Circular No. 12/2010/TT-BVHTTDL stipulates the model for organization, operation, and criteria of Commune Cultural-Sports Centers.

Article 1. Scope of Regulation and Applicability

This Circular stipulates the organization, operation, and criteria of Commune Cultural-Sports Centers. Cultural-Sports Centers under ministries, sectors, armed forces, religious institutions, and specialized entertainment facilities in communes are not subject to this Circular.

Article 2. Functions, tasks, and authorities

1. Function: To disseminate and popularize the Party's guidelines and policies, State laws; organize cultural, sports, and recreational activities; preserve and promote traditional forms of cultural and sports activities; nurture artistic and physical education talents; enhance public literacy and cultural and sports enjoyment levels; attract and create favorable conditions for all strata of the population to participate in cultural and sports activities; serve local socio-economic tasks.

2. Tasks:

a) Develop monthly, quarterly, and annual activity programs and plans, submit them to the People's Committee of the commune for approval; implement the approved programs and plans;

b) Propose and advise the People's Committee of the commune to strengthen leadership and guidance in building Commune Cultural-Sports Centers; implement policies of socializing cultural and sports activities within the commune;

c) Coordinate with departments and mass organizations at the commune level to organize cultural and sports activities; provide professional guidance and assistance to community cultural houses, cultural clubs, and sports clubs; build and manage a professional staff and volunteers; manage assets and finances allocated according to current regulations; implement reporting, statistical systems; conduct mid-term and final reviews, draw practical lessons, and recommend commendations for outstanding individuals and groups;

d) Organize cultural, sports, and recreational activities for children;

đ) Participate in cultural and physical education activities organized by the district level;

3. Authorities:

a) Advise the People's Committee of the commune and higher-level cultural management agencies on matters related to the organization and operation of Commune Cultural-Sports Centers;

b) Receive state budget funding for constructing infrastructure and equipment; receive subsidies for personnel and volunteers and operational costs according to assigned functions and tasks;

c) Be allowed to send staff to attend professional training courses, festivals, competitions, and performances organized by higher-level specialized agencies;

d) Invite professionals in cultural and sports fields to direct, guide, or produce programs for Commune Cultural-Sports Centers in accordance with the law;

đ) Be permitted to collaborate with organizations and individuals to operate cultural, sports, and recreational services within the commune in accordance with the law.

Article 3. Structure and Organization

a) Director: A commune civil servant responsible for culture-society affairs, accountable to the Chairman of the Commune People's Committee for all activities of the Cultural-Sports Center of the commune; the Director must hold a diploma from a college-level program in culture-society or physical education and sports.

b) Deputy Director: Appointed by the Chairman of the Commune People's Committee upon the recommendation of the Director of the Cultural-Sports Center of the commune.

c) Non-specialized professional staff are individuals who have been trained and instructed in: mass art; physical education and sports instructors; propaganda editors; painters; librarians, museum curators; technical personnel (sound, lighting, broadcasting); methods instructors, club work, team work...

d) Collaborators are heads of local sectors and mass organizations and voluntary, enthusiastic individuals with the ability to participate in organizing cultural and sports activities.

Article 4. Material Basis, Equipment, and Funding

1. Infrastructure:

a) The Cultural-Sports Center of the commune shall be allocated land for use from the land fund designated for cultural-social welfare purposes, with an area according to the approved planning;

b) The scale of the Cultural-Sports Center of the commune, according to centralized planning, located at the commune center, includes main components and functions: The Cultural-Sports Center Hall: a multi-purpose hall used for organizing community learning activities, cultural, artistic, information, exhibition activities; reading room, commune radio station, interest group activity rooms, and outdoor stage; Sports Complex: At least one sports facility such as a sports field; physical training center; swimming pool or pond and other sports facilities.

2. Equipment:

a) Cultural house equipment: Conference tables and chairs; backdrop screens; sound and light equipment, musical instruments, props, costumes for artistic performances; broadcasting equipment, bookshelves, newspapers, magazines...

b) Physical education and sports equipment: Specialized equipment for each sport.

3. Funding:

a) The Cultural-Sports Center of the commune is a public service unit, funded 100% by the local budget (province, district, commune) for construction, procurement of equipment, and ensuring regular operational funding according to assigned functions and tasks;

b) Civil servants in charge of culture-society affairs serving as the Director of the Cultural-Sports Center; commune-level cadres concurrently performing Cultural-Sports Center duties, non-specialized staff working at the Cultural-Sports Center of the commune shall enjoy benefits, policies, and allowances as stipulated in Decree No. 92/2009/ND-CP dated October 22, 2009 of the Government and Circular Joint No. 03/2010/TTLT-BNV-BTC-BLDTBXH dated May 27, 2010 of the Ministry of Home Affairs, Ministry of Finance, and Ministry of Labor, Invalids and Social Affairs;

c) The Cultural-Sports Center of the commune shall proactively generate revenue from cultural-sports service activities, membership fees for clubs, and interest groups;

d) Implement policies to encourage socialization and create conditions for individuals, organizations, and businesses to invest in building cultural-sports activity facilities, entertainment venues within the commune.

Article 5. Content and Methods of Operation

1. Propaganda and Mobilization Activities: Organize various forms of oral propaganda, visual propaganda, and cultural propaganda through art performances at central locations and mobile activities in residential areas within the jurisdiction, serving major national anniversaries, significant events of the country, and local political and socio-economic tasks;

2. Mass Cultural Activities: Develop and promote mass cultural movements; cultural teams and groups; nurture cultural nuclei to serve as core forces for these movements; organize annual cultural performances, festivals, and exchanges; arrange visits from professional cultural troupes; exploit, preserve, and develop traditional folk songs, dances, and folk performances; incorporate them into traditional festival activities and cultural-sports days at all levels;

3. Sports and Physical Education Activities: Develop and promote the mass movement "All People Practicing Physical Fitness Following the Example of Great President Ho Chi Minh"; increase the number of people and families regularly practicing sports and physical fitness; exploit, preserve, and develop ethnic sports and folk games; integrate them into traditional festival activities and cultural-sports days at all levels; organize regular sports competitions and meetings;

4. Club Activities: Develop various types of interest clubs, creating favorable conditions for all social strata to participate in regular cultural, artistic, and sports activities;

5. Building a Civilized Lifestyle: Organize activities to mobilize the public to implement civilized lifestyles, thrift in wedding, funeral, festival, ancestral worship, and holiday practices, and other forms of cultural-social activities in the locality; build civilized public behavior, cultural communication and interaction in community life; protect landscapes, nature, environment, and maintain social security, prevent and combat social evils;

6. Implementation of the Movement "All People United to Build a Civilized Lifestyle": Assist the Steering Committee of the Movement "All People United to Build a Civilized Lifestyle" in the commune to direct and implement the movement within the jurisdiction; organize propaganda and encouragement activities for the construction of "Civilized Family," "Advanced Residential Area," "Cultural Village," and "Cultural Neighborhood";

7. Other Cultural-Sports Activities: Organize cultural-sports service activities; provide professional guidance to village cultural centers, cultural-sports clubs, and sports activity points; build libraries, bookshelves, reading and following books campaigns; participate in contests, performances, and sports competitions organized by higher-level cultural-sports departments; coordinate with other sectors and organizations in the commune to organize cultural-sports activities, entertainment services for children, and grassroots cultural life construction.

Article 7. Implementation Organization

1. Based on this Circular and related legal documents, the People's Committees of provinces and centrally-administered cities shall issue directives through their respective People's Councils regarding: land use planning; state investment support policies; specific regulations on infrastructure, equipment, and operating budgets; staffing levels, cooperators, and remuneration systems; mechanisms and measures for socializing culture in Commune Cultural and Sports Centers.

2. The People's Committee at the commune level shall implement the land use plan for the Commune Cultural-Sports Center that has been approved; balance the budget to ensure regular expenditures and provide comprehensive guidance on organization and operation according to the criteria of the Commune Cultural-Sports Center.

3. National cultural, sports, and tourism agencies at central and local levels shall direct and guide specialized vocational matters, training, and capacity building for staff and volunteers of the Commune Cultural-Sports Center.

4. Towns and townsites shall apply and organize the implementation of this Circular based on specific conditions.

Article 8. Effective Date

1. This Circular takes effect from March 1, 2011. The Circular Jointly Issued No. 22/2007/TTLT/BVHTT-UBTDTT dated July 24, 2007, by the Ministry of Culture and Information and the State Sports Committee guiding the organization and operation of the Commune Cultural-Sports Center, and Decision No. 2448/QĐ-BVHTTDL dated July 7, 2009, by the Ministry of Culture, Sports and Tourism on issuing the Standards for the Commune Cultural-Sports Center are hereby abolished.

2. Any issues arising during implementation should be promptly reported to the Ministry of Culture, Sports and Tourism for study, supplementation, and amendment as necessary./.
