Decree No. 12/2010/ND-CP amends and supplements some articles of Decree No. 14/2008/ND-CP on the organization of specialized agencies under the People's Committee of districts, towns, urban districts, and provincial cities. This Decree provides detailed regulations on the roles and tasks of the People's Council and People's Committee Office, Economic and Infrastructure Department, and adds the Ethnic Minorities Department.

Amending and supplementing some articles of Decree No. 14/2008/NĐ-CP dated February 4, 2008 of the Government on the organization of specialized agencies under the People's Committees of districts, towns, urban districts, and provincial cities as follows:
Amending and supplementing Clause 10 of Article 7 as follows:

THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Organization of People's Councils and People's Committees dated November 26, 2003;
Considering the proposal of the Minister of Home Affairs,
DECREE:
Article 1. "10. The Office of the People's Council and People's Committee or the Office of the People's Committee in places piloting the non-establishment of the People's Council shall provide advisory support to the People's Council and People's Committee regarding their activities; advise the Chairman of the People's Committee on his directives and management; provide information for the management and operation of the People's Council, People's Committee, and local state agencies; ensure material and technical facilities for the activities of the People's Council and People's Committee.
1. For districts with ethnic minority populations but not meeting the criteria for establishing an ethnic affairs agency, the Office of the People's Council and People's Committee or the Office of the People's Committee in places piloting the non-establishment of the People's Council shall advise and assist the People's Committee in performing state management functions related to ethnic affairs.
For administrative units at the district level bordering the national territory on land, sea, and islands, the Office of the People's Council and People's Committee or the Office of the People's Committee in places piloting the non-establishment of the People's Council shall advise and assist the People's Committee in performing state management functions related to foreign affairs and border control."
Amending and supplementing Point b Clause 3 of Article 8 as follows:
"b) Department of Industry and Infrastructure: advise and assist the People's Committee of the district in performing state management functions concerning industry; small-scale industry; commerce; construction; urban development; architecture and urban planning; building materials; housing and office buildings; urban infrastructure including water supply, drainage, environmental sanitation, parks, green spaces, lighting, waste disposal, and urban parking lots; transportation; science and technology;
2. For districts experiencing high economic and social development and urbanization rates, with plans to develop into towns or provincial cities, the Provincial People's Committee shall submit to the same-level People's Council for decision the establishment of a Department of Industry and a Department of Urban Management."
Supplementing Clause 4 to Article 8 as follows:
"4. Ethnic Affairs Department: advise and assist the People's Committee of the district in performing state management functions related to ethnic affairs.
3. The establishment of the Ethnic Affairs Department shall be decided by the Provincial People's Committee upon submission to the same-level People's Council based on the criteria stipulated in Point a Clause 3 of Article 2 of Decree No. 53/2004/NĐ-CP dated February 18, 2004 of the Government on improving the organizational structure of ethnic affairs agencies at all levels.":
This Decree takes effect from April 15, 2010.
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Councils, and Chairmen of People's Committees of centrally governed cities are responsible for implementing this Decree./.
Article 2. Effective Date
This Decree takes effect from April 15, 2010.
Article 3. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of People's Councils, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decree./.
