Pursuant to the Law on Organization of the Government dated December 25, 2001;

BASED ON THE EDUCATION LAW ON JUNE 14, 2005; THE AMENDMENT AND SUPPLEMENT TO CERTAIN PROVISIONS OF THE EDUCATION LAW ON NOVEMBER 25, 2009;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on ethnic affairs;

At the proposal of the Minister of Education and Training;

The Prime Minister issues this Decision to regulate support policies for high school students in regions with particularly difficult socio-economic conditions,

Article 1. Scope of Regulation and Applicability

This Decision regulates support policies for high school students who are ethnic minorities, or Han Chinese belonging to poor households in communes with particularly difficult socio-economic conditions, provided they meet the conditions stipulated in Article 2 of this Decision.

Article 2. Conditions for enjoying support policies

1. For high school students who are ethnic minorities:

a) Currently studying at a public high school or a multi-level public school that includes a high school level;

b) The student, father, mother, or guardian has permanent residence registration in a commune or village with particularly difficult socio-economic conditions;

c) Due to distance from school or difficult terrain and transportation, it is impossible to travel to school and return home on the same day, thus must stay at school or nearby areas to study.

2. For high school students who are Han Chinese: In addition to the conditions stipulated in Clause 1 of this Article, they must also belong to a poor household.

Article 3. Level of Support

1. Food allowance: Each month, they are supported with 40% of the national minimum wage and can enjoy this benefit for no more than nine months per academic year per student.

2. Housing allowance: For students who need to arrange their own accommodation, each month they are supported with 10% of the national minimum wage and can enjoy this benefit for no more than nine months per academic year per student.

Article 4. Source of Funds

According to their assigned authority, they are responsible for directing and organizing the implementation of the support policy for students stipulated in this Decision.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Ministry of Education and Training:

1. This Decision takes effect from January 1, 2014.

- VPCP: BTCN, all PCN, Assistant PM, Portal, all Departments, Units, Agencies, Official Gazette;

2. Ministry of Finance:

a) Allocate regular budget funds to support localities in implementing the student support policies specified in this Decision within the annual state budget according to current management levels;

b) Take the lead and coordinate with relevant ministries and sectors to inspect the use of funds by localities.

3. The Chairperson of the People's Committee of provinces and centrally governed cities shall be responsible for:

a) Issuing specific regulations regarding the conditions under which students cannot travel to school and return home on the same day due to difficult terrain and transportation;

b) Approving annually the list of students eligible for support policies and being responsible for such approvals;

c) Directing, inspecting, and supervising the implementation of support policies, and annually reporting the results of implementation to the Ministry of Education and Training for consolidation and reporting to the Prime Minister.

Article 6. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from March 15, 2013.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
