including wages and allowances for workers, staff, and officials involved in surveying, designing, and consulting, the A1.8 wage scale, Group III, issued along with Decree No. 205/2004/NĐ-CP dated December 14, 2004, shall be applied; the allowance system according to Joint Circulars No. 10/2005/TTLT-BNV-BLĐTBXH-BTC and 11/2005/TTLT-BNV-BLĐTBXH-BTC-UBDT dated January 5, 2005, guiding the implementation of the attraction allowance and regional allowance systems; Circular No. 05/2005/TT-BLĐTBXH dated January 5, 2005, guiding the implementation of the mobility allowance system in state-owned enterprises.
2. Unstable Production Coefficient: Applying a rate of 15% of the job grade wage, position wage, or specialized wage.
3. Midday Meal System: Applying a midday meal allowance of VND 5,000/person/day. Enterprises are responsible for organizing the midday meal system for workers and officials working at the project site.
III. IMPLEMENTATION:
a) The Health Insurance Fund;
a. The provisions set forth in Points 1, 2, and 3 of Section II of this Circular shall apply to workers, staff, and officials directly involved in construction work, which is included in the total construction volume budget of the entire project, except for the midday meal allowance, which is not included in labor costs. For workers, staff, and officials under the Project Management Board, it is included in the Project Management Board's expenses.
b. Additional funding sources to implement the provisions set forth in Points 1, 2, and 3 of Section II of this Circular shall be sourced from the contingency fund of the project. In cases where the contingency fund is insufficient, the competent authority shall be requested to consider adjusting the total investment amount (if the total investment amount has been approved) or allowing it to be included in the total project budget (if the total investment amount has not yet been approved).
c. The provisions set forth in Points 1 and 2 of Section II of this Circular shall apply to workers, staff, and officials involved in surveying, designing, and consulting who are directly working at the project site, which is included in the labor cost budget for consulting and design fees.
2. Responsibilities of Vietnam Electricity Corporation (Project Owner):
a. Based on the quantity determined according to the technical design or construction drawing design or the work requirements that need to be carried out for the project; the regimes prescribed in Section II of this Circular and the Circular guiding the preparation and management of project investment construction costs to calculate labor costs in the project estimate.
b. Based on the quantity of work completed and accepted, and the hourly wage rate and midday meal allowance included in the project estimate for advance payment and settlement to the construction unit.
3. Construction units, based on the completed work volume, hourly wage rate, and midday meal allowance included in the project estimate which have been advanced or settled by the investor, organize timely and full payment to workers in accordance with productivity, workload, quality of work, and project progress.
4. The Ministry of Industry shall inspect whether the investor applies the regimes stipulated in Section II of this Circular to the unit price and project estimate.
5. The Ministry of Construction shall inspect construction units' implementation of the regimes prescribed in this Circular.
IV. EFFECTIVE DATE OF IMPLEMENTATION:
This Circular takes effect fifteen days from the date of publication in the Official Gazette.
During the implementation period, if there are any difficulties, please report them to the Ministry of Labor - Invalids and Social Affairs for study and resolution./.
